    of public concern ,Have agreed as fo ll ows:Article I

    OBJECTIVEThe objective of this Protocol is to enhance public access to information through th e estab li shm ent of coherent, integrated, nat ionwidepollutant release and transfer registers (PRTR s) in accordance with theprovis ions of thi s ProtocoL wh ich cou ld facilitate public participationin env iron mental decision-mak in g as we ll as contribute to the preven-tion and reduction of pollution of the environment.

    Article 2DEFINITIONS

    For th e purposes of thi s Protocol ,I. , Party" means, unl ess the text indicates otherwise, a State ora regiona l economic integrat ion organi za tion referred to in article 24which ha s consent ed to be bo und by thi s Protocol and for which th eProtocol is in force;2. ,Conve ntion" mea ns th e Conve nti on on Access to Information,Publ ic Partic ipati on in Dec ision-making and Access to Justice in Envi ronmenta l Matters, don e at Aa rhus, Denm ark, on 25 June 1998;3. , The publi c" means one o r more natural or legal persons, and ,in acco rdance with national legislation or practi ce, their associa tions,orga ni zations or group s;4. ,Faci li ty" means one or more install ations on the same s ite, o ron adjoining sites, that are owned or operated by the same natural orlega l person;5. ,Comp etent au th ority'' means the national au thority or auth ori ties, or any o th er competent body or bodies, designated by a Party tomanage a national pollutant release and transfer registe r system;6. , Pollutant " means a sub stance or a group of substances th atmay be harmful to the environment or to hum an hea lth on account of itsproperties and of its introdu cti on into th e environment ;7. , Re lease" means any introduction of pollutants into the envi-ronment as a resu lt of any human activity, whether deliberate or acc i-dental, routine or non-routine, including spilling, emi tt ing, di schargi ng,injecting, di spos in g or clumping, or through sewer systems without 11-na l waste-water treatment ;8. , Off-site transfer" means the movement beyond th e boundaries of th e fac ility of eith er po llutants or waste dest ined for di sposa lor recovery and of pollutan ts in waste wa ter destined for waste-watertreatment ;9. . Di ffuse sources" means th e many smaller or scattered sour-ces tlom whi ch po llu ta nt s may be released to land , ai r or water, whosecombined impact on those medi a ma y be signifi cant and for whi ch it isimpractica l to co ll ect reports fiom each individual sou rce;I0. The term s ,.nati onal" and , nationwide" shall , with respect tothe obli gations under the Pro tocol on Parti es th at are regional economicintegrati on orga ni zations, be construed as apply ing to the regi on in question unl ess otherwi se indica ted;II . , Waste" means sub stances or objects which are:(a) Di sposed of or recovered;(b) Intend ed to be di sposed of or recovered; or(c) Required by the provisions of national law to be di sposed ofor recovered;12 . , Hazardous waste'' means waste that is dcllned as hazardousby th e provisions of nationa l law;

    13. ,O ther wa ste" means waste th at is not ha zardous waste;14. , Waste wa ter'' means us ed water containing substances or objects th at is subject to regul ation by nationa l law.

    Article 3GENERAL PROVISIONS

    I. Eac h Party sha ll take the necessary legis lat ive , regulatory andother measures, and appropriate enforcement measures, to implementth e provisions of thi s Protoco l.2. The provis ions of thi s Protocol shall not affect th e ri ght of a Partyto maintain or introduce a more extensive or more publicly access iblepollutant re lease and transfer register th an required by thi s Protocol.3. Each Party shall take the necessary measures to require thatempl oyees of a faci I ty and members of the pub! ic wh o report a violation by a fac ility of national laws implementing this Protocol to publicauth orities are not pena lize d, persecuted or harassed by th at fac ility orpublic authorities for th eir ac tions in reporting th e violation.4. In th e implementati on of thi s Protocol, each Party shall be gu-id ed by the precautionary approach as set forth in principle 15 of th e1992 Ri o Declaration on Environment and Development.5. To reduce duplicati ve reporting, pollutant release and transferregister systems ma y be integrated to th e degree prac ticable with existing in formation sources such as reporting mechanisms under licencesor operatin g permits.6. Parties shall strive to ac hi eve convergence among national pollutant release and transfer registers.

