SynopsisOn 9-15-2011, at approximately 1:10 AM, the MN BCA was requested by the Winona County Sheriff's Office to conduct aninvestigation into an Officer Involved Shooting occurring at approximately 12:25 AM in Minnesota City in Winona County. On 9-15-11 at approximately 1:10 AM, the MN BCA was requested by the Winona County Sheriff’s Office toconduct an investigation into an Officer Involved Shooting occurring at approximately 12:25 AM inMinnesota City located in Winona County.

SA Schafer spoke with Winona County Sheriff Dave Brand by phone who advised Deputy John Hazeltonhad fired his department issued weapon once at Chase KOLSTAD after KOLSTAD had produced andpointed a weapon at Deputies Hazelton and Chris Cichosz. Deputy Hazelton and Deputy Cichosz had beenremoved from the scene. KOLSTAD was pronounced dead and remained at the scene. Deputy Hazelton’sweapon had been secured in Deputy Cichosz’s squad at the scene.

SA Schafer along with SSA Evans, SAIC Hansen and SA Mueller responded to Minnesota City. The BCACST headed by Mark Patterson and assisted by SA Hanegraaf and other CST personnel also responded toprocess the scene.

At the scene and later at the LEC, SA Schafer was briefed by Sheriff Brand and other law enforcementpersonnel. SA Schafer was advised since approximately 5:07 PM on 9-13-11, Winona PD, Goodview PD, andthe Winona County SO have been attempting to locate KOLSTAD as it had been reported he was missingand suicidal by his friends.

At the time of the initial missing person report, KOLSTAD’s mother, Kelly Laak, advised WPD KOLSTADhas made previous threats of suicide including at least once threatening use of a firearm. Laak also reportedKOLSTAD is using prescribed and illegal drugs, including a synthetic drug referred to as plant food. Untilrecently, KOLSTAD had been staying at Sarah Gibbs’ residence.

After immediate attempts to located KOLSTAD were unsuccessful, Winona PD entered KOLSTAD in NCICas a missing person. Continued searching on 9-13-11 and 9-14-11 did not produce KOLSTAD. WinonaPolice drafted an internal Officer Safety memo advising KOLSTAD is missing/wanted, may be in possessionof a firearm, and is a known plant food user. The memo was posted and distributed internally to both theWinona PD and Winona SO staff. SA Schafer acquired a copy of the memo and is identified as item 787.1and is attached to this report.

On 9-14-11, at 10:51 PM, Sarah Gibbs reported to the Winona PD that she and Cullen Frisch were receivingthreatening messages from Chase KOLSTAD. Gibbs told WPD KOLSTAD stated he was in possession of ahandgun and wanted to kill Frisch while Gibbs watched. KOLSTAD also stated he would kill any lawenforcement officer that confronted him. While taking the report, KOLSTAD had called Gibbs and in thepresence of WPD Officer Joyce, KOLSTAD was put on speaker phone. KOLSTAD stated he had a gun tohis head and he wanted to meet Gibbs, but if she brought Frisch, he would shoot Frisch. Investigationshowed KOLSTAD was making these calls from the Alyssa Mueller residence in Minnesota City. WCSO,WPD, and GVPD responded to Minnesota City to locate KOLSTAD.

At approximately 12:11 AM on 9-15-2011, GVPD Officer Volkman and WCSO Deputy Hansen locatedKOLSTAD in the ball diamonds/city park near the bridge in Minnesota City. As they maintained theirposition to the east of the bridge, at 12:16 AM, WCSO Deputies Hazelton and Cichosz encounteredKOLSTAD as KOLSTAD took up a position on the middle of the west side of the bridge, on the outer ledge.

Deputies Hazelton and Cichosz took a position on the south side of the bridge, approximately 30 yards fromKOLSTAD. After an approximately 9 minute stand-off, at 12:25 AM, KOLSTAD pointed a weapon atDeputies Hazelton and Cichosz. Deputy Hazelton fired his department issued AR-15 once at KOLSTAD.KOLSTAD fell off the bridge into the grass below. Medical personnel pronounced KOLSTAD dead at thescene.

During the stand-off, Chad Westby had driven up to KOLSTAD while on the bridge, exited his vehicle andapproached KOLSTAD. Westby was ordered off the bridge and was taken into custody. SA Schafer spokewith Westby on 9-15-11. Please refer to report 787/3 for details of the interview.

The BCA CST collected four items of evidence, including Deputy Hazelton’s AR-15and a knife fromKOLSTAD’s person. Prior to being transported to the MRMEO for autopsy, CST Patterson located a whiteenvelope in KOLSTD’S inner jacket pocket with the writing “my suicide note by Chase Kolstad.” Pattersonalso located a small white plastic bag with white powder residue and a spoon with additional white powderresidue. These items remained on KOLSTAD’S person pending autopsy. Please refer to CST Patterson’sreport for details of processing the scene.

On 9-15-2011 at 4:37 AM, SA Schafer and Mueller interviewed Winona County Deputy John Hazeltonrelating to his actions and observations during an Officer involved shooting in Minnesota City. A CDcontaining the audio of the interview is identified as Item 787/1.1. Deputy Hazelton also produced a sketchof the scene, Item 787/1.2, and provided a urine sample, Item 787/1.3. The urine sample was submitted to thelab by SA Schafer as Lab Item 8.

Prior to the interview, Deputy Hazelton met with MPPOA representative Paul Eng, who was also presentduring the interview. Deputy Hazelton provided a signed BCA Criminal Investigation Warning and BCAConsent for Chemical Testing which are attached to this report.

