AN ORDER CREATING AN ARCHIVES AND RECORDS CENTER IN THE CITY
GOVERNMENT OF DAVAO, PRESCRIBING ITS FUNCTIONS, PROVIDING FOR ITS
ORGANIZATIONAL STRUCTURE AND FUNDING, AND FOR OTHER PURPOSES
WHEREAS, Section 13 of Article III of Republic Act No. 9470 (or the
National Archives of the Philippines Act of 2007) provides that, "A/l
government offices shall each establish their archives and records office/unit
in coordination with the DBM and the National Archives from their organic
personnel within a year from the effectivity of this Act ..."
WHEREAS, Section 30 of Rule 20, Title IV of the Implementing Rules
and Regulations of said RA 9470 further provides that, "... It shall plan,
formulate and implement a records management and archival administration
program for the efficient creation, utilization, maintenance, retention,
storage, preservation, conservation and disposal of public records including
the adoption of security measures and vital records protection program for
the agency."
WHEREAS, Section 32 of Rule 20, Title IV of the same IRR also states,
"... every LGU should establish an archival system to ensure the safety and
protection of all public documents and records such as births, marriages,
deaths and such other documents and records of public interest in various
offices and departments in the ... city ... "and
WHEREAS, many of the City's Offices and Departments have been
clamoring for proper disposition of their documents given the overflowing
volume and lack of sufficient storage space .
NOW THEREFORE, I, RODRIGO R. DUTERTE, MAYOR of Davao City, by
virtue of the powers vested in me by law, do hereby order:
Section 1. The creation of a CITY ARCHIVES AND RECORDS CENTER in
the City Government of Davao, pursuant to Republic Act No. 9470, its
Implementing Rules and Regulations and other related issuances, which shall
have the following functions, personnel and organizational structure, and
funding:

Section 2. Organizational Structure. - The City Archives and Records
Center (CARC) shall be temporarily under the supervision of the Office of the
City Mayor until it is completely organized and operational, at which time its
formal integration into the City's plantilla and budget shall be submitted to
the Sangguniang Panlungsod for approval.
Section 3. Personnel Complement. - (a) The CARC shall be headed by a
Records Officer, an Archivist, or any employee of equal competence, who will
be so designated by the City Mayor from among the ranks of the City
Government; (b) All Records Officers, Records Clerks and other employees
whose duties and responsibilities involve the handing of records and
documents in the different Offices and Departments of the City are
transferred to and will henceforth be under the supervision of the CARC. The
actual transfer of such employees will be effected in a separate memorandum
for the purpose.
Section 4. Functions. - The CARC in general shall plan, formulate and
implement a records management and archival administration program for
the efficient creation, utilization, maintenance, retention, storage,
preservation, conservation and disposal of public records including the
adoption of security measures and vital records protection program for the
City Government of Davao and exercise such other functions as mandated by
Republic Act No. 9470, its implementing rules and regulations and all other
related and applicable laws.
Section 5. Records Management Improvement Committee. - In its
infancy and to ensure its fast and full operationalization, the CARC shall be
assisted by a Records Management Improvement Committee (RMIC) as an
advisory Body, in accordance with Item 3.4, Rule 4 of General Circular No. 1
dated January 20, 2009 of the of the National Archives of the Philippines. The
RMIC will be composed of the City Administrator as Chairman and four (4)
other Members of his choice and their designation and other details will be
signed by the City Mayor in a separate order.
Section 6. Funding. - (a) Personal Services. - Appropriations for
salaries and other benefits of the employees transferred to the CARC shall
eventually be incorporated with the Office of the City Mayor in the next
Annual Budget, and (b) Maintenance and Other Operating Expenditures and
Capital Outlay. - necessary current funding for Maintenance and other
Operating Expenditures and Capital Outlays shall be provided in the next
LCHOR . QUITAIN City Administrator

Supplemental Budget and regular appropriations thereafter also incorporated
in the next Annual Budget.
Section 7. Intervenor. - The City Administrator shall be responsible for
the full and complete implementation of this Order.
Section 8. Separability Clause. - If any part or provision of this Order is
held unconstitutional or invalid, other parts or provisions thereof which are
not affected shall contain to remain in force and effect.
Section 9. - Effectivity. - This Executive Order shall immediately take
effect upon signing hereof.
