Sir,This has reference to your application No. IIIL/Nasik SEZ/MOEF /2014-

15/695 dated 06.02.2015, submitting the above mentioned proposal to thisMinistry for grant of Environmental Clearance (EC) in terms of the provisions ofthe Environment Impact Assessment (EIA) Notification, 2006 under theEnvironment (Protection), Act, 1986.

2. The proposal for 'Multi-product SEZ' in villages Gulvancb andMusalgaon of l'ebsil Sinnar, District Nasik (Mabarashtra) by MIs IndiabullsIndustrial Infrastructure Ltd (IIIL), was considered by the Expert AppraisalCommittee (EAC) in the Ministry for Infrastructure Development, CoastalRegulation Zone, Building/ Construction and Miscellaneous projects, in its 147thEACmeeting helci"on 23rd - 24th April, 2015.

3. The details of the project, as per the documents submitted by the ProjectProponents (PP), and also as informed during the above said EAC meeting, arereported to be as under:-

(i) The project was accorded ToR vide letter no. 21-71/2012-IA-III dated11.04.2013.

(ii) The proposal involves 'Multi-product SEZ' in villages Gulvanch andMusalgaon of Tehsil Sinnar, District Nasik (Maharashtra) by M/ s IndiabullsIndustrial Infrastructure Ltd (IIIL).

(iii) Total available notified area of Multiproduct SEZ is 1011.264 ha, out ofwhich 436.194 ha has already been granted Environmental Clearance for

? Thermal Power Plant.

(iv) The present proposal seeks Environmental Clearance for the balance areaof SEZ, i.e. 575.07 ha, comprising of Processing Area (PA):512.068 ha and Non-Processing Area (NPA):63.002 ha.

(v) The proposed project site is located in MIDC's Industrial area of Sinnarsituated at approximately 33 km from Nashik City. The proposed site is 5.70 kmfrom NH-50 Nashik-Pune highway and 1.20 km from SH-45 (Sinnar-Loni-Kolhar)and adjacent to SH-39 (Sinnar to Shirdi).

(vi) The Special Economic Zone (SEZ) will mainly comprise of PA and no redtype industry would be housed. SEZ will be an industrial hub for the following:

Free Trade and Ware HousingAuto and AncillaryAviation and AncillaryPharmaceu ticals FormulationLight EngineeringElectronic and Electrical based Industries

(vii) Total water requirement for the proposed SEZ is 14.881 MLD for PA +2.876 MLDfor NPA. The requirement will be met from MIDC.

(viii) During Operational phase, 2.17 MLD of domestic wastewater will begenerated and treated in 2.50 MLD STP located within the site. The STP will beprovided with primary, secondary and tertiary treatment facilities and will bebased on conventional suspended growth treatment system (diffused aerationsystem). The treated water from ETP will be recycled and used for flushing,horticulture and cooling. The proposed SEZ will follow Zero Discharge and hencethere will be no impact on the surrounding water bodies.

(ix) Storage of municipal solid wastes will be provided at designated places.During storage period waste will be kept in covered bins. Storage facilities or'bins' will have-reasy to operate' design for handling, transfer and transportationof waste. Personal protective equipment, like gloves, gum boots and safety maskswill be provided to workers. Vehicles used for transportation of wastes shall becovered. Transportation will be carried out by hired authorized party or byMunicipal Authority for disposal at municipal land fill site. The non-biodegradable waste will be transported to landfill site. Assurance for disposal ofsolid waste has been obtained by Sinnar Municipal Council, WS No. 97 dated19.03.2010. IIIL will adopt suitable technology or combination of suchtechnologies to make use of wastes so as to minimize burden on the landfill. Thebiodegradable wastes shall be processed by composting or by bio-methanationprocess.

(x) Hazardous Waste generated from the specific industry will be temporarilystored within their premises as per provisions of Hazardous Waste Management& Handling Rules, 2008. All hazardous waste will be stored in HDPE bags andMS Containers and placed in concretes lab. Hazardous Waste will be handed overto the authorized vendors of Maharashtra Pollution Control Board (MPCB) totransport hazardous waste to the landfill site approved by MPCB. Assurance forHazardous Waste disposal has been obtained from Mumbai Waste ManagementLtd. dated 15.03.2010.