Deputy Hazelton stated he has been a POST licensed officer for 10 years, all of which has been with theWinona County Sheriff’s Office. Deputy Hazelton is currently a sniper on the Emergency Response Unit.Deputy Hazelton is assigned to the 5:00PM to 3:00 AM shift and is currently in his third work day of hisweek. Deputy Hazelton works in a fully marked squad in full uniform and his call number is 513. Part ofDeputy Hazelton’s department issued equipment includes an.223 caliber model AR-15 rifle which is keptsecured in his squad.

Deputy Hazelton explained he was aware of recent law enforcement contacts with Chase KOLSTAD and hadviewed a memo from 9-14-2011 advising that KOLSTAD was suicidal, a suspected drug user, and possibly inpossession of a handgun.

At approximate 11:30 PM on 9-14-11, Deputy Hazelton was advised to phone into dispatch. Hazelton wasadvised that KOLSTAD is calling from the Alyssa Mueller residence in Minnesota City. Hazelton wasfurther advised KOLSTAD was armed with a handgun and was threatening to harm himself and others andwas heading to the park. Hazelton, along with other law enforcement, are told KOLSTAD has a scanner andto utilize cell phones to communicate with one-another.

Deputy Hazelton headed towards Minnesota City from Winona and called Goodview PD Officer Volkman asGoodview is located between Winona and Minnesota City. Hazelton and Volkman agree to meet afterVolkman gets night vision equipment. They agreed to meet off the main road away from the park as they didnot want to announce their presence as they are concerned they could be ambushed by KOLSTAD.

Deputy Hazelton and Officer Volkman are met by Deputy Brand and they park their squads at the south exiton hwy 61, Bridge Street, at Minnesota City. All three approached the area on foot, utilizing the night visionto locate KOLSTAD. Deputy Hansen arrives and the four are now at the railroad bridge to the south of thepark over Bridge Street and are unable to locate KOLSTAD.

Deputy Brand and Officer Volkman remain at the railroad bridge as Hazelton and Hansen go back to theirsquads. Back at the squads, they are met by Deputy Cichosz. Between them, they feel KOLSTAD has notmade it to the park and may still be at Mueller’s residence. They plan to proceed to Mueller’s residence toset up a perimeter, make contact with KOLSTAD, and contact a negotiator to speak with and resolve thesituation with KOLSTAD.

Prior to leaving, Officer Volkman announces over the radio that he has spotted a person in the park.Volkman and Deputy Brand maintain their position near the railroad bridge. Deputy Hazelton and Cichoszadvise they will approach the area in Cichosz’s squad “blacked out.” Deputy Hazelton takes his duty riflefrom his squad.

As Hazelton and Cichosz approach, Cichosz turns on the squad spotlight to assist in locating the subject.Officer Volkman advises the subject is couching, avoiding the spotlight. Hazelton and Cichosz continue toapproach on Bridge Street and as they near the bridge from the south end, they see a subject about halfwaydown the bridge, on the west side outer ledge.

The deputies park and leave the squad, keeping the spotlight on the subject. Deputy Hazelton takes up akneeling position on the south end of the bridge, west side, behind a sign with his rifle sighted on the

subject. Deputy Cichosz is standing directly behind Hazelton. Hazelton and Cichosz repeatedly shoutcommands for the subject to show his hands. The subject does not comply or acknowledge the deputies.

As they continued to shout commands, a vehicle drove onto the bridge from the north end and stoppednear the subject. The vehicle headlights were pointed at Hazelton and Cichosz, hindering their vision. Thedriver, Chad Westby, exited the vehicle as Hazelton and Cichosz shouted commands for the driver to getinto his vehicle and leave the area. The driver complied and the vehicle drove south past the deputies. Thevehicle was eventually stopped by other officers and Westby was detained and ultimately arrested.

Hazelton and Cichosz continued to focus on the subject and shout verbal commands for the subject toshow his hands. Hazelton observed the subject was reaching into his jacket pocket and pulled out ahandgun. Cichosz confirmed it was a gun and that information was broadcast to the officers at the scene.Hazelton and Cichosz advised the assisting officers not to position themselves on the immediate north endof the bridge to avoid a cross-fire situation and to shut down Bridge Street to traffic.

The subject was holding the gun in his right hand and was placing it directly under his chin pointing theend upwards. The subject was also placing the gun against this temple and placing it inside his mouth. Asthe subject placed the gun again under his chin, Deputy Hazelton felt certain the subject was going to shoothimself. Deputy Hazelton shouted at the subject, “don’t do it!, don’t do it!, drop the gun!, drop the gun!”

The subject put the gun back to his head and then began to wave it around, pointing it in the direction ofthe north end of the bridge. Deputy Hazelton said the residences of Minnesota City are located just northof the bridge and other officers were in the general area, however Hazelton did not discharge his weapon ashe did not identify an immediate threat.

The subject then bought the gun back to his head and then brought it down, pointing it directly at Hazeltonand Cichosz. Deputy Hazelton though the subject was going to shoot at them. Hazelton explained he wasin fear of his life and Deputy Cichosz who was directly behind and above Hazelton. As the subject kept theweapon pointed at the deputies, Hazelton said he was certain if Hazelton did not shoot, they would be shotby the subject.

