Post Mortem• December 22 - Government Shutdown

Congress failed to provide FY19 funding for several agencies - including HUD and USDA- affected expiring PBRA, Section 202, Section 811 contracts

• Housing Choice Voucher Program Funding

• HUD obligated for January and February

• No funding for March!

• January 25th - Government Reopens through short-term Continuing Resolution (CR) - expires February 15th

• March and April - Initial indication CR will support payments Public Housing and Voucher Funding - Need HUD confirmation

Assuming shutdown with No funding obligated

• Request use of HUD Held Reserves - HUD Letter -1/15/2019:

Sources of Funds in the Housing Choice Voucher (HCV) Program

Acceptable funds to prevent termination of participants: Proceeds from PH Demo/Dispo, COCC funds, State Funds, donations from philanthropic parties

Impact to tenantsIf HAP not paid

• Can’t be evicted for non HAP payment but:

• Could get a 90 day notice if not in the initial 12 month term of lease

• Could have disregarded HQS Fails which lead to defat landlords leaving the program

• Check for Eviction controls in your jurisdiction. San Jose Moratorium

• Need to communicate that the tenant must pay their portion of rent, even if HAP is not paid.

Advocacy

• Utilize NAHRO’s Advocacy Center to send timely letters to congressional representatives

• NAHRO working with HUD to minimize burdensome requirements for accessing reserves and approval process for utilizing outside sources if normal HAP funding is not available
