    CHAPTER 86

    RENTAL DWELLING UNITS§ 86-3. Definitions.As used in this chapter, the following

    terms shall have the meanings indicated:DWELLING UNITA structure or building, one-, two- or

    three-family dwelling, apartments, mul-tiunit apartments, apartment houses,condominiums, cooperatives, gardenapartments or townhouses, occupied orto be occupied by one or more personsas a home or residence.

    A dwelling unit is a single unit withina building or structure providing com-plete independent living facilities forone or more persons, including perma-nent provisions for living, sleeping eat-ing cooking and sanitation.

    § 86-5. Application for rental occu-pancy permit.

    B. New applications.G. Notwithstanding the above, no

    rental occupancy permit shall be re-quired for any commercial hotel/motel

    business operating exclusively and ca-tering to transient clientele, that is, cus-tomers who customarily reside at theseestablishments for short durations forthe purpose of vacationing, travel, busi-ness, recreational activities, conventions,emergencies and other activities that arecustomary to a commercial hotel/moteloperation, except that the exemption inthis subsection G shall not apply to anycommercial hotel/motel whose primarypurpose is to provide permanent resi-dences to its customers as defined in thischapter.

    § 86-6. Fees.A. A nonrefundable biannual bien-

    nial permit application fee shall be paid,upon filing an application for a rental oc-cupancy permit or for a renewal rentaloccupancy permit, in accordance withthe following schedule of rental dwellingunits per structure:

    plus $50 100 for each unit in excess offour five

    B. The fee required by this sectionshall be waived for any applicant whichdemonstrates that the dwelling unit isoccupied by the immediate family of theowner of the dwelling unit as defined inthis chapter.

    C. Any commercial hotel/motel busi-ness operating exclusively and cateringto transient clientele, that is, custom-ers who customarily reside at theseestablishments for short durations forthe purpose of vacationing, travel, busi-ness, recreational activities, conventions,emergencies and other activities that arecustomary to a commercial hotel/moteloperation, shall be exempt from the feerequired by this section. Pay a biannualfee of $500 per application, plus $50 foreach unit. For the purposes of this chap-ter, a “short duration” shall be defined asnot more than 21 consecutive days. Theexemption in this subsection C is sectionshall not apply to any commercial hotel/motel whose primary purpose is to pro-vide permanent residences to its custom-ers and shall pay a biennial fee of 1,000per application, plus $50 $100 for eachunit. For the purposes of this chapter,“permanent residence” shall be definedas more than 21 consecutive days.

    D. Any rental dwelling unit that onlyoperates during a one-hundred-fifty-dayperiod in the months of May, June, July,August and September, only, shall pay abiannual biennial fee of $25 $50 per unit.

    E. Notwithstanding any other sec-tion of this Chapter, any violation of

    §86-6 for the failure to obtain or timelyrenew a rental permit by the owner(s)and/or tenant(s) shall be punishable asfollows:

    (1) By a fine of not less than $250.00and not exceeding $1,000.00 or by im-prisonment for a period not to exceed15 days, or both, for conviction of a firstoffense.

    (2) By a fine of not less than$1,000.00 nor more than $3,000.00 orby imprisonment for a period not toexceed 15 days, or both, for convictionof the second of two offenses, both ofwhich were committed within a periodof five years.

    (3) By a fine of not less than$2,000.00 nor more than $5,000.00 orby imprisonment for a period not toexceed 15 days, or both, for convictionof the third or subsequent offenses ofa series of offenses, all of which werecommitted within a period of five years.

    F. Each week’s continued violation

    ARTICLE LXIIICOMMUNITY BENEFIT ZONING

    USE DISTRICT (CBD)§ 108-333. Purpose and Intent.A. It is the purpose of the Commu-

    nity Benefit District (CBD) to imple-ment the recommendations of theTown of Riverhead ComprehensivePlan (2003) by permitting the construc-tion of clustered multi-family rentaldwelling units in a manner designed tomeet the needs of a range of users whoare presently underserved by the hous-ing market, including young peopleentering the work force, young families,and seniors.

    B. Such development is to be com-bined with an on-site community cen-ter and non-residential use(s) that,together or individually, provide anenhancement of not only the subjectproject for its residents but for the use,enjoyment and enhancement of thesurrounding community as well.

    C. The goals of the CBD District are:1. To promote a mixed-use develop-

    ment on a single site in a cohesive man-ner, with the main purpose of providing

    for the needs of its residents and resi-dents in the larger community;

    2. To promote the most desirableland use upon real property that is suit-able for such development due to itssize, location and access to necessaryinfrastructure, and;

    3. To provide standards to facilitatedevelopment not currently possibleunder the Town of Riverhead ZoningOrdinances in order to meet identifiedcommunity needs.

