A RESOLUTION OF THE BOARD OF SUPERVISORS OF MONTGOMERYTOWNSHIP, MONTGOMERY COUNTY, PENNSYLVANIA TO CONGRATULATE

MARY GRIFFITH.ALFARANO FOR BEING NAMED CHAIRPERSON OF

THE CHAMBER OF COMMERCE FOR GREATER MONTGOMERY COUNTY

WHEREAS, Mary Griffith-Alfarano, a long-time resident of the Township, has recently been

selected as the Chairperson of the Chamber of Commerce for Greater Montgomery County; and

WHEREAS, Mary serves on the Business Development Partnership, Finance Committee, and

Autumn Festival Committee for the Township in addition to serving as a Board Member for Laurel

House; and

WHEREAS, Mary continues to give of her time to benefit both the residents of this Township and

the extended community we are a part of;

NOW' THEREFORE BE IT RESOLVED by the Board of Supervisors of Montgomery

Township, Montgomery County, Pennsylvania, that Mary Griffith-Alfarano be commended and

congratulated for this appointment in recognition of her dedication and service to the Chamber ofCommerce.

1. Call to Order: The January 4,2021- reorganization meeting of the Montgomery Township Board

of Supervisors was held at the Montgomery Township Municipal Building, 1001 Stump Road,

Montgomeryville, PA. Chair, Tanya C. Bamford called the meeting to order at 7:00 p.m.

2. & 3. Following the Pledge of Allegiance, upon motion by Mr. Quigg, seconded by Ms. Bamford,

and unanimously carried, Ms. Chimera was appointed to serve as the Temporary Chair.

4. Nomination and Election of Chair:

Upon nomination by Ms. Chimera, seconded by Mr. Quigg, Ms. Bamford was nominated as

Chair, no other nominations were presented, the Board unanimously appointed Ms. Bamford as

Chair for 2O2Lby Resolution #202I-OL.

5. Nomination and Election of Vice Chair:

Upon nomination by Ms. Chimera, seconded by Ms. Long, Mr. Quigg was nominated as Vice

Chair, no other nominations were presented, the Board unanimously appointed Mr. Quigg as

Vice Chair for 2O2t by Resolution #2021-O2.

6. Appointment and Swearing in of Township Auditor:Township Manager Carolyn McCreary reported that elected auditor Jennifer LoStracco notified

the Township that she must step down from her position as she will be moving out of the

Township. A vacancy on the Board of Auditors was posted and Township resident Lauren D'

Wilson, CPA, MS indicated her interest in serving in this capacity. Ms. Wilson was present to

introduce herself and make a brief statement of her interest in serving and her background.

MOTION: Upon motion by Ms. Bamford, seconded by Mr. Quigg, the Board

unanimously appointed Lauren Wilson, CPA, MS to the position of elected auditor,

fillinS the current vacancy.

7. Re-Appointments to Volunteer Committees and Boards:

MOTION: Upon motion by Ms. Bamford, seconded by Mr. Quigg and unanimously

carried, the Board adopted Resolution #2O2L-O3 appointing the Volunteer Committee

and Board members to new terms in accordance with the bylaws of their respective

committees and boards.

8. Establishment of Township Holidays for 2O2l:

MOTION: Upon motion by Ms. Bamford, seconded by Ms. Chimera and unanimously

carried, the Board adopted Resolution #2O2t-O4 establishing the Township holidays in

2021.

9. Establishment of Meeting Dates for 2O2l=

MOTION: Upon motion by Ms. Bamford, seconded by Mr. Quigg and unanimously

carried, the Board adopted Resolution #?:O2L-OS establishing the meeting dates for the

Board of Supervisors for 2021.

10. Resolution to Set the Treasurer's Bond:

MOTION: Upon motion by Mr. Quigg seconded by Ms. Long and unanimously carried,

the Board adopted Resolution #2021-OG setting the Treasurer's Bond at $2,500,000 for202L.

11. Resolution to Qualify Depositories:

MOTION: Upon motion by Ms. Bamford, seconded by Ms. Chimera and unanimously

carried, the Board adopted Resolution #2O2L-O7 qualifying its depositories as

presented.

12. Appointment of Officials and Consultants:

MOTION: Upon motion by Ms. Bamford, seconded by Mr. Quigg and unanimously

carried, the Board adopted Resolution #2021-08 appointing Township Officials and

Consultantsfor 2O2L as presented.

13. PSATS Voting Delegate:

MOTION: Upon motion by Mr. Quigg, seconded by Ms. Chimera and unanimously

carried, the Board adopted Resolution #2O2L-O9 appointing Beth A. Staab, Supervisor,

to be Montgomery Township's PSATS Voting Delegate for 2021'.

14. Supervisors Committee Liaison Positions:

MOTION: Upon motion by Ms. Bamford, seconded by Ms. Chimera and unanimously

carried, Resolution #2O21,-tO appointed the Board members to serve as liaisons toTownship Committeesior 2O21. as presented.

