THURSDAY DECEMUR 23 1886
AN ABUSE
There is something barbarous in a
law that allows the stopping of a man
from taking passage out of the King
dom without tlie intervention of
judge or jury upon a claim that is
squarely disputed and can only be set
tled by mutual arrangement or refer-
ence
¬
to the courts When as in the
case reported to hae happened yestcr
day the victim of the law is called
away on such an errand of humanity
as the illness of a wife the proceedingis calculated to work great hardship
Writs of capias in other countries are
sometimes abused in like manner but
there is the safccuaid in their case ofgreater formality in the producing of
the suspected intending absconder im
mediately before a magistrate for ex ¬
amination into the claim against him
In any case however the passport law
of this country should have a pro-
vision
¬
requiring reasonable notice of
intention to stop a debtor leaving tne
country if his purpose be known within
a day of his projected departure Tobe complete moreover such a law
should go a little further and compelstreets
at lcasl thirty six hours in advance of
the sailing of the vessel that is take
them and allow no process to inter-
fere
¬
with their departure twelve
hours prior to the time of the shipsleaving port Of course per-
sons
¬
of property in the Kingdomshould be pxempted so that the pro-
vision suggested would not interferewith the exigencies of business which
often call a man of affairs abroad on
very brief notice But perhaps the
best way toamend the law would be toabolish it leaving people to look outfor themselves and be more careful in
giving credit than they are under such
an arbitrary law While the law is inexistence however it will manifestly
be the part of wisdom for anybody
having any difference whatever with
the little world of Hawaii to force a
settlement or an understanding of
the particular matter before buying a
ticket for any foreign port
THE CIGAR IMPOST
Users of the weed may be left tolook out for themselves in samplingcigars perhaps but there are two seri-
ous
¬
charges in the letter of a corres-
pondent
¬
published morning which
demand a searching investigation Thethat the increased duty on
cigars was especially intended
0 favor the importers of other kinds ofMr Haysclden who was tariff
and internal taxation engineer at thesession should come forward and
blnw if he can that there were good
and sufficient reasons of another kind
for the discrimination againstcigars In the case of any otherLegislature knovn to modern institu-
tions
¬
it might look absurd to ask
for reasons a after it hadbecome law but Hawaiian legislatorssome ot them have a peculiar habit ofrushing a law through first and allowingits reasons to appear in results For
instance an honorable noble in thesession of 1884 had scleral policemen
addeU to a certain district where vari ¬
ous members said there was a sufficient
number already through the knock

down argument expressed in the laconic1
declaration I want them Tiftopinion of the Herald that theduty on Manila cigars was raised as a
simple means of increasing rcvcnilcsfor extravagant expenditure that classof cigars being a luxury of thepoorman and the poor man in this tin
democratic country being more pas ¬
sive than the man of casitr circum-
stances
¬
A cognate sample of piling
on the agony to poor people is theinci cased duty on China matting embodied in the same act
A more serious charge one that we
have heard before is that the bill in
question received the royal sign manual
on second reading This being n case
somewhat similar to the question of the
ten days clause in the Oceanic subsidybill demands immediate attention from
the Trivy Council if not taken upby that body the people will have totake into consideration means of strictlyexamining the whole process of Icgishtion What in earth is this nation coining to
if there is uncertainty left on the minds
of the people as to what laws
or parts of laws are genuine
and what base counterfeits It will be
an object of the Herald to investigate
the facts relating to the tariff amend-
ment
¬
as it has been to uncover the
scandalous omission of a clause in thesteamship subsidy bill Hut there is
no use in a newspaper ferreting outgrave crimes and misdemeanors unless
the public who arc injured arc pre ¬
pared to do their part like men
NOTES AND COMMENTS
Places of convivial resort for whitemen and natives are obliged by law toclose at half past eleven which is
proper but there are scores of housesin Chinatown wherein loud revelry andgambling are kept up the livelong
night What about that
The recent Chicago strike was endedthrough the determined action of MrPowderly Grand Mastcrof the Knightsof I nbor who issued a letter informing
the Chicago Knightstthat the strike
being contrary to orders from the exe-
cutive
¬
must cease or the charters of
the local lodges be surrendered
Science is gry headed and Modern
Science is growing a beard but thestreet makers of Honolulu have notlearned that water finds its level nor
the statesmen of Hawaii that the same
money cannot be spent at the same
time in Samoan politics and in making
all persons to enter for passage abroad decent and sidewalks in Hone

