COMMUNICATION

We are proud of our quality communication to both landlords and tenants. This is the key to our service and we keep our clients fully informed with regular calls, emails, letters and updates. We will advise you promptly on all matters of interest which affect your investment. YOU CHOOSE your preferred means of contact so we can make it easy for you! Landlords don’t like surprises so our service is designed to keep you fully informed.

We respect our tenants’ privacy and value their tenancies as an important part of the equation. Customer service is paramount. By educating and informing our tenants we help develop successful long term relationships and avoid unnecessary vacancies.

MARKETING YOUR PROPERTY

We focus on securing the highest quality tenant for your property using proven marketing techniques and careful tenant selection. All properties are uploaded to multiple websites including the Allen Realty website, Trade Me and Realestate.co.nz. We also often use local newspapers and other publications. Our prospective tenant database gets all new listings that meet their criteria emailed to them daily. If your tenants confirm they will be vacating then you can be assured that we will begin marketing your property ASAP to ensure minimal vacancies in between tenancies.

TENANT SELECTION

We follow strict protocols when screening tenants including credit checks, thorough reference checks and Tenancy Tribunal database checks. This ensures that tenancy applications that don’t meet our criteria are declined. YOU CHOOSE if you would like to authorise all tenancies or leave the final decision to the property manager.

TERM OF TENANCIES

We offer both periodic (month to month tenancies) and fixed term (eg 12 month) tenancies. Periodic tenancies have a start date and no end date and can be terminated by either party giving the appropriate notice. Fixed term tenancies have a start date and a termination date and cannot be terminated prior to the termination date unless there is an agreement reached between both parties. YOU CHOOSE if you would like us to secure a periodic or fixed term tenancy. Your property manager will complete all relevant legal documentation including tenancy agreements, bond lodgements and condition reports.

FREQUENCY OF INSPECTIONS

As part of our service we provide digital property inspection reports. Our initial inspections (condition reports prior to tenants moving in) and bond inspections (condition reports at expiry of tenancies) which are included in your fees. Maintenance inspections are recommended while tenants are in occupation and YOU CHOOSE quarterly (required by some insurers), six monthly or yearly frequencies. Following each inspection you will receive a report on the condition of the property and any maintenance issues. We believe regular inspections can help keep maintenance costs down by being proactive and dealing with small issues before they become problematic. You can change your inspection frequency as your needs change.

METH MANAGEMENT SERVICE

Our Meth Management Service is for landlords who require extra protection for their investment. A certified Meth-free property ensures tenants a safe living environment.

MAINTENANCE

Our flexible service means YOU CHOOSE if we arrange maintenance on your behalf or you can stipulate a maintenance spending limit (eg. any repairs over $200 to be authorised by owner first). Alternatively choose to have no repairs and maintenance undertaken without your prior approval. If you request this, we guarantee to phone/email before we fix unless it is an urgent issue that we are required to take action on to prevent further damage to the property, neighbours or occupants! This ensures that there will be regular cashflow and no unnecessary costs being deducted. We use a variety of contractors who are reliable, consistent, and cost competitive, and can provide quotes on most major maintenance issues. By having a focus on communication we ensure that there are no surprises at the end of each week/fortnight/month when you expect to receive your rents.

RENT ARREARS

Allen Realty has a zero rent arrears policy. Rent arrears are minimised through highly effective arrears control which is carried out daily. If tenants miss a rent payment then a comprehensive system is followed to ensure any missed payments are followed up and remedied promptly. This may include phone calls, text messages, emails and legal notices. Allen Realty will fulfil all obligations under the Residential Tenancies Act and ensure any Landlord Insurance obligations are followed to ensure prompt recovery of any debt. If tenants do not remedy missed payments quickly then we will make an application to the Tenancy Tribunal to recover all debts and terminate the tenancy if need be. Careful tenant selection ensures we reduce the likelihood of arrears problems, but if your tenants get into rent arrears you will be notified and updated throughout the process.

FREQUENCY OF PAYMENTS

Rent is payable weekly or fortnightly in advance by the tenant into our audited Trust Account. This rent is paid directly into your nominated bank account, and YOU CHOOSE to receive these rent payments from us weekly, fortnightly or monthly. You can change your payment frequency as your needs change. On the first working day of each month we send you a statement accounting to you for the rent and management fees, along with any other disbursements for the month. This can be sent electronically via email or in the post, and you can also access your statements at any time using our free 24/7 Online Statement service.

