SBIPA (Bengal Circle) - SHRI R.N.BANERJEE Passes Away

We report to our members/affiliates with deep sense of grief and sorrow the demise of our belovedPresident of Federation and the founder General Secretary of Bengal Circle SBIOA Sri R.N.Banerjee, on29th instant at 12-15 pm. His departure leaves a huge void in the leadership of the organisation. All of usknow that he is suffering from a serious ailment “Blood Cancer” for the past three decades. He is 82 yearsold. Sri Banerjee held the position of General Secretary of Bengal Circle Pensioners’ Association for manyyears. He was the Secretary of our Federation before taking up the position of President at the AnnualGeneral Meeting,Lucknow in the year 2015. We dip our banner to pay our deepest respect to him. We prayAlmighty to grant sublime peace to the departed soul.

We furnish a brief of Sri Banerjee for the information of our Affiliates and members.

“A bright alumnus of Allahabad University, ShriR.N.Banerjee joined the Bank as Probationary Officer on01.03.1961. As building a carrier was not his only resolve, he plunged into the officers’ movement andultimately became the General Secretary of State Bank of India Supervising Staff Association, since renamedas S.B.I.Officers’ Association. It was under his stewardship that the officer community in SBI organized astiff fight against the management culminating into a historic indefinite Strike of Work in the year 1969. Whilein one hand he proved his ability as a leader of the officer employees, on the other he proved his skill as anofficer of the Bank and ultimately rose up to the rank of General Manager. During the carrier he was deputedto West Bengal Financial Corporation to perform as its Managing Director. He was carefully chosen by theauthority to manage challenging incumbencies at different foreign offices of the Bank.

After his retirement he joined the Pensioners’ Association in Bengal Circle in the year 2001. His totaldedication to champion the cause of the pensioners and diligence to pursue made him the ultimate choicefor the position of General Secretary at Circle level and President, Federation of SBI Pensioners’ Associationsin the year 2015. His name will also be remembered as architect of unity of pensioners’ organisations in theBanking Industry. It is his initiative, which was instrumental in emergence of CBPRO, a UFBU- like umbrellaorganisation to pursue and resolve the issues confronting the senior bank men. A devout perfectionist, aman with profound knowledge, charming oratory and a facile pen, Shri Banerjee was loved by all in thepensioners’ fraternity of SBI in particular and Banking Industry in general. His wish was that the court casepresently fought by the Federation shall be concluded as early as possible, that was his last suggestion tothe undersigned when he visited Kolkata on 26th December 2017 along with Federation Treasurer andPresident of SBIPA Hyderabad Circle, he passed away in a months’ time. We always keep this suggestionas the Agenda of Federation to pursue for conclusion of the case as early as possible. An octogenarian atthe time of departure, Shri Banerjee had been suffering from the dreadful disease of Leukaemia for overthree decades. It may appear unbelievable to many as he never failed in his duties and travelled distantplaces to meet his organizational obligations untiringly. Ultimately he had to surrender to the Nature’s designand he breathed his last at 12-15pm on the Monday, the 29th January 2018 in presence of his wife, daughterand granddaughter at Santiniketan, Bolpur, a place far from the madding crowd of Kolkata.

We pray eternal peace for his departed soul and convey our heartfelt condolences to the members ofthe bereaved family.

AMENDMENT TO THE SBI EMPLOYEES’ PENSION FUND REGULATIONS2014

REVISION IN PENSION

Annexure - I:

The State Bank of India Employees’ Pension Fund (Amendment) Regulations,2017: In the State Bankof India Employees’ Pension Fund Regulations, 2014, in regulation 23, for the provisos, the following provisosshall be substituted, namely: —

(A) in sub-regulation (2):

EXISTING REGULATIONS : sub-regulation :

(2) The maximum pension shall not exceed one-half of the average monthly substantive salary drawnduring the last twelve months pensionable service or rupees two thousand four hundred per month (pro-rata in the case of part time employees) whichever is less:

AMENDED REGULATIONS : sub-regulation : (2) No Change :

Provided that the maximum amount of pension shall be increased for the members who retired or retire onor after the 1st November,1987, from rupees two thousand four hundred per month to rupees three thousandseven hundred seventy-five per month (pro-rata in the case of part-time employees).

EXISTING REGULATIONS : Provided that the maximum amount of pension shall be increased for themembers who retired or retire on or after the 1st November, 1993 from rupees two thousand four hundredper month to rupees four thousand two hundred fifty per month (pro-rata in the case of part-time employees)after adjustment of dearness allowance on the basic pay upto 1148 points in the quarterly average of the AllIndia Working Class Consumer Price Index (General) Base 1960=100:

AMENDED REGULATIONS : Provided further that the maximum amount of pension shall be increased forthe members who retired or retire on or after the 1st November, 1992 (Award Staff) or the 1st July 1993(Supervising Staff) from rupees two thousand four hundred per month to rupees four thousand two hundredfifty per month (pro-rata in the case of part-time employees) after adjustment of dearness allowance on thebasic pay up to 1148 points in the quarterly average of the All India Working Class Consumer Price Index(General) Base 1960=100:

EXISTING REGULATIONS : Provided further that with effect from the 1st March, 1999 the maximumamount of pension for the members who retired or retire drawing substantive salary in the Pay Scaleseffective from the 1st November, 1992 (Award Staff) or the 1st July, 1993 (Supervising Staff) and thereaftershall be computed till further amendments in this regard, as under—

AMENDED REGULATIONS : No Change.

