MEMO TO: Oil & Gas Well File
FROM: Gerald (Mack) McGillivray, Geologist 414 SUBJECT: Inspection of Abandoned Oil Wells in Lantry Field, Dewey Co.
Last Wednesday (7/14), I took part in an inspection of six abandoned oil wells on the Cheyenne River Reservation near Lantry in Dewey Co. The other participants were Randy Lambdin (EPA-Denver), Bill McManus (BLM-Dickinson), Leo O'Connor (BIA-Eagle Butte), and Wayne Kingman (Sioux Tribe-Eagle Butte). This inspection was scheduled at the request of Dave Nelson (Tribal Env. Mgr.) last November when Lambdin, McManus, and I were conducting a "Problem Oil Pit" inspection in that area. At that time, Nelson asked Lambdin to look at some abandoned wells that he felt were posing dangers to human health and the environment. Lambdin told him there was not enough time, but we would schedule an inspection for later, hence this inspection.
We all met at Lantry on Wednesday morning except for Nelson, who was a no-show. We inspected six abandoned well sites, all on allotted tribal land. While inspecting the first well, we noticed O'Connor talking to Kingman, than leaving location. Kingman told us O'Connor said he was hungry. He never came back. Even though two of the main principals were gone, we decided to go on. Of the six wells, three were shut-in, and three were flovving water into pits being used as stock watering ponds. Of the three flowing wells, Lambdin determined that only one (Joe Little Skunk #1) was a problem, because there was an oil sheen associated with the water, and there was a light film of oil in one comer of the pit.
Following is a detailed description of the inspections for each well. They are listed in the order the inspections were conducted. BLM and BIA have some of the wells named differently than what is listed in the file. Therefore the file name is listed first, and the other name is in parenthesis. Photos were also talcen at all of the sites, and they will be placed (along with this memo) in each well file.
Investors #2 Wallace Cook (Wallace Cook #2) SESW 33 -13N-22E: The wellhead consisted of 5 1/2 casing, a casing swedge, and 2" valve. There appeared to be a small lealc below the valve, and oil was pooled up around the wellhead. There was also a section of pipe protruding from the ground with a valve on it. It is probably the old flowline; there were no visible leaks. There was an old pit nearby, but it was dry, and completely overgrown.
Investors #1 Wallace Cook (Wallace Cook #1) NESW 33-13N-22E: There was a large (1000 bbl) bolted tank on top of the hill. It appeared to be empty and in good condition, no visible leaks. Nearby was a large, dry, overgrown pit. The wellhead was approximately 500 yds to the north. It consisted of casing, swedge, and valve. Water was flowing into a small wooden stock tank, which was flowing into a pond. 'There was no oil or sheen in the flovving water, or in the pond. The pond was very lush with vegetation.
Investor's #1 Little Skunk (Osborne Little Skunk #1) SWSW 29 -13N-22E: The wellhead consisted of casing, swedge, and valve, and was shut-in. No leaks were visible. There was a large, dry, overgrown pit nearby. There was also an old tanlc, and other junlc scattered around the location.
Tuck #1 Little Skunk (Joe Little Skunk #1) SWSE 29 -13N-22E: 'The wellhead consisted of casing, tubing, and valve, and was flowing water into a large three-celled pit. The water was flowing from both the tubing and around the casing packing. There was a light rainbow sheen in the water pooled up around the wellhead, and a light oil film in the SW comer of the pit. The pit was not discharging, and there was no evidence it had discharged in the recent past. There was an old tank, piping, and other junk scattered around. This was the site that Randy Latnbdin (EPA) determined was a problem, and would need to be remediated.
Investors #1 Anna Red Bird (Anna Red Bird #1) SENE 30 -13N-22E: The wellhead consisted of casing, swedge, and valve, and was shut-in. No lealcs were visible, but there was some very old oil around the wellhead that has weathered to a hard, asphalt like substance. There was a large, dry, overgrown pit nearby.
Investors #3 Little Skunlc (Jacob Little Skunlc #1) NWNW 29-13N-22E: The wellhead consisted of casing, swedge, and valve, and was flowing water into a plastic stock tank, which was flowing into a pond. There was no oil or sheen in the flowing water, or in the pond. The pond was very lush with vegetation. The pond was not discharging, but it was apparent that it had in the past. Water had flown out of the NE comer and down into a draw. There were some dead trees in the draw, but also many live ones.
There was a lot of discussion dwing and after the inspection on who was responsible for cleaning up the JLS #1. McManus said BLM felt that since BIA released all bonds (and liability) from the last operator (Timberline) without their approval in 1995, that BIA was responsible for remediation of the site. Lambdin seemed to agree with this, and he said he would go back and talk to his superiors about the next step.
On Monday (7/19), Latnbdin called me. He said EPA was issuing what amounts to a notice of violation under RCRA to BIA for the Tuck #1 Little Skunk.

