Beyond the Grave / Taking Care of our Pets Needs

We wonder what will happen to us if we get sick, or worse yet, die... what will become of our home, who will we

leave the china to, and who will we ask to watch over our children in the event we cannot. What happens though

when something stops us from getting to the door at 3am to let the dog out, or who will feed our beloved cat her lunch

time snack so she doesn't fall into a diabetic coma, or who will give our senior pet their special home-cooked diet or

medication so they can live another day? Before we go off naming who will get the cherished plates and antique

sofa—we should first make sure that our living property will be cared for.

As bizarre as it sounds, pets today are still considered "property". Similar to your couch, your car, your boat, your

clothes, a piece of jewelry, or even your food storage containers, your pet is by law—your property. GASP! It's true,

pets still to this day, really don't have any rights of their own yet - this is why they are still legally considered "your

property".

So, before fixing to name your best-friend the new owner of your favorite little black dress, or your in-law as the new

owner of your snuzzling, fuzzy little fur ball of fun - there are a few things you should know. You cannot legally en-

force anyone to take over the care of your pet. You alone, the court alone, no one can do this. The only way you can

make sure that your beloved pets will eat, live and not be put in a shelter to die - is to create a Pet Trust and a Pet Pro-

tection Agreement.

The very first piece of property you should consider is your living property - memorialize what lives and breathes

before anything else. Here's why, there are many state and federal agencies that will step in to care for human chil-

dren in the event that the child's parent or guardian falls sick or dies. Foster families are often found and no child is

ever put to death due because their parent or guardian died. However, in the case of companion animals - there are

countless cases of pets being left without pet guardians, left to starve or to die, or picked up by rescue. Some unfortu-

nate Pets are dropped off to shelters that euthanize these pets because no one adopted them before their time ran out.

How will you make sure your cherished pet is taken care of in the event you become unable to love and care for them

yourself? The answer is that you must create a Pet Trust and/or a Pet Protection AgreementTM as soon as possible.

If you believe in living each day as if it was your last - then you should be prepared like each day could be your last.

What is a pet trust? What's a Pet Protection AgreementTM and how does a responsible pet owner get one? Here's a

breakdown:

Pet Trust**:

Legal and binding document that can be enforced by law.

Allows Pet Owners a way to give detailed instructions on how to care for their Pet.

Can manage and disburse funds that will pay for a Pet's care throughout the life of the Pet.

Trust funds are not subject to probate and the funds are not delayed by court or other end of life legalities.

Funds are not controlled by the executor or the Pet Owner's estate.

Terms of the trust are deemed by law to be private.

A Pet Trust can help keep Pet Owners with their Pets in the event that the Owner requires in-home care or is put

into an assisted living facility or a nursing home.

Pet Protection AgreementTM**:

Ensures that your pets will be treated exactly as you decide.

Is a detailed, individualized manual of instructions – from you – for the care of your pets.

These instructions are legally enforceable in the Pet Protection AgreementTM and will protect the pets you love.

Both a Pet Trust and a Pet Protection AgreementTM**:

Are secured by being signed by both the Pet Owner and future Pet Guardian or Trustee.

Attorney Rachel Hirschfeld works primarily with estate planning for people with pets. She is located in New York and

specializes in Trusts and Estates. Her clients come to her from all over the US and the world to work with her in the

planning of their pets futures. Hirschfeld explains that she has legal counsel contacts in every state and is able to

work across state lines making sure that each of the Pet Trusts that she creates, are legal, legally binding and can and

will be upheld by law.

Giving pets everywhere a paw up, Hirschfeld works on behalf and in the best interest of the Pet first while addressing

all of the Pet Owners concerns and desires. "Putting your pet into your will, is like a death warrant for your pet,"

Hirschfeld explained. "Wills that include a Pet's future care are not able to ensure that those instructions will be en-

forced because the will can only dispense of property - it cannot follow up on any instructions that were left. And,

wills are not signed by both parties thus making it a surprise to the future owner that a pet was left to them." Hirsch-

feld further explains, wills that include instructions on how or how long to care for a pet are impossible to enforce

through legal, moral or ethical means. In short, if a Pet Owner leaves their pet to someone in their will, then they are

giving up all their rights and their pets rights to the care they desire. Instead they are "willing" their rights and the

rights of their beloved Pet to the New Pet Guardian or Trustee—hoping that their New Pet Owner will continue proper

care. Sadly, this doesn't always happen, and many Pets find themselves quickly forgotten or homeless.

A Pet Trust is best left to a professional like Attorney Hirschfeld who can work within both the Federal /State Trust

Laws and Federal/State Pet Trust Laws. Pet Owners can look forward to working on their Pet Protection AgreementTM

which is the detailed outline of how to physically, mentally and emotionally care for their pets.

