SECTION 1: DEFINITIONS

ACTIVE ACCOUNT - A Customer who is currently receiving telephone service, or one whose service has been temporarily disco1U1ected (vacation, nonpayment> storm damage, etc.).

ADDITIONAL LISTING - Any listing of a name or other authorized infonnation in connection with a Customer's telephone number in addition to that to which he is entitled in connection with his regular service.

ANCILLARY SERVICE OR EQUIPMENT -Any communication service or equipment not included in the definitions of transmission service, terminal equipment or inside station wiring.

AREA CODE - The first three digits (NXX) of a ten-digit telephone nwnber in the form NXX­NXX-XXXX, where N represents any one of the numbers 2 through 9 and X represents any one of the numbers O through 9.

AUTHORIZED USER- A person, firm or corporation (other than the Customer) on whose premises a telephone, private branch exchange> or private line service or cha1U1el is located and who may communicate over such channels in accordance with the terms of the Tariff.

BUILDING- The term "Building" is a structure occupied by a Customer or authorized user. Multi occupant structures will be considered different buildings when space of one Customer or authorized user is separated by space occupied by others.

BUSINESS SERVICE- Central Office Access Line service furnished to Customers where the actual or obvious use is of a business, professional or occupational nature.

CALLS - Telephone messages attempted by Customers or users.

CENTRAL OFFICE-A unit in a telephone system which provides service to the general public, having the necessary equipment and operating arrangements for terminating and interco1U1ecting Customer lines and trunks or trunks only. There may be more than one central office in a building.

CENTRAL OFFICE ACCESS LINE-A circuit extending from the central office equipment up to and including the demarcation point.

CENTRAL OFFICE ACCESS LINE CHARGE - For work associated with the telephone line, extending from central office equipment up to and including, the demarcation point located at the Customers' premises.

CHANNEL - An electrical path suitable for the transmission of communications.

CHARGES - Nonrecurring amounts billed to Customers for regulated services and equipment.

CHECK OF SERVICE or SERVICE CHECK-An examination, test or other method utilized to determine the condition of Customer provided terminal equipment and inside station wiring.

CIRCUIT - A channel used for the transmission of electrical energy in the furnishing of telephone and other communication services.

CLASS OF SERVICE - The various categories of service generally available to the Customer, such as business, residential, pay telephone service and resale or shared services.

COMMUNICATIONS SYSTEM -Channels and other facilities that are capable, when not connected to exchange telecommunications service, of two way communications between Customer provided terminal equipment or Telephone Company stations.

CONNECTING COMPANY - A corporation, association, partnership or individual owning or operating one or more exchanges and with which communications services are interchanged.

COMMISSION - The Nebraska Public Service Conunission.

CONSTRUCTION CHARGE - A separate recurring and/or nonrecurring charge made for the construction of facilities in excess of those contemplated under the rates quoted in the exchange tariffs.

CONTIGUOUS PROPERTY -Two or more parcels of property, occupied by the Customer, in which the boundary line of one property touches the boundary line of the other(s).

CONTRACT - The agreement between a Customer and the Telephone Company under which service and facilities are furnished in accordance with the applicable provisions of the Tariff.

COST - The cost of labor and materials, which includes appropriate amounts to cover the Telephone Company's general operating and administrative expenses.

LOCAL EXCHANGE SERVICE

CUSTOMER - The individual, carrier, reseller, partnership, association, corporation or government agency which contracts for telephone service, or relays messages to or from points outside the extended area, and is responsible for the payment of charges and compliance with the rnlcs and regulations of the Telephone Company.

CUSTOMER PREMISES EQUIPMENT ("CPE")-Terminal equipment located on the Customer's premise owned by the Customer or owned by the telephone utility or some other supplier and leased to the Customer.

DELINQUENT OR DELINQUENCY - An account for which a bill or payment agreement for regulated services or equipment has not been paid in full on or before the last day for timely payment.

DEMARCATION POINT - The point of connection provided and maintained by the telephone utility to which the telephone utility owned existing inside station wiring or Customer provided new inside station wiring becomes dedicated to an individual building or facility. For an individual Customer dwelling, this point of connection will generally be immediately adjacent to, or within twelve inches of, the protector or the Customer's side of the protector. The drop and block, including the protector, will continue to be provided by and remain the property of the telephone utility. In the instance where a physical protector does not exist at the point of cable entrance into the building or facility, the demarcation point is defined as the entrance point of the cable into the building or facility.

DIRECTORY LISTING -A publication in the Telephone Company's alphabetical directory of information relative to a Customer's name or other identification and telephone number.

DISCONNECT - The disabling of circuitry preventing both outgoing and incoming communications.

DISCONNECT NOTICE- The written notice sent to a Customer following billing, notifying that service will be discontinued if charges are not satisfied by the date specified on the notice.

DOMESTIC (CALLS OR TRAFFIC) - Calls or traffic that originate and terminate within the United States, including the several States and Territories, the District of Columbia, and the possessions of the United States, but does not include the Philippine Islands or the Canal Zone.

DROP WIRE - That portion of a circuit between the pole line or cable distributing box and the protector or equivalent.

ENTRANCE FACILITIES - Facilities extending from the point of entrance on private property to the premises on which service is furnished.

EXCHANGE - A geographical area established for the administration of local communications services in a specified area, called the "Exchange Area", which usually embraces a city, town or village, and its environs. It may contain one or more central offices together with the associated plant, equipment, and facilities used in furnishing communication service within that area.

EXCHANGE AREA - The tenitory served by an exchange.

EXCHANGE SERVICE- The furnishing of facilities for communication within an exchange area, in accordance with the regulations and charges specified in the Local Tariff.

EXTRA LISTING - See "Additional Listing."

FEATURE GROUP D - The switched access service provided by a local exchange company as trunk side switching through the use of end office or access tandem switch equipment. Where no access code is required, the number dialed by the Customer shall be a seven to ten digit number for calls in the North American Numbering Plan (NANP). For international calls outside the NANP, a seven to twelve digit number may be dialed. The form of the numbers dialed by the Customer is NXX-XXXX, 0 or l + NXX-XXXX, NPT + N XX-XXXX, 0 or 1 + NPA + NXX­XXX, and when the end office is equipped for the International Direct Distance Dialing (IDDD), OJ +CC+ NN or 011 +CC+ NN. FCC - FEDERAL COMMUNICATIONS COMMISSION

FLAT RA TE ACCESS SERVICE - Telecommunications service furnished at a fixed monthly or periodic charge.

LOCAL ACCESS TRANSPORT AREA (LATA)-A contiguous geographic area: (1) Established before Febmary 8, 1996 by a Bell operating company such that no exchange area includes points within more than one metropolitan statistical area, consolidated metropolitan statistical area, or State, except as expressly permitted under the AT&T Consent Decree; or (2) Established or modified by a Bell operating company after February 8) 1996 and approved by the FCC.

LOCAL EXCHANGE SERVICE - Telecommunications within a local service area in accordance with the provisions of the Telephone Company's tariffs.

LOCAL MESSAGE - A completed Customer or user call between stations located within the same Exchange Area or Local Service Area.

LOCAL SERVICE AREA-The area within which telephone service is furnished under a specific schedule or rates without the application of a long distance message charge.

LONG DISTANCE SERVICE - Sec "INTEREXCHANGE."

LOW INCOME CONNECTION ASSISTANCE PROGRAM - An aggregate term for the assistance programs identified as the Link Up Assistance Program and the Lifeline Assistance Program.

MESSAGE-A completed Customer or user call.

TOLL USAGE (CHARGE) - The usage-sensitive charge assessed on toll services or service components sold on a per-minute-of-use base.

MINIMUM CONTRACT PERIOD - The minimum length of time for which a Customer is obligated to pay for services and/or facilities, whether or not retained by the Customer for such minimum length of time.

NONRECURRING CHARGE-A one time charge associated with certain installations, changes or transfers of services, either in lieu of or in addition to recurring monthly charges.

OUTSIDE PLANT - The telephone facilities installed on, along, or w1der streets, alleys, highways, and private rights of way between Customer locations, central offices or the central office and Customer location.

PAY TELEPHONE SERVICE - A central office access line providing connections for pay telephone equipment.

PAY CENTRAL OFFICE LINE - A circuit extending from the central office equipment up to and including the demarcation point to provide both local and toll service.

PRESUBSCRIBE(D INTEREXCHANGE CARRIER)- When a Customer selects an interexchangc carrier and is then able to access such carrier through "1 +" dialing.

PREMISES -The space occupied by an individual Customer in a building, in adjoining buildings, or on contiguous property including property separated only by a public thoroughfare, a railroad right of way, or a natural banier.

PRIVATE BRANCH EXCHANGE TRUNKS - See "Central Office Access Line."

PROTECTOR-A utility owned electrical device located in the central office, at a Customer's premises or anywhere along any telephone facilities which is designed to protect both the Telephone Company's and the Customer's property and facilities from over voltage and over current by shunting such excessive voltages and currents to ground.

RA TES - Recurring amounts billed to Customers for regulated communications services.

RESIDENTIAL SERVICE -Telecommunication service furnished to Customers when its use is for domestic purposes.

SERVICE CHARGE-The charge a Customer is required to pay at the time of the establishment of telephone service or subsequent changes to that service.

SER VICE CHECK - See "Check of Service".

SERVICE ORDERING CHARGE- For work involved in receiving, recording and transmitting, information for establishment of telephone service or subsequent change to that service including directory listing.

TERMINATION CHARGE - A charge applied under certain conditions when a contract for service is terminated by the Customer before the expiration of the minimum contract period.

TIMELY PAYMENT - Payment on a Customer's account received on or before the due date shown: on a cmrent bill for rates and charges, or by an agreement between the Customer and the Telephone Company for a series of partial payments to settle a delinquent account.

TOLL SERVICE- See "Interexchange Service."

TOLL BLOCKING- A service that lets consumers elect not to allow the completion of outgoing toll calls from their telecommunications channel.

TRAVEL CHARGE -A charge that applies whenever a visit is required to complete the Customer's request. One charge will apply for all work requested at the same time on the same visit.

A. General

1. Undertaking of the Telephone Company

The Telephone Company's service is furnished to Customers for intrastate commwucations. The Telephone Company's service is available twenty-four hours per day, seven days per week.

The Telephone Company arranges for the installation, operation, and maintenance of the service provided in this tariff for the Customer in accordance with the terms and conditions set forth in this tariff.

B. OBLIGATION AND LIABILITY OF TELEPHONE COMPANY

1. Availability of Facilities and Equipment

The Telephone Company's obligation to furnish exchange and toll service is dependent upon its ability to secure and retain, without unreasonable expense, suitable facilities, and rights for the construction and maintenance of the necessary pole lines, circuits, and equipment

Allowance for Failure of Service

a. In the event of an interruption to the service not due to the negligence or willful act of the Customer or Customer premises equipment, a pro rata allowance on the month's charge for the period of days dming which the access line was interrupted will be made if the interruption continues for more than 24 hours from the time it is reported to or detected by the Telephone Company, upon Customer request.

b. The Customer is responsible for providing a suitable supply of commercial electrical power, including outlets, when and where required by the Telephone Company for the operation of any Telephone Company telecommunications equipment on the Customer's premises. Failw-e to supply adequate commercial electrical power or battery back-up is considered negligence of the Customer. A Customer may be billed a service dispatch charge whenever a dispatch is made to correct a service interruption caused by Customer negligence or failure on the Customer's side of the demarcation point.

c . In the event the Customer is affected by such interruption, not due to Customer negligence, for a period of less than 24 hours, no adjustment will be made. No adjustments will be earned by accumulating non­continuous periods of interruption.

d. Liability

1. In view of the possibility of errors and difficulties occurring in the transmission of messages by telephone, and the impossibility of fixing the cause thereof, the Customer asswnes all risks connected with the service except as follows:

If the initial installation is defective or if service is intetn1pted otherwise than by the negligence or willful act of the Customer, an allowance at the minimum rate for the telephone facilities and class of service at the time of the installation or intetn1ption shall be made for the time such outage continues after notice and demand to the Telephone Company unless such outage is due to the inside wiring or Customer premises equipment. No other liability shall in any case attach to the Telephone Company.

