Hello Pat,
Please find enclosed Moses Lake Industries (MU) application for renewal of our industrial wastewater permit #ST0005375 which has an expiration date of September 30, 2020.
MU anticipates amending the application later this fall to support positive environmental sustainability objectives associated with minimizing waste, reducing energy usage, increasing discharge water re-use and improving treatment efficiency associated with industrial wastewater Outfall #001. Additionally, MU is working with the Port of Moses Lake to support an increase in RO generated wastewater directed to the Port's beneficial crop irrigation system.
To assist in reviewing the application, comments are provided below, including some explanation of proposed changes from the existing permit (applied for January 28, 2011/issued August 26, 2015), as well as some anticipated path forward steps and discussion of additional information that will be provided in the future to supplem'ent the application .
Permit Comments:
1. Reverse osmosis generated water flow via Outfall #004 to Port of ML.
a. This water is basically a mineral enriched form of the incoming City of Moses Lake well water supply. Relative to the characteristics of the existing RO Reject water, going forward there is not expected to be any increase in concentrations of this water versus the existing permit limits, and due to updates to the RO system operation, there may actually be some decrease in TDS concentrations for some of the operating periods.
b. Due to anticipated future growth in plant production and staffing, MU anticipates some increased water usage and discharge flows. The existing monthly average flow to the Port of Moses Lake crop irrigation system is now typically in the range of 30,000 to 40,000 gal/day versus a monthly average permit limit of 50,000 gal/day. The updated subscription agreement with the Port will be for 80,000 gal/day on a monthly average basis to cover longer term growth projections. The updated subscription agreement should be finalized very soon and will be forwarded to Ecology. This should assure good coordination and input between the Port of ML, MU and Ecology on this section of the permit. MU is requesting an increase in our Outfall #004 limit to accommodate this change.
2. Reverse osmosis generated water for seasonal on-site landscape irrigation.
a. MLl's existing permit includes the option for irrigation of on-site lawn areas. Additionally, an engineering report was submitted during the last permit cycle for replacement of the perimeter tree-line irrigation system. While MLI does not currently implement on-site irrigation, MLI requests that this option be maintained in the permit should it become needed in the future. MLI understands that prior to implementation, appropriate irrigation and crop management plans and related documentation and monitoring would need to be submitted and implemented as described in the existing permit.
3. Outfall #001 industrial wastewater flows, future treatment upgrades and permit limits.
a. We believe the current permit limit flow of 13,000/22,000 gal/day (monthly average/daily maximum) is probably adequate at this point.
b. However, going forward, as part of anticipated future upgrades to the treatment system, such as treatment of low concentration metals waters via resin-bed ion exchange, MLI may request an increase in the daily maximum flow. This change would support the ability to collect and pretest treated wastewater in holding tanks followed by tank discharge after receiving passing lab results.
c. MLI is considering a project to increase the size of the existing neutralization tank located adjacent to the PB-95 building, internal Outfall #001 to reduce the number of times per day that employees must process/test and sample this flow. This will have no effect on discharge concentrations, and is simply a labor savings item, since the existing tank was installed decadesago when the facility was much smaller.
d. MLI understands that an Engineering Report and Plans will need to be submitted and appropriate approvals obtained from WDOE for these upgrades. We have been conducting onsite treatment trials to generate data that will be included in a future Engineering Report. In the event this project is implemented MLI would propose that the Subpart AJ concentration limits in 40CFR415.365 which refers to 40CFR415.364 would apply as well as potentially the analogous Subpart BM limits in 40CFR415.657 which refers to 40CFR415.654 in the event such water is processed.
e. MLl's existing permit includes a color discharge limit for Outfall #001 under Sl.A. of 15 color units. The 15 color unit limit does not appear to be appropriate as it was originally issued based on a City of Moses Lake Local Limit that was itself established incorrectly. We understand that the City of Moses Lake color limit issue was identified and then revised up to 100 color units. As such, it seems appropriate to coordinate the limit in MLl's permit. MLI made such request in 2016 and requests that it be updated in this permit cycle.

