Environmental Review under CEQA

CEQA is a public disclosure law that applies to projects that require a discretionary approval by a state or local governmental agency (i.e., Solano County). Solano County, acting in the role of CEQA Lead Agency, for this project has concluded that potential environmental effects associated with the project warrant the preparation of an Initial Study and Mitigated Negative Declaration (IS/MND).

An IS/MND is deemed the appropriate environmental document under CEQA in instances where the lead agency finds, based on substantial evidence, that the project would not have a significant effect on the environment.

IS/MND ProcessThe basic steps in the IS/MND process include the following:

The preparation of an IS/MND requires that the County file a Notice of Intent (NOI) with the State Clearinghouse (SCH) indicating that it intends to adopt a IS/MND for the project.

The filing of the NOI marks the 30-day public review period for the IS/MND, as required by CEQA, which will end on May 18, 2010.

The county has provided additional opportunity for public comment by holding tonight’s community meeting; however, the holding of a community meeting is not required by law.

Pending comments received on the IS/MND, the County’s next step will be to file a Notice of Determination (NOD) approved by the board of supervisors with the SCH indicating its intent to adopt the IS/MND.

Required Agency Approvals Under CEQA, the County of Solano Board of Supervisors (BOS)

will need to file a NOD indicating its intent to adopt the IS/MND and approve the expenditure of funds for the project. In addition to the County BOS approval, the project also requires the following agency approvals:

Solano County Board of Supervisors - Approval of the Project.

Bay Area Air Quality Management District (BAAQMD) - Air Quality permit for construction.

Solano County Department of Resource Management Building and Safety Division - Construction permits.

California Department of Fish and Game - Nesting Bird Survey (if vegetation is removed between February 1 and August 31).

Solano County Airport Land Use Commission - Determination of compatibility with the Nut Tree Airport Land Use Plan.

City of Vacaville Encroachment Permit - Public Right of Way Encroachment

General Permit for Storm Water Discharge - Central Valley Regional Water Quality Control Board.

Approach to Assessing Environmental Effects

The analysis of project-related environmental impacts is guided by the conditions observed at the project location at the time of the environmental review and in the context of those actions associated with the project (e.g., renovation of an existing County owned building located in the City of Vacaville).

The existing site conditions, commonly referred to as the environmental baseline, are used in determining whether a project-related impact is significant or not based on established significance criteria as outlined in Appendix G of the CEQA Guidelines.
