The 136th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher

Education (NCTE) was convened on 4th – 6th July, 2012 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar, Nayapalli, Bhubaneswar.

The Chairperson, Members and Convener as listed below were present at the time of the 136th ERC Meeting.

At the outset, the Regional Director welcomed all the members of Committee and apprised them about the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the permission of Chairperson, Dr. J. P. Dwivedi (Convener) presented the Agenda before the Committee for its due consideration and appropriate decision.

Proceedings of the 135th ERC meeting confirmed with the following modification:1. The decision to Constitute VT in respect of application ID ERCAPP1262 is kept in abeyance till

the confirmation of the fact that the title of land was in the name of donor (of gift deed) through registered sale deed at the time of registering gift deed.

2. Appropriate decision would be taken by the Chairperson ERC in respect of application ERCAPP553 (Deferred in 135th ERC meeting) on the submission of verification report of Land related documents by the state representative.

3. Appropriate decision would be taken by the Chairperson ERC in respect of application ERCAPP629 (Deferred in 135th ERC meeting) on the submission of verification report of M.Ed. Marks Sheet of the Principal by the state representative.

4. The following corrigendum is made to the 135th ERC decisions:a. In respect of application ERCAPP925 at Sl.No. 66, ER-135.6.17, the part

“course D.El.Ed. with an intake of one basic unit of 50” be read as “course B.Ed. with an intake of one basic unit of 100.”

b. In respect of application ERCAPP1039 at sl.no. 139, ER-135.9.37, the part “an opportunity under section 14(3)(b) of the NCTE Act 1993” be read as “an opportunity under section 15(3)(b) of the NCTE Act 1993.”

c. In respect of application ERCAPP1235 at sl.no. 195, ER-135.10.9, the part “applied course D.El.Ed.”be read as “applied course B.Ed.”

ER-136.2 Court Case

1. ER.136.2.1Sidra B.Ed. College, Vill- Moregram, Po- Madhaipur, Via- Mangalbari, Dist- Malda, West Bengal – 732142 (B.Ed) (Private) (University of Gour Banga) ( Code No. APE01045)

After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules , Regulations and guidelines issued by NCTE Hqrs., the decision of the Hon’ble High Court of Kolkata in Writ Petition 19384(W) of 2009 and the clarification of the institution in response to the 133rd

ERC decision regarding submission of Land document, Building Plan and Building completion certificate, the Committee discussed the matter in detail and observed as under:

1. Gift Deed is registered on 04.06.2009 in favour of Uttarbanga B.P.Ed. College run by Nightiangle Socio Development and Welfare Media. The same society has also applied for B.Ed. course in the name of Sidra B.Ed. College. The land document submitted is not in favour of Sidra B.Ed. College. The Land deed must be in the name of Sidra B.Ed. College exclusively. The new institution cannot be run on the land in favour of other institution.

2. As per submitted building plan, the two institution Uttarbanga B.P.Ed. College and Sidra B.Ed. college are housed in the same building/premise without any demarcation of two separate institution.

3. As per NCTE Regulation 2007, an institution can apply for new course only for the subsequent academic session. The institution Uttarbanga B.P.Ed. College was granted recognition for B.P.Ed course from the session 2008-9 and was eligible to apply for new course B.Ed. for the session 2009-10 only. The applicant society applied for recognition of new institution Sidra B.Ed.Collegeon 29 Oct 2008 and the land was registered on 4 Jun 2009 in favour of Uttarbanga B.P.Ed. College

4. As per NCTE Regulation 2009, the physical education institution (running D.P.Ed/B.P.Ed/M.P.Ed) shall not house any other courses including teacher education course.

In view of the above the committee is of the opinion that neither NCTE Regulation 2009 allows the B.Ed. course in the premise of B.P.Ed course nor NCTE Regulation 2007 allows an institution (Sidra B.Ed.College) on the land in favour of other institution (Uttarbanga B.P.Ed College).The committee decided that Show cause notice be issued to the institution as to why the Recognition of the institution Sidra B.Ed College for the applied course B.Ed be not refused on the above points. The Committee therefore, provides an opportunity under section 14(3)(b) of the NCTE Act 1993 to the institution to submit its reply within 30 days before the Committee takes final decision.