15. Authorized Drivers:

MOTION: Upon motion by Ms. Bamford, seconded by Ms. Chimera and unanimously

carried, Resolution #2021-t1. authorized specific Township personnel to drive

Township-owned vehicles for commuting purposes.

L6.2O2l Fee Schedule:

MOTION: Upon motion by Ms. Bamford, seconded by Ms. Chimera and unanimously

carried, Resolution #2O21-L2 approved the 2021 Fee Schedule as presented.

ACTION MEETING

1. Call to Order: The January 4, 2O2L action meeting of the Montgomery Township Board of

Supervisors was called to order by Chair, Tanya C. Bamford at 7:25 p.m.

2. Public Comment: There was no public comment.

3. Announcement of Executive Session: Township Solicitor Sean Kilkenny, Esquire announced

that the Board met in executive session at 6:30 p.m. this eveningto discuss five (5) personnel

matters.

4. & 5. Consent Agenda:

MOTION: Upon motion by Ms. Chimera, seconded by Mr. Quigg and unanimously

carried, the minutes of the December t4,2O2O meeting and the Bills List dated

January 4,2021-were approved as presented.

Planning & Zoning:

6. Conditional Use Hearing: JP Morgan Chase Bank NA, Satellite ATM Kiosk - Gwynedd Crossing

Shopping Center: Chair Tanya Bamford opened the public hearing at7:26 pm. Notes of testimony

were taken by Court Reporter, Tim Kurek. The applicant, JP Morgan Chase Bank NA proposes to

install a freestanding Walk-Up ATM location in the Gwynedd Crossing Shopping Center parking

lot which is allowed by Conditional Use, Section 230-78.1- Satellite Uses. Township Solicitor Sean

Kilkenny, Esquire, entered the exhibits into the record and Attorney Robert Careless, Esquire,

presented the revised plan as recommended by the Township Planning Commission' Under

public comment, Vince Tulio of 10L Glasgow Circle recommended that if bollards used are

straight with concrete inside, they should be modified to prevent any sharp edges. This is a safety

issue with people walking to the ATM and tripping. The hearing was closed at 7:38 p.m.

MOTION: Upon motion by Ms. Bamford, seconded by Ms. Chimera and unanimously

carried, Resolution #202L-tg approved the Conditional Use for JP Morgan Chase Bank

NA - Satellite Use of Freestanding Walk-Up ATM at Gwynedd Crossing Shopping Center.

7. Drive-ln Movie Events at Water Tower Square: Jim McGarrity, Esquire, an attorney

representing Water Tower Square Associates and the Goldenberg Group presented a request to

hold a drive-in theater in January and February on a temporary basis, at the Water Tower Square

movie theater parking lot. The proposal is to hold two screenings per night, at 5pm and 8pm on

Friday through Sunday from January 15 to February 28, with a capacity of 55 cars per showing.

Discussion followed. The Police Chief and Fire Chief expressed concerns with the car parking

layout and having cars blocked in at the first row. Representatives of the movie theater were

agreeable to moving the cars back and allowing for cars to move if necessary.

MOTION: Upon motion by Ms. Bamford, seconded by Ms. Long and unanimously

carried, the use was permitted under the condition that existing issues were worked

out with Township staff.

8. Zoning Hearing Board Application - Kirk and Evalee McBean - L2l Kent Drive - The Board

agreed unanimously to remain neutral to the request.

Administration and Finance:

9. Appointment of Delegates for the Montgomery County Tax Collection Committee

MOTION: Upon motion by Ms. Bamford, seconded by Ms. Long and unanimously

carried, the Board appointed Brian Shapiro to serve as the delegate, and Carolyn

McCreary as the alternate delegate on behalf of the Township, on the Montgomery

County Earned Income Tax Collection Committee.

10. Appointment of Alternate Delegate: Wissahickon Clean Water Partnership

MOTION: Upon motion by Ms. Bamford, seconded by Ms. Chimera and unanimously

carried, the Board appointed Greg Reiff as the alternate to the Wissahickon Clean Water

Partnership.

11. Authorization of Township Records Disposition

MOTION: Upon motion by Ms. Bamford, seconded by Ms. Long and unanimously

carried, the Board approved the disposal of non-permanent Township records as

presented.

12. Authorization of Change Order for HVAC lnstallation

MOTION: Upon motion by Ms. Bamford, seconded by Mr. Quigg and unanimously

carried, the Board ratified Township approval of the change order for the HVAC

replacement project at the Township building in the amount of $13,500.00.

Public Safetv:

13. Authorization of Advertisement of Proposed Ordinance Amending Chapter 222 - Vehicles

and Traffic-Vilsmeier Road: Chief J. Scott Bendig requested authorization to advertise fortheamendment with regard to the speed limit on Vilsmeier Road. Currentlythe speed limit is 35mph.