    Article 4CORE ELEMENTS OF A POLLUTANT RELEASE AND

    TRANSFER REGISTER SYSTEMIn accordance with this Protocol , each Party shall establish andma int ain a publicly accessible nati onal pollutant rel ease and transferregister th at :(a) Is facility-specific with respect to reporting on point sources;(b) Accommodates reporting on diffuse sources;(c) Is pollutant-spec ific or waste-spec ific, as appropriate;(d) Is multimedia, di stin guishing among releases to air, land andwa ter;(e) In clud es inform ation on transfers;(f) Is based on mand atory reporting on a periodic basis;(g) Includes sta nd ardi zed and tim ely data, a limited number ofstand ardi zed reporting thresholds and lim ited provisions, if any, lorconfidentiality;(h) Is coherent and designed to be user-friendly and publicly access ibl e, including in electronic form ;(i) Allows for public participation in its development and moditlcat ion; and( j) Is a structured, computerized database or several linked databa ses maintai ned by the competent auth ority.

    Article 5DESIGN AND STRUCTURE

    I. Each Party shall ensure that th e data held on the register referred to in article 4 are presented in both aggregated and non-aggregatedt'orm s, so that releases and transfers can be searched and id entified according to:(a) Faci lity and its geographical locati on;(b) Ac ti vity;(c) Owner or operator, and, as appropriate, company;(d) Pollutant or waste, as appropriate;(e) Ea ch of the environmental medi a into which the pollutant isreleased; and(f) As specifi ed in article 7, paragraph 5, th e destination of th etransfer and , where appropriate, the di sposal or recove ry operation forwaste.2. Each Party shall also ensure th at th e data can be searched andidentified according to those diffuse sources which have been includedin the registe r.

    sibility or its future expansion and ensuring that the reporting data fromat least the ten pre vious reporting yea rs are publicly accessible_

    4_ The register shall be designed lor maximum ease of public access through electronic means, such as the Internet. The design shall allow that, under normal operating conditions, the infom1ation on the register is continuously and immediately available through electronic means.

    5_ Each Party shou ld provide links in its register to its relevalllexisting, publicly accessible databases on subject matters related to env ironmental protection_6_ Each Party shall provide links in its register to the pollutant release and transfer registers o f other Parties to the Protocol and, wherefeasible, to those or other countries_

    Article 6SCOPE OF TH E REGISTER

    l_ Eac h Party shall ensure that its register includes the information on:

    (a) Releases of pollutants required to be reponed under article 7_paragraph 2:

    (b) O f l ~ s i t e transfers required to be reported under article 7_ paragraph 2: and

    (c) Releases of pollutants from diffuse sources required under article 7, paragraph 4_2_ Having assessed the experience gained from the developmentof national pollutant release and transfer registers and the implementation of this Protocol, and taking into accoulll rele1 an t internationalprocesses, the Meeting of the Parties shall revie11 the reporting requircments under thi s Protocol and shall consider the following issues in itsfurther development:

    (a) Revision of the activities specified in annex 1:(b) Revision or the pollutants speci1ied in annex II:(c) Revision of the thresholds in annexes I and II: and(d) Inclusion of other relevant aspects such as information on on

    site transfers. storage , the specification of reporting requirements fordifCu se sou rce s or the development of criteria for including pollutantsunder this Protocol.

    Article 7REPORTING REQU IREMENTSI_ Each Party shall either:(a) Require the owner or the opcrator of each individual facility

    within its jurisdiction that undertakes one or more of the activities specified in annex I above thc applicable capacity threshold specified inannex I, co lumn I, and:

    (i) Releases any pollutant specified in annex II in quantities exceeding the applicable thresholds spccilied in anncx II. column I:

    (ii) Transfers ofT-site any pollutant specif ied in annex II in quantities exceeding the applicable threshold specified in annex II . column2, where the Party has op ted for pollutant-specific reponing oftransrerspursuant to paragraph 5 (d):

