Disabilities and the LawADA, 504 and IDEA

•ADA prohibits discrimination in employment, or public services on the basis of a disability

•Disability must substantially limit one or more of life’s activities

•504 prohibits discriminating due to disability in programs receiving federal funds

Each form is several pages in length. Follow directions carefully.

Give the appropriate documentation guidelines below to your doctor or psychologist.

There is a specific form that goes with each of the 5 forms in the previous slide. Print off the matching form for the Doctor and/or Evaluator:

Who is an advocate?

An adult who helps the GED candidate when he/she:

• physically cannot complete the form(s)

• is not sure how to complete the form• is unable to get the form completed

by a diagnosing professional• has difficulty following through on a

multi-step process.

If the student has a copy of the report, then, an advocate ...

•can transcribe all the information requested onto the form (from originally signed report)

•attach a copy of the report to the accommodation request

•complete the advocate information as requested in section 3.

Section 1All Forms

The candidate completes all the information and must sign the application. If under eighteen (18) years of age, the signature of a parent or legal guardian must be provided.

Section 2All Forms

The Chief Examiner must complete and sign Section 2 asserting the application is complete otherwise it will be returned by the GED Administrator.

Section 3All Forms

The Professional Diagnostician, Doctor or

Advocate fills out this section.

Section 5All Forms

The GED Administrator for the State or Region completes Section 5.

CONSIDER SENDING US SUPPORTING DOCUMENTATION

It would be helpful (but is not required) for you to provide additional supporting documentation, such as:

• School records that show participation in special education services • Individualized Education Plans (IEPs) • Transcripts from middle school or high school • Other records that show a history of academic difficulties due to your disability

You may appeal an accommodations decision if you’re unhappy with the outcome. Please

complete the “Request for Testing Accommodations Appeal

” and provide us with additional documentation to review. Disability experts review all appeal requests.