Deputy Hazelton then fired one round and the subject fell off the bridge to the ground below. Dispatch andother officers were advised of the “shots fired”. Hazelton and Cichosz approached from the top of thebridge as others approached the subject from below. Hazelton and Cichosz remained on the bridge untilmedical personnel pronounced the subject dead at the scene.

Deputy Hazelton said the incident on the bridge lasted approximately 4-5 minutes. Hazelton added the entiretime the subject never spoke or complied with any commands.

Hazelton secured his rifle in Deputy Cichosz’s squad and both cleared the scene.

On 9-15-2011 at 5:45 AM, SA Schafer spoke with Winona County Deputy Chris Cichosz concerning hisactions and observations relating to an Officer Involved Shooting with Chase KOLSTAD. A CD containingthe audio of the interview is identified as Item 787/2.1. Deputy Cichosz also produced a sketch of the scene,identified as Item 787/2.2.

Deputy Cichosz stated he has been a POST licensed officer for 9.5 years, all of them with the WinonaCounty Sheriff’s Office. Cichosz is a K-9 handler and works from 5:00 PM to 3:00 AM and his call number is518. 9-14-11 was his first day back at work, however he and his K-9 had been requested on 9-13-11 to assistin the search for Chase KOLSTAD, who was reported as a suicidal male with a gun. Cichosz was not able tosearch for KOLSTAD at that time.

Cichosz was working in a fully marked SUV in full uniform when dispatch advised him to call in. Dispatchadvised Cichosz that KOLSTAD was in the Minnesota City area. KOLSTAD was reported to be suicidaland in possession of a gun and a scanner. Cichosz was also told KOLSTAD had made death threats to lawenforcement and others.

Cichosz proceeded to Minnesota City and met up with other deputies on the south highway 61/BridgeStreet exit. Deputies Hazelton and Hansen were coming back to the squads from the north. As Cichoszarrived, GVPD Volkman radioed he spotted a subject in the park. WPD Sgt Allen called by cell phone andadvised the observed subject could also be Chad Westby who may be with KOLSTAD.

Volkman advised the subject was moving towards the bridge. Deputy Cichosz and Deputy Hazelton tookCichosz’s squad and proceeded on Bridge Street, north, to the park. As they got closer to the park, Cichoszturned on his squad headlights and spot light.

As they neared the south end of the bridge, Cichosz and Hazelton spotted a subject about half-way downthe bridge, on the west side outer ledge. Cichosz parked at the south end, west side and he and Hazeltontook cover at the end of the bridge, about 30-40 yards from the subject. Hazelton was kneeling and holdinghis duty rifle sighted on the subject and Cichosz was standing behind Hazelton.

Deputies Cichosz and Hazelton began to shout commands at the subject to drop the gun. Cichosz explainedhe did not see a gun at this time, but it was believed the subject possessed a gun. The subject did notrespond.

As Deputy Hazelton continued to give commands to the subject, Cichosz saw a gun in the subject’s righthand. Cichosz explained the subject was gripping the weapon like a gun and at one point held it up underhis chin with both hands and Cichosz thought he was going to shoot himself.

Cichosz said as the subject waved the weapon around, it flashed in the light and Cichosz described it as achrome handgun. Cichosz said he could see the subject holding the grip of the weapon with the shiny metalbarrel perpendicular to the grip and pointed outwards, parallel with the subject’s arm.

As Cichosz and Hazelton continued to shout commands, a truck approached from the north, with itsheadlights shining at Cichosz and Hazelton making it difficult for the deputies to see and illuminating them,putting them at a tactical disadvantage. Cichosz said the truck stopped where the subject was and thedriver exited. Cichosz recognized the driver as Chad Westby. Cichosz said as Westby approached thesubject, it seemed to agitate the subject. Westby was ordered to get back in the truck and leave the area.Westby left the bridge and was detained by other officers.

Deputy Cichosz noticed that Officer Volkman and Deputy Brand had now joined him and Hazelton, takingcover behind a large rock behind them.

Cichosz said Hazelton remained on target with the subject as Cichosz gave commands to drop the gun.Hazelton also continued to give commands to drop the gun, adding “it can’t be that bad.” Cichosz said the

subject laughed at that statement. Cichosz said that was the only time the subject had said anything oracknowledged the deputies.

At that point, Cichosz said based on the subject’s actions and their observations, he and Hazelton wereconfident the weapon was a gun.

Cichosz then advised dispatch to contact a negotiator to come to the scene. Cichosz stated he had turnedaround to tell Volkman and Brand to set up a perimeter at the north end of the bridge. Cichosz said as heturned around, Hazelton shot once. Cichosz turned back to see the subject had fallen off the bridge.

After the subject was pronounced dead, Cichosz was removed from the scene. His squad remained parkedat the scene.

On 9-15-2011 at 8:58 AM, SA Schafer spoke with Chad Westby concerning his actions and observationsrelating to an Officer Involved Shooting with Chase KOLSTAD. A CD containing the audio of the interviewis identified as Item 787/3.1.

Westby had been arrested earlier on 9-15-2011 on charges relating to the OIS. Prior to SA Schafer speakingwith Westby, he had been released from custody.

Westby said he and KOLSTAD were best friends and had gone through treatment together. Westby wasaware KOLSTAD had made prior threats of suicide by hanging or overdosing. Westby has heard fromKOLSTAD he claimed to have possession of a .38 handgun; however, Westby does not believe KOLSTADhad a gun.

Westby said KOLSTAD does have “a little pocket knife” and described it as a 4-6 inch silver folding bladeand was unable to describe the handle. Westby was aware KOLSTAD was a “plant food” user and hadoverdosed on plant food earlier in the month.