Indications are strong and increasing
that the Conservative party in Englandwill adopt the protection doctrines to
save itself with the working classes
Mr Gladstone is preparing the strong-
est
¬
arguments against protection to
meet the revolt against free trade
which is gathering strength among theworking people of England The Con-
servatives
¬
hope by raising the cry of
protection to home industries to divert
the attention of the people from the
Irish question
It has been suggested to us that
efforts should be made to induce Mr
Raymond of Boston to bring an ex-
cursion party to these Islands Thisdistinguished excursion manager hasbrought a large number of people fromthe East to California this winter Perhaps special rates could be given for alarge party hither by the OceanicSteamship Company also by the inter- -
island steamship companies for visiting
the volcano One party of wealthy
tourists would likely be followed byolhers and a recular stream of travellers directed this way which would
put large amounts of money in activecirculation
Naturalized Englishmen in NewYork have taken preliminary action forthe fitting celebration of Queen Vic
torjas jubilee on the throne next JuneDoubtless British subjects all over theworld will engage in commemorative
exercises of some sort and those in
Honolulu should not be behind theirbrethren elsewhere in manifestations ofloyalty on the auspicious occasion Asthey join with citizens of the UnitedStates in keeping holiday on the anni-
versary
¬
of American independenceprobably they might count upon Amer-
icans

sympathizing and evenwith them in some degree to cele ¬

To Smokers
To the Editor of the IltraldAt the last session of the Legislature
a bill wts introduced in the interests ofimporters of so called Havana cigars
which are principally manufacturedin Germany and Connecticut and arecommonly known as Stinkadoras

¬
etc protecting these im-
porters¬
by imposing a duty of 10 per1000 and to per cent ad valorem onManila cigars and in the hurry tosecure their subject it was passed to 1second reading and it is said went tothe King and was signed by him inthat form It not having reached thethird reading can it be consideredlegal to collect the duties as prescribedby law They arc being collected andthe result is it is very difficult to find areally good Manila cigar in town asunder the circumstances it will notpay to import them and the dealers inthc Stinkadoras arc havjng thingstheir own way for a time Let me ad-
vise¬
the smokers of the so called Havanas to cut a piece off the small endof the cigar and then light the cigar atthe small end instead of the large oneor usual end and I think they will besoon cured of their love for cattlechips rolled up in cabbage leavesOne of the largest manufacturers ofcigars in the United States says hecan undersell the world as he usesgood tobacco in the large part of thecigar but the poorest in the mouthend As a cigars particularly these
Havana Regalias arc seldom smok-ed
¬
up a little of them going a longway the poor quality of the tobacco ishardly noticed and as they are muchcheaper than good Manilas they aregradually working the best out of themarket I his is not righr either inlaw or equity and I hope a test casewill be made of the legality of the lawand the next Lccislature will imposesuch a duty on these Havana luxuries
that will prevent their coming intocompetition with the genuine article

THURSDAY DECEMUR 23 1886
AN ABUSE
There is something barbarous in a
law that allows the stopping of a man
from taking passage out of the King
dom without tlie intervention of
judge or jury upon a claim that is
squarely disputed and can only be set
tled by mutual arrangement or refer-
ence
¬
to the courts When as in the
case reported to hae happened yestcr
day the victim of the law is called
away on such an errand of humanity
as the illness of a wife the proceedingis calculated to work great hardship
Writs of capias in other countries are
sometimes abused in like manner but
there is the safccuaid in their case ofgreater formality in the producing of
the suspected intending absconder im
mediately before a magistrate for ex ¬
amination into the claim against him
In any case however the passport law
of this country should have a pro-
vision
¬
requiring reasonable notice of
intention to stop a debtor leaving tne
country if his purpose be known within
a day of his projected departure Tobe complete moreover such a law
should go a little further and compelstreets
at lcasl thirty six hours in advance of
the sailing of the vessel that is take
them and allow no process to inter-
fere
¬
with their departure twelve
hours prior to the time of the shipsleaving port Of course per-
sons
¬
of property in the Kingdomshould be pxempted so that the pro-
vision suggested would not interferewith the exigencies of business which
often call a man of affairs abroad on
very brief notice But perhaps the
best way toamend the law would be toabolish it leaving people to look outfor themselves and be more careful in
giving credit than they are under such
an arbitrary law While the law is inexistence however it will manifestly
be the part of wisdom for anybody
having any difference whatever with
the little world of Hawaii to force a
settlement or an understanding of
the particular matter before buying a
ticket for any foreign port
THE CIGAR IMPOST
Users of the weed may be left tolook out for themselves in samplingcigars perhaps but there are two seri-
ous
¬
charges in the letter of a corres-
pondent
¬
published morning which
demand a searching investigation Thethat the increased duty on
cigars was especially intended
0 favor the importers of other kinds ofMr Haysclden who was tariff
and internal taxation engineer at thesession should come forward and
blnw if he can that there were good
and sufficient reasons of another kind
for the discrimination againstcigars In the case of any otherLegislature knovn to modern institu-
tions
¬
it might look absurd to ask
for reasons a after it hadbecome law but Hawaiian legislatorssome ot them have a peculiar habit ofrushing a law through first and allowingits reasons to appear in results For
instance an honorable noble in thesession of 1884 had scleral policemen
addeU to a certain district where vari ¬
ous members said there was a sufficient
number already through the knock