EXISTING REGULATIONS : (a) where the average of monthly substantive salary drawn during the lasttwelve months’ pensionable service is upto rupees eight thousand five hundred per month, fifty per cent. ofthe average of monthly substantive salary drawn during the last twelve months’ pensionable service (pro-rata in the case of part-time employees); and

AMENDED REGULATIONS : (a) No Change.

EXISTING REGULATIONS : (b) where the average of monthly substantive salary drawn during the lasttwelve months’ pensionable service is above rupees eight thousand five hundred per month, forty per centof the average of monthly substantive salary drawn during the last twelve months’ pensionable servicesubject to minimum of rupees four thousand two hundred fifty (pro-rata in the case of part-time employees):

AMENDED REGULATIONS : (b) No Change.

Provided also that with effect from the 1stNovember, 1997 (Award Staff) or the 1stApril, 1998 (SupervisingStaff), the maximum amount of pension for the members who retired or retire drawing substantive salary inthe Pay Scales effective from the 1st November, 1997 (Award Staff) or the 1stApril, 1998 (Supervising Staff)shall be computed, by arriving at the corresponding stage by dividing the average basic pay by 1684 andmultiplying it by 1616, till further amendments in this regard, as under -

(a) where the average of monthly substantive salary drawn during the last twelve months’ pensionableservice is up to rupees thirteen thousand six hundred sixty-six per month, fifty per cent. of the average ofmonthly substantive salary drawn during the last twelve months’ pensionable service (pro-rata in the caseof part-time employees); and

(b) where the average of monthly substantive salary drawn during the last twelve months’ pensionableservice is above rupees thirteen thousand six hundred sixty-six per month, forty per cent of the average ofmonthly substantive salary drawn during the last twelve months’ pensionable service subject to minimum ofrupees six thousand eight hundred thirty-three (pro-rata in the case of part-time employees):

Provided also that with effect from the 1stMay, 2005, the maximum amount of pension for the memberswho retired or retire drawing substantive salary in the Pay Scales effective from the 1stNovember, 1997(Award Staff) or the 1stApril, 1998 (Supervising Staff) shall be computed, as under—

(a) where the average of monthly substantive salary drawn during the last twelve months’ pensionableservice is up to rupees fourteen thousand two hundred forty per month, fifty per cent. of the average ofmonthly substantive salary drawn during the last twelve months’ pensionable service (pro-rata in the caseof part-time employees); and

(b) where the average of monthly substantive salary drawn during the last twelve months’ pensionableservice is above rupees fourteen thousand two hundred forty per month, forty per cent of the average ofmonthly substantive salary drawn during the last twelve months’ pensionable service subject to minimum ofrupees seven thousand one hundred twenty (pro-rata in the case of part-time employees):

EXISTING REGULATIONS : Provided also that with effect from the 1st May, 2005, the maximum amountof pension for the members who retired or retire drawing substantive salary in the Pay Scales effective fromthe 1st November, 2002 shall be computed till further amendments in this regard, as under—

(a) where the average of monthly substantive salary drawn during the last twelve months’ pensionableservice is up to rupees twenty one thousand forty plus Professional Qualification Pay plus Fixed PersonalPay per month, fifty per cent of the average of monthly substantive salary drawn during the last twelvemonths’ pensionable service (pro-rata in the case of part-time employees); and

(b) where the average of monthly substantive salary drawn during the last twelve months’ pensionableservice is above rupees twenty one thousand forty plus Professional Qualification Pay plus Fixed PersonalPay per month, forty per cent of the average of monthly substantive salary drawn during the last twelvemonths’ pensionable service subject to minimum of rupees ten thousand five hundred twenty plus half ofProfessional Qualification Pay plus half of Fixed Personal Pay wherever applicable (pro-rata in the case ofpart-time employees):

EXISTING REGULATIONS : Provided also that with effect from the 1st November, 2007, the maximumamount of pension for the members who retired or retire drawing substantive salary in the pay scaleseffective from the 1st November, 2007 shall be computed till further amendments in this regard, as under:

AMENDED REGULATIONS : No Change.