2. In the case of interruption to any interexchange service (private lines, WATS, etc.), allowance for message toll service used by the Customer during the period of interruption, will be made at the regular message toll rates.

Directory Errors and Omissions

a. The Telephone Company, except as provided herein shall not be liable for damage claimed on account of errors in or omissions from its directories nor for the result of the publication of such errors in the directory nor will the Telephone Company be a party to controversies arising between Customers or others as a result of listings published in its directories. Claims for damages on account of interruptions to service due to errors or omissions in directory lis6ngs will be limited to a pro rat.a abatement of the charge for such of the Customer's service as is affected, the maximum abatement not to exceed one half the service charges for the period from the date of issuance of the directory in which the mistake occuned to the date of issuance of a new directory containing the proper listing.

b. In the cases of extra listings in the alphabetical section of the directory for which a charge is made, the Telephone Company's liability shall be limited to an amount not to exceed the established rate for such listing during the period which the error omission continues.

Adjustment of Charges

In the adjustment of charges for overbilling by the Telephone Company, a refund will be made of the full amount of excess charges when such amount can be determined; when the period or amount for which overbilling cannot be fixed from available records, the maximum refund ,vill not exceed an estimated amount equal to such overbilling for a three-year period.

5. Transmitting Messages

a. The Telephone Company does not transmit messages but offers the use of its facilities for communications between patrons. If because of transmission difficulties the operator repeats messages, in order to accommodate the Customer, the operator is deemed to be acting as an agent of the persons involved. Therefore, no liability shall attach to the Telephone Company because of any errors made by the operator or misunderstandings that may arise between Customers because of the errors.

b. While the Telephone Company's local exchange access line service may be used by the Customer for dial-up access, the advertised speeds of the Customer's modem may not be attainable with this service and are not guaranteed by the Telephone Company.

Use of Connecting Telephone Company Lines

When suitable arrangements can be made, lines of other telephone companies may be used in establishing wire connections to points not reached by this Telephone Company's lines. In establishing connections with the lines of other Companies, the Telephone Company is not responsible or liable for any action of the Connecting Telephone Company.

7. Defacement of Premises

The Telephone Company shall exercise due care in com1ection with all work done on Customer's premises. No liability shall attach to the Telephone Company by reason of any defacement or damage to the Customer's premises resulting from the existence of the Telephone Company's facilities, on such premises, or by the installation or removal thereof, unless such defacement or damage is the result of the sole negligence of the Telephone Company.

C. USE OF SERVICE AND FACILITIES

1. Ownership and Use of Equipment or Service

a. All equipment and facilities furnished by the Telephone Company to provide transmission service on the premises of a Customer are the property of the Telephone Company. The agents and employees of the Telephone Company shall have the right to enter said premises at any reasonable hours for the purpose of installing, inspecting, maintaining or repairing the equipment, instruments and lines, or for the purpose of making collections from coin boxes or upon termination of the service, for the purpose of removing such equipment, instnunents and lines. Such equipment, instruments and lines are not to be used for performing any pru1 of the work of transmitting, delivering or collecting any message where any toll or consideration has been or is to be paid any party other than the Telephone Company, without the written consent of the Telephone Company.

b. If the installation and maintenance of transmission service are requested at locations which are or may be hazardous or dangerous to the Telephone Company's employees or to the public or to property, the Telephone Company may refuse to install and maintain such service) and) if such service is furnished, may require the Customer to install and maintain such service and may also require the Customer to indemnify and hold the Telephone Company harmless from any claims, loss) or damage by reason of the installation and maintenance of such service.

2. Attachments or Connections

The Telephone Company shall not be required to attach its equipment or facilities to facilities not owned and installed by it unless provided for elsewhere in this Tariff. In case any such unauthorized attaclunent or connection is made, the Telephone Company shall have the right to disconnect the same or to suspend the service during the continuance of such attaclunent or connection or to terminate the service.

3. Use of Customer Service

a. Customer telephone service, is furnished only for use by the Customer, his/her family, employees or business associates, or persons residing in the Customer's household, except as the use of the service may be extended to persons temporarily subleasing a Customer's residential premises.

b. Customers who subscribe to pay telephone service may resell such local exchange service to users of their Customer provided coin or noncoin pay telephone equipment. The Telephone Company is not responsible for the confidentiality of service between Customers and their users.

4. Tampering With Equipment

The Telephone Company may refuse to furnish or may deny telephone service to any person, firm or corporation on whose premises is located any telephone equipment owned by the Telephone Company which shows any evidence of tampering, manipulation, or operation, or use of any device whatsoever, for the purpose of obtaining telephone service without payment of the charges applicable to the service render

5. Unlawful Use of Transmission Service

The Telephone Company may refuse to furnish or may discontinue transmission service to any person, firm, or corporation upon:

a. Objection to the furnishing of such service made by or on behalf of any governmental authority on the grounds that such service is, or is to be, used for an illegal purpose.

b. Use with intent to terrify, intimidate, threaten, harass, annoy, or offend another telephone user.

6. Interference with Telephone Company Equipment or Transmission Service to Others

a. The Telephone Company may disconnect, without advance notice, transmission service to any person, firm, or corporation which:

1) ls used in such a manner as to interfere with the service of other telephone users.

2) Is used in such a manner as to adversely affect the Telephone Company's plant, property, or service. This includes overloading of telephone circuits resulting in preventing, obstructing, or delaying the transmission service of others.

b. Following the disconnection of service for any of these reasons, the Telephone Company will immediately notify the telephone Customer thereof:

When the general transmission service to the public is impaired by a Customer's use of exchange telephone service, the Telephone Company shall have the right to require the Customer to contract for and properly attend as many additional central office access lines as are needed to adequately serve the Customer's requirements, or to discontinue the service of the Customer in question.

ESTABLISHMENT AND FURNISHING OF SERVICE

l. Applications for Service

a. Applications for initial or additional services made verbally or in writing become a contract upon the establislunent of the service or facility.

b. Any change in rates or regulations prescribed by public authority having jw'isdiction, modifies all terms and regulations of contracts to the extent of such changes.

2. Telephone Numbers

The Customer has no property right in the telephone number nor any right to continuance of service through any particular central office, and the Telephone Company may change the telephone number of the central office designation, or both, of a Customer whenever it deems it advisable in the conduct of its business to do so.

3. Alterations

The Telephone Company will be reimbursed for the costs associated with Customer requests for relocation or rearrangement of facilities located on his premises.

4. Connections to New or Existing Inside Wiring

The Telephone Company is responsible for making all connections at the protector or providing a facility to permit Customer connection with new inside station wiring at the demarcation point. Nothing contained herein shall require or necessitate changes or modifications to telephone utility connections with existing inside station wiring.

Customer Provided Terminal Equipment

a. General

1) Customer provided terminal equipment is all terminal equipment normally used on the Customer's premises and owned by the Customer; or owned by the Telephone Company or some other supplier and leased to the Customer; including the terminal equipment located on the Customer's premises or held in inventory.

2) Customer may not repair or maintain terminal equipment owned by the Telephone Company without the Telephone Company's consent.

3) 1t is the Customer's obligation to ensure compliance with any applicable state or federal laws governing the installation and use of Customer provided terminal equipment.

b. Standards for Customer Provided Terminal Equipment

1) The Telephone Company shall allow Customers to secure the provision, repair, and maintenance of terminal equipment from any supplier provided that such equipment shall be in compliance with applicable registration standards promulgated by the Federal Communications Commission.

2) The Telephone Company will endeavor to answer any qucs6ons concerning the installation, repair, and maintenance of terminal equipment by telephone contact, personal contact, or printed material, upon request.

Maintenance and Repairs

All ordinary expense of maintenance and repair, unless otherwise specified in the Telephone Company's Tariff, is borne by the Telephone Company. In case of loss of, damage to, or destruction of any of the Telephone Company's facilities, up to the demarcation point, not due to ordinary wear and tear, the Customer is held responsible for the cost of replacing the facilities destroyed or for the cost of restoring the facilities to their original condition, except where such damage is not occasioned by the negligence of the Customer. Customers may not rearrange, disconnect, or remove or permit others to rearrange, disconnect, or remove any facilities, up to the demarcation point, installed by the Telephone Company, except upon the consent of the Telephone Company.

7. Unusual Installation Costs

Where special conditions or special requirements of the Customer involve unusual construction or installation costs, the Customer may be required to pay a reasonable proportion of such costs.

8. Furnishing of Announcement, Answering, and Recording Services

a. Use of Telephone Company facilities or service in connection with automatic announcement service, automatic answering and recording service, recorder coupler service, or miscellaneous devices for recorded public announcements are subject to the following conditions.

1) For purposes of identification, Customers to transmission service who transmit recorded public announcements over facilities provided by the Telephone Company shall include in the recorded message the name of the organization or individual responsible for the service and the address at which the service is provided.

2) Customers transmitting factual public announcements, such as time, stock market quotations, airline schedules, and similar information are excluded from the preceding condition.

3) Nonpublished telephone service will not be furnished for use with recorded public announcements.

4) Failure to comply with the provisions of this Tariff shall be cause for termination of the service.

9. Use of Connecting Telephone Company Lines

When suitable anangcments can be made, lines or other telephone companies may be used in establishing wire connections to points not reached by this Telephone Company's lines. In establishing connections with the lines of other companies, the Telephone Company is not responsible or liable for any action of the Connecting Telephone Company. Connection of the Telephone Company's lines to the lines of another telephone company shall be the sole discretion of the Telephone Company.

E. APPLICATION OF BUSINESS AND RESIDENTIAL RATES

Circumstances in Which Business Rates Apply

a. When the service is furnished at a location where a business, trade or practice is performed and where use of the location is not confined primarily to domestic activities. Service for social clubs (for example, Elks, VFW, Eagles, etc.) will be considered business service.

b. When the directory listing is to be a business listing.

c. When the service is provided to or through a reseller of local exchange service.

Circumstances in Which Residential Rates Apply

a. When the service is furnished at a location used primarily for domestic purposes; a residence location typically contains cooking and sleeping facilities.

b. Residence service will be allowed for individual rooms at group homes (for example, fraternities, sororities, patient rooms at retirement homes, boarding houses, when service to the rooms is not provided tlrrough a reseller oflocal exchange service, if the listing is in an individual's name).

c. Residence service will be allowed in church living quarters and the clergy person's private study if the listing is in an individual's name.

F. ESTABLISHMENT AND MAINTENANCE OF CREDIT

1. Positive Identification

The Telephone Company requires positive identification of the applicant to be included in the application for service. Positive identification can be accomplished either through the verification of the applicant's Social Secmity number or through the completion and notarization of a Positive Identification Form. The applicant's positive identification information will be held strictly confidential and will not be used by the Telephone Company for any other purposes other than for establislunent of service.

Establishment of Credit

The Telephone Company is not obligated to furnish service to any individual or firm that owes (see Refusal or Disconnection of Service) for service previously rendered at the same or a different address, until a1Tangements have been made to pay off the amount owed to the Telephone Company. The Telephone Company will consider employment status and other information pertaining to credit worthiness. Any applicant who has not previously had telephone service or established a payment record may be required to establish and maintain credit in one of the following ways:

a. By furnishing references acceptable to the Telephone Company;

b. By providing a suitable guarantee in writing, in form prescribed by the Telephone Company; or

c. By means of an advance payment or cash deposit.

a. Customers, who are tu1able to satisfy or unwilling to provide information to establish credit W011hiness or who have an unsatisfactory credit rating may be required to make an Advance Payment. The Advance Payment will be equal to the applicable installation charge and one month of recurring charges, excluding taxes and surcharges. The Advance Payment will appear as a credit and be applied to the first month bill. The Telephone Company reserves the right to refuse·service if the Customer fails to fulfill standard requirements. After service has been established, the Customer will be responsible for the payment of all applicable charges to avoid discontinuance of service.

b. For Customers required to make an advance payment, the Telephone Company may require proof of positive identification. Failure to provide acceptable forms of identification may result in denial of telephone service. The Telephone Company will provide a notification and information letter to those Customers required to make an advance payment. The notification letter shall contain the reason for the advance payment and/or the credit bureau used to obtain a copy of the credit report.

