WHEN A COVER-UP EQUATES TO MURDER

A defective and proven to be deadly smoke detector has been marketed into more than 80 million U.S. homes. This incredible and four decades long fraud has caused the deaths of at least ten

thousand children and horrible injuries to probably 50 thousand more. Perhaps the most horrific part of this crime against humanity is that those who sold the deadly “safety device” did

so with the cooperation of federal agencies including FEMA, CPSC and NIST.

I realize that a claim that defective smoke detectors were sold to unsuspecting consumers with the cooperation of federal agencies, agencies that falsified fire research and covered up the failures for more than three decades, is virtually beyond belief. So, the first evidence I present to you to confirm the impossible actually happened is my report entitled, The Legal Cause of Fire Deaths. Let me remind you that the cover-up of the crimes of the pedophile priests went on for at least four decades, more likely eight, before the media finally broke the story. I can guarantee you that the smoke detector crimes have been far more destructive of children than were the wayward priests.

Fortunately, within recent years, those who refused to remain silent as the children burned have finally conducted live fire tests and independent investigations that prove: The marketing of the ionization type smoke detector has been probably the deadliest fraud ever pulled off within the United States – and with federal government complicity. Obviously, it is a criminal act when a defective safety device is sold to the public with the help of blatant performance lies plus deliberately falsified fire testing. But what many people, including fire department officials, do not seem to realize that it also is a crime to be aware of this serious fraud and help hide the endangerment from the public. Those who are or become aware of the endangerment have a legal obligation to warn the public. To fail to do so makes the person a co-conspirator with the criminals. To help conceal the endangerment due to a defective safety device that could kill would be considered criminal negligence. Criminal negligence equates to second degree murder.

was a friend of Timothy McVeigh, the man who bombed the Murrah federal building in Oklahoma City causing 168 deaths. Fortier did not play a role in the bombing. However, he knew that McVeigh was going to bomb the building and failed to warn the authorities. If he had warned the authorities of the plot the bombing and the deaths could have been prevented. Therefore, the failure to warn was a criminal act and a contributor to a large number of deaths. Fortier became a witness for the prosecution and helped convict McVeigh. However, that did not save him from paying for his personal disrespect for human life. He was sentenced to twelve years in prison. Fortier said he never thought the bombing plot could “…bear such rotten fruit”.

There is a lesson here for those who have been aware of the defective nature of the ionization device, or who now become aware of the endangerment, and fail to take appropriate action. The action required of fire department officials is obvious: They must provide full and honest disclosure of the endangerment posed by a smoke detector that will fail to warn of fire in a timely manner more than 50 percent of the time when brand new with a fresh battery. As the device ages the reliably will fall. If the field performance of the device is compared to the extravagant and false performance claims as they were advertised in the Fire Journal of the National Fire Protection Association (NFPA) during the early years of promoting it (from 1965 until 1982), the device has a 100 percent failure rate.

Fortier was sentenced to 12 years as a result of a crime that destroyed 168 lives. From the mid 1960s when the smoke detector fraud was initiated I calculate that there have been approximately 75,000 fire deaths and about five times that many serious injuries in homes as a result of the phony ionization smoke detector failing to warn in a timely manner, or not at all. Far too many of the victims were little children. What length of jail time would be appropriate for concealing the defects of this deadly device from the consumer? It’s something to think about.

Advice to Fire Department Officials: To avoid future criminal charges for “failure to warn” is one excellent reason for providing the public with full disclosure. There is an even more compelling reason to comply with the law. As every fire official knows, pre-school children are especially vulnerable to house fires because they are unable to adequately react to the danger and because they spend most of their time in the home. The second and more important reason for full disclosure is to save many children from an incredibly horrible fate.