Provided also that with effect from the 1stNovember, 2012, the maximum amount of pension for the memberswho retired or retire drawing substantive salary in the Pay Scales effective from the 1stNovember, 2012shall be computed till further amendments in this regard, as under—

(a) where the average of monthly substantive salary drawn during the last twelve months’ pensionableservice is up to rupees fifty-one thousand four hundred ninety per month, fifty per cent. of the average ofmonthly substantive salary drawn during the last twelve months’ pensionable service plus half of ProfessionalQualification Pay plus half of increment component of Fixed Personal Pay, wherever applicable (pro-rata inthe case of part-time employees);

(b) where the average of monthly substantive salary drawn during the last twelve months’ pensionableservice is above rupees fifty-one thousand four hundred ninety per month, forty per cent. of the average ofmonthly substantive salary drawn during the last twelve months’ pensionable service subject to minimum ofrupees twenty-five thousand seven hundred forty-five plus half of Professional Qualification Pay plus half ofincrement component of Fixed Personal Pay, wherever applicable (pro-rata in the case of part-timeemployees).”

EXISTING REGULATIONS : (9) (a) In the case of members who ceased to be in the Bank’s pensionableservice from the 1st November, 1987 to the 31st October, 1993, dearness relief shall be payable for everyrise or be recoverable for every fall, as the case may be, ofevery 4 points over 600 points in the quarterlyaverage of the All India Average Consumer Price Index for IndustrialWorkers in the series 1960=100.

AMENDED REGULATIONS : (9) (a) In the case of members who ceased to be in Bank’s pensionableservice from 1stNovember 1987 to the 31stOctober 1992 (Award Staff) or the 30thJune, 1993 (SupervisingStaff), dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be,ofevery 4 points over 600 points in the quarterly average of the All India Average Consumer Price Index forIndustrialWorkers in the series 1960=100.

(iii)(a) on and from the 1stMay, 2005, in respect of employees who retired or retire on or after the 1stNovember, 1997(Award Staff) or the 1stApril, 1998 (Supervising Staff), dearness relief shall be payable for every rise or be recoverable forevery fall, as the case may be, of every 4 points over 1684 points in the quarterly average of the All India AverageConsumer Price Index for Industrial Workers in the series 1960=100;

(b) such increase or decrease in dearness relief for every aforesaid four points shall be calculated in the manner givenbelow : -

(i) up to Rs. 3550 0.24 per cent.

(ii) Rs. 3551 to 0.24 per cent of Rs. 3550 plus 0.20 per cent of theRs. 5650 basic pension in excess of Rs. 3550.

(iii) Rs. 5651 to 0.24 per cent of Rs. 3550 plus 0.20 per cent of theRs. 6010 difference between Rs. 5650 and Rs. 3550 plus 0.12

RECOVERY ON ACCOUNT OF INCORECT DATA

We refer to the trail mails on account of captioned subject and advise as under

1. Our intention should be to recover full amount of recovery in one go without causing anyinconvenience to the pensioner. Therefore, if there are sufficient funds in the account then recoverthe total amount after discussing with the pensioner.

2. If the partial amount is available in the account, discuss with the pensioner whether he/she canmake good the total amount by making available more funds in account and if the full amount isarranged then recover the same in one go.

3. However, if partial amount is available in the account and pensioner after discussion has shownhis/her inability to make good the amount in full, a suitable instalment may be fixed and recoveryshould be made through monthly pension. However, please note that the recovery should becompleted maximum within 36 months.

4. We have taken up the matter with HRMS to avoid further deduction of income tax, however, theincome tax already deducted and remitted to Income Tax department may be claimed by theindividual pensioner.

5. We are attaching a list of pensioners with recovery components of basic and dearness reliefpaid separately. Please arrange to raise the IBTS on CAO, Kolkata and arrange to remit basicand D.A. recovered separately on monthly basis (for accounting purpose) and also arrange toadvise us in the following format:

In this connection those pensioners who have donated generously to the Association, on receipt of arrears by

them, are requested to write to the Association’s Pune Office with particulars of remittance, for refund of

RECOVERY AND WRONG PAYMENT OF ARREARS

We profusely convey our thanks for considering our request and passing on suitable instructions toLocal Head Offices to recover the amount of arrears paid to the officers’ retired from 1st November 1997 to31st March 1998 in 36 monthly instalments in consultation with retirees by the respective LHOs. Thismagnanimity of the bank instilled confidence in the hearts of pensioners that the Bank has taken care of theretirees at the appropriate time and allowed them to live peacefully.

In this connection we bring to your kind information that the arrears of pension so paid is recoveredincluding the money deducted at source and paid to IT departmentagainst PAN number of pensioners bythe Corporate Center. It is suggested that the matter may be taken up by the Corporate Center withthe ITauthorities instead of putting the burden on the pensioners as many of the pensioners in this category donot fall under tax-net and hence not filing tax returns every year. Now fresh filing of tax return for refund ofmoney may land them in to problems as the department will definitely question the filing status of thereturns for the previous years.

This is also bringing to your kind information that the family pensioners are yet to be paid arrears onexecution of the relative documents. We understand that at PPF&G department at LHOs level has alreadychecked the calculations and the same have been retransmitted duly corrected to the Corporate Center.We request you to kindly arrange to take up this matter for early payment of arrears to all the eligible familypensioners of the deceased.

There are cases of some regular pensioners who are yet to receive 90% arrears, this issue may alsobe looked in to on top priority basis as much time has elapsed in payment of arrears