(xi) Energy efficient machineries shall be used during operation phase as perEnergy Conservation Building Code (ECBC), 2007. Member units shall beencouraged to utilize renewable sources of energy for conservation of non-renewable sources of energy. It is proposed that 100% of the organic wastegenerated within SEZ premises will be composted. Solar powered street lightsEC_lndiabulls_SEZ

shall be used within the SEZ premises. Traffic lights are also proposed to be solarpowered.

(xii) Green belt development (20% of construction projects and 33% for others).Green Area of 76.81 Ha in the PA and 12.60 Ha in NPA is reserved in the SEZ.Indigenous plant species will be selected to minimize fugitive and noise impacts,enhance aesthetics and develop a habitat for avi-fauna. Ideal size of greenbeltshall be between 15 and 80m wide all along length of roads, major structuresand open spaces.

(xiii) Adequate parking space will be provided for vehicles within the proposedSEZ project site as per MoEF norms. Suitable parking spaces will be provided asper the local by-laws and NBC guidelines.

(xiv) The total estimated cost of the proposed project is about Rs.1380.00 Croresthat includes the cost of land, internal development and construction cost,marketing over heads, administrative costs, and associated contingencies andoverall industrial development within the area.

(xv) The project area does not fall under the designated Critically Polluted area.

(xvi) Forest land: No forest land is involved in the project.

(xvii) Wildlife issues: There are no National Parks, Wildlife sanctuary, biospherereserves found inthe 10 km buffer zone.

(xviii)There is no court cases/violation pending with the project proponent.

(xix) Employment potential: It is expected that during construction phase,about 1100 unskilled labour will be hired locally in order to generate theemployment to the local people. During operational phase, employment of 52,086and 28,332 is expected in the PAand NPArespectively.

(xx) Public Hearing: Public Hearing for the proposed SEZ was held on27.08.2014 in Nasik. A total of 212 written applications were received during andafter the Public Hearing.

(i) 'Consent to Establish' shall be obtained from State Pollution Control Boardunder the Air (Prevention and Control of Pollution) Act, 1981 and the Water(Prevention and Control of Pollution) Act, 1974.

4. The proposal was considered by the Expert Appraisal Committee (EAC)inits 147th meeting held on 23rd - 24th April, 2015 for grant of EnvironmentalClearance. As per recommendations of the EAC, the Ministry of Environment,Forest & Climate Change hereby accords Environmental Clearance for the above-mentioned project Multi-product SEZ' in villages Gulvanch and Musalgaon ofTehsil Sinnar, District Nasik (Maharashtra) by M/ s Indiabulls IndustrialInfrastructure Ltd (IIIL), under the provisions of the Environment ImpactAssessment Notification, 2006 and amendments thereto and Circulars issuedthereon and subject to the compliance of the following specific conditions, inaddition to the general conditions mentioned below:-

PARTA - SPECIFICCONDITIONS:

Internal Road widths within the SEZ shall be minimum 24 m ROW.

(ii) The responsesj commitments made to the issues raised during publichearing shall be complied with in letter and spirit. A hard copy of theaction taken shall be submitted to the Ministry.

(iii) All the recommendation of the EMP shall be complied with letter and spirit.All the mitigation measures submitted in the EIA report shall be preparedin a matrix format and the compliance for each mitigation plan shall besubmitted to RO, MoEF&CC along with half yearly compliance report.

(iv) The Project Proponent while issuing the allotment letter to individualmember units shall specifically mention the allowable maximum quantityof water usage and effluent generated by each member unit.

(v) The member units shall provide storage tanks for storage of effluent formonitoring the characteristics of effluent before taking into the CETP forfurther treatment.

(vi) Proper meters with recording facilities shall be provided to monitor theeffluent quality and quantity sent from member industries to CETP andfrom CETP.to the final disposaljre-use on a continuous basis.

(vii) Member industries shall treat the effluent to meet the prescribed CETPinlet norms.

(viii) The environmental monitoring and compliance mechanism as stipulated byMoEF&CC shall be complied. The same shall be specifically mentioned inthe allotment letter issued to individual member units by the projectproponent.

The Project Proponent shall establish an environmental monitoring cellwith all the potential polluting units as members to review theenvironmental monitoring data and suggest for improvements.

Common facilities such as repair shops, rest rooms for drivers andattendants shall be provided.

A green belt of minimum width of 20 m shall be developed all around theproject boundary.

MoU duly covering environmental legal frame work for disposal of effluentswith PP shall be entered and the copy shall be submitted to MoEF&CC andState PCB.

