under any circumstances.What is this lawsuit about?Plaintiffs claim that New York State
has failed to provide constitutionally re-quired criminal representation to poorpeople in five counties, including On-ondaga, Suffolk, and Washington Coun-ties. Plaintiffs claim that lawyers are notavailable to poor defendants at critical
stages of the criminal process, includingthat defendants face first appearanceswithout counsel and that defendantseffectively have no one advocating forthem during plea negotiations. Plain-tiffs do not seek to overturn any crimi-nal conviction. Instead, Plaintiffs seekto reform the public defense system bygetting a court order declaring that theState is not providing constitutionallysufficient representation to poor peopleand requiring the State to fix the consti-tutional problems.

Ronald McIntyre brought this lawsuit, onbehalf of themselves and all other peoplesimilarly situated in five counties in New
York who are or will be entitled to re-ceive constitutionally required, publiclyfunded criminal defense representation.A New York State appellate court certi-fied the case as a class action in January2011.
Where is this lawsuit pending?The lawsuit is pending in Supreme
Court in Albany County.Who is this lawsuit against?The lawsuit is against the State of New
York, as well as the Counties of Onon-daga, Suffolk, and Washington.
Who is settling?The Plaintiff class is settling its claims
involving Onondaga County, SuffolkCounty, Washington County, and theState of New York that exist as of Octo-ber 21, 2014. The Plaintiff class separatelyagreed to settle its claims involving On-tario County and Schuyler County, andthe State agreed to include these twocounties in this settlement.

This lawsuit is not a way to attack yourindividual criminal conviction or plea.The lawyers for the Plaintiff class cannotadvise you on these matters.

Do I have to pay any lawyers?No. The State has agreed, as part of
the settlement, to pay attorneys fees andcosts of $5.5 million to Plaintiffs attor-
neys.What are the terms of the settlement?The State of New York will ensure
that defense attorneys are present at allarraignments or first appearances in eachof Onondaga, Ontario, Schuyler, Suffolk,and Washington Counties. The State will,through the New York State Office ofIndigent Legal Services (ILS), estab-lish and implement caseload/workloadstandards, including hiring attorneys andsupport staff as needed in each county tomeet those standards. The State of NewYork, through ILS, will create plans to im-prove the quality of public defense repre-sentation in Onondaga, Ontario, Schuy-ler, Suffolk, and Washington Counties.ILS will establish statewide defendanteligibility criteria to ensure uniform andfair eligibility determinations. The Stateof New York will also monitor and reporton its obligations under the agreement toPlaintiffs counsel.
In exchange, the Plaintiff class hasagreed to dismiss the systemic claimsconcerning the constitutionality of crimi-nal representation for poor people inOnondaga County, Suffolk County, andWashington County that were made orcould have been made in this lawsuitagainst the State of New York, OnondagaCounty, Suffolk County, and Washington