In response to the E-mails and our telephone conversations, I called Jerry Cox with Timberline Oil (341-3400) this moming. Jerry said that when they originally leased the two wells they discovered both were on allotted or trust land.
The Cook #1 (NESW 32-13N-22E) is held in trust for Wallace Cook, Allottee #736, which encompases the all of the SW 1/4 of Section 32, except 2 1/2 acres.
The Red Bird #1 (SENE 30-13N-22E) is held in trust for the Anna Red Bird Estate, Allottee #1546, which encompasses all of the N 1/2 of Section 30.
Jerry said you can contact Leo O'Connor with the BIA Realty Office in Eagle Butte (964-6200), for confirmation of this, or any other questions you may have. He also said that when they originally planned applying for the UIC Permits, he called David Nelson with the Environmental Protection Dept. of the Cheyenne Sioux Tribe, and offered to send him the required material. Nelson said to wait until he contacted Timberline back. Jerry said he received a phone call a short time later from (?) Johnson with the EPA. Johnson told Jerry that EPA had primacy over the two wells, and sent a follow-up letter with the original EPA/SD UIC Primacy Agreement. Based on that, Timberline submitted the Application to EPA.
I don't know if this clears things up or not, but let me know if you have any more questions. --

BOTH APPLICATIONS ORIGINALLY WENT TO EPA AND WE JUST RECIEVED COPIES OF THEM. I THINK THEY ARE REFERRING TO THE WELLS AND WELL HEADS THEMSELVES WHEN THEY INDICATE THAT OWNERSHIP IS "PRIVATE". HOWEVER, I DON'T KNOW THIS FOR SURE. I'M STILL WAITING RESPONSE ON THE MINERAL RIGHTS.
From: Giedd, Roxanne To: Hamann, Sheldon
Okay, assuming the mineral ownership is owned by surface owners (which may not be the case -- wait until you know for sure), I'd say the state only has jurisdiction over the injection wells on Davis' land, and the other on allotment land should be forwarded to EPA. EPA isn't going to like getting half, but that's okay. I'm somewhat confused by the company's claim that ownership is "private" , given the existence of allotment land.

NO, ACCORDING TO THE ENROLLMENT OFFICER FOR THE CHEYENNE TRIBE, THEY ARE NOT ENROLLED.
From: Giedd, Roxanne To: Hamann, Sheldon
allotment land is Indian land and we don't have jurisdiction. I would suggest calling the tribe and asking if the Davis' are enrolled members. ---
From: Hamann, Sheldon To: Giedd, Roxanne; Pimer, Steve
BOTH UIC SITES ARE WITHIN THE OLD RESERVATION BOUNDARIES. THE SW 1/4 OF SEC. 32, T13N-R22E IS ALLOTMENT LAND (AVAILABLE TO NATIVE AMERICANS FOR THEIR LIFETIME, BY THE TRIBE) AND THE ONE IN THE NE 1/4 OF SEC. 30 (SAME TOWNSHIP) IS DEEDED OUT TO A HARROLD AND PAULINE DAVIS. THE REGISTRAR IS DOING SOME MORE CHECKING ON MINERAL RIGHTS AND WILL GET BACK TO ME. IS THIS
ENOUGH INFO TO GET ANYTHING STARTED, IF NEED BE?
From: Gledd, Roxanne To: Hamann, Sheldon
*Private" ownership doesn't help for our inquiry. We need to know whether the land is owned by an Indian or non-Indian. I'd suggest getting the legal
description and calling the registrar of deeds -- she might know. I'm assuming the application lies within the exterior boundaries of the reservation — if it doesn't, then we will assert jurisdiction.
From: Hamann, Sheldon To: Pimer, Steve; Giedd, Roxanne
THE EPA UIC APPLICATION INDICATES THAT OWNERSHIP IS PRIVATE (WHETHER THIS PERTAINS TO THE LAND OR THE ACTUAL WELL WHICH IS TO BE CONVERTED FOR INJECTION IS NOT INDICATED) BUT THE DEPARTMENT OF INTERIOR - BIA, HAS RECEIVED A $15,000 BOND FROM TIMBERLINE FOR OPERATION ON THE CHEYENNE INDIAN
RESERVATION. WHAT IS THE PROCEDURE FOR DETERMINING WHETHER THIS IS ON WHAT LANDS?
THE 4 INJECTION PERMITS COVER 2 EXISTING WELLS WITH PERMITS FOR EITHER THE DAKOTA OR RED RIVER FORMATIONS FOR BOTH WELLS.

FYI

Yes; if the activities are on Indian land, I think its EPAs. ---
From: Pimer, Steve To: Giedd, Roxanne; Nadenicek, Joe
Do they also need to determine if the facilities are on Indian or nonlndian land? If they are on Indian land, would these permits be EPA's?
From: Woodmansey, Kent To: Giedd, Roxanne
Today I received from the above company applications for 4 injection permits
(given to Sheldon) and 2 NPDES permits. The facilities will be located within the Cheyene Reservation. Because I'm assuming this is a nonindian company, I will be letting them know they need a state issued SWD permit.