    (iii) Transfers ofT-site hazardous waste exceeding 2 tons per yearor other waste exceeding 2,000 tons per year, whe re the Party has optedfor waste -specific reporting of transfers pursuant to paragraph 5 (d); or

    (iv) Tran sfers o l l ~ s i t e any pollutant spec ified in annex II in waste water destined for waste-water treatment in quantities cxceeding theapplicable thrcshold specified in annex I L column l b:

    to undertake the obi igation imposed on that owner or operatorpursuant to paragraph 2: or

    (b) Require the Ol \ ncr or the operator of each individual facilitywithin its jurisdiction that undertakes one or more of the activities speci tied in anne_ I at or above the employee threshold speci tied in annexI, column 2, and manufactures , processes or uses any pollutant specified in annex II in quantities exceeding the applicablc threshold specified in annex IL column 3, to undertake the obligation imposed on thatowner or operator pursuant to paragraph 2_

    2_ Each Party sha ll require the owner or operator of a facil ity referred to in paragraph I to submit the information specified in paragraphs

    5 and 6, and in accmdance with the requirements therein, with respectto those po llutants and wastes for which thresholds were exceeded.

    3. In order to achieve the objective of this ProtocoL a Party maydecide with respect to a particular po llutant to appl y e ither a releasethreshold or a manufacture_ proces s o r use threshold, provided that thi sincreases the relevalll information on releases or transfers available inits register.

    4_ Each Part y shall ensurc that its competent author ity collects, orshall designate one or more public autho rities or competent bodies tocollect. the information on releases of pollutants Crom diffuse sourcesspec i tied in paragraphs 7 and 8_ for inc lusion in its register.

    5_ Each Party sha ll require the owners or operators of the facilitiesrequired to report under paragraph 2 to co mplete and submit to its competellt authority. the lollowing info1mation on a lacility-spcc itic basis:

    (a) The name. street address. geographical location and the ac ti vity or activities of th e reporting racility, and the name of the owne r oroperator. and. as appropriate, company:

    (b) The name and numerical identifier of each pollutant requiredto be reported pursuant to paragraph 2;

    (c ) The amount of each pollutam required to be reported pursuantto paragraph 2 released liom the facility to the environment in the reponing year. both in aggregate and according to whether the release isto air. to 11atcr or to land, including by underground injection:

    (d) Either:( i) The amount of eac h pollutant required to be reported pursuantto paragraph 2 that is transferred off-site in the reporting year, distingu

    ishing bet11een the amounts transferred ror disposal and lor recovery,and the name and address of the facility receivi ng the transfer; or

    (ii) The amount of waste requi1ed to be reported pursuant to paragraph 2 transferred o t T ~ s i t e in the reporting year, disti nguishing between ha zardous waste and ot her waste, for any operations of recoveryor disposaL indicating respecti vely with 'R or 'D ' whether the wasteis destined for recovery or disposal pursuant to annex Ill and, tor transboundary movements or hazardous waste, the name and address of therecoverer or disposer or the waste and the actua l recovery or disposalsite recei1ing the transfer:

    (e) Th e amount of each pollutant in was te water required to bereported pursuant to paragraph 2 transferred off-site in the report ingyear: and

    (f ) The type of methodology used Il l dc:rive the informat ion referred to in subparagraphs (c) to (e), according to article 9, paragraph 2,indicating whether the inlormation is based on measurement, calculation or estimation_

    6. The information referred to in paragraph 5 (c) to (e) shall include information on releases and transfers resulting ti-om routine activities and from extraordinary evems_

    7. Each Party shall present on its register, in an adeq uat e spa tialdisaggregation. the information on releases of pollutants from diffuseso urces for which that Parry determines that data are being collectedby the rel c1 ant authorities and can be practicably inc luded. Where theParty determines that no such data e.xist, it shall take measures to initiate reporting on releases of relevant pollutants fi-om one or more diffusesou rces in accordance with its national priorities_

    8_ The info rmation referred to in paragraph 7 shall include information on the type of methodology used to derive the informat ion .