4. Source Control and Monitoring Improvements.
a. MU has implemented and continues to focus on source control and monitoring improvements. These include collection of sump water from the PB-97 area, PB-90 area as well as boiler blowdown wastewater and storm-water accumulation water from the DMC pad area.
b. Additionally, we have implemented on-line conductivity monitoring for steam condensate return to the boiler from the PB-97 evaporators. It is anticipated that the future resin bed ionexchange treatment system will be utilized to provide treatment for this wastewater along with certain streams from the PB-97 scrubber systems and possibly the boiler blow-downs.
5. Management of On-site Storm Water.
a. MU is located in a desert region of Washington and does not discharge stormwater off-site . The closest surface water body is over 1 mile to the east. The vast majority of stormwater from impervious surfaces immediately infiltrates adjacent to buildings and roadways, with a small amount directed to on-site drywells. As part of voluntary clean-up and source control activities MU submitted a report in November 2017 and received a No Further Action (NFA) letter from the Ecology MTCA program (with cc to the Water Program) on roof, soil, asphalt and drywell clean-up activities along with runoff water sampling in the vicinity of PB-97. MU anticipates closure of this drywell later this fall as part of changing the runoff sloping in the area and updated asphalt work.
Section J: POTW Certifications.
We will be separately forwarding the certifications from the City of Moses Lake for the Outfall #001 and Port of Moses Lake for Outfall #004.
MU appreciates the input and suggestions of Ecology relative to upgrades to our wastewater. We anticipate the generation of additional treatment and monitoring information and look forward to reviewing with Ecology later this fall.

1. In order to improve water treatment efficiency, increase water re-use/recovery, reduce waste generation and reduce energy useage MLI is evaluating the feasibility of installing a resin-bed ion-exchange treatment system to treat certain low concentration metals streams. MLI has conducted onsite non-discharge trials and anticipates providing an updated
permit application with a supporting Engineering Report and related documents later in 2019 for this project. This project supports efforts that have been made by MLI to improve source control, monitoring and positive environmental sustainability.
2. MLI is contracting with the Port of Moses Lake to increase the maximum existing RO Reject wastewater permitted discharge volumes from the existing 50,000 gal/day to 80,000 gal/day (monthly average). There will be no increase in the concentrations of allowable discharges.

/Hazarous and non-hazardous wastes are generated from laboratory and production processes. Corrosive wastes and trace metals containing wastes are neutralized and evaporated as allowed under the Treatement-By-Generator rules. Port of Moses Lake Industrial Process Water Treatment Facility
SUBSCRIPTION AGREEMENT
THIS AGREEMENT is entered into by and between THE PORT OF MOSES LAKE (Grant County Port District No. 1 0), hereinafter referred to as the "Port'' and MOSES LAKE INDUSTRIES_ INC, hereinafter referred to as "MLI".
RECITALS:
WHEREAS, the Port is the owner and operator of an industrial process water treatment system and has adopted Resolution No. 1329 setting user rates charges and fees, for the Port Industrial Process Water Treatment System (the "System"); and
WHEREAS, the Port has adopted Resolution No. 1336, the Industrial Process Water Treatment Facility Use Resolution ("Resolution No. 1336'); and
WHEREAS, MLI is desirous of subscribing to monthly capacity based on an average daily discharge of 80,000 gallons; and
WHEREAS, this agreement supersedes the original subscription agreement executed January 24, 2002, and the Subscription Agreement Amendme11t #1 executed on September 2, 2008.
NOW THEREFORE,
Based on mutual promises contained herein, the Port and MLI agree to enter-into this Subscription Agreement on the following ti-rms and conditions:
1. Subscription Capacity. The Port wlll provide MLI monthly capacity based on an average daily discharge to the System. Upon the commencement date of this Agreement, the monthly capacity is based on an average daily discharge of80,000 gallons. This ls the minimum amount under the term of this Agreement and for any future renewal terms.
1.1 Additional Capacity. At the end of each calendar year, or any time during the term of this Agreement and during any renewal terms, at such time as MLI requites to reserv.e additional discharge capacity, MLI will provide the Port with sixty (60) days' advance notice, stating the need and amount for additional capacity. It is within the Port's sole discretion to agree to additional capacity. ff the Port allows the additional capacity, it will calculate an updated System Development Charge and User Charge, and 1:Qis Subscription Agreement will be modified to reflect both the additional capacity and updated charges.