As Hirschfeld describes, if a Pet is left without a Pet Trust or Pet Protection AgreementTM then NO One is left in

charge of those pets. If there is only a will, then it is even worse. Sometimes a will isn't found until weeks later, and

by that time, the pet could be suffering from some sort of abuse or neglect. Since instructions in wills aren't enforce-

able, leaving a pet in a will leaves it up to the named guardian to decide what they will ultimately do with a Pet that's

been left behind. Should that guardian be in a place where they are unable or unwilling to take on the responsibility of

a pet, then they can do whatever, however, whenever with those once beloved pets. "My goal is to cut down on the

animals that wind up in shelters or rescues because their Pet Owner died or became disabled," Hirschfeld says.

Attorney Hirschfeld advises that, "Whenever Pet Owners are in front of a legal advisor or an attorney who will be

handling their estate, they should always discuss their Living Property first. A Pet's needs should be considered on a

wider spectrum than regular property and children. Legally Pets fall between being property and being a child who

requires lifelong care."

Because Pets fall between both categories, sometimes Pets fall in-between the cracks and are forgotten which can be

life-threatening for them. Pet Law is developing law and considered on the cutting-edge, so treading lightly, with a

well-educated and well-informed attorney should be the goal for all Pet Owners. A Pet Trust and a Pet Protection

AgreementTM allows Pet Owners to care for their Pets well after they have become disabled and unable to care for

them. Pet Owners can care for their Pets through these legal means well beyond the grave too. This is a gift that Pet

Parents can offer to their animal companions so that going from one home to another can be a smooth transition. Al-

though our Pets don't have many legal rights of their own, Attorney Rachel Hirschfeld has given Pet Owners all over

the world, the rights to their Pets care forever!

In February, 2011 Google inc., put in place an algorithm to improve its search engine results. This new algorithm

works to increase organic search engine results. What this means to website owners as a whole, is that web content

will now need to be original, diversified, and literate.

Google’s New Algorithm Knocks Down Content Farms

It’s hard to describe exactly what a content farm is but the general consensus seems to be businesses or website own-

ers, who create inappropriate content or overuse search engine optimization techniques. Examples of this are:

Creating content about current trending topics.

Overusing keywords on a webpage.

Duplicating the content of other website pages.

Using patterns of words in order to satisfy an algorithm.

These search engine optimization methods are just a few of the ways that some websites drive traffic to their landing

pages. These techniques are called ―black hat SEO‖. There is a very fine line between legitimate search engine opti-

mization and the misuse of search engine optimization practices.

Websites that use ―black hat SEO‖ methods are prime offenders of Google’s new algorithm. It’s now very important

for companies who want to improve their website rankings to be aware that their content will need to be original, tar-

geted, and user-friendly.

Google’s new algorithm is intended to provide web-users with quality search results. It’s meant to de-clutter senseless

information and provide users with trusted resources. Website owners are now finding their search rankings plummet-

Copywriters who want to hone their craft to offer a higher level of service to their customers can turn to learning more

about the ins and outs of the back-side or computer side of web content. One way to learn more is to understand that

mathematical equations or calculations take place when the internet meets a surfer who randomly inputs information

into either a search engine box or posts information on a website for viewing. The random‖ness‖ of the internet, is not

random at all. Rather it consists of a finite set of rules that dictate what and how people find and locate information on

the World Wide Web. Become a web savvy copywriter and learn about what an algorithm does, how it works and

why it’s so important. We’ve done the research for you and have re- scaled this complex process down to just the ba-

sics and how it applies to the written or entered word.

What is an Algorithm?

An algorithm is a method that’s used in mathematics and computer science to express a finite list of instructions and

can also perform functions like calculations, data processing and automated reasoning. The history of algorithms dates

back to 1928 when David Hilbert worked to solve the Entscheindungsproblem, also called the decision problem. Hil-

bert’s work is the first known partial formalization of what we call an Algorithm today.

There is no formal definition of what an algorithm is because an algorithm is not specific in itself, meaning that, algo-

rithms can change and be developed to do more than one process. There are several generalized definitions that offer a

basic understanding of what an algorithm does and two of them are below.

An Algorithm can be:

A specific set of exact rules that define a specific sequence of operations.

An Algorithm can also be:

A set of instructions on a process that generates output integers from random input integers.

In basic terms, we would consider that a generalized definition of an algorithm is this: If we input information into an

algorithm correctly, we will receive an output response that has been calculated based on our input.

How Algorithms Work

Sometimes it’s easier to relate an abstract process to our day to day life. So to take a close look at what an algorithm is

and what it does — Think the Internet. We know the World Wide Web uses algorithms to function. After-all the inter-

net could be considered an enormous computer program completely based in algorithmic calculations. When we hop

onto the Information Super-Highway, we jump aboard the largest algorithm we probably know. Here’s how the inter-

net uses algorithms and how we use and benefit from an algorithm’s calculations every day.