Westby said KOLSTAD has “really gone downhill” the past few days, adding he has never seen KOLSTADso depressed. Westby felt mostly because KOLSTAD had recently broken up with Sarah Gibbs and shehas a new boyfriend, Cullen Frisch. Westby also told SA Schafer within the past two weeks, he has hadsexual relations with Gibbs. On 9-13-2011, KOLSTAD learned of Westby and Gibbs from Gibbs. Westbyexplained to SA Schafer though he thought KOSTAD learning of that incident did not “put KOLSTAD over,it did not help.”

On 9-13-2011, Westby had been looking for KOLSTAD for over five hours as KOLSTAD has beendepressed and they could not locate him. Westby and KOLSTAD had talked on the phone and KOLSTADsaid he was going to hang himself. According to Westby, KOLSTAD said he had 240 milligrams ofoxycontin and one gram of meth. Westby was on the phone with KOLSTAD when KOLSTAD said he wasactually shooting the drugs all at once as they spoke. Westby said KOLSTAD said “oh shit!” and thenKOLSTAD dropped the phone. Westby though he had died at that point.

Later in the evening on 9-13-2011, After calling the police and asking for help in locating KOLSTAD,Westby said he had spoke with WPD Officer Sobotta and told her KOLSTAD was found and is OK butwould not advise police where KOLSTAD was.

Westby said the last he actually saw KOLSTAD was at approximately 1:00 PM on 9-14-2011 when he andKOLSTAD had gone grocery shopping for Alyssa Mueller. Westby said they were together for about 2 ½hours. Westby said he did have two or three short conversations with KOLSTAD about 2-4 hours beforeseeing KOLSTAD on the bridge. KOLSTAD told Westby “he had a plan.”

Westby sad he had been driving around in Minnesota City for about an hour before seeing KOLSTAD onthe bridge and he parked near the bridge and park area. Westby called the Winona Police number to tellsomeone where Westby was and wanted an officer to stop by so he could tell them what was going on withKOLSTAD. Westby was told Officer Joyce could call him back and Westby, seeing a deputy nearby, askeddispatch if the deputy could come over.

After the deputy did not come over, Westby the drove around towards the bridge and saw KOLSTADstanding on the bridge and saw 15 police cars. Westby said as he approached, he saw Deputy Hazeltonwith a shotgun and other officers at the opposite end of the bridge. Westby said he pulled up to KOLSTADwho was standing on the outer ledge of the bridge and asked KOLSTAD to come down. Westby said heheld out his hand and KOLSTAD put his hand out to him. Westby said we was ordered off the bridge bydeputies, detained, and ultimately arrested.

Westby initially told SA Schafer as he pulled up to KOLSTAD, KOLSTAD was “not pointing the gun atnobody else.” When SA Schafer asked for details about the gun, Westby said KOLSTAD did not have agun. When asked if KOLSTAD had any kind of weapon, Westby said KOLSTAD did not.

Westby said as he was in the back of a squad care, he heard over the radio that shots had been fired and thesubject was in the water. Westby said he was eventually transported to the Winona county jail andbooked.

On 9-22-2011 SA Schafer sought and was granted a search warrant for Facebook, Inc. for records relating toChase KOLSTAD. KOLSTAD Facebook ID was identified as “Chase E ntGuilty”, ID3282762546994. Thesearch warrant was reviewed and signed by Winona District Judge Mary Leahy.

On 10-1-2011, per Facebook guidelines, the search warrant was emailed to their headquarters located in PaloAlto CA.

As of 11/7/2011 SA Schafer has not received a response from Facebook. Once received, it will be made apart of the case file.

On 9-22-2011 at 10:12 AM, SA Schafer spoke with Eric Burfeind relating to a Facebook conversation he hadwith Chase KOLSTAD. A CD containing the audio of the interview is identified as Item 787/8.1.

Eric Burfeind had approached the Winona County Sheriff’s Office advising he had information relating tothe officer involved shooting with Chase KOLSTAD.

Burfeind told SA Schafer on 9-14-2011, between the hours of 11:00 AM and 2:00 PM, Burfeind had aconversation with KOLSTAD through Sasha Brinkmeier’s Facebook account. Brinkmeier is Burfeind’sgirlfriend. Burfeind stated he was using the account when KOLSTAD’s name appeared on the screenrequesting a conversation. During the conversation Burfeind did not identify himself he was uncertain inKOLSTAD knew if he was writing to Burfeind or Brinkmeier. Brinkmeier was present during this exchangewith KOLSTAD.

In the five minute conversation, KOLSTAD stated he is “the proud new owner of a .38” and “he was goingto be take the gun wherever he goes.” KOLSTAD also said he has a list of three people who he is watchingand will be going after them to pay them back. Burfeind explained KOLSTAD never said he was going to killthem, however, Burfeind stated because of his criminal background, he inferred KOLSTAD was going to killthem.

Burfeind recalled one name on the list as “Sarah W’ and two males whose names he was unable to recall.

Burfeind also said KOLSTAD stated he was depressed as his girlfriend had left him and KOLSTAD hadbeen using a lot of “plant food”.

Burfeind stated he came forward and was concerned for the deputy. He usually does not approach thepolice and offer information. Burfeind stated if SA Schafer contacted Brinkmeier, she would lie about theFacebook conversation.

Burfeind stated his Facebook user name is “bowhunter55952”.

