STANDARDS GOVERNING EXERCISE OF THE ZONING POWER
PURSUANT TO SECTION 1702 OF THE 1985 ZONING RESOLUTION, THE BOARD OF COMMISSIONERS FINDS THAT THE FOLLOWING STANDARDS ARE RELEVANT IN BALANCING THE INTEREST IN PROMOTING THE PUBLIC HEALTH, SAFETY, MORALITY, OR GENERAL WELFARE AGAINST THE RIGHT TO THE UNRESTRICTED USE OF PROPERTY AND SHALL GOVERN THE EXERCISE OF THE ZONING POWER.

Based upon the above reasons, the applicant feels that this is a reasonable request and that action contradictory to the zoning request will constitute a taking of property in violation of the Just Compensation Clause of the Fifth Amendment and the Due Process Clause of the Fourteenth Amendment to the Constitution of the United States, and Article 1 , Section 1 , Paragraph 1 , and Article 1 , Section 3, Paragraph 1 of the Constitution of Georgia, denying the owner viable use of its land.

REZONING APPLICANT'S LETTER OF INTENT
The Applicant, Parkland Communities Inc., requests rezoning on 69.588 acres for
the purpose of developing a Single Family detached subdivision. In order to develop the
site as proposed, the Applicant respectfully requests a rezoning from RA-200 to Open
Space Conservation (OSC).
The proposed OSC zoning plan is an environmentally sensitive design that respects
the natural features of the property. The enclosed site plan proposes 170 homes on the
subject property with a net density of 2.49 homes per acre. The site plan shows that the
project will be served by one entrance from Fence Road. The minimum heated square
footage for the homes will be 2,000sf for a ranch style home and 2,400sf for a 2 story
home with a maximum height of 35 feet for all proposed dwellings. The front fa9ade of all
homes will consist of a mixture of brick, stone, shake or fiber cement siding with the
balance of the home being the same or fiber cement siding. The price range for the homes
will be from the mid $200s to the low $300's.
The plan provides for many amenities for all homeowners' enjoyment. There is a
proposed cabana and pool planned for the amenity area near the development entrance.
Sidewalks will be installed along all interior streets and along the entire road frontage of
Fence Road, plus a connecting sidewalk to Dacula Elementary. The applicant also plans to
build mulch trails within the open space areas and proposes to extend a connecting mulch
trail to the existing walking trail in Dacula park that abuts the property. This will allow the
homeowners convenient access to all park attractions and the library. The site plan also
provides 17.54 acres (25.2%) of open space for the homeowners' enjoyment.
Finally, the applicant requests a buffer reduction from 25 feet to 10 feet for the
buffer adjacent to Dacula Elementary school. The school is an O&I use and if it was zoned
to its use then the development would not be required to have a buffer at all. This buffer
area will be replanted with evergreen trees. All buffers and open space will be owned and
