Dear Ms. Rhodes:
This Site received Variance Approval on April 27 of 2016 (2016-0023-V). Because the BuildingPermit has not been issued to date, we are requesting an Extension to the Variance TimePeriod necessary to allow the Building Permit process to be completed (Article 18-6-405, TimePeriod after which Variances and Special Exceptions are Void).
The Site was originally owned by a Contractor who illegally dumped debris on the Site SevernBank then foreclosed on the property and has been working with the Attorney General's Officeand MDE to facilitate the site cleanup. However, the prior Owner continued dumping debris forseveral months after the Order to Vacate the Property had been issued. This delayed sitecleanup and caused hesitation by the Bank to move forward with any further developmentapprovals.
Since that time, the Grading Permit has been completed except for posting of the security andcompletion of the Forest Conservation Easement. We have also continued to work with theHealth Department to secure Septic Approval which is required for filing of the Building Permit.We have included the letter from the Health Department requiring Well Abandonment prior toFinal Plan Approval. As soon as the final cleanup is complete (which should occur prior toFebruary 2018) the Well will be abandoned and the Building Permit Application completed.
In conclusion, as circumstances created by the illegal debris dumping have delayed the projectcompletion, we are requesting an additional twelve (12) months Extension which we believewill be satisfactory to finalize this project.