4. Deposits

The Telephone Company may require from any existing or new Customer, unless the Customer has not had service disconnected for nonpayment within the last twelve months, a deposit intended to guarantee payment of bills for service, after explaining in writing why a deposit is required, if any of the following conditions exist:

a. The Customer's past payment record to a telecommunications company shows delinquent payment practice {that is, Customer has had two consecutive 30-day arrearages, or more than two non-consecutive 30-day arrearages in the past 24 months, or Customer has been sent four or more late payment notices in the past nine months.

b. A new Customer cannot furnish either a letter of good credit from a reliable source or an acceptable co-signer or guarantor on the same system within the State of Nebraska to guarantee payment.

c. A Customer has no deposit and presently is delinquent in payments (that is, has had two consecutive 30-day arrears, or more than two non­consecutive 30-day arrears in the past 24 months).

d. A Customer has had his service terminated by any telecommunications company for non-payment or fraudulent use. The Telephone Company shall issue a receipt of deposit to each Customer from whom a deposit is received, and shall provide means whereby a Customer may establish his claim if this receipt is lost.

e . Deposits shall be retmned, with accrued interest, after 12 consecutive months of prompt payment. The interest shall be accrued annually and the rate of interest paid by the Telephone Company on any security deposit received from a Customer shall be at a simple rate of 7%. The deposit shall cease to draw interest on the date it is returned, on the date that service is terminated, or on the date that notice is sent to the Customer's last known address that the deposit is no longer required.

f. Deposits shall be refunded completely with interest unless the Customer has had two consecutive 30-day arrearagcs or more than two non­consecutive 30-day arrearages in the past 24 months, or has had service denied or interrupted for non-payment of bills, or has been sent more than fom late payment notices in the past nine months, or has a retmned check in the past six months. Upon termination of service, the deposit with accrued interest shall be credited to the final bill and the balance shall be retmned within 45 days to the Customer.

g. A maximum deposit may be required up to an amount equal to an estimated two months total bill (including toll and tmces) for a new Customer. For an existing Customer, a maximum deposit may be required up to an amount equal to the total actual bills of the highest consecutive months within the preceding six months.

h. New and existing residential Customers may be allowed to pay deposits or requests for increases in existing deposits over a period of at least three months.

1. Where a Customer has been required to make a guaranteed deposit, that deposit shall not relieve the Customer of the obligation to pay the service bill when due. If the Telephone Company discontinues the account, the utility shall apply the deposit of such Customer toward the discharge of such account and shall refund to the Customer any excess.

G. MINUTE-OF-USE MEASUREMENT, BILLING, AND PAYMENT FOR SERVICES AND FACILITIES

1. Minute-of-Use Measurement

a. Chargeable time begins when connection is established between the calling station and the called party.

b. Chargeable time ends when either party ( called or calling) hangs up.

c. Usage is rounded up to next whole minute.

2. Bills

a. Regular Customer bills are issued monthly. They contain the dates included in the billing period, dates for service charges associated with work performed, and the last date for timely payment. Bills will be issued on a monthly basis showing the amount of the net charge, stated by category, for local transmission service and ancillary services and equipment. Bills will be issued with all services and equipment itemized for single line Customers. Single line Customers will also receive this detail itemization as changes appear in billing due to service order activity.

b. Toll service, sales tax and excise tax, together \vith the gross amount of the bill, with separate entries for total amounts current or in arrears will be included on each bill. Reasonable requests for bill detail will be furnished.

Payment

a. An applicant for network access, who under the "Establishment and Maintenance of Credit" portion of this Tariff section, is required to make a deposit to guarantee payment of bills, may be required to pay the service charges and deposit prior to access. An applicant not required to make a deposit shall not be billed a service charge earlier than the first regular monthly bill.

b. The Customer shall pay for services and facilities monthly in advance except Departments, Administrations, and Agencies of the Federal, State, County, Township, or Municipal Governments and shall pay for toll messages and service charges when billed. Failure to receive a bill does not relieve the Customer of the responsibility for payment in accordance with the provisions set forth herein.

c. Customer payments are considered prompt when received at the Telephone Company or its agent by the pay by date on the bill. The pay by date is 20 days after the bill is rendered. Residential Customers may request a last date for timely payment later than the pay by date. Such requests must be made in writing and may be granted for good cause.

d. The Telephone Company may request payment, upon issuance of a final bill, when service is terminated at the Customer's request. For all other bills, payment will not be requested until the pay by date.

e . The Customer is held responsible for aJI charges for exchange service and facilities furnished at the Customer's request and for all toll service rendered at his telephone, including charges for toll messages received on which the charges had been reversed.

f. When a Customer is connected or disconnected, the central office access line is out of order, or for cause other than Customer premises equipment and wiring, the service received deviates by more than 24 consecutive hours from the normal billing period, the bill shall be prorated. If the prorating indicates a refund is due, the refund shall be accomplished by bill credit.

g. The regular restoral of service charge will be made for reconnecting services which have been discontinued for nonpayment of charges due. Subsequent to the completion of an order to terminate the service, it shall be reestablished only on the basis of a new application.

Disputed Bills

In the event of a dispute concerning the bill, the Telephone Company may require the Customer to pay a sum of money equal to the amount of the undisputed portion of the bill. Following payment of the undisputed amount, efforts to resolve the complaint, using complaint procedures in the Telephone Company's Tariff, shall continue and for not less than 45 days after the rendering of the disputed bill, the service shall not be disconnected for nonpayment of the disputed amount. The 45 days may be extended by up to 60 days ifrequested of the utility by the Commission in the event the Customer files a written comp)aint with the Commission.

5. Returned Checks

A $25 .00 charge will be assessed for checks with insufficient funds or non-existing accounts.

H. FEF,S ORT AXES TO BE BILLED TO CUSTOMERS

When any municipality, other political subdivision or local agency of government, imposes upon the Telephone Company any license, occupation, or other similar charge or tax applicable to service by the Telephone Company to the Customer, or imposes a charge or tax based upon a percentage of gross receipts, net receipts, or revenues from sale of telephone service by the Telephone Company, the charges for local service to Customers within such municipality, other political subdivision or local agency of government, shall be increased by an amount equal to each such Customer's proportionate part of any such charge or tax, and such amount shall be shown separately on the Customer's bill.

I. INITIAL CONTRACT PERIODS AND TERMINATION OF SERVICE

I. Initial Contract Periods

a. Except as hereinafter provided, the initial (or minimum) period for all services and facilities is one month at the same location.

b. The length of contract period for directory listings where the listing have been published, is the directory period. The directory period is from the day on which the directory is first distributed to the Customers to the day the succeeding directory is first distributed to Customers.

c. The Telephone Company may require a contract period longer than one month at the same location in connection with special (nonstandard) types of arrangements or for unusual construction, necessary to meet special demands, and involving extra costs.

2. Termination of Service

a. Service may be terminated prior to the expiration of the initial contract period upon notice being given to the Telephone Company, and upon payment of the termination charges given below, in addition to all charges due for service which has been furnished.

1) In case of service for which the initial contract period is one month, the charges due for the balance of the initial month.

2) In the case of directory listings where the listing has been published, the charges due to the end of the directory period, except that in the following cases charges wiJI be continued only to the date of termination of the extra listings, subject however to a minimum charge for one month: (a) the contract for the central office access line(s) is terminated; (b) the listed party becomes a Customer to some class of exchange service; ( c) the listed party moves to a new location; and ( d) the listed party dies.

3) for special types of arrangements, the charges will be based on the individual circumstances in each case as agreed upon at the time of installation.

b. Service may be terminated after the expiration of the initial contract period, upon the Telephone Company being notified, and upon payment of all charges due to the date of termination of the service.

Termination Liability/Waiver Policy

Services provided via service agreements may be subject to the Termination Liability/Waiver Policy. This policy applies only to services that specifically reference this Termination Liability/Waiver Policy in their respective section of this Tariff.

a. Definitions

1) Minimwn Billing Level

When services are provided under a service agreement, a Minimum Billing Level will be established for use in calculating discontinuance charges. The Minimum Billing Level is 100% of the total monthly rates for the service provided w1der the Customer's service agreement, unless otherwise specified.

2) Minimum Service Period

When services are provided under a service agreement, a Minimum Service Period may be established. This would be the period of time that the 100% factor of the Termination Liability Charge would apply.

b. Complete Disconnect

lf the Customer chooses to completely discontinue service, at any time during the term of the agreement, a termination charge will apply, unless the Customer satisfies the conditions specified in the Waiver Policy. The termination charge is 100% of the rates for the Minimum Service Period, if applicable, plus the Minimum Billing Level multiplied by the termination liability percentage specified in the service agreement, for the remaining term of the agreement.

For example, if the Customer discontinues service after 17 months of a three-year agreement, the termination charge will be the Minimum Billing Level for the service, multiplied by the termination liability percentage, multiplied by 19 months.

If the Customer discontinues service after six months of a three-year agreement, with a one-year Minimum Service Period, the Termination Charge will be 100% of the Minimum Billing Level for the remaining six months of the Minimum Service Period, plus the Minimum Billing Level multiplied by the termination liability percentage, multiplied by 24 months.

c. Partial Disconnect

If the Customer discontinues a p01tion of their service, and that causes the Customer's monthly billing level to fall below the MinimtUn Billing Level of the agreement, a termination charge will apply to the po1tion of the service agreement that is below the Minimum Billing Level.

d. Waiver Policy

A termination charge will be waived when the Customer discontinues their contracted service(s), provided all of the following conditions are met:

1) The Customer signs a new service agreement for any other Telephone Company provided service(s)

2) Both the existing and the new service(s) are provided solely by the Telephone Company

3) The order to discontinue the existing service(s) and the order to establish the new service(s) are received by the Telephone Company at the same time

4) The new service(s) installation must be completed within 30 calendar days of the disconnection of the old service(s), unless the installation delay is caused by the Telephone Company

5) The total value of the new service agreement(s), excluding any special construction charges and any other noruecurring charges, is equal to or greater than 115% of the remaining value of the existing agreement(s)

6) A new minimum service period goes into effect when the new service agreement term begins

7) The Customer agrees to pay any previously billed, but unpaid recurring, and any outstanding nonrecurring charges. These charges cannot be included as part of the new service agreement

8) All applicable nonrecwTing charges will be assessed for the new contracted service(s). '

J. DISCONNECTION OR REFUSAL OF SERVICE

1. The Telephone Company may refuse service or terminate existing service to an end-user without notice for tampering with the Telephone Company's equipment, or misuse or abuse thereof in order to avoid payment of lawful charges or use thereof in such manner as to create danger to life or property of the Telephone Company or end users.

2. The Telephone Company may refuse service or terminate existing service to a Customer pursuant to the disconnect procedure provided below for any of the following reasons:

a. Nonpayment of a bill within the period prescribed by this Tariff and/or nonpayment of a single bill within a multiple-billed account.

b. Failure to make a security deposit as set forth in this Tariff.

c. Violation of or noncompliance with any provision of law.

d. Refusal to permit the Telephone Company reasonable access to its telecommunications facilities for recovery, maintenance, and inspection thereof.

e. Interconnection of a device, line, or channel to the Telephone Company's facilities or equipment contrary to the Telephone Company's terms and conditions of service on file with and approved by the Commission.

f. Use in such manner as to interfere with service to other Customers.

g. Abandonment of the service.

h. Impersonation of another with fraudulent intent or other acts, whether real or perceived, to defraud the Telephone Company.

1. Use of service or facilities for a call or calls in a manner reasonably expected to frighten, abuse, torment, or harass another.

