therein named and ordered by the oaths of the witnesses thereof and on the motion of Jacob
Kysor [#2], one of the executors named in the said will who entered into and acknowledged
bond in the penalty of $10,000, and made oath thereto as the Court directs. A certificate is
granted him for obtaining probate thereof in due form. The widow of the deceased and the
other Executrix named in the said will have personally appeared in Court and refused to take
upon herself the Burthen of the execution thereof and it is Capt. William Pence, John Harri-
son, Capt. Henry Mellie, Lt. Kirtley or any three of them being first sworn, be appointed to
appraise the estate of the said Decd. and make report thereof. The Court

In the Name of God Amen..
I, Michael Kysor of the Parish and County of Rockingham in the State of Virginia being in per-
fect health and memory do think proper while I am to make my last will and testament, which
I hereby do in the following manner:
First: I give and bequeath to my wife [#/1] during her natural life the plantation whereon I now
live, together with the Negroes and the stocks of all kind and implements of husbandry, the
latter to enable her to bring up my three younger children now living with me and if my sons
John [#8] and Daniel [#A] should live with their mother after they become of age and work
the plantation and otherwise assist in the management of it, whether married or single, they
and each of them shall have one third of all the profits arising therefrom, but should they or
either of them choose to go elsewhere, then I direct they have no more than what their mother
thinks proper to give them.
2ndly: I give and devise to my sons John and Daniel four hundred acres, part purchased of Mi-
chael Goger and part of Robert Slaughter to them their heirs and assigns forever. Neverthe-
less if either of them should die before they become of age or married, then the part share or
money of the one dying, the whole to be divided into equal parts as near as may be and be
appraised by 3 indifferent persons to be appointed by the Court of Rockingham County, and
survivor have refusal of it at appraisment, then if he should not accept it then my eldest son
Valentine [#1] to make his choice of acceptenance and if he refuses to take it at such ap-
praisement, then my next son, Jacob to have his choice whether he wil have it on the aforesa-
id terms, and if he refuses to take it my next son Philip may then declare his intentions of tak-
ing the same and whichever the one so taking the same that pay the appraised value among
all ny children saving one share to himself, and in case they all shall refuse, than I direct my
executors to sell the same at public sale to the best bidder and the money arising to be divided
among all my children aforesaid.
3rdly: My son Philip [#5] chosing trade rather than farming, I give and I bequeath to him the
sum of 300 pounds Virginia money, but in case I should during my life give him the sum as is
my intentions to do so, If I live, then the legacy to be void and of no effect.
4thly: I give and bequeath to my daughter Eve [#9] the sum of 200 pounds Virginia money, and
in case I should die before she is married, I give her further some of 20 pounds like money,
being as near as I can recollect the value of sundry house holds I gave to each of her sisters
upon their marriage besides their portion of 200 pounds apiece.
5thly: I give to my daughter Elizabeth [#6] wife of Martin Straul [#6/1] the sum of 100 pounds,
having before paid her husband the like sum of money but in case I should pay the sum of
money during my life time this legacy to be void.
6thly: I give to my daughter Magdalena [#7] the wife of John Shuler [#7/1] the sum of 200
pounds, but in case I pay the money during my life time this legacy to be void.
My daughter Catherine [#4], married to Martin Quiet [Kite] [#4/1] has received her portion of
200 pounds.
My daughter Anna Maria [#3] married to Jacob Spot [#3/1] has received her portion of 200
pounds.
My son Valentine has received his portion of 300 pounds in a tract of land sold him which I pur-
chased from Robert Slaughter and Michael Cogar. I have his bond for 300 pounds, the bal-
ance the purchase money.
7thly: I direct that after my wife's death, the negroes, stock of all kinds, utensils of husbandry
and everthing else herein not disposed of to be sold and the money arising thereby be equally
divided among all my children, and if any of the married ones should be leaving a child or
children shall in the distribution represent their parents so dying be entitled to a share.
8thly: And lastly I appoint my wife and son Jacob executors., witness hereby I have here to set
my hand and affixed my seal this 21st day of September, 1792.