down argument expressed in the laconic1
declaration I want them Tiftopinion of the Herald that theduty on Manila cigars was raised as a
simple means of increasing rcvcnilcsfor extravagant expenditure that classof cigars being a luxury of thepoorman and the poor man in this tin
democratic country being more pas ¬
sive than the man of casitr circum-
stances
¬
A cognate sample of piling
on the agony to poor people is theinci cased duty on China matting embodied in the same act
A more serious charge one that we
have heard before is that the bill in
question received the royal sign manual
on second reading This being n case
somewhat similar to the question of the
ten days clause in the Oceanic subsidybill demands immediate attention from
the Trivy Council if not taken upby that body the people will have totake into consideration means of strictlyexamining the whole process of Icgishtion What in earth is this nation coining to
if there is uncertainty left on the minds
of the people as to what laws
or parts of laws are genuine
and what base counterfeits It will be
an object of the Herald to investigate
the facts relating to the tariff amend-
ment
¬
as it has been to uncover the
scandalous omission of a clause in thesteamship subsidy bill Hut there is
no use in a newspaper ferreting outgrave crimes and misdemeanors unless
the public who arc injured arc pre ¬
pared to do their part like men
NOTES AND COMMENTS
Places of convivial resort for whitemen and natives are obliged by law toclose at half past eleven which is
proper but there are scores of housesin Chinatown wherein loud revelry andgambling are kept up the livelong
night What about that
The recent Chicago strike was endedthrough the determined action of MrPowderly Grand Mastcrof the Knightsof I nbor who issued a letter informing
the Chicago Knightstthat the strike
being contrary to orders from the exe-
cutive
¬
must cease or the charters of
the local lodges be surrendered
Science is gry headed and Modern
Science is growing a beard but thestreet makers of Honolulu have notlearned that water finds its level nor
the statesmen of Hawaii that the same
money cannot be spent at the same
time in Samoan politics and in making
all persons to enter for passage abroad decent and sidewalks in Hone
to
within

Indications are strong and increasing
that the Conservative party in Englandwill adopt the protection doctrines to
save itself with the working classes
Mr Gladstone is preparing the strong-
est
¬
arguments against protection to
meet the revolt against free trade
which is gathering strength among theworking people of England The Con-
servatives
¬
hope by raising the cry of
protection to home industries to divert
the attention of the people from the
Irish question
It has been suggested to us that
efforts should be made to induce Mr
Raymond of Boston to bring an ex-
cursion party to these Islands Thisdistinguished excursion manager hasbrought a large number of people fromthe East to California this winter Perhaps special rates could be given for alarge party hither by the OceanicSteamship Company also by the inter- -
island steamship companies for visiting
the volcano One party of wealthy
tourists would likely be followed byolhers and a recular stream of travellers directed this way which would
put large amounts of money in activecirculation
Naturalized Englishmen in NewYork have taken preliminary action forthe fitting celebration of Queen Vic
torjas jubilee on the throne next JuneDoubtless British subjects all over theworld will engage in commemorative
exercises of some sort and those in
Honolulu should not be behind theirbrethren elsewhere in manifestations ofloyalty on the auspicious occasion Asthey join with citizens of the UnitedStates in keeping holiday on the anni-
versary
¬
of American independenceprobably they might count upon Amer-
icans
¬

To Smokers
To the Editor of the IltraldAt the last session of the Legislature
a bill wts introduced in the interests ofimporters of so called Havana cigars
which are principally manufacturedin Germany and Connecticut and arecommonly known as Stinkadoras
Telephone cigars Teamsters Re-galias
¬
etc protecting these im-
porters¬
by imposing a duty of 10 per1000 and to per cent ad valorem onManila cigars and in the hurry tosecure their subject it was passed to 1second reading and it is said went tothe King and was signed by him inthat form It not having reached thethird reading can it be consideredlegal to collect the duties as prescribedby law They arc being collected andthe result is it is very difficult to find areally good Manila cigar in town asunder the circumstances it will notpay to import them and the dealers inthc Stinkadoras arc havjng thingstheir own way for a time Let me ad-
vise¬
the smokers of the so called Havanas to cut a piece off the small endof the cigar and then light the cigar atthe small end instead of the large oneor usual end and I think they will besoon cured of their love for cattlechips rolled up in cabbage leavesOne of the largest manufacturers ofcigars in the United States says hecan undersell the world as he usesgood tobacco in the large part of thecigar but the poorest in the mouthend As a cigars particularly these
Havana Regalias arc seldom smok-ed
¬
up a little of them going a longway the poor quality of the tobacco ishardly noticed and as they are muchcheaper than good Manilas they aregradually working the best out of themarket I his is not righr either inlaw or equity and I hope a test casewill be made of the legality of the lawand the next Lccislature will imposesuch a duty on these Havana luxuries
that will prevent their coming intocompetition with the genuine article