    108-334. Definitions.Community Center - is a structure/s

    providing educational and recreationalservices to the community, includingbut not limited to, day care, nutritionand wellness programs, performingarts space, sports, and fitness facilities.Food service, ATM, and re ta ilspace in support of the foregoing ac-tivities shall be permitted in the Com-munity Center.

    Workforce Housing  - is residentialhousing occupied by residents whoseincome conforms to guidelinespublished by a governmental author-ity with appropriate jurisdiction as80% to 120% of median adjusted forarea.

    § 108-335. Creation of the Commu-nity Benefit District.

    A. The CBD district may be imposedby the Town Board as an overlay dis-trict in conjunction with or to the ex-clusion of all other use districts shownon the Zoning Use District Map of theTown of Riverhead.

    B. In the event of a conflict between

    the provisions of this Article and otherprovisions of the Town of RiverheadOrdinance, the provisions of this Ar-ticle shall apply.

    C. All special permit uses set forthherein shall be subject to the approvalof the Town Board pursuant to the re-quirements and procedures set forth inSection 108.133.1 of this Code.

    § 108-336. Eligible Properties.In order to be considered for the

    CBD designation, a property shallmeet all of the following criteria:

    1) The minimum area of a parcelshall be 10 acres;

    2) The site shall have frontage on aState or County arterial highway, ontowhich all vehicle access shall be di-rected;

    3) The minimum road frontage on aState or County arterial highway shallbe 800 linear feet.

    4) The property shall be served byappurtenances of the Riverhead Water

    District and the Riverhead Sewer Dis-trict, or shall be in sufficient proximityto such district boundaries as to permitaccess to such infrastructure;

    5) Be of sufficient area to providefor all applicable parking, buffer yards,landscaping and open space require-ments.

    § 108-337. Uses.A. In the Community Benefit

    (CBD) District no building, structure,or premises shall be used or arrangedor designed to be used and no buildingor structure shall hereafter be erected,reconstructed, or altered or occupiedunless otherwise provided in this chap-ter for the following special permitteduses:

    1. Detached and/or attached multi-family dwelling units;

    2. One-family dwelling units withProfessional Office.

    3. Community Center, Day Care,Nursery School.

    4. Recreational uses including parksand playgrounds, swimming pool, and/or outdoor sports facilities.

    5. Houses of Worship.B. Any development pursuant to this

    Article shall contain some combinationof residential, recreational and non-residential uses listed in subsection “A”of this section.

    § 108-338. Accessory Uses.Accessory uses shall include those

    uses customarily incidental to any ofthe above specially permitted uses whenlocated on the same site or within astructure with a specially permitted use.Specifically allowed are the following,provided that the total lot coverage doesnot exceed five (5) percent of the site:

    1. Maintenance structures.2. Garages.3. Storage buildings.4. Pump station for wastewater dis-

    posal purposes.§ 108-339. Workforce Housing Re-

    quirement.A minimum of one hundred percent

    (100%) of dwelling units shall be soldor rented to households that meet in-

    come standards, as those standards maychange from time to time, as set by theState or Federal government and desig-nated as workforce housing.

    § 108-340. Community Center Re-quirements.

    Any community center approvedpursuant to this chapter shall conform tothe following requirements:

    1. All facilities of the communitycenter shall be available to the generalpublic;

    2. Individual facilities within thecommunity center may be rented to thegeneral public. Fees may be charged foruse of the facilities but such fees shall belimited to only those necessary to defrayexpenses.

    § 108-341. Mixed Use Residential/ Professional Office Structures.

    A. The Professional Office use shallbe of such character as to be appropriatefor a residential neighborhood setting.

    B. All such structures are to be lim-ited in floor area, not to exceed 2,500square feet (SF) in size each.

    C. One residence may be locatedwithin each such structure, and may onlybe occupied by the owner or an employ-ee of the Professional Office that occu-pies that structure.

    § 108-342. General Lot, Yard, Bulkand Height Requirements.

    Maximum Building Net Floor AreaRatio: 0.40

    Maximum Lot Coverage (total foot-print): 0.20

    40,000 sq. ft.§ 108-343. Redemption of Preserva-

    tion Rights to Increase Dwelling UnitYield.

    A. Preservation credits may be usedto increase dwelling unit density withinthe Community Benefit Zoning UseDistrict. In its review and approval ofany site plan application within theCommunity Benefit Zoning Use Districtutilizing preservation credits, the Plan-ning Board shall condition the final siteplan approval upon the redemption ofthe appropriate number of credits, withthe signature of the mylar predicated

    upon the redemption and retiring ofthe appropriate number of preservationcredits.