Last year, the Police Department's Highway Safety Unit conducted an evaluation of the roadway

to address the recent traffic complaints. Township Traffic Engineer, Gilmore and Associates, lnc',

is in agreement that the speed limit should be reduced to 25mph.

MOTION: Upon motion by Ms. Bamford, seconded by Ms. Chimera and unanimously

carried, the Board authorized the advertisement for the proposed ordinance.

14. Adjournment: Upon motion by Ms. Bamford and seconded by Mr. Quigg, the meeting was

adjourned at 8:24 p.m.

The 2O2I Peterbilt Dump Truck will replace the following vehicle:o 1999 Mack Dump Truck with 49,871 miles

Attached is a quote dated january 19,2O2t, from G. L Sayre Peterbilt, an authorized vendor under

the Co-Stars Cooperative Purchase Program (Contract # 025-OI7l, to provide the requested vehicle

at a total cost of 5147,016.00.

Attached is a quote dated January L3,zOZt, from Triad Truck Equipment, an authorized vendor

under the Co-Stars Cooperative Purchase Program (Contract 025-060), to provide the requested

dump body, snowplow, and installation at a total cost of Sg9,ZZS.OO.

The quotes received are 516,241.00 over the amount originally budgeted for the following reasons:

The total cost to replace this 1O-wheel Dump Truck, to include equipment and installation, is

BUDGET IMPACT:

A total of 5220,000.00 was included in the 202L Approved Final Budget for the purchase of thetruck, however, the funds utilized for this purchase, although 5I6,24L over the figure budgeted,

will not impact the Township's budget as the purchase will be made with State Liquid Fuels funds.

RECOMMENDATION

It is recommended the Board of Supervisors approves the awarding of the contract for thereferenced purchase per the 2O2t approved Final Budget.

The Tree City USA" program, sponsored by the Arbor Day Foundation in cooperation with the

USDA Forest Service and the National Association of State Foresters gives national recognition for

urban and community forestry programs in towns and cities that meet the following four

standards: A Tree Board or department, a Tree Care Ordinance, a Community Forestry Program

with an annual budget of at least $2 per capita, and an Arbor Day Observance and Proclamation.

The application process is to be completed online at Arborday.org. Attached are the Application

Signature Pages and the 2020 STC Annual Work Plan. Montgomery Township has received the

Tree City recognition for the last twenty-three years and has received the Growth Award for

nineteen of those years.

This evening, staff is requesting consideration for the adoption of an amendment to Chapter 222

of the Montgomery Township Ordinance-Vehicles ond Traffic. Specifically, staff recommends the

amendment of Section 9-A of this ordinance governing the speed limit on Vilsmeier Road'

Currently, the speed limit on Vilsmeier Road is 35 mph.

ln 2O2o,the Police Department's Highway Safety Unit evaluated the roadway to address recent

traffic complaints. This matter was also vetted with the Township's Traffic Engineer, Gilmore &

Associates, lnc. After careful consideration, it is recommended that the speed limit on Vilsmeier

Road be reduced to 25 mph.

The Board of Supervisors authorized the advertisement of the proposed ordinance amendment

at January 4,2OZL, public meeting.

WHEREAS, the Township of Montgomery, Montgomery County, Pennsylvania, acting

through its Board of Supervisors, has determined that certain roads situated in and under the

jurisdiction of the Township ("Township Roads") have and should have speed limit-control

devices regulating all manner of traffic in and through the Township; and

WHEREAS, Section 6109 of the Pennsylvania Motor Vehicle Code allows a local

authority to establish speed limits; and a change in conditions has occurred to warrant a

reevaluation of traffic control previously adopted; and

WHEREAS, the Pennsylvania Motor Vehicle Code sets requirements in order for the

Township to set speed limits; and traffic control; and

WHEREAS, on the basis of the aforesaid it has been determined that setting a limit of 25

mph for speed on certain roads in the Township in order to advance the welfare and safety of the

residents of the Township and such other persons who use said streets and roads, deems itnecessary, and accordingly has recommended Township action; and

WHEREAS, currently, the speed limit on Vilsmeier Road is 35 mph; and

WHEREAS, the Township believes that amending Chapter 222 of the Montgomery

Township Ordinance-Vehicles and Traffic, Section 9-A to limit the speed to 25 mph is in the best

interests of the health, safety and welfare of Township residents, business owners and visitors.

NOW THEREFORE,IT IS HEREBY ORDAINED AND ENACTED by the Board

of Supervisors of Montgomery Township as follows:

retail price of 580,900.00 and represents a savings of 59,716.00. The equipment meets the

specifications prepared by the Police Department.

Co-Stars Cooperative Purchase Program (Contract # OL}-LGL\, to provide the requested vehicle

equipment and installation at a total cost of 524,2L4.35. This cost is over ZtYo off the

Board consideration to release the financial security held forthis project. The Township Engineer

was asked to review the completed project compared to the land development plan and provide

a report to the Township.