J· Any other violation of the Telephone Company's regulations. In an effort to protect itself and/or its Customers, the Telephone Company will, at its option, disconnect an End User's service without prior notice for violation of subsections (f) or (h) above. The Telephone Company will provide documentation to the Customer upon request, indicating the reason(s) that service is being withheld.

3. The Telephone Company shall not be required to provide service to an applicant or Customer who has not paid for prior telephone service rendered by another teleconununications service provider in the same or different location, and furnished to the same person or legal entity.

4. The Telephone Company shall not be required to furnish or continue furnishing service when applied for in the name of another person or legal entity, or a fictitious name or other member of the same household, for the purpose of avoiding payment of an unpaid obligation for telephone service previously furnished.

5. Customers will not be held responsible for the nonpayment of another Customer's bill unless the Customer superseded the service or was a co-applicant or guarantor for the service or shared the service of the nonpaid account.

6. The Telephone Company will extend a payment arrangement to an applicant for a prior bill, unless the applicant has not fulfilled prior payment arrangements within the past 12 months.

7. The Telephone Company will not refuse service or disconnect existing service by reason of nonpayment for telephone service by a previous occupant at the premises for which service is sought, or by reason of nonpayment of any amount hack-billed due to misapplication of rates provided the applicant enters into a deferred payment plan. The Telephone Company will not disconnect or suspend service without mailing or delivering a bill to the Customer for the amount due to The Telephone Company. Service may not be withheld from a Customer whose name was fraudulently used to obtain service at another location without the Customer's permission or knowledge

8. Service will not be discontinued to a current Customer in good standing who accepts an additional household member owing a previous bill to The Telephone Company, unless that additional household member is listed on the lease a1Tangements or another utility service as a responsible party, or unless the household member shared service with the Customer at a different or same location.

9. The Telephone Company will not provide billing and collection for any provider of intrastate telecommunications services who docs not have proper authority to operate in the State of Nebraska.

l 0. The Telephone Company may require each Customer whose service has been suspended for nonpayment of bills, to pay all amounts due for regulated services or execute a deferred payment agreement, if offered before service is restored.

11. If there is an unresolved dispute pending with the Commission concerning a bill and the Customer pays the undisputed portion of that bill, disconnection procedmes shall be held in abeyance until the dispute is resolved.

12. Service to a Customer may be disconnected for any reason which by this Tariff requires notice, other than nonpayment for service or failure to make a security deposit, only upon order of the Commission, upon application and after notice and hearing. For good cause shown, the Commission may order disconnection of service pending hearing, with or without notice to the Customer.

13. Telephone Calls with Intent to Annoy:

a. The Telephone Company may discontinue service to any Customer, who with intent to annoy, telephones another and addresses to or about such other person any obscene language or addresses to such person any tlu-eat to inflict injury to the person or property of the person addressed or any family member.

b. The Telephone Company may discontinue service of any Customer, who with intent to annoy, repeatedly telephones another without disclosing his/her true identity to the person answering the telephone, whether or not conversation ensues during the telephone call.

c. The Telephone Company may, at its discretion, terminate service to any Customer who establishes a pattern of behavior with respect to the services provided by the Telephone Company that is intended to vex, harass or annoy the Telephone Company, its employees, agents or other Users of the Publicly Switched Telephone Network. A pattern of behavior is intended to vex, harass or mmoy if it disturbs, irritates or interrupts the Telephone Company's operations tlU'ough continued and repeated acts, or disturbs, irritates, or interrupts Users of the Public Switched Telephone Network through continued and repeated acts.

d. Prior to disconnection of service for calls described in this subsection 13, the Telephone Company will make reasonable effort to persuade the Customer placing such calls to cease all such activity. If such activity persists, the Telephone Company may, at its option, disconnect service. Prior to disconnection of service for calls described in subsection c above, the Telephone Company may, at its option, refuse to transact business with the Customer except by written communication. If the Customer continues to engage in conduct set forth in subsection c above, the Telephone Company may, at its option, immediately discontinue service.

e. For the purpose of this section, telephone calls shall includes Customer's usage of facsimile, paging or any other communication devices to access the service provided by the Telephone Company.

f. Telephone Company may disconnect service to any Customer who violates 47 U.S.C. § 227, Restrictions on the Use of Telephone Equipment.

14. Customer Notification of Service Disconnection

a. Unless stated otherwise above, written notice of a pending disconnect will be rendered ten days prior to the disconnection. The notice will include all reasons for the disconnect and the final date by which payment is to be made or specific action taken. The notice will include a toll free number where a Customer can obtain additional information.

b. Jn unusual credit circumstances or abnormal usage of service which would result in undue revenue loss, disconnection may occur prior to the expiration of the five day notice.

c. Except as provided above, or in unusual credit circwnstances or abnormal usage of service, no service will be disconnected on the day preceding or day on which the Telephone Company's Business Office or agent is closed. Nor will service be disconnected on a weekend, holiday or after 2 p.m. unless service can be reconnected the same day.

15. Postponement of Disconnect Due to Medical Emergency

The Telephone Company shall postpone the disco1mection of service to a residential Customer for a reasonable time, not in excess of 30 days, if the Customer produces verification from a physician, or a public health or social services official, which states that telephone service is essential due to an existing medical emergency of the Customer, a member of the Customer's family or any permanent resident of the premises where service is rendered. This written verification shall identify the medical emergency and specify the circumstances. Initial verification may be by telephone if written verification is forwarded to the utility within five days.

A Customer or prospective Customer may initiate a complaint with the Telephone Company on any relevant matter by telephone, in writing or in person directed to the Telephone Company at any of its offices. The Telephone Company's response to the complaint will generally be in the same form used by the Customer. However, the Telephone Company may respond to written complaints by telephone or personal visits when it believes such communications will be effective in resolution of the issues.

The Customer may, at any point during resolution of the complaint, seek review by a supervisor or manager. If the Customer is still not satisfied, the nature of the complaint with sufficient detail to afford an investigation should be documented and addressed to:

Ownership and Use

Directories regularly furnished to Customers are the property of the Telephone Company, are loaned to Customers only as an aid to the use of the telephone service. Customers must not deface or mutilate directories. The Telephone Company shall have the right to make a charge for directories issued in replacement of directories destroyed, defaced, or mutilated while in possession of the Customer.

M. POST-BILLING TOLL BLOCK

1. General

Post-Billing Toll Block (PBTB) is a process whereby the Telephone Company will initiate toll blocking on high risk accounts which have unpaid balances. A grace period will be given to the Customer to respond to the toll block. This service is designed to minimize the Telephone Company's network exposure from uncollectible accounts and to act as an enhancement to the late payment treatment process. If payment is not received the normal late payment treatment process will continue. This process will be accomplished where the Telephone Company is technically capable.

2. A risk level assessment process determines Customers with high risk accounts and is based as a result of either Credit Scoring for new Customers or Behavioral Scoring (Telephone Company payment history) for existing Customers.

3. Risk level assessment is categorized for new Customers via Credit Scoring whereby the Telephone Company will be provided a credit score through the use of a third party credit reporting service. A credit score is computed on the inquhy date by utilizing a credit scoring model plus information contained in the Customer's credit files. The Customer's score is delivered by the National Credit Bureau at the time of service application. Credit Scoring allows the Telephone Company to assign a low, mediwn or high credit risk rating to all new Customer accounts.

a. A high risk level assessment is assigned to new Customers having the following criteria:

Collection judgments Charge (Written) off accounts Outstanding collection accounts Various degrees of delinquency history from 30-180 days, and not paid in full or current at time of scoring

b. Behavioral Scoring, based on Telephone Company payment history, will establish a risk assessment for existing Customers. A score will be established and maintained (re-scored) on each Customer when the program is initiated and/or after a six-month service period has been established. Existing Customers for the purpose of this Tariff, are those Customers that have had continuous service with the Telephone Company over a six-month period.

c. A high risk level assessment is assigned to existing Customers having the following criteria:

Six or more telephone bills not paid by the due date or in full during the preceding 12 months Three or more Non-Sufficient Fund (NSF) checks for telephone bill payments during the preceding 12 months Two or more service denials due to nonpayment during the preceding 12 months Six or more reminder notices on accoW1t during the preceding 12 months

4. A delinquent account Customer will be given a grace period of two business days from the "please pay by date" or due date of the bill to make payment otht!rwise Post-Billing Toll Block will be initiated.

5. An intercept recording will inform the delinquent accolUlt Customer that the long distance (1+, O+, and pay per call charges) call can not be completed. Long distance service access will be restored when the delinquent balance is paid. Should the Customer request payment arrangements, the account will remain toll blocked until the delinquent amount is paid. Should the Customer ultimately fail to make payment for local service, disconnection of local and toll service will occur.

6 . Toll blocked accounts will retain local dial tone, local calling and access to emergency services. However, the Telephone Company will also restrict all collect, credit card and third number bill calls.

7. No restoral of service charges will be incurred by the Customer as a result of restoring tol I service.

8. After the Post-Billing Toll Block is initiated late payment treatment notices will be rendered. If payment is not received for local service or payment arrangement made a temporary disconnect and finally an out of service order will follow.

9. Deposit requirements will not be effected as a result of Post-Billing Toll Block.

SECTION 3: SERVICE AND CONSTRUCTION CHARGES

A. SCOPE OF SECTION

The service and construction charges described herein pertain only to the services described in this Tariff.

B. SERVICE CHARGES

1. General

a. A service charge consisting of one or more of the charges shown in this section is applicable for the following activities undertaken at Customer>s request:

b. Service charges are in addition to all other applicable rates and charges associated with the service being provided unless otherwise stated for specific items. Service charges apply in addition to and not in lieu of installation charges> nonrecurring charges or construction charges which are found in other sections of this Tariff.

c. Payment of Service Charges.

d. The charges specified herein do not contemplate work being performed by Telephone Company employees at a time when overtime wages apply due to the request of the Customer nor do they contemplate work begun interrupted by the Customer. If the Customer requests overtime labor, being performed or interrupts work once begun, a charge in addition to the specified charges will be made equal to the additional cost involved.

e. Certain interexchange Service Charges covered by connecting company tariffs apply to installations, moves, and changes of interexchange services, such as Foreign Exchange lines and other special services, and may be in addition to charges in this tariff.

2. Definitions Applicable Solely to the Extent That the Te1·ms Defined Pertain to Service and Construction Charges

a. The term "Change" denotes the substitution of a different telephone number assigrunent made at the request of the Customer that is not required to maintain adequate service. Change also denotes move of service drop, or station protector.

b. The term "Connection" denotes the establishment of telephone service. A move of existing service to a different premises requires a connection.

Application of Charges

a. Service Charges are applicable for work done in receiving, recording, and processing information necessary to execute a Customer's request for connections of service, or changes or additions to existing service. Service order activity is classified as either initial ( establishment of service) or subsequent (modification to an existing service). Only one service ordering charge is applicable for all items ordered at the same time for completion on the same date.

1) One initial service ordering charge is applicable to each order for connection of the service.

2) One subsequent service ordering charge is applicable to each order for change or addition and the following:

A) Customer initiated change of telephone number or change of Telephone Company record.

B) Only one charge is applicable per order if more than one change is requested on the order.

3) A service ordering charge is not app)icable to restoral of service that is disconnected for nonpayment.

b. Line Connection Charge

I) A Line Connection Charge is the charge for work associated with provision of service from the central office including, but not limited to, central office connections, cable cross connections and/or outside plant connections up to and including the protector and/or the point of demarcation.

2) A Line Connection Charge is not applicable when service is asswned by a Customer prior to discontinuance by another Customer (supersedure) and there is no change of telephone nwnber.

3) A Line Connection Charge is applicable to each change in telephone number made at the request of the Customer.

c. Restoral Charge - A rcstoral charge is applicable to each service reconnection that is temporarily disconnected for nonpayment.

d. No service charges apply under the following circumstances:

1) Moving or changing telephone service or equipment up to the demarcation point if required or initiated by the Telephone Company;

2) Disconnection of service for nonpayment of charges due. The charge applicable for restoral of service is specified in this section;

3) Customer-initiated requests providing work is limited to service established at an interim location, nor to the subsequent re­establishment of service at the same or another location, due to the destruction of the Customer's premises by a natural disaster, flood, or other acts of God;

4) Telephone equipment is located on a Customer's premises but used exclusively by the Telephone Company for maintenance or training activities.