    Article 8REPORTING CYCLE

    I_ Each Party shall ensure that the inlormation required to be incorporated in its register is publicl y available, compiled and pre se nted on the register by calendar year. Th e reportin g year is the calendaryear to which that information relates_ For each Party, the first repo rting year is the calendar year after the Protocol enters into force for thatParty. The reporting required under article 7 shall be annua L However,the second reporting year may be the second ca lendar year followingthe first reporting year.

    2_ Each Party that is not a regional economic integration organization shall ensure that the information is incorporated into its reg isterwithin tificen months from the end of each reporting year. However,

    3. Each Party that is a reg ional economic integration organi zationsha ll ensure th at the information for a parti cular reporting year is incorporated into its register six months after the Parti es th at are not regionaleconomi c integration organi zations are required to do so.

    Article 9DATA CO LLECTION AND RECORD-K EEPING

    I. Each Party shall require th e owners or operators of the facilities su bject to th e reporting requirements of arti cle 7 to co llect th edata needed to determine, in accordance with paragraph 2 below andwith appropriate fiequency, the faci li ty's releases and off-site transferssubj ect to reporting under article 7 and to keep ava ilable for the com-petent auth ori ties the records o f the data from which the reported information was derived for a pe riod of fiv e years, starting from the endof the report ing year conc ern ed. These reco rd s sha ll also describe themethodology used for data ga th ering.2. Each Party sha ll require the owners or operators of th e faciliti essubj ect to reporting under art icle 7 to use th e best available information, which may include monitoring data, emi ssion factors, mass balance equations , indirect monitorin g or other ca lculat ions, eng ineer ingjudgments and oth er methods. Wh ere appropriate, thi s should be clonein accordance w ith internat ionally approved methodologies.

    Ar ticle 10QUALITY ASSESSMENT

    I. Each Pa rty sha ll req uire the owners or operators of the fac ilitiessu bject to the reportin g requirements of art icle 7, paragraph I, to ass urethe qua lity of th e information that they report.2. Each Party shal l ens ure that th e data contained in its reg ister aresubject to qua lity assessment by the co mpetent author ity, in parti cul aras to th eir completeness, consistency and credibility, taking into account any guidelines that may be deve loped by the Meet ing of the Parties.

    Article IIPUBLI C ACCESS TO INFORMATION

    I . Each Party sha ll ensure public access to informati on contai nedin its pollutant release and transfer reg ister. without an interest havingto be stated, and accord ing to the provisions of this Protocol , primaril yby ensuring th at its register pro vid es for direct electroni c access through pub lic tel eco mmunications networks.2. Where th e inform ation contained in its register is not eas ilypublic ly accessible by direct electronic means, each Party sha ll ensurethat its competent authori ty upon request provides th at information byany other effective means. as soon as possible and at the latest withinone month after the request has been submitted.3. Subject to paragraph 4, each Party shall ensure th at access toinformat ion contained in its register is free of charge.4. Ea ch Party may a llow its competent authority to make a chargelo r reproducing and mailing the spec ific information refe rred to in paragraph 2, but such charge s hall not exceed a reasonab le a mount.5. Where the inform ation conta ined in its reg ister is not eas ily publi cly accessible by direct electronic means, each Party shall faci litate electronic access to its reg ister in publicly accessible loca tions , forexample in public libraries, offi ces of local authorities or oth er appropriate places.

    Article 12CONFIDENTIALITY

    I. Each Party may authori ze the competent aut hority to keep inform ation held on the register confidenti al where pu blic di sc losure ofthat in formati on would adversely affect:(a) ln temational re lations, national defence or public sec urity;(b) The course of ju stice, the abi li ty of a person to rece ive a fa irtri al or the abi lity of a public authority to conduct an en quiry of a cr iminal or disciplinary nature;

    (c) The confidenti ality of commercial and industri al inform ation,where such confiden tiality is protected by law in order to protect a leg itimate economic interest;(d) Inte llectual property right s; or(e) The confidentiality of personal data and/or Ii les relat ing to anatural person if th at person has not consented to th e di sclosure of theinformation to the public, where such confidentiality is provided lor innational law.The aforementioned grounds for confidentiality sha ll be interp re

    ted in a restrictive way, taking into account the public interest servedby disc losu re and whether th e in formation relates to releases into theenvironment.2. Within the framewo rk of paragraph I (c), any inform a tion onreleases whi ch is re leva nt for th e protecti on of the environment sha ll beconsid ered for disclosure according to nat ional law.3. Wh enever in fo rmation is kept confidential according to paragraph I, the regi ster sha ll indicate what type of info rmati on has beenwi thhe ld , through, for exa mple, providing generic chemical in formation if possible, and for what reaso n it has been wi thheld.