On September 15, 2011, SA Hanegraaf was contacted by the Bureau of Criminal Apprehension’s (BCA)operations center to respond to a crime scene located at the “Bridge” on Bridge St./Wenonah Rd, inMinnesota City, MN. Upon arrival SA Hanegraaf was briefed by SA Schafer regarding the crime scene. TheBCA Crime Scene Team (CST) responded to the scene as well. The BCA CST was comprised of MarkPatterson as the team leader and Eric Grunwald, Katie Igowsky as team members.

SA Hanegraaf documented the crime scene through digital photography. These digital images were latertransferred to a master DVD, which was labeled item 9.1. The compact flash card was sent to the crime scenesection where a contact sheet and compact discs were made. Copies of the contact sheets and compactdiscs will be given to SSA Evans to distribute.

SA Lehman also responded to the scene to assist in scene documentation. SA Lehman documented thescene with video. This was recorded on a MiniDV, which was transferred to a DVD for easy viewing. TheMininDV has been labeled item 9.2.

The above items of evidence have been properly marked and will be stored within the crime scene files.

On 9-28-2011 at 3:28 PM, SA Schafer and WCSO Investigator Glover interviewed Richard Urbick concerninghis actions and observation relating to an Officer Involved Shooting involving Chase KOLSTAD. A CDcontaining the audio of the interview is identified as Item 787/14.1. Urbick also produced a sketch of thescene, Item 787/14.2 which is attached to this report.

Urbick stated he is a maintenance employee with Winona State University and works until 12:00 AM. On9-15-2011, Urbick left work and as he approached his residence in Minnesota City at approximately 12:15AM, he was met by law enforcement at the southern highway 61 exit. Urbick was advised he would have tofind an alternate route home as the bridge was closed as “a man was threatening suicide with a weapon.”

Urbick drove around and as he neared his house, he pulled over by the old auto garage near the north edgeof the bridge and exited his vehicle. Urbick was about 50 feet away and walked to a nearby tree andwatched. Urbick said he was not able to clearly see what was occurring, but was able to hear.

Urbick stated he was there for about 10 minutes and about 5 minutes in her heard the command, “drop yourweapon” once. About 5-6 seconds later, Urbick heard one shot. Urbick then heard a voice say, “shotsfired, shots fired” and then some officers went to the middle of the bridge and looked over the edge.

Urbick then saw 3 kids running along the area just to the east of the bridge. Urbick then saw a deputy nearhim and asked what was going on and Urbick was told to go home.

Urbick then went to his residence and told his son that “a guy was trying to commit suicide and he’s got agun”.

At this point in the interview, SA Schafer asked why he had told his son the guy had a gun, if Urbick hadseen a gun, or if he was certain the terminology used by officers was “weapon” or “gun”. Urbick said hewas not certain of the terminology used, then recalled with certainty that the word used by officers was“gun” and not “weapon.” Urbick stated did not see a gun.

Urbick admitted he has seen and read media reports related to the incident since 9-15-2011 and at times, hismemory is bad.

On 9-30-2011 at 12:54 PM, SA Schafer spoke with Brenden Thatcher concerning to his knowledge relating tothe KOLSTAD Officer Involved Shooting. A CD containing the audio of the interview is identified as Item787/15.1.

Thatcher told Schafer he had been attending a meeting on 9/29/2011 from about 5:00 PM to 8:00 PM at theWenden Recovery House. Present were 5 other people, including a white female described as long blondhair with dark roots, Dark glasses, dark eye shadow, and thin. Thatcher was shown a picture of AlyssaMueller and Thatcher positively identified her.

During group, Mueller was talking about the officer involved shooting and mentioned a” Chase” and a“Chad” frequently. Thatcher does not know any of the people Mueller was speaking of.

Mueller spoke for a total of about 90 minutes and Thatcher recalled comments referring to Chad beingresponsible for Chase being on the bridge, Chase was standing on the outer ledge of the bridge, there was agirl mentioned and internet relationships. Mueller never mentioned the officer involved and Thatcher neverspoke with Mueller, rather just listened while she spoke.

Most of what Mueller said, Thatcher was unable to recall specifics of. Thatcher said he clearly recalled onecomment Mueller did say and it really disturbed him and was his motivation for speaking to lawenforcement.

Mueller stated she had gone to the bridge after the police left and found a gun and a knife in a piece ofcardboard. Thatcher said this specific comment was made out of group in the presence of Thatcher and twoother unknown males.

Thatcher said at times it was hard to follow what Mueller was saying as she spoke in fragmented sentencesand was speaking a lot.

On 9/30/2011 at 1:39 PM SA Schafer and Winona County Chief Deputy Ganrude spoke with Alyssa Muellerconcerning her knowledge relating to the KOLSTAD officer Involved Shooting. A CD containing the audioof the interview is identified as Item 787/16.1.

The purpose of the interview was to determine if Mueller had recovered a gun or knife from the scene of theOIS. Mueller stated she had not and denied ever making a comment that she had.

Mueller told SA Schafer she is involved with Winona County Human Services and currently is allowed onlyscheduled, supervised visits with her kids. Because Mueller is desperately trying to regain custody, Muellerappeared to determine if the answer would help or harm her in getting custody of her children.

Mueller stated she had met KOLSTAD in early September 2011 but has been life-long friends with Westby.Mueller was aware KOLSTAD had been dating Sarah Gibbs, but they had ended their relationship andWestby began dating Gibbs. Mueller said Westby would bring KOLSTAD to her place so Westby could bewith Gibbs without KOLSTAD finding out.

