De Minimis

• What is de minimis?

• Administrative exemption

• Value of goods (per shipment) that may be imported free of duty

• Maximum value with change from $200 to $800

• Opportunities / implications

• Existing rules don’t change

• Further facilitates eCommerce

• PGA policies not immediately changing

– Do not have a de minimis

– Being encouraged to establish

• De minimis shipments (as manifest entries) do not appear in the ACE portal

• Expedite cargo release

• Incorporate commercially significant and measurable trade benefits

• Primary investigation to be conducted by CBP

• Dep’t of Commerce will maintain some authority

• Re-liquidation required to occur within 90 days of original liquidation

• Opportunities / implications

• Investigation will be with CBP who maintain experience in this area

• 90 day re-liquidation rule provides importers protection from reliquidation of deemed

entries years later

• Creates the duty to implement CEE’s built around an industry based model

• Centralize trade enforcement and trade facilitation

• Formalize an account based approach

• Facilitate more frequent interaction with the PGA’s*

• Opportunities and implications

• Account based importers will interact with on CEE and may want to consider how many

locations where their entries’ are processed

• PGA’s will likely become more and more integrated with the customs process

“New” COAC and the Trade Support Network

• Advisory Committee on Commercial Operations (COAC) to become the

Commercial Customs Operations Advisory Committee

• Represents interests of the trade community

• Three year terms, extended from two, single renewal option

• Co-chaired by Secretary of Treasury and Secretary of Homeland Security

• CBP required to consult with Trade Support Network (TSN)

• Formalizes communications that have been voluntary to this point

• TSN instrumental in providing input during the ACE migration