    Article 13PUBLIC PARTICIPATION IN TH E DEVELOPMENT

    OF NAT IONAL POLLUTANT RELEASE AND TRANSFERREGISTERS

    I. Eac h Party sha ll ensu re appropriate op portuni ties to r publicparticipa tion in th e deve lopm ent of its national pollutant release andtransfer reg ister, within the fram ework of its national law.2. Fo r the purpose of paragraph I, each Party shall provide the opportunity fo r free pu blic access to th e information on th e proposed measures concerning th e deve lopment of its nationa l pollutant re lease andtransfer regi ster and for the submiss ion of any com ments, inform at ion,anal yses or opinions that are rel eva nt to th e dec ision-making process.and the re leva nt authority sha ll take clue account of such public input.3. Each Party shall ensure that , when a deci sion to establi sh orsignificantl y change its register has been taken, info rm ation on the decision and the cons id erations on which it is based arc made publiclyava ilable in a timely manner.Artic le 14

    ACCESS TO JUSTICEI. Each Party sha ll , wi thin the fram ewo rk of its nat ional legislation, ensure that any person who considers that hi s or her request forinformation under art icle II , paragraph 2, ha s been ignored, wrongfull yrefused, whether in part or in full , in adeq uately answered, or otherwisenot dea lt with in accordance with th e provi sions of th at paragrap h hasaccess to a review procedure befo re a court of law or ano ther independent and impartial body establ ished by law.2.     Ar ticle 15CAPACITY-BU ILDI NG

    I. Each Party sha ll promote public awa reness of its pollutant release and transfer reg ister, and sha ll ensure that ass istance and guidanceare provided in access ing its reg ister and in understanding and us ingth e inform ation conta ined in it.2. Each Party shou ld provide adequate capacity-building for andguidan ce to th e re sponsi bl e authorities and bod ies to ass ist them in carry ing out their duties under this Protocol.

    Article 16INTERNAT IONA L COOPERATION

Thereafter. ordinary sess ions of the Meeting or the Parties shall be held sequen tially with or parallel to ordinary meetings ofthe Parties to the Conventi on, unless other\\'ise decided by the Partiesto thi s Protocol. The Meeting of the Parties shall hold an extraordinarysession if it so decides in the course or an ordinary session or at thewritten request of any Party provided that. \\ithin six months of it beingcommunicated by the Executi\'e Secretary ol the Economic Comm is-

    sion for Europe to all Pmiies. the said request is supported by at leastone third or these Parties.2. The Uni ted Nations. its specia lized agencies and the International Atomic Energy Agency. as well as any State or regional economicintegration organization entitled under article 24 to sign this Protocolbut which is not a Party to it. and any illlcrgovernmental orga ni zationqualified in the fields to whi ch the Protocol relates. shall be entit led toparticipate as observers in the sessions of the Meetint.! of t h ~ Parties.Their admission and participation sha ll be subject to t h ~ rules of procedure adopted by the Meeting of the Parties.5. Any non-gcncrnmental organization qualilicd in the fields towhich thi s Protocol relates which has informed the Execu ti ve Secretary

    at a session of the Meeting of the Parties sha ll be enti tl ed to participateas an observer unless one third of the Parties present at th e sess ion raiseobjections. Their admission and participation shall be subject to the rules of procedure adopted by the Meeting of the Parties.Ar ticle 18

    RIGHT TO VOTEI. Except as pro\ided for in paragraph 2. each Party to this Protocol shall have one \'Otc.2. Regional economic integration organi zations. in matters within their competence. sha ll exercise their right to vote with a number

    of votes equal to the number of their member States which are Parties.Such organi zat ion s shall not exercise their right to vote if their memberStates exercise theirs. and \'ic e versa.Article 19

    A:\NEXESAnnexes to this Protocol shall form an integral part th ereof and.unless expressly provided otherwise. a reference to this Protocol constitutes at the same time a reference to any annexes thereto.