Solar lighting in the non-process area shall be provided.

Parking space to accommodate trucks, cars, two wheelers and bicyclesshall be provided as per the norms.

On-line monitoring system shall be provided at the outlet of ETP for criticalparameters in consultation with SPCB.

(xvii) Continuous VOC monitors at SEZ periphery at different locations shall beprovided in consultation with SPCB.

(xviii)Zoning of industries shall be done for environmental planning. Concept ofindustrial ecology shall be adopted.

(xix) Treated waste water shall be used for flushing of toilets, horticulture andHVACpurposes, in that order.

(xx) Special Purpose Vehicle (SPV) will be established for compliance of theenvironmental safeguard like monitoring of Common Effluent TreatmentPlant (CETP),emissions and air quality in entire industrial estate.

(xxi) All required sanitary and hygienic measures should be in place beforestarting construction activities and to be maintained throughout theconstruction phase.

(xxii) Soil and ground water samples will be tested to ascertain that there is nothreat to ground water quality by leaching of heavy metals and other toxiccontaminan ts.

(xxiii)Construction spoils, including bituminous material and other hazardousmaterials, must not be allowed to contaminate watercourses and the dumpsites for such material must be secured so that they should not leach intothe ground water.

(xxiv)Any hazardous waste generated during development/ construction phase,should be disposed off as per applicable rules and norms with necessaryapprovals of the Maharashtra Pollution Control Board.

(xxv) The diesel generator sets to be used during development/ constructionphase should be low sulphur diesel type and should conform toEnvironment (Protection) Rules prescribed for air and noise emissionstandards,

(xxvi)The diesel required for operating DG sets shall be stored in undergroundtanks and. if required, clearance from Chief Controller of Explosives shallbe taken.

(xxvii)The quantity of fresh water usage, water recycling and rainwaterharvesting shall be measured and recorded to monitor the water balance asprojected by the project proponent. The record shall be submitted to theRegional Office, MoEF&CC along with six Monthly Monitoring reports.

(xxviii)Vehicles hired for bringing construction material to the site should be ingood condition and should have a pollution check certificate and shouldconform to applicable air and noise emission standards and should beoperated only during non-peak hours.

(xxix)Ambient noise levels should conform to residential standards both duringday and night. Incremental pollution loads on the ambient air and noisequality should be closely monitored during construction phase. Adequatemeasures should be made to reduce ambient air and noise level duringconstruction phase, so as to conform to the stipulated standards byCPCB/Maharashtra SPCB.

(xxx) Fly ash should be used as building material in the construction as per theprovisions of Fly Ash Notification of September, 1999 and amended as on27th August, ~W03.

Regular supervision of the above and other measures for monitoring shouldbe in place all through the construction phase, so as to avoid disturbance tothe surroundings .

Under the provisions of Environment (Protection) Act, 1986, legal actionshall be initiated against the project proponent if it was found that

(xxxi)Ready mixed concrete must be used in building construction.

(xxxii)Storm water control and its re-use as per CGWB and BIS standards forvarious applications.

(xxxiii)Water demand during construction should be reduced by use of pre-mixedconcrete, curing agents and other best practices referred.

(xxxiv) Permission to draw ground water shall be obtained from the competentAuthority prior to construction/operation of the project.

(xxxv) Separation of grey and black water should be done by the use of dualplumbing line for separation of grey and black water.

(xxxvi) Fixtures for showers, toilet flushing and drinking should be of low floweither by use of aerators or pressure reducing devices or sensor basedcontrol.

(xxxvii)Use of glass may be reduced by upto 40% to reduce the electricityconsumption and load on airconditioning. If necessary, use high qualitydouble glass with special reflective coating in windows.

(xxxviii)Roofshould meet prescriptive requirement as per Energy ConservationBuilding Code by using appropriate thermal insulation material to fulfillrequirement.

(xxxix) Opaque wall should meet prescriptive requirement as per EnergyConservation Building Code which is proposed to be mandatory for allaircoriditioned spaces while it is aspirational for non-airconditioned spacesby use of appropriate thermal insulation material to fulfill requirement.

(xl) A First Aid Room will be provided in the project both during constructionand operation of the project.

(xli) Provision shall be made for the housing of construction labour within thesite with all necessary infrastructure and facilities such as fuel for cooking,mobile toilets, mobile STP, safe drinking water, medical health care, crecheetc. The housing may be in the form of temporary structures to be removedafter the completion of the project.