    B. Preservation credits may be ac-quired through the transfer of develop-ment rights pursuant to Article LXII ofthe Riverhead Town Code or the acqui-sition of Workforce Housing Develop-ment Rights through the Suffolk CountyWorkforce Housing Transfer of Devel-opment Rights Program. Any preserva-tion rights acquired through the SuffolkCounty Workforce Housing Transfer ofDevelopment Rights Programs must berights that were placed in the programfrom the purchase or preservation ofproperty located in the Town of River-head.

    C. The Town Board in its review andapproval of an application for a spe-cial permit may increase the allowabledwelling unit yield at a rate of one (1)dwelling unit per preservation credit re-deemed, not to exceed ten (10) dwelling

    units per 40,000 square feet after sub-tracting for that land area required forinfrastructure and public improvements.

    § 108-344. Open Space Requirements.A. Minimum of 40 percent of the total

    site area shall be reserved for vegetatedopen space, pond areas, or passive recre-ational use.

    B. Such recreational amenities mayinclude, but not limited to, playgrounds,walking trails, fitness trails, picnic areasor sitting areas; no landscaped areas thatare not easily accessible for use and oc-cupancy as recreational space are to beincluded in this calculation.

    §108-345. Off-Street Parking Re-quirements.

    The development shall endeavor toprovide a minimum off street parking inconformance with the following sched-ule:

    Residences: 1.5 spaces/unitCommunity Center: 1 space/300

    square feet of floor area

    Church: 1 space/3 pew seatsNon-Residential Spaces: 1 space/200

    square feet of floor areaIn recognition of the shared use as-

    pects of the CBD District, if the planningboard determines that an applicant hasconclusively demonstrated that one ormore of such uses will be generating ademand for the parking spaces primarilyduring periods when another use or useshas or have a significant lower parkingdemand, the planning board may, uponapplication, reduce the total parkingspaces required.

    § 108-346. Additional Guidelines.A. All utility service lines within the

    site shall be constructed underground.B. The development shall provide

    safety and security lighting in appropri-ate areas, including but not limited tobuilding exteriors, building entrances,walkways, vehicle access points andwithin parking areas.

    C. All exterior lighting fixtures shallconform to Article XLV of the River-head Zoning Ordinance, such that nofugitive lighting impacts adjacent prop-erties.

    D. To the maximum extent practica-ble, sustainable energy site lighting shallbe utilized.

    E. All lighting fixtures, whethermounted on building walls or on poles,shall be placed at the minimum heightnecessary to cast adequate lighting in-tensities on illuminated surfaces.

    F. All buildings shall be handicappedaccessible.

    G. A maintenance plan for all groundand buildings shall be in effect and suchinitial plan shall be included in site planreview.

    H. Landscaping shall be designed to

    reduce heat island effects.I. Onsite retention/harvesting ofstorm water runoff to minimize sewerimpact and reduce water usage for irri-gation shall be utilized.

    J. In recognition of the inherentmixed use character of the CBD District,no abutting landscape buffer areas otherthan those specifically required in thissection shall be required.

    K. For the purpose of the require-ments for off-street loading berths, thepermitted and accessory uses shall notbe considered as being used for business,industrial or hospital purposes.

    L. Where the CBD zoning district hasbeen applied to a property the site planmust show a twenty-five foot (25 ft) non-improved transitional buffer along anyboundary shared with a residential useor residentially zoned property. If in theopinion of the planning board the natu-ral vegetation existing on the site doesnot provide a sufficient buffer between

    the property and the abutting r esidentialuse or residentially zoned property; theplanning board may require the appli-cant to augment the buffer appropriatescreening and vegetation. For the pur-poses of this section, fencing in the non-improved transitional buffer area shallnot be deemed an improvement.

    § 108-347. Service Providers Ameni-ties and Services.

    Where the development includeshealth and fitness facilities and/or daycare services for preschool-age and/or services for senior citizen within thecommunity center, oversight and super-vision shall be provided by professionalstaff.

    § 108-348. Development StandardWithin the Community Benefit District.

    No earthwork, land clearing, con-struction or land disturbance of any kindshall take place upon real property with-in a CBD until such time as a site planhas been approved by the Riverhead

    Planning Board. I n cases in which a pro-posed project involves the subdivision ofland, no development may proceed untilfinal conditional subdivision approvalhas been granted by the Riverhead Plan-ning Board. Approval of site plan fordevelopment shall be conditioned uponapproval by Suffolk County Departmentof Health Services. Energy Star compli-ance on all equipment and appliances inresidential units shall be required. Allusers and residents within the CBD shallbe required to comply with a recyclingplan for refuse. Buildings shall be ori-ented to maximize natural daylight. Lowflow water for all plumbing fixtures shallbe utilized.