PREVIOUS BOARD ACTION:

The Board executed a License and Security agreement with the Committee which established an

escrow of 575,000 to insure completion of the project.

I am writing to you on behalf of The Korean War Memorial and Peace Plaza

Committee. As you know, the Committee has completed the construction of The Korean

War Memoriaf ana the America-Korea Alliance Peace Plaza at Memorial Grove Park on

Kenas Road. It is beautiful and many veterans in the area are appreciative of the Memorial.

Pursuant to a License and Security Agreement with Montgomery Township dated

August l2,21lg,the Committee escrowed with the Township the sum of $75,000 to insure

coripletion of the Memorial and Peace Plaza. As you can see from the attached letter dated

January 15,2021from Gilmore & Associates, the Township Engrneer has l'fo-und the

improvements satisfactory,* and further recommends that the secwity being held for these

improvements be released.

Please let me know if there is any additional information or documentation that the

Township requires for this release, and whether it can be placed on an agenda of the Board

of Supervisors in the near future. I am enclosing a report the Committee made to some ofour funders.

agreement as to the assessment appeals and reverse assessment appeals, which now require

action by the Board of Supervisors on behalf of the Township. The properties in question are as

follows:

988 Bethlehem Pike owned by OSJ of Montgomeryville LLC (docket no. 2019-25L45)

913 Bethlehem Pike owned by Lukoil North America, LLC (docket no. 2016-28289)

PREVIOUS BOARD ACTION: None

BUDGET IMPACT:

Settlement for the tax appeal of the property located at 988 Bethlehem Pike will result in the

Township refunding the taxpayer SZ,09t.Lt for 2O20. Settlement for the tax appeal of the property

located at 913 Bethlehem Pike will result in the Township refunding the taxpayer S1,365.62 for tax

years 2077 lhrough 2020.

RECOMM DATION:

Staff recommends the Board of Supervisors approve the identified settlements.

the existing assessment of the subject property at 3,119,070'

On or about October 23,20lg,the Property Owner appealed to this Court from the Board's

determination of no change.

Settlement Terms

Based upon the risks and costs of litigation, the parties have decided it is in their best

interests to settle this matter based upon the terms and conditions set forth in this

Stipulation.

Accordingly, the parties, intending to be legally bound, and to bind their respective clients,

agree to the following settlement terms:

2020 Assessment: Effective January 1,2020 for County and Township tax years and July

l,2020for the School District taxyea\the assessment on the Properly shall be decreased

from its assessment of 3,119,070 to 1,715,640. Applying the County's 2020 common level

ratio of .493 this assessment results in an indicated market value of $3,480,000'

2021 Assessment: Effective January 1,2021for county and Township tax years and July

l,2011for the School District tax year, the assessment on the Property shall be decreased

from its assessment of 3,119,070 to2,016,700. Applying the County's 2021 common level

ratio of .469 this assessment results in an indicated market value of $4,300'000'

The Property's assessment shall remain at 2,A16,700 for each subsequent tax year after

2021, and tax bills will be issued in accordance with this assessment, until a change as

otherwise permitted by Pennsylvania law has been made.

The parties acknowledge that this agreement does not limit the Montgomery County Board

of Assessment Appeali' statutory authority to revise the assessment of the subject parcel

as the rcsult of a countywide reassessment, change in the subject property resulting in the

issuance of an interim assessment, or otherwise provided by applicable law. If there is any

such change in the assessment of the subject property, all parties shall have the right to

appeal from that change as provided by law.

assessment upptut with the Board of Assessment Appeals challenging the Property's

issued a notice ofNo Change in Assessment-

Settlement Terms

Based upon the risks and costs of litigation, the parties have decided it is in their best

interests to settle this matter based upon the terms and conditions set forth in this

Stipulation.

Accordingly, the parlies, intending to be legally bound, and to bind their respective

clients, agree to the following settlement terms:

2017 Assessment: Effective January 1,2017 for County and Township tax years and Ju-lV

l, 2017 for the School District tax year' the assessment on the Property shall be

decreased from its assessment of 691,630 to 475,000. Applying the County's 2017

common level ratio of .561 this assessment results in an indicated market value of

9846,702.

2018 Assessment: Effective January 1,2018 for County and Township tax years and Ju,lf

1, 201,8 for the School District iut y"ur, the assessmgnt on the Property shall be

decreased from its assessment of 69i,630 to 475'000. Applying the County's 2018

common level ratio of .541 this assessment results in an indicated market value of$878,004.

2019 Assessmenfi EfFective January l,2}lg for County and Township tax years and July

l,2}lg for the School District tax year, the assessment on the Property shall be

decreased from its assessment of 691,630 to 450,000. Applying the County's 2019

common level ratio of .509 this assessment results in an indicated market value of

$884,086.