“Rockingham County, Virginia
In the name of God Amen I, Joel S. Graves, of the County of Rockingham State of Virginia being
weak in body but of a sound and disposing memory do make this my Last Will and Testa-
ment in manner and form following, that is to say
First of all I desire and will that all my just debts and funeral expenses be paid and for this pur-
pose order that all my perishable property be sold together with all my land lying in the fol-
lowing bounds: beginning on the county line of Rockingham and Shenandoah near a _____;
thence following the County line to the top of Chapman’s Mountain not far from Hepner(?)’s
Gap; thence following the top of the Mountain to Daniel Utz land; thence leaving Geo Utz’
land to the east and pursuing the mountain to a corner which Jonce (?) made for John Deets
and then with the lines of that survey to the foot of the Mountain to a corner of said survey;
thence around the foot of the Mountain in a north west direction with the lines of the Big
Survey so-called to the beginning (except my slaves) by my executors hereinafter to be
named. And if that should prove insufficient to pay my debts, I order and will the land in the
following bounds be also sold to aid in the discharge of my just debts, that is to say: Begin-
ning on the top of Chapman’s Mountain and pursuing the County to the top of the long ridge
near the Maple Spring thence along the top of said Ridge to a Deep Hollow; thence down the
Hollow to Branch crossing said Branch and N. Naked Creek to Utz’ said line and with his
line and to the top of the mountain; and thence with a line of the first mentioned tract to the
beginning. Should this still prove insufficient, I order a part of the land I hold in the county of
Orange be also sold and the proceeds applied in discharge of my debts. To wit: beginning at
the angle of Rockingham and Orange County line and pursuing the Orange line down as far
as my line extends and then with my patent line to the top of a ridge nearly opposite old Mrs.
Booton’s and thence up the ridge to the top of the mountain; thence along the mountain to the
beginning.
Next I give and devise to my son James the tract of land I had one surveyed for John Deets of
which I hold a plat containing about eleven hundred acres with the exception what I sold Ja-
cob Bear to be good to him, his heirs and assigns forever.
3rd Item. I give and devise to my daughter Sarah Daniel five hundred acres of land beginning at
the Rock Bridge and corner to James’ land and Bear land thence crossing south Naked Creek
to the top of the Mountain from thence to a large High Rock near Powell’s Creek and then in
such a direction around to James’ land as to include the said five hundred acres to be good to
her, her heirs and assigns forever.
4th Item. I give to my daughter Nancy Hammer, her heirs and assigns forever the land included in
the following bounds that is to say: Beginning on Folands (?) Line on the top of a Ridge op-
posite to where Smith once lived; thence up the said Ridge to Ben. Powell’s line and with his
lines to Beesley’s lines and directly on the Branch that comes down from Beesley’s; thence
down the Branch to Foland’s lines and with thence to the beginning.
5th Item. I give and bequeath to my son Joel Asher his heir and assigns forever five hundred
acres of land beginning at a small hickory (where two red oaks stood) corner to the Wycick’s
place; thence along the lines of the Wydick’s place to Geo. Utz land and with his lines on to
the top of the mountain and thence down to south Naked Creek crossing the creek to a large
pine across said branch and near the ford continuing the course to the top of the mountain on
Ridge on the south side of the creek; thence to the white (sic) near the Road and Corner of the
Wydick’s tract; thence with a line of the same to the beginning so as to include the five hun-
dred acres.
6th Item. I give and bequeath to my daughter, Cinthia, her heirs & assigns forever five hundred
acres of land including the plantation where Joseph Samuel now lives. Beginning at the S.
Naked Creek where Joel A. crosses and thence up the Creek to the lock; thence up the right
hand prong to the mouth of Aggy’s Run; thence up that branch to said Aggy’s Run; up from
thence in such a direction to Joel A. corner on the top of the mountain on the South side of
Naked Creek and with line to the beginning as to take in the five hundred acres.
7th Item. I give and bequeath to my son Harden, his heirs and assigns forever five hundred acres
of land beginning at the mouth of Aggy’s Run and running up Jack’s prong two hundred and
fifty poles from thence to a place called Buck Thorough Fare from thence around in such di-
rection as will include the five hundred acres.