    Article 20AMEN DMENTS

    I. Any Party may propose amendments to this Protocol.2. Proposals for amendments to this Pmtocol shall be consideredat a session or the Meeting of the Parties.3. Any proposed amendment to this Protocol shal l be submittedin writing to the secretariat. which shal l communicate it at least sixmomhs before the session at \lhich it is proposed tor adoption to allParties. to other States and regional econom ic integration organizat ionsthat have consented to be bound by the Protocol and for wh ich it hasnot yet entered into force and to Signatories.4. The Parties shall make every effort to reach agreement on anyproposed amendment to this Protocol by consensus. If all eflorts at consensus have been exhausted. and no agreement reached, the amendmelll shall as a last resort be adopted by a three-fourths majority vote ofthe Parties present and voti ng at the session.

    5. For the purposes of this article, .,Pa rti es present and voting"means Panics present and casting an affirmative or nega ti ve vote.6. Any amendment to this Protocol adopted in acco rdance with paragraph 4 shall be commun icated by the secretariat to the Depositary,who shall circu late it to all Pmiies, to other States and regional economi cintegration organi zations that have consented to be bound by the Protocoland for which it has not ye t entered into Ioree and to Signatories .7. An amendment, other than one to an annex, shall enter into forcefor those Parties having rati lied. accepted or approved it on the ninetiethday after the date of receipt by the Depositary of the instruments of rati-fication. acceptance or approval by at least three fourths of those whichwere Parties at the time of its adopti on. Thereafter it shall enter into torce for any other Party on the ninetieth day after that Party deposits itsinstrumem of ratification, acceptance or approval of the amendment.8. In the case of an amendment to an an ne x, a Party that does

    not accept such an amendment sha ll so notify the Depos itary in writingwithin twelve months from the date of its circulation by th e Depositary.The Depositary shall without delay inform all Parties of any such notification received. A Party may at any time withdraw a notification ofnon-acceptance. whereupon the amendment to an ann ex shall enter intoforce for that Party9. On the expiry of twel\'e months from the date of its circulationby the Depositary as provided lor in paragraph 6, an amendment to anannex sha ll enter into force for those Parties which ha ve not submitteda notification to the Depositary in accordanc e with paragraph 8, provided that. at that time. not more than one third of those which wereParties at the time of the adoption of the amendment have subm ittedsuch a noti rication.I0. If an amendment to an annex is directly related to an amendment to this Protocol. it shal l not enter into force until such tim e as the

    tion recei ved in accordance with the provisions of this Protocol ;(c) Th e reportin g to the Meeting of the Parties on the ac tivities of

    the sec retariat; a nd(d) Such ot her functi ons as may be dete rmined by the Meeting of

    the Parties o n the basis of ava ilable resources.Article 22

    REVIEW OF COMPLIANCEAt its first sess ion , the Meeting of the Parties shall by consensus

    es tablish cooperati ve procedures and institutional arrangements of anon-judici al, non-adversarial and consultative nature to assess and promote compliance with the provisions of this Protoco l and to addresscases of non-compliance . In es tablishing these procedures and arrangements, the Meeting of the Parties sha ll con sider, inter a lia. whetherto allow for info rmation to be rece ived from members of the public onmatters related to this Protoco l.

    Article 23SETTLEMENT OF DISPUTES

    I. If a dispute ari ses between two or more Parties about the interpre tation or applica ti on of thi s Protocol , the y shall seek a so luti on bynego tiation or by any other peace ful means of disput e se ttlement acceptable to the parties to the di sput e.