Mueller stated KOLSTAD was at her residence on 9/14/2011 at about 2:00 PM with Westby and Ricky Orr.Mueller was having a supervised visit with her son and they all hung out at the “pits.” Mueller showed SASchafer a picture Orr had taken of KOLSTAD at about 4:30 PM which Mueller posted on her Facebook page. In the photo it appeared KOLSTAD was wearing the same clothing that was observed on him during thescene examination. Mueller later emailed SA Schafer the photo which is attached to this report.

Mueller recalled she was with KOLSTAD until about 6:00PM and she had gone to be at around 8:00 PM on9/14/2011. Mueller was unclear as to specific dates and times and who was at her residence at any giventime. Mueller stated she did tell BCA Agents on the morning of 9-15-2011 that she did not know KOLSTADwhen asked.

On September 15, 2011 at approximately 0440 hours, SSA Evans and SAIC Hansen spoke with DeputyRodney Hansen of the Winona County Sheriff’s Office regarding his involvement in this officer involvedshooting investigation. The interview was conducted at the Winona County Sheriff’s Office and wasrecorded on SSA Evans digital recorder. A CD has subsequently been recorded, which has been labeleditem 17.1. During the interview Hansen completed a diagram of the scene, which has been labeled item 17.2.

Hansen indicated that he was working as a uniformed patrol deputy on September 14, 2011. He was madeaware that there was a suicidal male call in Minnesota City. Hansen indicated that this male, later identifiedas Chase Kolstad, was armed with a gun.

Hansen responded to this area and he eventually took a position of cover near the bridge that was in thearea of Bridge Street and Highway 61 in Minnesota City. Kolstad was standing on the outside of the bridgerailing. At one point Hansen heard Kolstad say, “Do you want me to jump?”

He saw something in Kolstad’s hands, but could not see what it was. Hansen heard officers say “drop theweapon” and then heard a shot. Hansen did not know if an officer had shot or if Kolstad had shot himself.

Kolstad fell off the bridge and officers then went down to the area where he fell. Officers located a knifewith Kolstad when they found him below.

On September 15, 2011 at approximately 515 hours, SSA Evans and SAIC Hansen spoke with Officer TravisVolkman of the Goodview Police Department in relation to his involvement in this officer involved shootinginvestigation. The interview was recorded on SSA Evans digital recorder and a CD has subsequently beencreated containing this recording, which has been labeled item 18.1. During the interview, Volkman created adiagram of the scene, which has been labeled item 18.2.

Volkman indicated he was working as a uniformed patrol officer on the evening of September 14, 2011.While working, Volkman became aware of a call in Minnesota City of a suicidal male. Volkman was awarethat this person was likely Chase Kolstad, whom authorities had been trying to locate for several days. Ithad been reported that Volkman was suicidal and possible armed, so authorities were looking for him tocheck his welfare. Volkman was also aware that Kolstad was a “plant food” user, which Volkman knows tocause hallucinations.

Volkman responded to the area of Bridge Street and Highway 61 in Minnesota City. Volkman used nightvision to survey the area. At one point he saw a male in the park area, at which time officers moved towardsthe bridge on Bridge Street. Officers then became engaged in a standoff with Kolstad, who was standing onthe ledge of the bridge.

Volkman heard a deputy say that Kolstad had a gun. Volkman saw Kolstad turn towards officers and sawhim making a motion as though he was holding a gun to his head. Volkman heard a gunshot at one pointand saw Kolstad fall off the bridge. Volkman thought Kolstad had shot himself. Volkman did not anyoneshoot Kolstad, but later learned a deputy had fired his weapon.

Volkman indicated that they then ran down to the area where Kolstad had fallen. A knife was found nearhim that was a folding knife with a black handle.

On September 15, 2011 at approximately 0556 hours, SSA Evans and SAIC Hansen met withDeputy Darrin Brand of the Winona County Sherriff’s Office at the Winona County Sheriff’sOffice. Agents had requested an interview with Brand regarding his involvement in an officerinvolved shooting that occurred in Minnesota City. The interview was recorded on SSA Evansdigital recorder and has subsequently been transferred to a CD. This recording was labeled item19.1. During the interview with Brand he completed a diagram of the scene, which has beenlabeled item 19.2.

Brand informed agents that he was working for the Winona County Sheriff’s Office on theevening of September 14, 2011 when he learned of a report of a suicidal male named ChaseKolstad was in Minnesota City. Brand was aware that law enforcement had been looking forBrand, that he was suicidal, and that he was possibly armed with a gun.

Brand responded to the location. When he arrived at the location he saw someone in the parknear Bridge Street and Highway 61. Eventually he saw the party later identified as ChaseKolstad on the bridge in this area. He saw something in Kolstad’s hand that he believed was agun. Brand heard loud verbal commands from officers on-scene instructing Kolstad to “put downthe gun” and instructing Kostad that they would get him help.

During the incident Brand saw the item he believed was a gun in Kolstad’s left hand towards thedeputies. Brand later contacted SSA Evans on September 21, 2011 and indicated that afterthinking about the incident he recalled Kolstad moving the item between both hands.

At one point, Brand heard a loud pop and saw Kolstad fall off the bridge. Brand ran down toKolstad’s location. He saw a knife in Kolstad’s hand, which he retrieved and gave to anotherdeputy. He described this knife as a 3 inch silver bladed knife, with a black handle. Medicalpersonnel were summoned, but Kolstad was pronounced dead on-scene.