5) The following cases, if the contract for the service and responsibility for the account including any amounts due or past due, are taken over prior to discontinuance of service and without lapse in rendition of or charge for service:

A) A change in the ownership of a business, not requiring a service order;

B) A transfer of residential service from one member of a family to another member of such family at the same location;

6) A change of name without change in the identity of a Customer, as where a Customer's name is changed by marriage or by authority of a court order;

7) Inside and outside temporary detachment and subsequent replacement without a change in location of drops or protectors;

8) The establishment or termination of a receivership, provided responsibility for service and facilities is assumed prior to discontinuance of service and without lapse in charge;

9) When a Customer's classification is changed from Business to Residential or from Residential to Business except when such change recurs on a seasonal basis;

10) Changes in billing name and address, whether by Customer notification or by address correction provided by the Post Office; or

11) The telephone number assigned a Customer results in wrong number calls sufficient in volume to be a nuisance.

f. The Demarcation Point for residential Customers shall be located on the exterior of the Customer's dwelling and within 20 feet of the power system gr0tmd if the dwelling has electric service. If the Demarcation Point cannot be located within 20 feet of the Customer's power system ground then the Customer shall pay the Telephone Company the total actual cost to colUlect the telephone system ground to the power system ground beyond the first 20 feet.

g. The Demarcation Point for business Customers may be located within the interior of the Customer's dwelling provided the Customer furnishes a conduit for the entrance cable from the requested Demarcation Point to a point on the Customers property that is beyond construction obstructions. The size and type of conduit shall be specified by the Telephone Company. The Customer must provide a power system ground that is accessible to the Telephone Company within 20 feet of the Demarcation Point. The Telephone Company may deny a request to place a Demarcation Point in the interior of a building if, in its own opinion, the Installation would not be in the best interest of the Telephone Company.

h. All telephone plant will be engineered and constructed in accordance with the National Electric Code and all applicable laws that are in effect at the time of construction.

2. Line Extensions

a. Subject to C.1. above, the Telephone Company will extend its facilities up to 1,500 feet on public right-of-way and up to 500 feet on private right-of­way to provide primary telephone service at no charge to the Customer. For extensions beyond 1,500 feet on public right-of-way and 500 feet on private right-of-way, the cost to the Customer shall be $1.00 per foot. The Telephone Company will select the shortest route possible that is clear of obstructions. The route footage shall include the straight-line footage plus any other footage necessary for cable laterals, loops, risers, etc.

b. Jfthe Telephone Company has to procure any private easements, licenses or permits to provide the requested service, then the Customer may be required to reimburse the Telephone Company for the procurement of such. The private easement, license or permit procurement costs are in addition to the line extension costs quoted above.

c. The Telephone Company, at its sole discretion, will determine whether the proposed construction will be aerial, buried, underground or combination thereof.

d. If the Customer requests a type of construction that is more expensive than what the Telephone Company would normally provide, then the Customer will pay the difference between the type proposed by the Telephone Company and the type requested by the Customer.

3. Line Extensions for Multiple Applicants

The Telephone Company will extend its facilities to multiple applicants subject to the specifications in C.2. above. When that occurs, applicants will be divided into two groups:

a. The first group includes all applicants whose collective allowance equals or exceeds the construction required to serve them. No charge is made to such applicants.

b. The second group includes all remaining applicants on the project. The overall charge for the project is divided equally among all applicants in the second group.

4. Pre-Cabling Subdivisions

If the owner or developer of subdivision requests the Telephone Company to place its facilities within said subdivision before there are any telephone service prospects, then the total cost to place such facilities shall be borne by the owner or the developer. At the Telephone Company's discretion, the owner or developer and the Telephone Company may agree on different terms than those stated above and the Telephone Company may reimbmse the developer or owner a portion of the construction costs based on the amount of telephone service revenue generated by Customers within the subdivision.

5. Plant Relocation

a. If the Telephone Company receives a request to relocate its plant, then the Telephone Company will review the request and determine if the requested relocation can be accomplished without compromising safety, telephone service quality and/or aesthetics. If, in the opinion of the Telephone Company, the foregoing standards will not be compromised then the Telephone Company will provide the requester a written estimate for the total cost to relocate the telephone plant in question. Relocations costs must be paid in full prior to the execution of the work.

b. Relocation requests may be subject to approval by the entity governing the right-of-way where the proposed relocation would occur.

6. Termination Fee

The Telephone Company reserves the right to require the Customer to sign a written contract agreeing to pay a termination fee related to the Telephone Company's unrecovered construction costs should service be terminated before such construction costs arc recovered.

SECTION 4: LOCAL EXCHANGE SERVICE

A. GENERAL

1 . The rates for Local Exchange Service as shown in the following rate schedules are subject to the conditions set forth herein and the General Rules and Regulations governing provision of such service. The General Rules and Regulations are set forth in Section 3 of the this Tariff.

2. Applicable taxes levied by Federal, State, County, and local taxing authorities are in addition to the rates set forth in this Tariff.

B. SERVICE DESCRIPTION AND CONDITIONS

L Basic Local Exchange Service

a. Rate Components

1) Exchange Service - Exchange Service is the furnishing of facilities necessary for communicating within and between exchanges. Exchange facilities are used to establish and maintain connection between an exchange station and the other telephone plant and facilities in connection with long distance calls or Extended Area Service calls. The rate for exchange service varies by class of service. Exchange Service includes the following:

2) Extended Area Service (EAS). EAS is a non-optional unlimited calling service in certain exchanges that permits Customers in such exchanges to place calls to other designated exchanges without the use of toll facilities and without incurring Long Distance Message Telecommunications charges. Applicable EAS additives are in addition to the exchange service rates applicable to that exchange. The rate for EAS varies by class of service and is developed based on the cost of each route between communities. Extended Area Service com1ections are described later in this Section.

Lifeline Assistance Service

a. Lifeline Assistance Service is a basic single-line residential service that provides voice grade access to the public switched network and includes touch calling, a standat'd white page listing, access to emergency services (for example, 911, E9 l l ), access to nperator services, access to interexchange services, access to directory assistance, and toll blocking service. Lifeline Assistance Service applies a credit to the basic local exchange service monthly recurring access rate for qualifying residential Customers. Lifeline Service is limited to onJy one Service per qualified customer or household; within this section, 'household' is defined as "any individual or group of individuals who are living together at the same address as one economic unit," with an 'economic unit' defined as, "all adult individuals contributing to and sharing in the income and expenses of a household."

b. Application

1) The Customer eligible for Lifeline Assistance Service must be a participant in at least one of the following programs:

a) Medicaid (for example, Title XIX/Medical, state supplemental assistance);

b) Food Stamps;

2) An applicant shall request telephone assistance through completion of a form provided by the Telephone Company. The form requires the appl.icant to certify, under penalty of pe1jury, their participation in the program(s) indicated on the application and/or the financial and household size information provided to qualify under the Federal Poverty Guidelines criteria.

c. Continuing Eligibility

I) The Lifeline Customer is responsible for notifying the Telephone Company if the Customer ceases to participate in any of the public assistance programs listed above or if their household income becomes greater than 135 percent of the Federal Poverty Guidelines.

2) If the Telephone Company has a reasonable basis to believe that a Customer is no longer eligible for Lifeline assistance, a letter will be sent to the Customer allowing 60 days to prove eligibility. If proof of eligibility is not received in the 60 days, the assistance will be removed from the Customer's account.

3) Annual Verification

A verification form will be sent to a statistically valid random sample of existing Lifeline Customers to verify continued eligibility on an annual basis. The munber of Customers who will receive this form will be determined based on the FCC's formula and chart located in Appendix J of the following FCC ruling: Lifeline and Link-up, Report and Order and Further Notice of Proposed Rulemaking, 19 FCC Red 8302 (2004)). Along with the verification form, the Customer will be required to present proof of continued eligibility. For Customers whose eligibility continues based on a public assistance program, the Customer will be required to present or submit a copy of a Lifeline-qualifying public assistance document. For Customers whose eligibility continues based on their income being at or below 135% of the Federal Poverty Guidelines, the Customer will be required to present or submit proof of their income along with the number of individuals in their household. In providing proof of their income, for any proof other than a prior year's state or federal tax return, three consecutive months (same calendar year) worth of the same income proof must be presented. The proof will be attached to the verification form through a signed form or a copy of submitted information.

The results of this verification will be report to the Universal Service Administrative Telephone Company annually.

The verification forms for income-based applicants will be kept for the term the Customer receives this service or until an audit is conducted by an Administrator.

d. Lifeline Assistance Service applies a baseline credit amount of $6.15 to offset the Federal End User Subscriber Line Charge as specified in the Telephone Company's federal access tariff, Tariff FCC No. l.

e . A supplemental reduction in the amount of$1.75 per month will be made to the basic local single-line residential access rate of qualifying Lifeline Assistance Service Customers.

h. Deposit requirements do not apply to a Lifeline Assistance Service Customer if the Customer voluntarily elects toll blocking service.

1. Lifeline Assistance Service may not be disconnected for non-payment of nonregulated toll charges.

J. Funding for Lifeline Assistance Service (Federal Baseline and Federal Supplemental amounts) is obtained from a universal service support mechanism to which all telecommmiications carriers that provide interstate telecommunications service contribute on an equitable and nondiscriminatory basis.

5. Nebraska Telephone Assistance Program {NTAP)

a. Description

NT AP assists qualifying low-income individuals with obtaining and keeping telephone services by lowering monthly service and connection rates.

NT AP reduces the cost of local telephone service up to $13.00 per month. The discount will appear as a credit on your monthly telephone bill within 60 days of enrollment. No cash or checks will be distributed. The telephone bill must be in the name of, or contain the name of, the individual that qualifies for the program.

NT AP provides reduced installation charges for phone service by 50% or $30.00, whichever is less. It also provides a deferred payment of installation charges without interest.

Long Distance Bundle

The Long Distance Bundle consists of two sets of three rate components:

a. Monthly recurring charges for the Basic Access Line, as described above in subsection D. l.

SECTION 5: CALLING SERVICES

A. GENERAL

Custom Calling Services are optional telephone service arrangements that may be provided only from central offices equipped to provide one or more custom calling features. The rates and charges contained herein are in addhion to all other applicable rates and charges located in other parts of this Tariff.

B. INDIVIDUAL SERVICE DESCRIPTIONS

Custom Calling Services arc comprised of service features associated with Residential or Business individual lines and tnmks.

1. Abbreviated Access: Allows a Customer to place a call to a predetermined telephone number by dialing an abbreviated code. Two arrangements are available, Abbreviated Access, one-digit or Abbreviated Access, two-digit. The Customer shares a speed call list with their Abbreviated Access provider and the provider controls the speed call list and informs clients of the digit(s) to dial to reach the predetermined number.

2. Anonymous Call Rejection: Caller Identification Customers who do not wish to receive blocked calls can activate Anonymous Call Rejection by pressing *77 (1177 on rotary phones). The code to deactivate is *87 (1187 on rotary phones). While the feature is activated, incoming blocked calls are routed to an announcement in the central office. Anonymous Call Rejection is automatically available to residential subscribers of Caller Identification, Residential monthly subscribers of Last Call Return and business subscribers where technically feasible.

3. Call Curfew: Allows the Customer the ability to block incoming and outgoing calls. The feature can be turned on and off manually or automatically by pre-set schedules which have been defined by the Customer. When the feature is activated, incoming calls will be blocked and calling party \vill hear an announcement that the Customer is unavailable. For outgoing calls, the Customer will hear a fast busy and the call will not be completed. When the feature is not activated, normal call processing will occur.

14. Call Forwarding (Variable): Provides for automatic forwarding of calls coming into a line to any other line. The alternate line must be selected each time the feature is activated.