8th Item. I give and bequeath to my daughter Drucilla Strole [#62/1], her heirs and assigns forev-
er five hundred acres of land beginning on the county line of Rockingham and Shenandoah at
a corner of the land directed to be sold near the Maple Spring and thence with that line along
the top of the ridge two hundred and fifty poles Thence leaving the top of the ridge nearly at
right angles crossing Naked Creek and pursuing that course for enough as to include five
hundred acres of land in nearly a square.
9th Item. I give and bequeath to my Daughter Elizabeth, her heirs & assigns hive hundred acres
of land lying in between the land given to Drucilla Strole and Joel A. to be laid out in the
most suitable manner for a farm.
10th Item. I give and bequeath to my two Grand Sons Joel Smith and Walter Riley Thomas their
heirs and assigns for ever five hundred acres of land to be laid off between Jack’s and Tho-
mas Creeks to begin in the fork of the creeks and pursuing each branch far enough to include
five hundred acres.
11th Item. I give and bequeath to my Daughter Frances, her heirs and assigns forever two hun-
dred and fifty acres of land including the place adjoining Jack’s place so called where James
Breeding now lives Beginning at a poplar and locust tree corner to Thomas Graves’ and with
his line to a poplar sump. Thence with the same degrees towards a place called Turkey Head
thence at a right angle two hundred poles from Thence in a direction to the Slippery Rocks
Branch where the path crosses said branch from thence in such direction around including the
clear land and we will take in the two hundred and fifty acres.
12th Item. I give and bequeath to my daughter Jane Crop her heirs and assigns forever my undi-
vided moiety of the Jacks place so called and when it is divided I order and direct that one
hundred and fifty acres more of wood land shall be added to the half allotted me to lie along
the side of it.
13th Item. I give and bequeath to my daughter Susan her heirs and assigns forever five hundred
acres of land including the place which Benjamin Hensley and Elijah Breeden now lives to
begin at the place where I directed my Daughter Nancy Hammer to begin on the ridge oppo-
site Smith’s old house on a line of Foland’s Land; and, thence up the ridge with Hammer’s
line to Powell’s line then around towards Berrey’s land in such a direction as will include the
said five hundred acres. And if in the future it shall so turn out that the place where Benjamin
Hensley and Elijah Breeding now lives shall be lost by any prior or older right that in that
case I order and will that my daughter Susan shall be compensated by other land of equal val-
ue.
14th Item. I give and bequeath of my Daughter Betty Rains, her heirs and assigns forever a small
piece of land lying between Berry’s, Jacob Miller’s and William Rain’s land being fifteen
acres more or less together with a Negro girl named Mariah and her two children which she
had while belonging to me and what household furniture, stocks etc. I gave her heretofore.
I desire it to be understood that my son-in-law William Hammer has a Negro girl in his posses-
sion named Ann and which I wish him to return to my family of Negroes to be disposed of
agreeable to my own wish and if he refuses to return her I will and order that he shall be ex-
cluded from any farther devise on or part of my estate by his wife.
And farther I will and order that my slaves shall be equally divided among my several children
here named, that is: James; Sarah Daniel; Hardin; heirs of my Daughter Elizabeth Thomas
decd, namely Joel Smith and Walter Riley Thomas; Drucilla Strole; Cinthia; Elizabeth;
Frances; Jane Crop; Susan; Joel Asher; and Nancy Hammer provided her husband William
Hammer returns the Negro Girl Ann now is his possession otherwise to be excluded. And all
such other lands and property which I own and not herein particularly given or devised I will
and order that be sold by my Executors to the best advantage on a reasonable credit and the
money arising therefrom to be equally divided between all my children herein named pro-
vided they comply with the preceding requestitions of this Will.
And lastly I do hereby constitute and appoint my friend George Conrad and my son James Ex-
ecutors of this my Last Will and Testament revoking all other or former wills by me hereto-
fore made. In witness whereof I have hereunto set my hand and affixed my seal this sixteenth