On 10-5-2011 at 12:29 PM, SA Schafer attempted to interview Ricky Orr relating to his knowledge of theevents leading up to an Officer Involved Shooting involving Chase KOLSTAD. Orr declined, however on10/19/2011 at approximately 10:45 AM; SA Schafer did speak with Orr. A CD containing the audio of thefirst interview is identified as Item 787/20.1; the audio of the second interview is identified as Item 787/20.2.

On 10/5/2011, SA Schafer attempted to speak with Ricky Orr while he was in custody at the Winona countyjail. Orr told SA Schafer he did not want to speak with him at this time as he was withdrawing from meth.The brief interview was recorded.

On 10/19/2011, SA Schafer spoke with Orr at the Winona County jail. Orr was in custody for probationviolations and SA Schafer clarified he was speaking with Orr as a witness to the OIS and not there toquestion Orr about his reasons for placement in the jail.

Orr told SA Schafer he had met Chase KOLSTAD about 5 days before he died. Orr has known ChadWestby and Alyssa Mueller for over 15 years.

Orr was aware KOLSTAD was on the run from warrants and had been reported as a missing person twodays before KOLSTAD died. Orr said KOLSTAD was at Mueller’s residence the whole time.

Orr never saw KOLSTAD use drugs, but KOLSTAD told Orr he used drugs and “plant food” was his maindrug. KOLSTAD told Orr he usually injects drugs and he showed ORR a syringe KOLSTAD had. Orr saidhe and KOLSTAD tried to get some drugs, but had no luck. When asked if KOLSTAD had any prescribeddrugs, Orr replied not that he knew of. When asked about Buspirone specifically, Orr stated he uses thatprescribed medication.

Orr said the short time he knew KOPLSTAD he seemed in good spirits, except for when KOLSTAD foundout 2 days before he died that Westby had sex with Gibbs KOLSTAD’S ex-girlfriend. Orr observedKOLSTAD was initially upset with Westby but they were able to be around each other without problems.

On the day KOLSTAD died, Orr said he, KOLSTAD, Westby, and Mueller were at the pits with Mueller’sson and a supervisor for the visitation. Orr said he had a knife he had borrowed to KOLSTAD to pick atrocks. Orr described the knife as a folding knife, black handle, silver blade, about 4 inches long. Orr said henever got the knife back from KOLSTAD.

Before leaving the pits, Westby left and Orr, KOLSTAD, and Mueller went back to Mueller’s home. Muellerand Orr were in bed by 11:00 PM and KOLSTAD was still up at that time. While at Mueller’s, Orr said henever heard any mention of KOLSTAD having a gun or was aware KOLSTAD was using a phone.

Orr explained he and Mueller did not get up during the evening and was not aware there was a problem withKOLSTAD until he and Mueller were greeted by BCA Agents.

On 10/5/2011, SA Schafer acquired Chase KOLSTAD'S cell phone from his mother, Kelly Laak. The LGphone is identified as Item 787/21.1. A CD containing photos of the phones contents are identified as Item787.21.2.

Laak notified the Winona County Sheriff’s Office that an unknown individual had left KOLSTAD’S cellphone in her mailbox.

SA Schafer met with Laak who turned over the phone, an LG pre-paid TracPhone assigned number507-429-4682. Laak said it was actually her phone that she had purchased at Wal-Mart in the summer of2011, but had given it to KOLSTAD for his use.

Laak said an unknown individual had left the phone in her mailbox which Laak discovered on 9/28-2011.Laak told SA Schafer she had recently added time and charged the phone.

Laak added she had gone through the phone and deleted some photos that were embarrassing and had alsodeleted some of the text messages prior to turning the phone over to Law Enforcement.

SA Schafer submitted the phone to SSA Chung in an attempt to capture the phone content. SSA Chungwas unable to access the phone.

The phone was returned to SA Schafer. SA Schafer took photos of the phones screen display relating tothe contacts, call logs, photo album, and text messages.

On 10/20/2011, Sa Schafer acquired the Chase KOLSTAD's from the BCA Lab in St Paul. SA Schafer thenphotographed and checked the operation of the knife. A CD containing 17 photos is identified as Item787/22.1.

The knife was left in the custody and control of the Winona County Sheriff’s Office.

SA Schafer examined the knife in the presence of Sheriff Dave Brand. SA Schafer noted the knife to consistof a black, plastic handle and silver blade. The knife measures approximately 5.5 inches overall, folded.Opened with the blade locked, the knife is approximately 9 inches in length, with the blade beingapproximately 3.5 inches long.

The knife has a locking mechanism in which when the blade is fully extended, it locks and can only beclosed by depressing a metal bar located at the rear of the knife, requiring two hands. The unlockingmechanism cannot be operated while gripping the knife in one hand with the bladed fully opened andlocked.

SA Schafer also noted in order to open the knife, it must have force applied. The blade is manufactured witha hole near the rear of the blade that is designed to allow it to be opened with one hand. SA Schafer heldthe knife closed with the blade facing downward. Gravity did not cause the blade to move from its closedposition.

SA Schafer noted areas of friction/wear where the blade attaches and pivots on the handle. Between beingfully closed and locked opened, the blade does not move freely and has to have force applied to move theblade in either direction. When closing, once the blade is approximately 1 to one-half inch from the body, itsnaps closed without assistance. It is the same feature that requires force to open the knife.

When fully closed, little of the blade is visible and when gripped with one hand, fully closed, the blade isnot visible.