2. Rates. MLI agrees to the User Charges and Other Charges/Fines as ~ t forth ~ Resolution No. 1329. Said Resolution is incorporated herein by reference. A cost sample of the rates calculated from Resolution No. 1329 is attached as Exhibit "A" and incorporated herein by reference. MLI has exercised the option to finance the System Developrnent Charge ("SDC") over a life of twenty (20) years at five percent (5%) interest per annum, with an initial annual amount paid to the Pott of Eighty-Six Thousand Eight Hundred Twenty-Seven Dollars ($86,827). '
3. Technical Compliance. The 'Port and MLI agree to the terms and conditions as set forth in the Resolution No. 1336, the terms and conditions of which are incorporated herein by reference, including, without limitation, Section 8 - Administrative Enforcement Remedies. Fuithermore, :MLI shall comply with the terms of the State Waste Discharge Pennit issued to it by the Washington State Department of Ecology ("Ecology") as such permit currently exists or is hereafter amended or reissued ("MLI's Permit").
3.1 Biochemical Oxygen Demand. In addition to the terms and conditions of MLI's Permit, MLI shall monitor the Biochemical Oxygen Demand in its discharge to the Port's Industrial Process Water Treatment System on a bi-annually (twice per calendar year) basis to ensure compliance with Resolution No. 1336 Table 2.4.
4. MLl's Permit Reissuance or Change. MLI will provi the Port with a draft of any proposed renewal, reissuance, or modification ofMLI's Permit rior to MLI's submittal of an application to Ecology for the same. MLI shall not submit such application to Ecology imtil the proposed changes to MLI's Permit are reviewed and approved in writing by the Port.
5. Exceptions to Local Limits (mass limitations). Although extra fees may be cha:rged as authorized under Port Resolution No. 1329, the following exceptions apply to the local limits established by Resolution No. 1336 Table 2.4:
• Total Nitrogen is allowed to reach a maximum mass of205 pounds per year or an estimated six-month average concentration of 3 ppm (mg/1).
6. Maximum Daily Flow. MLI's allowable maximum daily flow into the System is capped at 180,000 gallons per day.
7. Indemnification. Except to the extent that such failure or release is caused or contributed to by MLI, to the extent permitted by law, the Port agrees to defend, release and hold harmless MLI from all claims,.costs and liabilities asserted against MLI due to failure of the Port or other subscriber to comply with environmental laws or permits relating to the Industrial Process Water Treatment System or from the release of any hazardous substances at or from the System. This provision shall survive any termination of this Agreement.
8. Tenn. This Agreement shall be effective for four ( 4) months beginning September 1, 2019, and then shall automatically renew on an annual basis, unless terminated in writing by either party no less than ninety (90) days prior to the renewal date.

9. Winter Storage Capacity. The Port agrees to give sixty (60) days w1itten notice to MLI, when the Port's waste water winter storage capacity reaches 70% or 42 million gallons.
10. Notice. All notices shall be deemed to have been given on the third business day following the date of mailing, if properly mailed to the address provided below. The parties may designate new or additional addresses for notice by providing notice to the other pa1iy as provided in this section.

11 . Modification. No alteration, modification, amendment, or waiver of this Agreement shall be valid unless it is in w1iting and signed by both parties hereto.
12. No Third-Party Beneficiaries. This Agreement is for the sole and exclusive use of the parties hereto, and none of the provisions of this Agreement shall be deemed to be for the benefit of any other person or entity.
13. Counterparts. This Agreement may be signed in any number of counterparts, each of which shall be an original, and all of which shall constitute one and the same Agreement. Any party may execute and deliver this Agreement by transmitting an authorized signature via email transmission, and copies of this Agreement executed and delivered by means of emailed signatures shall have the same effect as copies executed and delivered with original signatures.
14. Entire Agreement. This Agreement constitutes the entire understanding of the patties with respect to its subject matter.

WHEREAS, this Resolution will supersede Resolution No. 1133, that was Passed and Approved by the Commission of the Port of Moses Lake (Pm1) on the 13th day of December, 1999; and
WHEREAS, the Port owns and operates an Industrial Process Water Treatment System (System), which has been operational since January, 2000 and has been available to v!ll'ious Industrial Subscribers for industrial waste water treatment, and
WHEREAS, due to increased demand for the use of the System, the Port has contracted with Forsgren & Associates (Forsgren) for Engineering Services for an expansion of the existing System, and
WHEREAS, the Port's expansion of the System is nearing completion and will become operational by the Fall of2014; and
WHEREAS, the Port is authorized by the Port's Facility Use Resolution No. 1336 to charge its System Subscribers rates, charges and fees associated with use of the System by such Subscribers; and ·
WHEREAS, the Port received professional engineering services from Forsgren to assist in determining ru1 adjusted rate structure and costs associated with the expansion of the System; and
WHEREAS, the spread sheet for computation of the rates and fees used by Forsgren is attached to this resolution;
NOW, THEREFORE, BE rr RESOLVED THAT THE FOLLOWING RATES AND FEES BE ESTABLISHED FOR SUBSCRIBERS OF THE SYSTEM EFFECTIVE JANUARY 1,2015
1) System Development Cl!arge (SDC)
Effective January l, 2015, the following SDC charges will be applied to any new subscription to the system. Existing subscriptions will continue to be charged using the SDC Basis that was established in Resolution 1133.
The System Development Charge is the Capacity Subscription Percentnge times the Current Value of System Project Costs
Cwucity Subscription Percentage is the user's subscription amount divided by the ·rated capacity of1he system.
Current Value of System Project Costs is the sum of all project costs depreciated by the straight line method. The estimated total project cost when completed in the Fall of2014 is $4,287,200.
System Development Charges may be ·paid:
1) hl full by lump sum prior to com1ection to System, or
2) Financed over a twenty year period at 5%, or
3) Combination of_ lump sum payment and financing over twenty year period (at the cost of capital associated with the fmancing · of a particular element of System).
2) User Charges