(xlii) The approval of the competent authority shall be obtained for structuralsafety of the buildings due to earthquake, adequacy of fire fightingequipments, etc. as per National Building Code including protectionmeasures from lightening etc.

Disposal of muck during construction phase should not create any adverseeffect on the neighbouring communities and be disposed taking thenecessary precautions for general safety and health aspects of people, onlyin approved sites with the approval of competent authority.

construction of the project has been started without obtainingenvironmental clearance.

(xlvi) 2% of the project cost shall be earmarked for CSR activities.

(xlvii) Necessary provision to develop facilities for disabled people shall be madeunder CSR.

(xlviii) Corporate Social Responsibility:

a) The Company shall have a well laid down Environment Policy approvedby the Board of Directors.

b) The Environment Policy shall prescribe for standard operatingprocess/procedures to bring into focus any infringements/deviation/violation of the environmental or forest norms/ conditions.

c) The hierarchical system or Administrative Order of the company to dealwith environmental issues and for ensuring compliance with theenvironmental clearance conditions shall be furnished.

d) To have proper checks and balances, the company shall have a well laiddown system of reporting of non-compliances/ violations ofenvironmental norms to the Board of Directors of the company and/orshareholders or stakeholders at large.

II. Operation Phase

(i) The installation of the Effluent Treatment Plant (ETP)/Sewage TreatmentPlant (STP)should be certified by an independent expert and a report in thisregard should be submitted to the Ministry before the project iscommissioned for operation. Treated effluent emanating from' STP shall berecycled/reused to the maximum extent possible. Treatment of 100% greywater by decentralised treatment should be done. Discharge of unusedtreated affluent shall conform to the norms and standards of theMaharashtra Pollution Control Board. Necessary measures should be madeto mitigate the odour problem from STP.

(ii) Necessary permission/NOC shall be obtained from competent authority forthe disposal of treated effluent into deep sea.

(iii) The solid waste generated should be properly collected and segregated. Wetgarbage should be composted and dry/inert solid waste should be disposedoff to the approved sites for land filling after recovering recyclable material.The hazardous wastes shall be disposed at authorised TSDF site.

(iv) Diesel power generating sets proposed as source of back up power forelevators and common area illumination during operation phase should beof enclosed type and conform to rules made under the Environment(Protection) Act, 1986. The height of stack of DG sets should be equal to theheight needed for the combined capacity of all proposed DG sets. Use lowsulphur diesel. The location of the DG sets may be decided with inconsultation with Maharashtra Pollution Control Board.

(v) Noise should be controlled to ensure that it does not exceed the prescribedstandards. During night time the noise levels measured at the boundary ofthe building shall be restricted to the permissible levels to comply with theprevalent regulat\ons.

(i) The environmental safeguards contained in the EIA Report should beimplemented in letter and spirit.

Provision should be made for supply of kerosene or cooking gas andpressure cooker to the labourers during construction phase.

The project proponent shall also submit six monthly reports on the statusof compliance of the stipulated EC conditions including results of monitoreddata (both in hard copies as well as by e-mail) to the respective RegionalOfficeof MoEF, the respective Zonal Officeof CPCB and the SPCB.

(vi) The green belt of the adequate width and density preferably with localspecies along the periphery of the plot shall be raised so as to provideprotection against particulates and noise.

(vii) Weep holes in the compound walls shall be provided to ensure naturaldrainage of rain water in the catchment area during the monsoon period.

(viii) Rain water harvesting for roof run- off and surface run- off, as plansubmitted should be implemented. Before recharging the surface run off,pre-treatment must be done to remove suspended matter, oil and grease.The borewell for rainwater recharging should be kept at least 5 mts. abovethe highest ground water table.

(ix) The ground water level and its quality should be monitored regularly inconsultation with Central Ground Water Authority.

(x) Traffic congestion near the entry and exit points from the roads adjoiningthe proposed project site must be avoided. Parking should be fullyinternalized and no public space should be utilized.

(xi) A Report on the energy conservation measures confirming to energyconservation norms finalise by Bureau of Energy Efficiency should beprepared 'incorporating details about building materials & technology, R &U Factors etc and submit to the Ministry in three months time.