15. Call Rejection: Enables a Customer to reject call attempts from up to 15 numbers of calling parties by dialing a code and the telephone numbers of calls to be rejected. Any call attempts to the Customer from these munbers will be prevented from terminating to the Customer and will instead be connected to an announcement informing the caller that the call is not presently being accepted by the called party. A Customer may also reject future calls from the most recent call received by dialing a code after completing the call.

16. Call Trace Block: Blocks the ability to activate Call Trace.

17. Call Transfer: Enables a Customer to transfer an incoming call to a third party or add a third party to an existing call, forming a three party connection, and then to leave the connection without disconnecting the call.

18. Call Waiting/Call Waiting JD: Provides for signaling a Customer, who is talking on the line, that another call has been placed to the line. The Customer may, by switchhook operation, hold the first call, answer the second, return to the first or converse alternately with both. In certain upgraded central offices, Call Waiting Deactivation is available without additional charge. This feature gives Call Waiting Customers the ability to control when Call Waiting functions on their line. A Customer with Caller Identification may also receive name and/or munber information on a call that is waiting (Call Waiting ID). A Customer who subscribes to Call Waiting may enhance their service to separately identify local and long distance calls. Different tones will distinguish the two types of calls, whether at the initial ring cycle or in the call waiting mode. There is no additional charge for this Long Distance Alert feature enhancement, nor will the Telephone Company charge to add this feature.

19. Caller Identification - Name and Number: Allows for the automatic delivery of a calling party's name and telephone number (including nonpublished and nonlisted telephone numbers) to the called Customer, which gives the called Customer an opportunity to decide whether to answer the call immediately or not. The name and number are displayed on Customer provided equipment. The name displayed shall be the name associated with the calling telephone number as shown on the Telephone Company's records. The Telephone Company, in its discretion, may abbreviate or limit that name for display purposes. The Telephone Company does not assure name accuracy, and it shall not be liable to any party for errors, omissions or mistakes. The Telephone Company's sole and only obligation shall be to reasonably correct errors in names when notified in writing of such errors. Caller Identification Customers who do not wish to receive blocked calls can activate Anonymous Call Rejection.

20. 21 . Caller Identification Blocking - Per Call: Enables a Customer to control the disclosure of their telephone number or name and telephone number to a subscriber of Caller Identification (where technically feasible) by temporarily changing the public/private status indicator of the telephone number. A Customer must dial a code before each call to change the indicator from public to private. "Public status" allows delivery of the telephone number or name and telephone number. "Private status" prevents delivery of the telephone number or name and telephone number. Per Call Blocking is provided at no charge.

22. Caller Identification Blocking - Per Line: Provides a permanent private indicator on a Customer's line. Once blocking is established on the Customer's line, the private status can be deactivated by the Customer, by dialing a code, *82 or 1182 on rotary phones, before each call, to change the indicator from private to public. This one-call unblock allows the name and number to be sent for that one call only. Rates and charges arc provided herein. Federal, State, and Local Law Enforcement Agencies, non-profit domestic violence/sexual assault agencies and their staffs, and victims of domestic/sexual assault or individuals who express a personal safety need, may be provided additional arrangements for private status and/or line blocking, on a line-by-line basis, at no charge. Tf a line is equipped with Per Line Blocking, the telephone number and name will not be delivered to subscribers of Caller ID, including poison control centers, hospitals, medical centers and others who might use Caller ID to provide assistance. 911 is not affected. Additionally, some subscribers of Caller ID Service may choose not to answer blocked calls.

23. Continuous Redial: Automatically redials the last number a Customer dials. If the called party's number is busy, a special tone will alert the Customer when the called number becomes idle. This service is available on a usage or subscription basis. Dial Call Waiting allows a Customer with a line equipped with the feature to direct a Call Waiting tone or a Distinctive Alert signal to a line equipped with Distinctive Alert. Dialing a preset access code and the telephone number of the line to which the signal is directed activates the feature.

24. Continuous Redial Block: Blocks the ability to activate Continuous Redial.

25. Dial Call Waiting: Allows a Customer with a line equipped with the feature to direct to a Call Waiting tone or a Distinctive Alert signal to a line equipped with Distinctive Alert. Dialing a preset access code and the telephone number of the line to which the signal is directed activates the feature.

26. Dial Lock: Allows a Customer the ability to manage their outbound calls (local, local long distance, and toll) by selectively blocking different types of calls placed from their line. This service will allow blocking to: all non-emergency local calls; long distance calls; international calls; operator assisted; toll free; information services; and directory assistance calls. The Customer will select the types of calls they wish to have blocked. Customers may override the blocking at anytime through a personalized assigned PIN code.

27. Directed Call Pick Up: Allows a Customer to answer a call, during the ringing cycle, that is directed to another line by dialing a preset access code and the telephone number of the line to be answered. Both the originating line and the line to be answered must be equipped with the feature.

28. Directed Call Pick Up with Barge-In: Allows a Customer to answer a call directed to another line which has been answered or is ringing by dialing a preset access code and the telephone number of the line to be answered. Both the originating line and the line to be answered must be equipped with the feature.

29. Distinctive Alert: Allows a Customer to receive an audible Call Waiting tone or Distinctive Ringing signal from a line equipped with Dial Call Waiting. If the called line is idle, a Distinctive Ringing signal will be heard. If the called line is busy, the called line receives a Call Waiting tone.

30. Do Not Disturb: Allows a Customer to prevent the ringing of their telephone. When the feature is activated, callers hear a Customer selected greeting indicating that the Customer is not available. If the Customer has messaging service the caller may stay on the line and leave a message.

31. Easy Access: Allows a Customer to place a call to a predetermined telephone number by dialing an abbreviated two-digit code. The dialing code is *98.

32. Hot Line Service: Allows a Customer to establish a switched connection to a predetermined nwnber when the Customer's telephone goes off-hook. No dialing is required and the call is processed automatically to the predetermined telephone number.

33. Last Call Return: Enables a Customer to perform an activation procedure and automatically redial the last incoming nwnber without having to know the number of the calling party. This service is available on a usage or subscription basis. Last Call Retilln Customers who do not wish to receive blocked calls can activate Anonymous Call Rejection.

34. Last Call Return Blocking: Allows a Customer to block the ability to activate the usage based Last Call Return Service.

35. Priority Call: Allows a Customer to assign a maximum of 15 callers' telephone numbers to a special list. The Customer will hear a distinctive ring at their location, when calls are received from callers' telephone nwnbers on that list.

36. Remote Access Forwarding (Call Following): Allows all incoming calls to be forwarded to another telephone nwnber. It allows the Customer to remotely change the termination of their incoming calls. From any tone signaling telephone, the Customer can activate, deactivate, or change the destination number. This service is marketed to residential Customers under the name of Call Following.

37. Scheduled Forwarding: Allows all incoming calls to be forwarded to another telephone number. It allows a Customer to remotely change the termination of their incoming calls and base the tennination upon a time schedule. From any tone signaling telephone, the Customer can activate, deactivate, or change the times, days and destination numbers.

38. Selective Call Forwarding: Allows a Customer to specify a special list of a maximum of 15 telephone nwnbers. Incoming calls placed to the Customer from telephone nwnbers on that list will automatically be forwarded to a predefined telephone nwnber. All other calls will be handled normally.

39. Speed Calling: Permits a Customer to place calls to a preselected telephone number by dialing fewer digits than the complete telephone number. The Customer may preselect a repertory list of maximum 8 or 30 telephone numbers. The Customer may change the information content of the repertory list by dialing a special code followed by the new telephone number to be placed in the list.

40. Talking Call Waiting: An enhancement for subscribers of Call Waiting that provides an audible announcement of the incoming caller's name. The audible announcement consists of the regular Call Waiting tone followed immediately by the calling party's name.

41. Three-Way Calling: Enables one to add a third person on an established local or long distance connection without operator assistance. The third person may be called by the person initiating the Three Way Calling on either a local or long­distance basis. This service is available on a usage or subscription basis.

42. Three-Way Calling Block: Blocks the ability to activate Three Way Calling.

43 . Warm Line Service: Allows a Customer to establish a switched connection to a predetermined number if the Customer does not dial a number within a specified length of time after going off-hook. When the Customer's telephone goes off­hook and dialing begins within a specified time delay period, the call will proceed normally as dialed. If dialing has not started before the end of the predefined time delay period, a predetermined stored number is automatically dialed by the central office switching equipment.

44. Wireless Extension: A wirelinc forwarding service that works with a Customer's wireless service. When a call is placed to the wireline number, it is automatically forwarded to a designated wireless number if the handset is turned on. If the wireless handset is turned off or is busy, the call rings at the wireline number and is not forwarded. In addition, any call coming from the designated wireless number to the wireline number will not be forwarded back to the wireless number.

A. DIRECTORY LISTINGS

1. General

a. The regulations for directory listings, as provided in this section, apply only to that section of the directory containing the regular alphabetical list of names of Customers.

b . One primary listing is furnished without charge to each Customer in confo1mity to the Telephone Company's practices with respect to its directories. Listings are intended primarily for the purpose of identification and are limited to information which is essential to such identification. Directories are furnished only as an aid to the use of the telephone service facilities and the Telephone Company reserves the right to refuse to insert any listing in its directories which does not facilitate telephone service.

c. Names and addresses in directory listings shall be limited to the following:

1) The individual name of the Customer or firm contracting for exchange telephone service.

2) A party for whom the exchange telephone service was contracted for by another party.

3) The name under which a firm regularly conducts business.

4) The same surname with no more than two individuals' given names who live at the same residential address. Each given name, for purposes of this Tariff, is defined as any combination, not to exceed two, of the following:

first name middle name initial nickname maiden name

An additional listing reversing the order of the individual's given names may be obtained at the rates for additional listings as specified herein. The restriction of no more than two given names applies only to listings involving two individuals' names.

5) The name under which a business is actually being conducted by someone other than the Customer and which the Customer is authorized by such other to use.

6) The individual names of the officers, partners, or employees of the Customer.

7) The names of departments when such listings are deemed necessary from a public reference viewpoint.

d . Whenever any question arises as to the right of a Customer (1) to list the name of a business which he claims he is authorized to represent, or (2) to use a listing which includes the trade name of another, the Telephone Company is privileged to require the Customer to secure from the owner of such name, written authority to use it, addressed to the Telephone Company for the acceptance for insertion or for the continuance of such listing; and is privileged to refuse to accept or to delete such listing where (1) such written authority is not so furnished, or (2) such authority is withdrawn by such owner in writing to the Telephone Company.

a. Primary Listings

1) One listing without charge, termed the primary listing, is provided as follows:

a) The primary listing, provided with a Customer's second residential exchange service line, may be the names or names and address of members of a Customer's family residing in the Customer's household.

b) When two or more lines serve a Customer in a group arranged for a "hunting" operation, each group of lines is considered one telephone number and is entitled to only one primary listing.

c) Names, addresses, and telephone numbers of public interexchange pay access lines are not listed in the directory.

d) Except as outlined above, a primary listing is provided with each central office access line associated with business, residential, pay telephone, rural, and general mobile. One primary listing per system is provided for private branch exchange service.

2) Upon request, a Customer's listing may be omitted from both the telephone directory and the Telephone Company's information records. Connections with such non-published service may be completed only when requested by telephone number. The Telephone Company will adhere to this practice notwithstanding any claim of emergency the calling party may present. The acceptance by the Telephone Company of the Customer's request to furnish nonpublished service does not create any relationship or obligation direct or indirect, to any person other than the Customer. See nonpublished listing service information in this section.

b. Additional Listings

1) Business additional listings may be the names of partners or members of the firm if the Customer is a partnership or firm, the names of officers of a corporation if the Customer is a corporation; and for any business establislunent, the names of associates or employees of the Customer. No other class of listing, such as service, agency, commodity, etc., will be accepted.

2) Residential additional listings may be the names of other members of the Customer's household living at the same address except in locations where business rates apply.