2020 Assessment: Effective January 1,2020 for County and Township tax years and Ju,lV

l, 202A for the School District i* y"ut, the assessment on the Property shall be

decreased from its assessment of 691,630 to 450,000. Applying the County's 2020

common level ratio of .493 this assessment results in an indicated market value of

2021 Assessment: Effective January 1,2021for County and Township tax years and July

l, 2021 for the School District tax year, the assessment on the Property shall be

decreased from its assessment of 691,630 to 450,000. Applying the Counfy's 2021

common level ratio of .469 this assessment results in an indicated market value of$959,488.

The Property's assessment shall remain at 450,000 for each subsequent tax year after

BACKG ROUND:

One of the goals in 2020 was to assess the nonuniform staff's pension plan and the deferred

compensation plan (457 plan)which is offered to all employees. During discussions with the staflwe discovered an overall dissatisfaction with the customer service and responsiveness to

employees and management. We also discovered the fees for the plan were higher than average

thereby affecting the employees financially. Further, an investment advisor was charging a fee for

his services to the Township even though the pension plan is a defined contribution plan and the

457 plan is via a payroll withholding and investments are self-directed.

PREVIOUS ACTION

The Board supported the staff's recommendation to move from BCG to Empower Retirement. This

change afforded all plan participants with better investment options, lower fees, and enhanced

customer service, particularly with a user-friendly website and a variety of pertinent online training

videos and seminars.

BUDGET IMPACT: None

RECOMMENDATION:

Based on the above, the increased oversight being provided by the Finance Director and his staff,

the updating of the plan policies, and the increased direct contact by Empower with individual

employees, I am recommending the Board of Supervisors dissolve the nonuniform pension

committee and authorize the Township Manager to notify the members and thank them for their

past service.

The three residents who serve on the Committee would continue to serve on the Police Pension

Advisory Committee as this is a defined benefit plan which needs to be overseen to ensure the

Township can meet its financial obligations in the future.

BACKGROUND:

The Township approved the First Responder Recruitment and Retention Stipend on April L3,2O2O

to incentivize volunteer first responders for their service in 2019. Prior to adopting this resolution

in 2O2L, for volunteer service in 2020, the Township must acknowledge the fire company's or EMS

squad's written criteria for determining Qualified Active Member status.

Per the FDMT by-laws, active status is determined as follows:

The point system shall consist of Probationary, Active, Fire Police, Life, and Junior members

(Administrative members will be exempt from this point system). Members will be able to accrue

points as follows:

1 point for Fire Calls

1 point for Duty Crews (when any crew is in house)

1 point for Drills & Meetings

L point for Stipend Shift

L point for Public Relations/Community Events/Birthday Party

2,5 points for half day at Fundraisers

5 points for full day at Fundraisers

Members must achieve 2Oo/o of total points accumulated to be considered as an active member

and status as a member in good standing. The20% is calculated bythe total points accumulated

from the previous FDMT year, which will be November 1 to October 31. Everyone will reset theirpoint status at the end of the FDMT year.

Communi and Recreation Center Renort

o The Community Recreation Center saw limited activity during the month ofDecember 2020. The facility was once again closed due to the COVID- 19 virus.

Directives from the Commonwealth of Pennsylvania shuttered our indoor operations

on Friday, December 12th. Scheduled reopening is anticipated to be Monday, January

4th,2o2l.

inside (prior to closure) and outside the physicalfacility:

o Our monthly CPR/AED instructional classes were conducted as scheduled on

Tuesday December 8th.

o The American Red Cross conducted a Blood Drive on Wednesday December 9th

in the gymnasium.

o The popular skills and drills Flag Football Clinics were able to hold several

sessions prior to our closing during early December'

o The Ikebana Sogetsu (Floral Art) group conducted their monthly instructional

classes virtually utilizing our Community room.

o Let's Play Guitar! (Group lessons) completed their final2020 session on

December 8th.

o The Holiday season was celebrated in unique fashion at the Community Recreation

Center. A drive through event was held on Saturday, December 18th. Festive crafts

to do at home as wll as individualizedtasty treats were distributed by a"Special'Guest" from the North Pole. Over 100 vehicles passed through for a tremendous

photo opportunity.

o Recreation program planning for winter 2021 was completed. A wide array of safe

activities are scheduled to begin the week of January 18,2021.

o During the second closure for the worldwide Pandemic, preventative and routine

facility maintenance was able to take place unimpeded. Items/Areas that were

serviced included:

1) Gym floor cleaning and game line tapping.

2) Carpet Cleaning throughout the facility.3) All fitness and strength equipment.4) HVAC checkups on all building units.

The entire Community and Recreation Center staff is eagerly awaiting the onset of 2021. We are

looking forward to resuming our safe, healthy, and positive services to citizens of Montgomery

Township.

General Fund 2020 Budget

Overall, total General Fund revenues are 513,935 ,453 or 98.35% of budget. The majority of the

revenues (59,787,87t) were generated by from Act 511 Taxes (Earned lncome, Real Estate

Transfer, Local Services, Amusement and Mercantile/Business Privilege Taxes).

