Malta is well-known for its gaming industry due to the low taxes and fees and the pro-business environment.

One of the most thriving sectors in the Maltese gaming industry is remote gaming.

The Remote Gaming Regulations (L.N. 176/04) made Malta the first country in the EU to have a remote gambling legislation.

The gaming industry in Malta is divided into sectors as it follows:

amusement machines; casinos that offer slot machines and

live gambling services;     commercial bingo halls or tombola; remote gaming; broadcasting media games ; commercial communication games; non-profit games; racecourse bets and sweepstakes.

Types of Gambling Activities in Malta

The Gaming Law provides for various types of gambling activities a Maltese company can offer.

Each type of activity is subject to various licensing requirements, which is why the Malta Gaming Authority (MGA) has enabled various licenses in order to open gambling facilities in this country.

Licenses for Gaming Facilities in Malta

Even if there are four classes of licenses for carrying out gambling activities in Malta, operators may apply for three of them:

the class 1 license, which is for casino and online lottery activities;

the class 2 license, available for betting activities;

the class 3 license, available for betting exchange and peer gaming activities.

Remote Gaming in Malta

One of the most thriving sectors in the Maltese gaming industry is remote gaming.

The MGA (Malta Gaming Authority) has provisioned remote gaming through the Remote Gaming Regulations (L.N. 176/04), thus making Malta the first country in the EU to have remote gambling legislation.

Lotteries in Malta

The National Lottery in Malta is conducted by the Minister of the Lotteries and Gaming Authority and it is the only entity able to issue a lottery license.

Opening a Casino in Malta

The first step to open a gambling facility is to register a company with the Maltese Companies Registrar and then apply for the proper type of license.

First of all, a company must meet the “fit and proper” criteria imposed by the Authority.

Secondly, the company must have a solid business plan which will also be subject to serious evaluation.

Capital Requirements for Opening a Casino in Malta

Companies applying for a remote gaming license are now subject to minimum share capital requirements, depending on the type of license applied for:

100,000 euros for class 1 and 2 licenses;

40,000 euros for class 3 and 4 licenses;

240,000 euros for companies applying for multiple licenses.

Taxation of Gambling Activities in Malta

The taxes applied to Maltese companies in the online gaming industry are strictly related to the license class and type of games the company provides. 

The maximum gaming tax a Maltese company must pay on an annual basis is 466,000 euros, no matter the license class.