RENT REVIEWS

All properties undergo regular rent reviews. You do not need to request these and your property manager will automatically contact you to advise of any rent increases issued to tenants. These reviews are completed every six months. We do not take rent increases lightly and all rents are reviewed after an individual assessment of your specific property and current market conditions. Alternatively YOU CHOOSE if you would like input on the rent review process and we will contact you with our suggestions to confirm if you are happy for us to increase your rents. Some clients have special relationships with tenants and choose to keep rents slightly under market value. We can accommodate all your requirements to ensure that you get the service, support and communication that you require.

FINANCIAL REPORTING

Statements are emailed on the first working day of each month and all clients have access to our free 24/7 Online Statement service. Our statements are designed to be easy to interpret and will confirm all tenant payments, management fees, any maintenance authorised by you as well as payments made to you. The statements can be copied to your accountant and provide all the information you will require for accounting purposes. We have many different statement formats and YOU CHOOSE the format that suits you.

TRADESMEN AND CONTRACTORS

If YOU CHOOSE to authorise Allen Realty to arrange maintenance on your behalf we use a variety of maintenance contractors who are reliable, consistent, cost competitive, and can provide quotes on most major issues. Some of our tradesmen have been with us for over a decade. You can be assured that where a specialist is required that the tradesman in question will be certified, experienced with attention to detail, offering all tenants great customer service. All our tradesmen will also carry any required insurance to ensure that your tenants and property are protected. If YOU CHOOSE to complete or organise maintenance yourself then we will assist by facilitating access at a convenient time. YOU CHOOSE what works best for you and we will make it happen.

WHAT RENT AM I LIKELY TO ACHIEVE AND HOW LONG DOES IT TAKE TO SECURE A TENANT?

Our experienced team will provide an appraisal to determine a market rent for your property. The average timeframe to secure tenants is 7-14 days. When tenants vacate they are required to give a minimum of 21 days notice and we begin marketing for new tenants immediately. The majority of properties we manage have new tenants secured before existing tenants have vacated.

CAN WE TAKE OVER EXISTING PROPERTIES WITH EXISTING TENANTS CURRENTLY MANAGED BY OTHER INDIVIDUALS OR PROFESSIONALS?

Yes. Allen Realty often takes over the management of properties already being managed by private individuals and other agents. We will arrange the entire transition and keep you informed. We will endeavour to inspect all new properties within the first two weeks of management in order to assess any outstanding maintenance issues and carry out rent reviews to ensure that the most competitive market rents are being obtained.

HOW MUCH BOND DO YOU TAKE AND WHAT HAPPENS TO IT?

We secure minimum of three weeks rent as bond and sometimes secure a four week bond if we deem it necessary. There are times, and with certain properties that we need to have a more flexible approach and sometimes tenants are allowed to pay off the fourth week of the bond. The bond is receipted by us and lodged with the Department of Building and Housing.

WHAT DO YOU DO IF THE TENANT GETS BEHIND IN THEIR RENT OR DAMAGES MY PROPERTY?

We have a zero rent arrears policy and rents are checked daily. If tenants miss payments we contact them to request any missed payments are remedied immediately. The appropriate legal written notices are served. If the tenant does not remedy the missed payment within 7 days an urgent application may be made to the Tenancy Tribunal to recover the rent arrears. If necessary we apply to the Tenancy Tribunal for a mediated order, or a termination of tenancy where appropriate. Your property manager will attend any required court hearings. The key to arrears management is systematic, timely and frequent monitoring of rent payments and also our comprehensive tenant selection screening.

Regular inspections enable us to identify how the tenant is caring for the property, if damages are present or repairs need completing. If we identify issues clients are always kept informed. Certain repairs may be needed to be carried out by the tenant at their cost (eg if a window has been broken through carelessness) and other repairs may be the responsibility of the landlord (eg window latches or door locks which have become loose over time with use). If a tenant vacates a property and damages are recorded we will hold the tenant responsible for the cost of making good the damage and have this recorded in the form of a sealed court order if necessary.