Total General Fund Expenditures are Sl-2,915,137 or 9L5L% of budget. Department

expenditures are within budget and trending as normal.

General Fund Department Expenditures

Police Services - 01.-410 - As of L2/31/2O -91..01% of budgeted expenditures. The Police

Department consist of 36 uniform and 9 non-uniform employees. The uniform employees are

covered by a collectively bargained contract with the Township. The 2020 Police Services

budget is 57 ,L4L,L30, in which 86Yo are personnel costs. Fixed costs such as utilities, insurance

and building maintenance consist of 4.22% of the Police Services. The remaining 9.7O% of the

Police Services budget consist of operating costs. These costs include ammunition, uniforms

and the canine unit.

Public - 01-430 - As of L2/31./2O - 86.68% of budgeted expenditures. The Public works

budget consists of various departments through the General Fund. They include Snow and lce

Removal, Traffic, Street Lighting, Repairs and General Public Works. ln total the Public Works

budget is 52,269,500. There are a total of 19 employees in the Public Works department,

including 1- full time and L part time office staff. Besides personnel costs (70%) the majority of

Public Works expenses are related to the operating costs for repairs and maintenance to various

infrastructure of the Township.

Code Enforce -OL-414 - As of L2/3t/20 -77.77% of budgeted expenditures' This

department consists of 3 full time and 1. part time employees. Code Enforcement's budgeted

expenditures is 5801,540 of which 24%is related to contracted inspection services. ln 2019 staff

processed over 1,300 permits and on average assisted 40 residents/businesses each day.

Finance and Tax Col on-01-403&01-405 -As of L2/3L/2O-86.96% of budgeted

expenditures. The total Finance and Tax Collection budget is 5635,580. The department has 3.5

full time employees. The Department is currently responsible for the collection of the annual

Business Privilege/Mercantile and Amusement Tax. ln2O2O 1,459 tax returns were issued and

reviewed. Other expenses from this department are the costs for the elected Real Estate Tax

Collector (520,000), Berkheimer Associates (583,080) and auditing services (563,650).

lnformation (rr) - 01-407 - As of 1213t/2O - 85.05% of budgeted expenditures. The

total tT budget is 5313,180 and consists of 2 full time employees. This department oversees all

technology needs of the Township.

Administration - 01.-400 - As of LL/3L/ZO -89.89% of budgeted expenditures. Expenditures in

this department include 6.5 employees and costs associated with the Board of Supervisors'

lncluded in the administration functions is Human Resources (2.5 employees), Public

lnformation (1 employee) and the daily operations of all Township functions. The total

Administration budget is $1,390,280. Other costs expensed in this department are Legal

(S130,000) and Engineering ($33,000). Additionally fixed costs associated with the day to day

operations of the Township are accounted for in this department.

COMMENDATIONS:

On December 10,2020, a letter was received from Blue Ribbon Drive residents thanking

members of the department for keeping their community safe.

On December 15,2020, a letter was received from township residents Maddyson and Jordan

Miller thanking officers for their service to the community.

On Decemb er 16,2020, a callwas received from Trudy Harrison thanking Sergeant Benner and

Officer Bouch for their assistance in moving her vehicle during a snowstorm.

On Decemb er 17 ,2020, a card was received from township residents Krishina and Vanya

Gudapati thanking officers for keeping their family safe.

On December 21,2020, Chandni Savaliya came to the department to thank Officer Dunlap for

his assistance and professionalism in investigating a vehicle crash.

On Decemb er 2l , 2020, a letter was received from Chief Martin McDonough of the Bucks

County District Attorney's Office Detective Division thanking Sergeant Ward, Detective

DeJesus, Officer Deussing, and Officer Haber for their assistance in the investigation of a

homicide at Nockamixon State Park.

On December 21,2020, a letter was received from Robert Kreamer of the North Penn Valley

Boys and Girls Club thanking the department for the donation of toys to Club members.

On December 22,2020, a letter was received from Patrick Walsh of Martha's Choice

Marketplace thanking the departm'ent for their food donation.

On Decemb er 26,2020, a letter was received from Judy Harris thanking Sergeant Benner for his

assistance after a vehicle crash.

On Decemb er 26,2020, acard was received from residents John and Mary Fultz thanking the

department for all that they do for our community.

EDUCATION:

On Decemb er 2 and December 3,2020, Officer Rushin attended SWAT-CR training at the

Montgomery County Public Safety Training Campus.

On Decemb er 8,2020, Chief Bendig and Officer Dunlap attended virtual training for the Police

Traffic Services Grant sponsored by the Pennsylvania Department of Transportation.

NOTED INCIDENTS:

On Decemb er 4,2020, officers responded to a theft in progress at a Commerce Drive business.