Let’s say we want to find a local auto dealer.

We type in the words or characters/letters ―auto dealer‖ in our search engine box.

We have just input our integer or number/letters.

The internet’s algorithm, or process, has taken our input letters and calculated a response for us.

The search engine generates a list with all the websites that contain the letters/characters ―autodealer‖.

If we live in New York, we won’t be interested in auto dealers in Texas. So we begin to narrow our search, or narrow

our input integers/letters in order to receive a better more targeted response.

We go back into our search engine box and type, ―auto dealer New York‖.

Now the internet’s algorithm re-calculates our input letters/integers and processes our input.

This new algorithm calculation responds to our new input integers/letters ―auto dealer New York‖.

A new list is generated and that results with a search list that contains all the auto dealers that have the letters

New York associated with their websites.

Moving ahead, we think to ourselves, New York includes Long Island and New York City. We think again, we

are located in Buffalo, New York and what we really want are local auto dealers in our own area.

So we again go back into our search engine box, we re-type the words, ―auto dealer New York Buffalo‖.

The search engine’s algorithm, takes our new input integers/letters, does another calculation, process and creates

a new response.

Another list is generated and the results offer us a search list with all the auto dealers that have the letters New

York Buffalo associated with their website.

We now have the info we wanted to begin with.

Relating Web Content To How Algorithms Function

We use algorithms every time we log online, most of us don’t realize it, but we are using a highly skilled mathemati-

cal function to communicate with our friends on social networking sites too. We use algorithms to help us find to-

night’s greatest meatloaf recipe and we also rely on an algorithm to generate calculations for us when we type in

―dangers of open-heart surgery‖ in order to learn about a loved one’s upcoming surgical procedure.

The fascinating point is that, what we input dictates what we find. The same goes for the information that’s input into

website pages for content. What a business, organization or individual posts on their website in the form of letters,

numbers, pictures, videos and more, is what an algorithm will capture to calculate a response. Mathematical algo-

rithmic functions are processes that have helped to make the World Wide Web useful for many people.

Search Engine Optimization is the process by which a website works to achieve a high rank index in the Search En-

gines. This high ranking status drives traffic, sales and promotes a website. Search Engine Optimization is what many

people consider to be the primary way to publicize an online presence.

Search Engine Optimization began in the early 1990’s and consisted primarily of webmaster-provided information

like meta tags and index files. Meta tags are keyword tags that a webmaster would insert into the HTML code area of

a website so that search engines could index a website’s page. This process was found to be un-reliable because the

keywords that a webmaster chose could prove to be an inaccurate representation of a websites actual content. Similar

findings were reported with index files. These type of Search Engine Optimization methods resulted in incomplete,

inaccurate and inconsistent data that allowed a website to rank higher than it should. It also created havoc for web-

users because if they were doing a search on a subject, their search result list would include irrelevant searches. In

short, this type of Search Engine Optimization did this:

Web-surfer types in House Paint into the search box.

10 websites links appear on their search result list.

6 of those websites have information on House Paint.

4 of those websites do not have any information on House Paint.

The 4 websites without House Paint information landed on the web-surfer’s search result list because hidden behind

the website, inside HTML code, input by a crafty webmaster, were meta tags that included the keywords, House Paint.

This is just one more way of understanding how the internet functions, how complex it is and how you can maximize

your search results!

Keyword Density has frequently been used as a Search Engine Optimization tool. At times, dishonest webmasters would work very

diligently to stuff their website pages with keyword rich content that resulted in unrelated search results.

In order to address Search Engine Rank abuse, Search Engines responded by developing complex algorithms that would index

websites in a variety of ways. The hope was that this would make the World Wide Web a safe and trusted resource of information

for web surfers.

In 2004, Search Engines reported that they had created algorithms that used a wide range of factors to rank websites. Google and

Yahoo! have never disclosed what those factors are, but it’s been reported that Google uses more than 200 different signals in their

algorithms. This has forced SEO providers to work hard and constantly study different approaches to Search Engine Optimization

in order to offer effective services to their website clients.

Late 2009 Real-Time Search was introduced in an effort to make search results timely and relevant. With Social Media Sites and

Blogs growth in popularity, this lead search engines to change their algorithms to use factors that allowed fresh content to rank

quickly within search results. This translates to meaning that today’s Search Engine Optimization methods should include real-

time, constantly re-freshed content that is timely and relevant.

With the internet being such a powerful tool, it’s necessary for the Search Engines like Google and Yahoo! to optimize their own

algorithm. In an effort to thwart the mass distribution of non-sense information – major Search Engines are keeping the internet a

safe place for web users.