TERMS AND CONDITIONS I / WE

being the owner or authorised agent of the owner of the property described above appoint ALLEN REALTY LTD (ARL) as the owner’s agent to manage and let the property on the following terms and conditions and authorise you:

1. To let the property when required and to prepare and sign Tenancy Agreements on the owners behalf.

2. To set new rent levels from time to time so that the property remains reasonably tenanted and reasonably reflects the current market level of rents for such properties. ARL shall use its best endeavours to ensure continuity of occupation at market rentals and maintenance of the existing condition of the property at all times but are not liable to the Owner(s) for any default in rent or other payment due by the tenant or damage to the property caused by any party. ARL has no responsibility for any injury to persons and/or damage to property arising out of the condition of the premises or any hazard in or about the premises.

3. To charge tenants a letting fee and to collect from the tenant a minimum of three weeks rent as bond.

4. To inspect the property as specified on page 1 of this agreement.

5. To arrange and have carried out any repairs to the property that may at ARL’s entire discretion be necessary from time to time.

6. To deduct the cost of any repair from any amount held on my account.

7. To collect rent from the tenant by automatic bank payment or any other method of collection which is acceptable to ARL.

8. To take action to collect arrears of rent when necessary including application to the Tenancy Tribunal on my behalf.

9. To deduct ARL’s charges and any amount outstanding, including credit checks, advertising costs, tribunal application fees, key cut costs to ARL and any other bona fide cost from any monies held on my account. Where no money is held, I/we agree to reimburse ARL promptly.

10. I/we agree to pay the following fees for service: a) On all rents, exemplary damages and debts collected

7.5% plus GST. b) On all repairs, maintenance and payments made on the

owner’s behalf 7.5% plus GST. c) All toll and fax charges as incurred, and postage, other

than regular postage and any other cost. d) On attending Tenancy Tribunal Hearings for related matters

to do with the property(s) managed under this agreement $35.00 plus GST per attendance.

e) For each Inspection/Body Corp meeting attendance the fee is $35.00 plus GST.

f) For each inventory inspection (furnished properties) the fee is $25.00 plus GST. Inventory purchase is $50.00 plus GST.

g) For each specialist power/water check meter readings and invoicing the fee is $20.00 plus GST.

11. To pay all monies to my account as specified on page 1 of this agreement.

12. I/we acknowledge I/we have been advised by ARL to notify my insurance company that the property has been tenanted. The Landlord acknowledges that failure to notify its insurance company may void the policy. I/we further acknowledge that as owner of the property, I/we am at all times responsible for insuring the subject property/s.

13. ARL has advised the Landlord that the property should meet the Landlords obligations under the Building Act and any other Local Body, Council or Government Statute or regulation that the Landlord must comply with and that ARL will accept no responsibility for any injury to persons and/or damage to property arising out of the condition of the premises or any hazard in or about the premises. The obligation to meet any lawful obligation under statute or local body regulation remains the responsibility of the Landlord at all times and any fines incurred for failure to meet requirements remain the responsibility of the property owner. The Landlord shall indemnify ARL in regards to all such requirements and costs and if necessary shall reimburse ARL promptly for same.

14. ARL does not complete insurance claims on behalf of the Landlord except for specific REAL Landlord Insurance policies associated with tenant arrears and damages. ARL can assist with other claims by providing any information required by you to lodge a claim.

15. I/ we acknowledge that I/we have been advised to have the telephone disconnected and final readings done on utilities before any tenancy commences.

16. I/we authorise you to pay disbursements on my behalf as specified on page 1 of this agreement.

17. All electronic media including video, photographic and digital material produced by ARL remains the property of ARL and shall not be used by any other party without prior consent.

18. If a free trial period is offered on property management fees, this does not include Tenancy Tribunal application and attendance fees incurred during this period which will still be payable by the Landlord.

19. Should either party to this agreement wish to cancel the agreement, they may do so by giving two months’ notice in writing.

20. The Landlord will advise ARL if the property has been affected or contaminated by Methamphetamine.

21. If you have received one month’s free management fees as part of a special offer, this will not apply to maintenance and disbursement fees.

22. SPECIAL COMMENTS / INSTRUCTIONS

If you are signing up for the free smoke alarm campaign then this contract is for a minimum of 12 months