The caller reported seeing two subjects on camera in the rear of the business. These subjects

appeared to be the same individuals who had taken scrap metal the night before. As officers were

responding, the caller reported seeing the subjects taking more scrap metal. Upon arrival, the

subjects had fled the area, abandoning their pickup truck. Officers requested the Warminster

Police Department's assistance in contacting the registered owner of the vehicle. The vehicle was

impounded. On December 10, 2020,the vehicle owner's son contacted MTPD and advised that

he was operating the vehicle the night of the theft. The subject could not provide a reasonable

explanation for operating the vehicle nor his reason for being there that night. The subject has

been charged with theft and related offenses.

On Decemb er 6,2020, officers conducted al;rafftc stop on a black Nissan on Bethlehem Pike in

front of Airport Square Shopping Center for an equipment violation. Officers approached the

vehicle and spoke with the two vehicle occupants. During conversations with the occupants,

officers noted their nervous behavior, conflicting statementso and evidence of drug use. An

exterior drug sweep of the vehicle was conducted by canine Cooper, who alerted to the presence

of narcotics. A search of the vehicle was conducted, yielding over 40 grams ofmethamphetamine, heroin, cocaine, and drug paraphernalia. Both vehicle occupants were placed

under arrest and charged with violations of the Drug Act, including possession with the intent to

deliver.

On December 10,2020, officers responded to the Gabe's on Knapp Road for a theft of a purse.

While in route, officers were advised that the subject who took the purse was still in the store'

Upon arrival, officers located and detained the subject while other officers reviewed surveillance

video of the incident. The video depicts the subject taking the victim's purse and concealing it in

her shoppin g caft. The subject then takes off her jacket and places it on top of the purse to further

conceal it. The subject walks around the store for a short period, then exits, where officers

approach her. The subject was placed under arrest and charged with theft and related offenses.

On Decemb er 15,2020, officers responded to a home in the 100 block of Oval Court for a report

of shots being fired. While in routeo officers were advised the homeowner discharged a firearm

inside the residence. This call was made by the resident's father, who was not on location. Upon

arrival, officers established a perimeter, contacted the homeowner, and advised him to exit his

residence, unarmed, to meet officers. Tho homeowner exited the residence and was detained.

Officers checked the home and secured the discharged firearm, an assault rifle. The investigation

revealed that the homeowner accidentally discharged one round into the ceiling after cleaning

and loading the firearm. Investigating officers were able to trace the projectile's flight path and

determine the round exited the residence through the roof. Throughout the investigation, the

homeowner was very cooperative. The case was forwarded to the Montgomery County District

Attorney's Office, who declined to pursue charges.

On Decemb er 19,2020, officers responded to a home in the 100 block of Shady Lane for a 91 1

hang up. Upon callback, the dispatcher spoke to the homeowner, who advised he did not want

police to respond. Upon arrival, officers met the homeowner outside. The homeowner stated that

his son was intoxicated and that he punched his son in the face earlier in the day aftet a verbal

altercation. Officers spoke with the son, who had visible bruising and swelling to his right eye.

The son confirmed the verbal and physical altercation. The homeowner was placed under arrest

for simple assault pursuant to the domestic violence statute.

On Decemb er 20,2020, officers responded to Wawa on Bethlehem Pike for a report of a hit and

run crash. Officers were advised that the collision occurred after apossible theft. Officers

checked the Fixed Automatic License Plate Reader, determining the vehicle traveled south on

Bethlehem Pike. Officers were able to identify and contact the driver, who confirmed he was

driving the vehicle during the incident. The driver responded to the station to be processed for

leaving the scene of the crash. As the driver pulled into the station lot, officers observed his

erratic driving behavior.

Upon speaking with the driver, officers noted that he was under the influence to an extent that

rendered him incapable of driving safely. The driver was placed under arrest for driving under

the influence and leaving the scene of the crash.

On Decemb er 21,2020, officers responded to the Rodeway Inn on Bethlehem Pike for a medical

emergency. Upon arrival, officers found an unconscious subject lying on the floor of a room. The

subject was unresponsive, had a weak pulse, and shallow breathing. Another occupant of the

room confirmed that the subject had ingested an unknown drug. Officers did observe

methamphetamine and heroin paraphernalia in plain view in the room. Officers administered two

doses of Naloxone. The subject started breathing normally, regained consciousness, and was

transported to Lansdale Hospital by the Volunteer Medical Service of Lansdale for treatment. No

charges were filed in accordance with Pennsylvania's Good Samaritan Law.

On December 21,2020, officers responded to a home in the 100 block of Knapp Road for a

suspicious incident. Upon arrival, officers spoke with the homeowner, who stated that a subject

came to his residence claiming to be with Montgomery County Emergency Services. The subject

arrived in a white Chevy Malibu, informing the homeowner that they would have to replace the

water line behind the home. The subject distracted the homeowners, taking them to the rear oftheir property to show them the alleged water line that was to be replaced. Additionally, the

homeowner noted the subject was speaking in a foreign language on a handheld radio to

someone while this was occurring. When the subject left, the homeowners noticed drawers in the

bedroom open. Upon checking the residence, the homeowners found that cash and jewelry were

missing. A canvas of the area revealed no additional information. A check of the Fixed

Automatic License Plate Reader for vehicles matching that description was negative.