    2. Wh en signing, ratify ing, accepting, approving or acceding tothi s Protoco l, o r at any tim e thereafter, a State ma y declare in writingto the Depos itary that, to r a dispute not reso lved in accordance withparagraph I, it accepts one or both of the following means o f di sputesettlement as compulso ry in relation to any Party accepting the sa meobligation :

    (a) Submission of th e di spute to the International Court of Ju stice;(b) Arbitration in accordance with the procedure set out in ann ex IV.A reg iona l eco nomi c integration organiza tion may make a dec la-

    ration with like effect in relation to arbitration in accordance with theprocedures referred to in subparag raph (b).

    3. If the parties to the di spute have accepted bot h mea ns of di spute settlement referred to in paragraph 2, the di spute may be submittedonl y to the Inte rn at ional Co urt o f Justice , unless the parties to the dispute agree ot herwise .

    Article 24SIGNATURE

    This Protoc o l sha ll be open for signature at Kiev (Ukraine) from2 1 to 23 May 2003 on th e occasion ofthe fifth Min is terial Co nference"Environment for Europe," and thereafter at United Nations Headquarters in New York until 3 1 December 2003 , by a ll States which aremembers of the United Nations and by regional eco nomic integrationorganiza tions constituted by sovereign States members of the Unit edNations to which their member States have transferred competenceover matters governed by thi s Protocol, including the competence toenter into trea ti es in respect of these matters.

    Article 25DEPOSITARY

    Th e Secretary-Genera l of the Un ited Nations shall act as the Depositary o f thi s Protoco l.

    Article 26RATIFICATION, ACCEPTANCE, APPROVAL AND

    ACCESSIONI. Thi s Protocol sha ll be subj ec t to ratification , acceptance or ap

    pro va l by signatory States and regional economic integra tion orga ni zation s referred to in article 24.

    2. This Protocol sha ll be open for accession as from I January2004 by the States and reg ional economic integration orga ni za tions referred to in article 24.

    3. Any reg ion al eco nomic integ ration organization re ferred to inartic le 24 which becomes a Party without any of its member States being a Party shall be bound by all the ob liga tions under thi s Protocol. Ifon e or more member States of such an orga ni zation is a Party, the organi za tion and its member States shall dec ide on their res pective responsibilities for the performance of their obligations under thi s Protoco l. Insuch cases, the organization and the memb er States sha ll not be entitledto exercise ri ghts und er thi s Protocol concurrently.

    4. In their instruments of ratification , acceptance, approva l or ac cess ion , the regional economic integration organizations re fe rred to inartic le 24 sha ll declare the ex tent of the ir competence with respect tothe matters governed by thi s Protocol. These organi zations shall alsoin form the Depositary o f any substantia l modifications to the ex tent oftheir co mpetence.

    Article 27ENTRY INTO FORCE

    I. Thi s Protocol sha ll enter into force on the nin et ieth day afte rthe date o f deposit o f the s ixteenth in strument of ratifi ca tion, acceptance, approva l or access ion.

    2. For the purposes of paragraph I, any in strument deposited bya reg ional economic integ ration organi zation sha ll not be co unted asaddit ional to those depo sited by the States members o f such an organi za tion.

    3. For each State or regional eco nomic integrat ion orga ni za ti onwhich ratifies, accepts or approves thi s Protocol or accedes there to afterthe depos it of the sixtee nth instrument of ratification . acceptance, ap pro va l or accession , the Protocol sha ll enter into force on the nin et ie thda y after the date of deposit by such State or organ iza tion of' its in strument of ratification , acce ptance, approval or accession.

    Article 21lRESERVATIONS

    No rese rvations may be made to thi s Protocol.Article 29

    WITHDRAWALAt any time after three years from the date on which this Protoco l

    has come into force with respect to a Party, that Party may withdrawfrom the Protocol by g iving written noli fic ation to th e Depos itary. Anysuch withdrawal shall take effect on the ninetieth clay afier the date o fits rece ipt by the Depo sitary.

    Article 30AUTHENTIC TEXTS

    Th e origi nal of thi s Protocol , of which the English, French an dRus sian texts are equ a lly authentic, sha ll be deposited with the Secretary-G eneral of the United Na tions.