On 10/20/2011 SA Schafer acquired the final autopsy report on Chase KOLSTAD from the Dr. RebeccaLossen of the Winona Medical Examiner’s Office. The autopsy was performed by forensic pathologist DrLindsey Thomas of the Minnesota Regional Medical Examiner’s Office.

The autopsy shows KOLSTAD died of a single gunshot wound to the head. KOLSTAD was also under theinfluence of methamphetamine.

SA Schafer acquired the clothing, personal property, and evidence from Chase KOLSTAD’s autopsy.

The items had been picked up from the Minnesota Regional Medical Examiner’s Office by BCA CST LeaderPatterson.

CST Patterson retained items: 3 (lab item 9), known DNA from KOLSTAD; item 5 (lab item 10) plastic bagwith white powder residue; and item 6 (lab item 11) spoon with white powder residue.

The remaining items, including KOLSTAD’s suicide note, were turned over to the WCSO to be maintainedin their custody and control.

On 11/10/2011, SA Schafer received a letter from Winona County Sheriff Dave Brand which had beenwritten by Chad Westby. The letter is identified as Item 787/30.1.

Sheriff Brand said Westby had been into his office on 11/8/2011. Westby was remorseful about his contactand statements to the media relating to the officer involved shooting of Chase KOLSTAD. During theconversation, Westby wrote a letter to Deputy Hazelton.

In the letter, Westby wrote that once Deputy Hazelton had gone back to work, Westby had been contactedby the local media asking if Westby was upset. Westby stated he was happy Deputy Hazelton hasreturned.

Westby also wrote, “(KOLSTAD) had a death wish that night because of some letters (KOLSTAD) had sentin the mail that day. I know deep down (KOLSTAD) did not want to come home”.

A copy of Westby’s letter is attached to this report. Please refer to it for additional details.

SA Schafer has attempted to locate Westby to ask about and possibly acquire the mailed letters fromKOLSTAD. As of 11/16/2011, Westby has not been located.

On 11/18/2011, SA Schafer received a call from Chad Westby. The call was not recorded; however, it wasmade from Sheriff Brand’s office in the presence of Sheriff Brand.

SA Schafer asked about the letters KOLSTAD had mailed out. Westby said he knows of two people thatreceived letters and KOLSTAD had left one in Westby’s truck.

Westby refused to identify the others that had received the letters, and was unable to recall if he still hadhis. Westby stated he would look for the letter.

Westby explained his letter said KOLSTAD was unable to take the pain anymore and that KOLSTAD didnot plan on coming back that night. Westby added he felt KOLSTAD wanted to die but was unable to dothe act himself.

Westby told SA Schafer he is still homeless and does not have a phone. Westby stated he visits theBethany House at least once a day and will keep in touch with the Sheriff.

On 2/22/2012, during an interview with SA Schafer and Assistant Hennepin County Attorney MarleneSenechal, Sarah Gibbs revealed Chase KOLSTAD had written her a letter explaining why he had killedhimself. The letter is identified as Item 787/34.1.

During the interview, Gibbs was asked if she had received a letter from KOLSTAD around the time he died.Gibbs stated she had, and she had found it in Chad Westby’s vehicle.

Gibbs stated the letter explained why he had killed himself. Gibbs said SA Schafer could have the letter ifshe could locate it.

At approximately 4:00 PM, Sarah Gibbs texted SA Schafer saying her mother, Kim, had the letter at herresidence in Winona and would look for it. At approximately 6:00 PM, Kim Gibbs called SA Schafer advisingshe had located the letter. SA Schafer made arrangements for Winona PD to pick the letter up and turn itover to Assistant Chief Tom Williams.

SA Schafer viewed the letter which is attached to this report. The letter, in part, states, “If you are readingthis, I’m already dead”. The letter continues and KOLSTAD explains why he killed himself.

SA Schafer and HCAO Assistant Marlene Senechal spoke with Chad Westby in relation to the Winona OIS. A note written by Chase KOLSTAD to Alyssa Mueller was acquired and is identified as Item 787/35.1.

SA Schafer and Assistant Hennepin County Attorney Marlene Senechal spoke with Westby in anon-recorded interview.

During the interview, Westby acknowledged he had a letter written by Chase KOLSTAD to Alyssa Mueller.Westby stated the letter was currently in his possession and produced the letter. SA Schafer copied theletter with Westby’s consent and is identified as item 787/35.1. A copy of the letter is attached to thisreport.

Westby also stated a few days prior to 9/15/2011 and the incident with KOLSTAD, Westby and KOLSTADhad come across a person that Westby knew, while all three were in Winona. The person had possession ofa 38 caliber handgun that he was trying to sell it to either Westby or KOLSTAD. Westby said neither henor KOLSTAD bought the gun.

When asked the identity of the person, Westby would only say his initials were “D.P” and that they werenot involved in the incident relating to KOLSTAD. Westby added KOLSTAD had never met the personbefore or after this encounter.

On March 6th and 7th, 2012, a 22 member Grand Jury heard the evidence in the Winona County ChaseKOLSTAD Officer Involved Shooting, present by Marlene Senechal of the Hennepin County Attorney’sOffice.

At approximately 5:00 on March 7th, 2012, the Grand Jury returned a “no bill”, clearing WCSO Deputy JohnHazelton and all others of any criminal charges.

A copy of the document is attached to this report. All evidence related to the case will be documented andreleased to the Winona County Sheriff’s Office.

The BCA investigation will be closed.