Informational bulletins regarding this distraction burglary have been distributed to local and

regional law enforcement groups to gain further information. This investigation is ongoing.

On Decemb er 23,2020, officers responded to the station for a theft report. Upon anival, officers

spoke with the victim, who advised that he received a phone call from the Philadelphia Police

Department's Central Detectives Division advising him that they had a male in custody who was

in possession of a fraudulent Pennsylvania Driver's License with his information on it. The

detective advised the victim to check his accounts, freeze them, and make a police report with his

local agency. The victim, who owns a business in the area, immediately checked his business and

personal checking accounts.

In doing so, the victim noted over $9,000.00 in unauthorized withdraws from both accounts.

Officers initiated an investigation, determining that the unauthorized withdraws were made at

banks in Philadelphia. Officers were able to gather evidence identifuing a subject that made the

unauthorized withdraws. An arrest warrant has been obtained for the subject charging him with

forgery and related offenses.

On Decemb er 24,2020, officers charged a subject from Philadelphia with retail theft and related

offenses. On October 19,2020, officers responded to Lowes Home Improvement for a retail

theft. Upon arrival, officers spoke with a member of asset protection, who advised that a subject

entered the store, posing as an XPO Logistics employee. The subject parked his pickup truck in

the store's open bay area, entering the store. The subject walked directly to the receiving

department, selecting a refrigerator and two gas ranges. The subject moved the items to the bay,

cut the lock on the bay door, and loaded the items onto the pickup truck. The value of the stolen

merchandise was $2,597.00. Further investigation revealed that the subject committed numerous

thefts in the tristate area. The total amount of theft from Lowes Home Improvement stores was

$14,688.09.

On December 30,2020, officers responded to the Rodeway Inn on Bethlehem Pike for a

suspicious incident. Upon arrival, officers spoke with the caller, who advised he was involved in

a physical altercation with three unknown subjects asking for money. The caller advised that he

was uninjured but did lose his cell phone during the incident. While officers were looking for the

caller's phone, they located marijuana on the ground. When the caller was confronted with the

officer's findings, he provided additional marijuana from his hotel room. A consent to search the

room was requested and granted by the caller. A search of the room was conducted, resulting in

the recovery of marijuana, heroin, and methamphetamine. The caller was placed under arrest for

violations of the Drug Act.

On Decemb er 7,2020, Officer Johnson conducted a presentation on Community Policing to the

Montgomery Chalfont Rotary Club.

During the month of December, Officer Johnson coordinated several holiday donation initiatives

through the Montgomery Township Community:

facing hardships at Mary Mother ofthe Redeemer School.

children of the Lansdale YMCA Giving Tree.

On December 22 andDecember 23,2020, Officer Johnson participated in the

Lieutenant Patty Simons Law Enforcement Food Drive, packing donated food and

delivering donations to the Salvation Army in Norristown.

On Decemb er 23,2020, Officer Johnson delivered turkeys donated by Costco to

Catholic Social Services in Norristown.

On December 24,2020, Officer Johnson delivered donated gifts to a local family offive.

PARKS/OPEN SPACE:

r The crew sanitized the tot-lots (once a week throughout the month) in all the parks.

o Larrv & Scott Y. assisted (to maintain social distancing requirements) with the leaf collection on December l-9th at

William F. Maule Park at Windlestrae. The leaf recycling dumpsters were not delivered until Monday, December 21't

o The crew took down and cleaned up a large number of dead trees throughout the month'

o Repaired a wash out at the walking bridge at William F. Maule Park at Windlestrae.

o The entire crew continued with debris cleanup due to excessive rainfall, high winds, and an EF-0 tornado.

ROADS:

. Bryan, Joe, Steve & Bill hauled leaves for recycling as part of the MS4 Storm Water Management Program.

o The entire crew continued with clearing drainage and debris cleanup due to excessive rainfall, high winds, and an

EF-0 tornado.

o Bill & Joe performed a curb reconstruction at L04 Bellows Way.

o The entire crew paved the Public Works driveway to complete the stormwater project.

FACILITIES:

r Todd & Dave fogged/disinfected the Administration building every Monday morning and the Township Meeting Room

on Tuesday mornings following the BOS Meetings and the Police Department every Friday morning.

r Todd, Don & Dave finished the semi-annual traffic signal inspections.

r Todd & Dave repaired or replaced several street signs due to excessive rainfall, high winds, and an EF-0 tornado.

r McCloskey Mechanical completed the rooftop HVAC unit replacement project.

o Don turned the school lights back on following their break'