(xii) Energy conservation measures like installation of CFLs/TFLs for thelighting the areas outside the building should be integral part of the projectdesign and should be in place before project commissioning. Use CFLs andTFLs should be properly collected and disposed off'/ sent for recycling as perthe prevailing guidelines 1 rules of the regulatory authority to avoid mercurycontamination. Use of solar panels may be done to the extent possible.

(xiii) Adequate measures should be taken to prevent odour problem from solidwaste processing plant and STPICEPT.

(xiv) The building should have adequate distance between them to allowmovement of fresh air and passage of natural light, air and ventilation.

PART - B. GENERAL CONDITIONS

J1(iv) A copy of the environmental clearance letter shall also be displayed on the

website of the concerned State Pollution Control Board. The EC letter shallalso be displayed at the Regional Office, District Industries centre andCollector's Office1 Tehsildar's officefor 30 days.

(v) The project proponent shall set up a separate environmental managementcell for effective implementation of the stipulated environmental safeguardsunder the supervision of a Senior Executive.

(vi) The funds earmarked for environment management plan shall be includedin the budget and this shall not be diverted for any other purpose.

5. Officials from the Regional Office of MoEF&CC, Nagpur who would bemonitoring the implementation of environmental safeguards should be given fullcooperation, facilities and documents/ data by the project proponents during theirinspection. A complete set of all the documents submitted to MoEF&CC should beforwarded to the CCF, Regional Office of MoEF&CC, Nagpur.

6. In the case of any change(s) in the scope of the project, the project wouldrequire a fresh appraisal by this Ministry.

7. The Ministry reserves the right to add additional safeguard measuressubsequently; if found necessary, and to take action including revoking of theenvironment clearance under the provisions of the Environmental (Protection) Act,1986, to ensure effective implementation of the suggested safeguard measures ina time bound and satisfactory manner.

8. All other statutory clearances such as the approvals for storage of dieselfrom Chief Controller of Explosives, Fire Department, Civil Aviation Department,Forest Conservation Act, 1980 and Wildlife (Protection) Act, 1972 etc. shall beobtained, as applicable by project proponents from the respective competentauthorities.

9. These stipulations would be enforced among others under the provisions ofWater (Prevention and Control of Pollution) Act, 1974, the Air (Prevention andcontrol of Pollution) act 1981, the Environment (Protection) Act, 1986, the PublicLiability (Insurance) Act, 1991 and EIA Notification, 2006.

10. The project proponent should advertise in at least two local Newspaperswidely circulated in the region, one of which shall be in the vernacular languageinforming that the project has been accorded Environmental Clearance and copiesof clearance letters are available with the Maharashtra Pollution Control Boardand may also be seen on the website of the Ministry of Environment, Forest &Climate Change at http://www.envfor.nic.in. The advertisement should be madewithin Seven days from the date of receipt of the Clearance letter and a copy of thesame should be forwarded to the Regional office of this Ministry at Nagpur.

13. A copy of the clearance letter shall be sent by the proponent to concernedPanchayat, Zilla Parisady Municipal Corporation, Urban Local Body and the LocalNGO, if any, from whom suggestions/representations, if any, were received while

11. This Environmental Clearance is subject to final order of the Hon'bleSupreme Court of India in the matter of Goa Foundation Vs Union of India in WritPetition (Civil)No.460 of 2004 as may be applicable to this project.

12. Any appeal against this clearance shall lie with the National GreenTribunal, if preferred, within a period of 30 days as prescribed under Section 16of the National Green Tribunal Act, 2010.

processing the proposal. The clearance letter shall also be put on the website ofthe company by the proponent.

14. The proponent shall upload the status of compliance of the stipulated ECconditions, including results of monitored data on their website and shall updatethe same periodically. It shall simultaneously be sent to the Regional Office ofMoEF&CC, the respective Zonal Office of CPCB and the SPCB. The criteriapollutant levels namely; SPM, RSPM, S02, NOx (ambient levels as well as stackemissions) or critical sectoral parameters, indicated for the project shall bemonitored and displayed at a convenient location near the main gate of thecompany in the public domain.

15. The environmental statement for each financial year ending 31st March inForrn-Vas is mandated to be submitted by the project proponent to the concernedState Pollution Control Board as prescribed under the Environment (Protection)Rules, 1986, as amended subsequently, shall also be put on the website of thecompany along with the status of compliance of EC conditions and shall also besent to the respective Regional Offices of MoEF&CCby e-mail.