The Port is required to meet specific limits in its Washington State Department of Ecology Discharge Permit as related to hydraulic flow, total nitrogen and total dissolved solids. Each Subscription Agreement includes discharging limits for each of these parameters. Subscribers are responsible to meet the limits as set forth in the Subscription Agreement. In the event a Subscriber exceeds the
prescribed discharge limit, the unit cost for that parameter will be increased by 100% for each discharge over the pre.scribed limit, These charges will be calculated and invoiced on an annual basis,
Any Depaitment of Ecology fines imposed for excessive discharges will be billed to the subscriber at fault.
Other services provided by the Port, such as for special inspections, copies of documents, etc., shall be charged at cost.
4) Billing a11d Collection
Charges are set forth in each subscription agreement and are due the first of each month.
5) Annual Review
User Charges will be reviewed annually in the third quarter. Projection forecasts will be developed based on prior usage -and users will be notified of any changes to their subscription for the next calendar year,

DEFINITIONS
Significant Industrial User (SIU)--
1) All industrial users subject to Categorical Pretreatment Standards under 40 CPR 403.6 and 40 CPR Chapter I, Subchapter N; and
2) Any other industrial user that: discharges an average of 25,000 gallons per day or more of process wastewater to the POTW (excluding sanitary, noncontact cooling, and boiler blow-down wastewater); contributes a process wastestream that makes up 5 percent or more of the average dry weather hydraulic or organic capacity of the POTW treatment plant; or is designated as such by the Control Authority on the basis that the industrial user has a reasonable potential for adversely affecting the POTW's operation or for violating any pretreatment standard or requirement (in accordance with 40 CPR 403.8(f)(6)).
Upon finding that the industrial user meeting the criteria in paragraph 2, above, has no reasonable potential for adversely affecting the POTW's operation or for violating any pretreatment standard or requirement, the Control Authority may at any time, on its own initiative or in response to a petition received from an industrial user or POTW, and in accordance with 40 CPR 403.8(f)(6), determine that such industrial user is not a significant industrial user.
Control Authority - means the Washington State Department of Ecology in the case of nondelegated POTW s or means the POTW in the case of delegated POTW s.
Categoric Industrial User (CIU): An industrial user subject to national categorical pretreatment standards promulgated by EPA (40 CPR 403.6 and40 CPR parts 405-471).

The information below is designed to better explain the various terms used in your report of analytical results from the Laboratory. This is not intended as a comprehensive explanation, and if you have additional questions please contact your project representative.
Results Disclaimer - Information that may be provided by the customer, and contained within this report, include Permit Limits. Project Name, Sample ID, Sample Matrix, Sample Preservation, Field Blanks, Field Spikes, Field Duplicates, On-Site Data, Sampling Collection Dates/Times, and Sampling Location. Results relate to the accuracy of this information provided, and as the samples are received.

If the sample matrix contains an interfering material, the sample preparation vo lume or weight va lues differ from the standard, or if concentrations of analytes in the sample are higher than the highest limit of concentration that the laboratory can accurately report, the sample may be di luted for analysis. If a va lue different than 1 is used in this field, the result reported has already been corrected for thi s factor.
These are the target % recovery ranges or % difference va lue that the laboratory has historically determined as normal for the method and analyte being reported. Successful QC Sample analysis will target all analytes recovered or duplicated within these ranges.
This column provides a letter and/or number designation that corresponds to additional information concerning the result reported. If a Qua lifier is present, a definition per Qualifier is provided within the Glossary and Definit ions page and potentia lly a discussion of poss ible implications of the Qualifier in the Case Narrative if applicable.
The actual analytical fina l result (corrected for any sa mple specific characteristics) reported for your sample. If there was no measurable result returned for a specific analyte, the resu lt in this column may state "ND" (Not Detected) or "BDL" (Below Detectable Levels). The information in the results column should always be accompanied by eithe r an MDL (Method Detection Limit) or RDL (Reporting Detection Limit) that defines the lowest va lue that the laboratory could detect or report for this analyte.
Confidence level of 2 sigma.
A brief discussion about the included sample results, including a discussion of any non-conformances to protocol observed either at sample receipt by the laboratory from the field or during the analytical process. If present, there will be a section in the Case Narrative to discuss the meaning of any data qualifiers used in the report.
This section of the report includes the results of the laboratory quality control analyses required by procedure or analytica l methods to assist in evaluating the va lidity of the resu lts reported for your samples. All sample aliquots were received at the correct temperature, in the proper containers, with the appropriate preservatives, and within method specif ied holding times, un less qua lified or notated within the report.