3) In connection with pay telephone service, additional listings are allowed at regular additional listing rates in the names of permanent guests or tenants at that location. Regular additional listing rates in connection with pay telephone stations are fW'nished tU1der the same regulations as specified above.

4) Ordinarily, all additional listings must be of the same address and telephone number as the primary listing, except as provided below for alternate listings. However, when, in the opinion of the Telephone Company, it appears necessary as an aid to the use of the directory and provided satisfactory service can be furnished, a listing may be permitted under the address of a PBX station, or additional station, which is located on premises of the Customer, but at an address different from that of the switchboard or central office access line using the telephone number of the primary listing.

5) Additional listing charges ( except for listings of alternate call numbers and office hours) date from the time the listing is posted on the information records. Information records are posted at the time application for the listing is made, or at the date of issue of the directory, as the Customer may desire. Charges for listings of alternate call number and office hours become effective on the date of the issue of the directory.

6) Customers whose names are cmrently spelled in more than one way may arrange for extra listings of the name as misspelled when such listings will aid in the use of the directory.

c. Special Types of Additional Listings

I) Duplicate and Cross Reference Listings

2) Alternate Call Nwnber Listings

a) Listing of an alternate telephone number, other than those covered under "Office Hour Listings" of this Section, to be called in case no answer is received, is permitted for Customers to all classes of service.

b) The alternate number may be that of a service not under contract with the Customer in connection with whose name it appears. In such case, the consent of the Customer to the alternately listed service must be obtained before the alternate listing is furnished.

c} The regular additional listing rate applies for each alternate call number listing.

3) Foreign Exchange Listings

a) Foreign exchange listings, those are, listings of Customers located in an exchange other than that in which the listed service is furnished, are permitted.

b) A special additional listing rate applies for each foreign exchange listing.

4) Temporary Tenant Listings

b) All billing and contractual arrangements remain unchanged, the Customer being responsible for the payment of all charges.

c) The regular additional listing rate applies for each temporary tenant listing.

5) Office Hour Listings/Line of Information

Listing of office hours or other information which is not required in order to efficiently handle telephone traffic, is not included in the charges for service. Customers who desire that their office hours or additional information appear in connection with their listing, may obtain same by paying the rates for regular additional listings. A phrase directing the method of calling when a PBX operator is not on duty may be listed in the directory at regular additional listing rates whenever night colUlections are provided.

d. Nonpublished and Nonlisted Directory Service

1) Nonpublishcd directory service is a telephone number which is not listed in the telephone directory or the Telephone Company's directory assistance records at the request of the Customer.

2) Incoming calls to nonpublished numbers will be completed by the Telephone Company only when the calling party places the call by number. The Telephone Company will adhere to this practice notwithstanding any claim of emergency which the calling party may present.

3) Information concerning nonpublished numbers will not be disseminated except to telephone companies as deemed necessary for business operations or to law enforcement agencies upon lawful demand.

4) The Telephone Company reserves the right to forward name and address information of nonpublished telephone number service Customers to governmental agencies subscribing to Enhanced 911 Service.

5) Acceptance by the Telephone Company of the Customer's request to furnish nonpublished service does not create a relationship or obligation, direct or indirect, to any person or entity other than the Customer.

6) The Telephone Company shall not be held liable for any damages which might result because of the Customer's telephone number(s) being nonpublished.

7) In the absence of willful misconduct, no liability for damages arising from publishing the telephone number of a Nonpublished Service Customer in the directory or disclosing a nonpublished service telephone number to any calling party shall attach to the Telephone Company. Where such a number is published or is disclosed by a Telephone Company employee, the Telephone Company's liability shall be limited to and satisfied by a refund of any monthly charges which the Telephone Company may have levied for the service.

8) Nonpublished Service rates will not apply in the following cases:

d) Local exchange service involving data terminals where there is not voice service contemplated.

e) A Customer requests nonpublished service due to unusual circumstances, such as harassing calls, threats, or other acts adversely affecting the health, welfare, security, or service of the Customers. (This service ,vill not be provided for a period of more than one month).

9) Nonlisted service is the omission of a Customer's listing from the telephone directory only. It may be obtained from the Directory Assistance operators.

10) The length of contract petiod for directory listings, where the listing actually appears in the directory, is the directory period. The directory period is from the day on which the directory is distributed to the Customers to the day the succeeding directory is distributed to the Customers. Unless the listing no longer serves the Customer because of disconnection, removal, etc., of the service, the minimum contract period will b.e for at least 30 days.

11) The length of a listing may be limited by the use of abbreviations where the clarity of the listing and the identification of the Customer will not be impaired.

B. LOCAL OPERATOR SERVICES

1. Description and Conditions

a. Generally

1) Local Operator Services is the provision of certain types of operator assistance feattrres for the convenience of the Telephone Company's Customers. These feattrres include, but are not limited to, such items as busy verification service, local operator assisted calls, and selective class of call screening. The types of available features offered may be expanded or deleted from time to time when determined to be in the best interest of the Telephone Company or its Customers.

2) The Telephone Company provides services as set forth in this section, however, as a service to its Customers the Telephone Company has also contracted with third parties to make the offorings contained herein available for those Customers requiring them. In third party arrangements the rates and charges apply when costs are passed on to the Telephone Company by contractor( s).

3) No liability shall accrue to the Telephone Company for errors or omissions dtrring the use of operator services except for the rates and charges for each type of service, in which case its liability shall be limited to a refund at the applicable nonrecurring charge or monthly rate for the time the error or omission occurred, after reasonable notice in ,vriting to the Telephone Company.

4) The Customer indemnifies and holds the Telephone Company harmless from any and all liability, damages, losses, claims or demands arising from any actions, omissions, mistakes, or negligence of any kind occurring from the use of operator services.

b. Emergency Handling Procedtrres

1) To enstrre that routing of emergency calls through Telephone Company operators are handled accurately and expediently Telephone Company operators are provided emergency call training. As general practice the operator will take appropriate action necessary to provide any type of emergency assistance needed. However, two basic variations of handling emergency calls exist, one for calls to official public emergency agencies (for example police, fire and ambulance) and another for non-agency calls (for example to an individual end user). The operator is responsible for distinguishing which type of emergency call is to be completed.

2) When processing an emergency agency call the operator identifies where the call originates and where the city and type of agency the call is to be directed. Subsequently, the operator transfers the call to the emergency agency by using a prepared list of readily available agency telephone numbers. In advancing the call the operator ensmes the connection is complete and the conversation is proceeding satisfactorily. The operator does not leave the line until the call has been expedited.

3) If the operator is unable to determine where to send the emergency call, where the call could go to several localities, the operator will ask the caller or com1ect the call to the most appropriate location under the circumstances. The operator will remain on the connection until the correct location is reached.

4) If the operator can not determine the required agency the call will go to the appropriate police department. If the operator can not sectrre a line to the appropriate emergency agency the operator will notify the caller and take any action deemed appropriate.

5) If the calling party leaves the line or requests the operator to report the emergency condition, the operator will report the occurrence to the proper agency giving whatever details the operator can provide.

6) Locally directed calls to emergency agencies are not billed. In cases of emergency calls to emergency agencies from public telephones a call will not be delayed to obtain a deposit.

7) If 911 access is available for emergency calls to the desired community the caller is connected to the emergency agency by dialing "91 l." Location info1mation to E91 l service will not transfer through an operator nor is it possible to accurately maintain 911 service areas. If 911 emergency service is not available within an exchange emergency calls must be handled via Telephone Company operators by end users dialing "O."

c. Busy Verification Service

1) Busy Verification Service is furnished to Customers upon request to provide Line Status or Busy Interrupt for a requested line or trunk.

2) This service is provided where facilities exist for Line Status or Busy Interrupt through a Telephone Company operator.

3) The provision of Line Status involves an operator determining the condition of a line or trunk that a Customer requests to be checked. The status of this line or trunk is verified to the Customer for a charge as listed below.

4) The provision of Busy Interrupt involves an operator interrupting a line or trunk that a Customer requests to be checked. Information concerning the Busy Interrupt to this line or trunk is passed to the Customer for a charge as listed below.

5) No request will be processed on a collect or reversal of charge basis.

d. Operator Assistance

1) Operator assistance is furnished to Customers upon request in order to complete local and toll calls.

2) For the purpose of rate application, local operator assistance charges are categorized as follows: Calling Card, Operator Station, and Person-to-Person calls.

a) Calling Card calls - The Customer dialed Calling Card rate is applicable to "O+" calls which arc completed by the caller or the operator and are billed to the caller's calling card or special billing number. This rate is also applicable when no automatic recording equipment for operator assisted calls is available in order to complete a calling card or special billing number call.

b) Operator Station calls - The Operator Station rate is applicable when calls are completed with the assistance of a Company operator, except as specified for the Customer dialed Calling Card or Person-to-Person type calls. Customer dialed "0-" calls where the operator completes the call and arranges billing are charged the Operator Station rate. The call can be billed to the originating telephone nu_mber, a calling card, the called number (collect), or to a third number.

Operator Station calls also include "O+" calls when the Customer is placing a collect or billed to third number call.

c) Person-to-Person calls - The Person-to-Person rate applies to Customer dialed "0-" calls where the operator completes the call to a designated person or extension. The call can be billed to the originating telephone number, calling card, the called number ( collect), or to a third number.

d) Dial Station-to-Station class of service applies to operator station-to-station calls placed sent paid from residential service lines or trunks which are certified by a qualified authority as services of persons who are disabled and unable to dial telephone numbers. All station-to-station calling card calls charged to the certified line are subject to the charges described below.

Certification is provided upon the Customer's written application to the Telephone Company for each residential line or trunk to be included. Certification becomes effective with the bill following approval of the application. Requests to change to or from certification are not subject to charge. Customers may verbally identify themselves as being unable to dial a call because of their disability. Only the Dial Station-to-Station charges will apply to these sent­paid calls.

e) Customers who verbally identify themselves as being unable to dial a call because of their disability will not be required to pay the operator assisted charge for sent-paid station-to-station calls from pay telephones.

b) Fully-Assisted Station-to-Station

Applies when the customer dials the toll-free number and elects to have the operator place the entire cal. This also applies to calls placed from pay telephones.

The charges listed below are in addition to the rates and charges associated with local or Long Distance Message Telecorrununications Service.

b. Local exchange Customers can dial 411 or 555-1212 to reach an operator to aid in directory assistance for both local and national calling. Customers have the options to request a telephone number, or a name. Customer Name and Address (CNA) Service is a reverse search feature which allows the caller to request a Customer's name and/or address after giving the directory assistance operator a complete phone munber. The Telephone Company will provide listings for residential, business, government, IT-Comm 1-800, and IT-Comm local emergency numbers.

2. Rates

Directory Assistance Service: $1.99 per call

3. Conditions

a. The Telephone Company shall not be liable for any errors or omissions, whether arising through negligence or otherwise, in the information furnished; and the Customer shall indemnify and save the Telephone Company harmless against all claims (including costs and attorney's fees) that may arise from the use of the service.

b. The Customer will have access to any in-or-out-of-franchise, number/address listing within the continental United States, Alaska and Hawaii, with the exception of non-published listings. When a non­published number/address is requested, the message "Non-published number/address" or "NP" is displayed and no information will be available.

c . Charges will apply on requests for numbers which are unlisted or which the operator cam1ot find.

d. A caller may request a maximum of two telephone numbers for each call to Directory Assistance.

1) Calls placed from residential telephones where a member of the Customer's household has been certified by a qualified authority as unable to use a directory or from the business telephone of a certified Customer where other assistance is not available. A qualified authority is defined as including doctors of medicine, ophthalmologists, optometrists, registered mrrses, therapists, professional staff of hospitals, institutions and public welfare agencies. Certification of physical disability sufficiently severe to prevent reading or using conventional reading materials may also be made by professional librarians or by any person whose competence in this area is acceptable to the Librarian of Congress of the United States.

2) Calls from cetiificd exempt Customers and charged to their calling card.

