Barbara Gallani, Director, Regulatory, Science & Health at the Food and Drink Federation (FDF) is responsible for the development, implementation and promotion of FDF's policy with respect to scientific, technical and regulatory issues. During her presentation she will cover labelling, including the process that led to the UK recommendation for a voluntary form of expression on packaging and the criteria behind the thresholds for colours.

Scope of the Regulation

Mandatory requirements for majority of pre-packed foods

Rules on voluntary provision:

Repetition of nutrition information

Non-pre packed foods

Alcoholic drinks

Does not apply to:

Food supplements (Directive 2002/46/EC)

Natural mineral waters (Directive 2009/54/EC)

Separate requirements in PARNUTS directives take

precedence

Application Dates

Until 12 December 2014:

Can comply with either Food Labelling Regulations 1996 (as

amended) or EU FIC

From13 December 2014 must comply if:

providing nutrition information on a voluntary basis

making a nutrition or health claim

From13 December 2016:

mandatory on all pre-packed foods

Must be present in significant amounts

15% NRV per 100g or 100 ml (except drinks)

7.5% NRV per 100ml (drinks only)

15% NRV if package contains a single portion size

Must provide details on the absolute amount and the %

NRV

Calculating Nutrition Information

Three methods listed:

Manufacturer’s analysis of the food

A calculation from the known or actual average values of the

ingredients used

A calculation from generally established and accepted data

EC has published guidance on tolerances

Note this varies if:

A claim is made

Vitamins and minerals are added to the food

EC has published guidance on roundings

FoP Hybrid Scheme Consultation 2012-13

May to Aug 2012 public consultation

Announcements by 10 major retailers - prepared to work on

consistent scheme based on hybrid approach (colour coding and

%reference intakes)

24th Oct Government announces work towards a scheme based on

the hybrid approach

25th Oct Stakeholder Meeting - DH state intention to start with FSA

criteria and undertake further modelling

Wider written consultation on technical aspects of scheme including

thresholds for colour coding

Legality of the scheme

DH held informal meetings with the Commission throughout the

development and consultation process

On the basis of Articles 30 (3) and 35 of the EU FIC, the Commission

considered:

Use of added sugars

- Preference for standardised % cut-off (no judgement on specific

nutrients)

Member States must inform the Commission of

additional forms of expression they intend to

recommend;

By Dec 2017 member states that have recommended

and Additional Form of Expression have to provide

additional information to enable the Commission to

prepare a report.