6. A credit allowance will be given, that is, the charge that would otherwise apply will be waived, when a Customer promptly notifies his or her Customer Service Representative, given the following circumstances:

a. The Customer experiences poor transmission or is cut-off during the call to Directory Assistance.

b. The Customer is given an inc01Tect telephone number by the Directory Assistance operator.

EMERGENCY SERVICES (911/E-911)

1 . The Telephone Company will supply the 9 l 1/E-911 service provider in the Telephone Company's service area with accurate information necessary to update the 91 l/E-911 database at the time Telephone Company accepts Customer orders.

2. At the time that the Telephone Company provides basic local service to a Customer, the Telephone Company will make the necessary equipment or facility additions in order to accurately and properly update the database for 911/E-91 l.

E. BASIC INTERCEPT SERVICE

1. Description

Basic Intercept Service is an optional service, which provides new number information to callers dialing changed or disconnected numbers. Dialing the Customer's former number results in a pre-recorded message, which announces the new number.

2. Conditions

a. Basic Intercept Service is offered to residential and business Customers subject to the availability of suitable facilities.

b. The above charges do not apply to company initiated number changes.

c. Basic Intercept Service will not be provided to Customers disconnected for nonpayment.

Telecommunications Relay Service (TRS) enables deaf, hard-of-hearing, or speech-impaired persons who use a telecommunications device for the deaf (TDD) or similar devices to communicate with the hearing population not using TDD. 1. Genernl

DID Service is a special trunking arrangement which permits incoming calls from the exchange network to reach a specific PBX station directly without attendant assistance.

2. Conditions

a. DID Service is available in those central offices which have been equipped for the service.

b. The charges applicable to DID Service contemplate the use of standard Telephone Company equipment and serving arrangements. When equipment or service of a special type is requested and provided, rates and charges based on the additional costs involved to meet the requirements of each case shall apply.

c. Where DID Service is requested on more than one group of central office lines, each group shall be charged for separately. The DID Service desired must be provided on all lines within the group.

d. Sequential numbers may be assigned if blocks of numbers are available and at the discretion of the Telephone Company.

I) A DID sequential number block is a group of 20 telephone numbers in muneric order. The last digit of the first number within the block is a 0, and the last number within the number block must include an odd number in the sixth digit and a 9 in the last digit.

2) Customers requesting that numbers in a sequential number block be removed from the block will be charged a Translation Charge as specified in the Tariff following.

a. Hunting Service applies for any business main line or PBX trunk arranged for hunting which allows completion of an incoming call from a line that is called but is in use to another line in the group, by means of central office equipment. Hunting applies to all but the last line arranged.

c. The monthly rate for each hunting line applies in addition to the rate for the service with which it is associated.

d. Circular Hunt starts at the dialed number and continues in ascending order to the last number in the hunting group. Hunting then proceeds to the first number of the hw1t group and continues thru the group until an idle line is reached or the number just preceding the dialed number is reached. The monthly rate for each Circular Hunt group as specified in B.2, following, applies in addition to the monthly rate for each line in hunt. This service is furnished only when the necessary facilities are available.

e. Preferential Hunt enables incoming calls to a specific number within a hunt group to hunt over a unique hunting sequence of lines within the hunting group. The unique hunting sequence is other than that encountered when a caller dials the first telephone number in the hunt group. The monthly rate for each line in Preferential Hunt as specified in B.3, following, applies in addition to the monthly rate for each line in hunt.

SECTION 7: CONNECTIONS WITH CUSTOMER PREMISES EQUIPMENT

A. GENERAL

1. Customer premises equipment and wiring may be used with the facilities furnished by the Telephone Company for telecommunications service as set forth in this Tariff.

2. This Tariff shall not be construed as to prohibit connection of registered or grandfathered Customer premises equipment or protective circuitry which may be directly connected to the telecommunication network in accordance with Part 68, of the FCC Rules and Regulations.

B. LIABILITY

l. In view of the fact that the Customer has exclusive control of his communications over the facilities furnished him by the Telephone Company, and of the other uses for which facilities may be furnished him by the Telephone Company, and because of unavoidability of errors incident to the services and the use of such facilities of the Telephone Company the services and facilities furnished by the Telephone Company are subject to the terms, conditions, and limitations herein specified.

2. The liability of the Telephone Company for damages arising out of mistakes, omissions, interruptions, delays, errors or defects in transmission, or failure or defects in facilities furnished by the Telephone Company, occurring in the course of furnishing service or other facilities and not caused by the negligence of the Customer, shall in no event exceed an amount equivalent to the proportionate charge to the Customer for the period of service during which such mistake, omission, interruption, delay, error or defect in transmission, or failure or defect in facilities occurs.

3. The Telephone Company shall be indemnified and saved harmless by the Customer or Customers against claims for libel, slander, or the infringement of copyright arising directly or indirectly from the material transmitted over the facilities or the use thereof, against claims for infringement of patents arising from combining with, or using in connection with, facilities furnished by the Telephone Company, apparatus and systems of the Customer; and against all other claims arising out of any act or omission of the Customer in connection with the facilities provided by the Telephone Company.

C. RESPONSIBILITY OF THE TELEPHONE COMPANY

1. The Telephone Company shall not be responsible for the installation, operation or maintenance of any Customer premises equipment. Subject to the provisions of the General Rules and Regulations, telecommunications service is not represented as adapted for use with all Customer premises equipment and, where such equipment is connected to Telephone Company facilities, the responsibility of the Telephone Company shall be limited to the furnishing of facilities suitable for telecommunications service and to the maintenance and operation of such telecommunications service. Subject to this responsibility, the Telephone Company shall not be responsible for (a) the transmission of signals through or generated by Customer premises equipment or for the quality of, or defects in, such transmission, or (b) the reception of signals by Customer premises equipment.

2. The Telephone Company shall not be responsible to the Customer or otherwise if changes in the Network Protection criteria as set forth in this Tariff section, or in any of the facilities, operations or procedures of the Telephone Company render any Customer premises equipment obsolete or require modification or alteration of such equipment or otherwise affect its use or performance.

RESPONSIBILITY OF THE CUSTOMER

1. Where telecommunications service is available under this Tariff for use in connection with Customer premises equipment, the operating characteristics of such equipment shall be such as not to interfere with any of the services offered by the Telephone Company.

2. The Customer shall subscribe to Telephone Company facilities which are in parity with the operating characteristics of the Customer premises facilities.

3. Such use is subject to the further provisions that the Customer premises equipment does not endanger the safety of Telephone Company employees or the public; damage, require change in or alteration of the facilities of the Telephone Company; interfere with the proper functioning of such facilities; impair the operation of the telecommunications system or otherwise injure the public in its use of the Telephone Company's services.

4. Upon notice from the Telephone Company that the Customer premises equipment or wiring is causing or is likely to cause such hazard or interference, the Customer shall make such change as shall be necessary to remove or prevent such hazard or interference.

5. The Customer shall be responsible for the payment of all Telephone Company charges for visits by the Telephone Company to the Customer's premises where a service difficulty or trouble report results from the Customer premises equipment or wmng.

E. VIOLATION OF REGULATIONS

Where any Customer premises equipment is used with telecommunications service in violation of any of the provisions set forth herein, the Telephone Company will take such immediate action as necessary for the protection of the network, and will promptly notify the Customer of the violation.

To protect the telecommunications network and the services furnished to the general public by the Telephone Company from ham1ful effects, the Customer premises equipment must comply with the following minimum network protection criteria:

1. To prevent excessive noise and crosstalk in the network, it is necessary that the power of the signal which is applied by the Customer premises equipment to the network be limited so that the signal power at the output to the network (that is, at the input to the Telephone Company line) does not exceed 9db below one milliwatt when averaged over any three second interval. However, to permit each Customer, independent to distance from the central office, to supply signal power which at the central office approximates 12db below one milliwatt when averaged over any three second interval, the Telephone Company, at the Customer's request, will specify, for each Customer location, the signal power at the output of network control signaling unit (that is, at the input to the Telephone Company line), which shall in no case exceed one milliwatt.

2. To protect other services, it is necessary that the signal which is applied by the Customer premises equipment to the network control signaling unit located on the Customer's premises meet the following limits at the output of the network control signaling unit (that is, at the input to the Telephone Company line):

a. The power in the band from 3,995 Hertz to 4,005 Hertz shall be at least l 8db below the power of the signal as specified in C. l. preceding.

b. The power in the band from 4,000 Hertz to 10,000 He11z shall not exceed 16db below one milliwatt.

c . The power in the band from 10,000 Hertz to 25,000 Heitz shall not exceed 24db below one milliwatt.

d . The power in the band from 25,000 Hertz to 40,000 Hertz shall not exceed 36db below one milliwatt.

e. The power in the band above 40,000 Hertz shall not exceed 50db below one milliwatt.

3. To prevent the interruption or disconnection of a call, or interference with network control signaling, it is necessary that the signal applied by the Customer premises equipment to the network control signaling unit located on the Customer's premises be limited so that the signal at the output of the network control signaling unit (that is, at the input to the Telephone Company line) shall at no time have energy solely in the 2,450 to 2,750 Hertz band. If there is signal power at the output of the network control signaling unit in the 2,450 to 2,750 Hertz band, it must not exceed the power present at the same time in the 800 to 2,450 Hertz band.

G. REGULATIONS APPLYING TO SPECIFIC TYPES OF EQUIPMENT AND FACILITIES

1. Recording Equipment

a. General

Teleconununications service fmnished by the Telephone Company is not represented as adapted to the recording of telephone conversations. However, Customer premises recording equipment may be used in connection with telecommtmications service subject to the following conditions:

Recording of Two-Way Telephone Conversations

l) Recording equipment shall be equipped with or connected to a recorder tone device automatically producing a distinctive recorder tone that is repeated at intervals of approximately fifteen seconds when the recording equipment is in use, except as follows:

2) Such distinctive recorder tone need not be produced when the recording equipment is used by a Federal Communications Commission-licensed broadcast station Customer for the recording of two way telephone conversations solely for broadcast over the air.

3) Recorder connector equipment without the recording tone device is allowed in connection with public fire and/or police service for the recording of two way telephone conversations) provided that proper public authority certifies that the service will be used exclusively for receipt of emergency fire and police calls.

4) The distinctive recorder tone need not be produced when the recording equipment is being used by the United States Secret Service of the Department of Treasury for recording of two way telephone conversations which concern the safety and security of the person of the President of the United States, members of his immediate family, or the White House and its grounds.

5) Such distinctive recorder tone need not be produced when the recording equipment is being used for recording at United States Department of Defense Command Centers of emergency communications transmitted over the Department ofDefense)s private line system when connected to Long Distance Message Telecommunications Service.

2. Automatic Announcement Equipment

a. General

Customers providing automatic announcement service must subscribe to a sufficient number of central office access lines to handle adequately the volume of telephone calls received without interfering with any of the services offered by the Telephone Company. In the event that the use of such Customer premises equipment causes such interference) the Telephone Company shall have the right to discontinue service.

b. Public Announcement Service

1) For purposes of identification, Customers of telephone service who transmit recorded public announcements over lines provided by the Telephone Company must include in the recorded message the name of the organization or individual responsible for the service and the address at which the service is provided.

SECTION 8: INDIVIDUAL CASE BASIS AND PROMOTIONAL OFFERINGS

A. INDIVIDUAL CASE BASIS OFFERINGS

Arrangements will be developed on a case-by-case basis in response to a bona fide request from a Customer or prospective Customer to develop a competitive bid for a service not generally offered under this Tariff. ICB rates will be offered to the Customer in writing and on a non-discriminatory basis. Further, certain offerings may be made on a contract basis pursuant to Title 291, Article 5 § § 003 .18 of the Nebraska Public Service Commission Telecommunications Rules and Regulations.

B. PROMOTIONAL OFFERINGS

The Telephone Company, from time to time, may make promotional offerings of its services which may include waiving or reducing the applicable charges for the promoted service. The promotional offerings may be limited as to the duration, the date and times of the offerings and the locations where the offerings are made.
