1. I am, by no choice of my own in a situation where I have become homeless and have lost most of my possessions and have been lied to, deceived and cheated by the Defendants above. This has caused serious illness and deprivation to myself. I have been communicating with the Defendants in relation to resolving the situation I have been unlawfully placed in. The Defendants have for a number of years now largely refused to address my serious matters. I believe the Defendants have also in a matter in total opposition of Australia’s Democratic System stopped my correspondence by Australia Post Registered Mail, Email, Facsimile etc from reaching the eyes and ears of the Elected Councillors of our Local Government.

2. My situation has become so desperate that I have no option but to appeal to the Courts to assist me with Justice and Humane Fairness. Attached to this Affidavit is my basic statement of claim which I have sent by Australia Post Registered Mail to ALL Cairns Regional Councils’ Elected Councillors and the Chief Executive Officer. I have also sent this basic statement of claim to

ALL of these persons by email. I have also sent numerous emails to the above persons pleading for Justice. My basic statement of claim has been sworn on Affidavit taken on the 4th November 2010 at the Supreme Court, Brisbane Registry and filed under Brisbane Registry Number 6528/07 and also sworn on Affidavit on the 2nd December 2010 at Mallacoota, Victoria. I believe that both of these Affidavits should be examined fully by the Court along with my basic statement of claim.

3. My basic statement of claim letter dated the 18th May 2010 which I have sent to the Defendants and all of their Councillors, the Queensland Ombudsman all appropriate Government Ministers and Government Departments at both State and Federal levels. Unfortunately it appears that all of these parties are fearful to address all of the Inhumane Lawless matters within this 68 paragraphed letter of 9 pages in typed form and addressed to Cairns Regional Council and dated 18th May 2010. I wish to Affirm that all the contents of this 9 page 68 paragraph letter to Cairns Regional Council dated 18th May 2010 is true and accurate to the best of my knowledge.

4. At this point in time the Defendants are still refusing to address the whole contents of this letter. In fact no Councillors of the Cairns Regional Council have ever responded to me and the basic consensus of all of the other parties that I have sent my letter of claim to has been to say: “The Queensland Ombudsman must deal with my matter”. Unfortunately the Queensland Ombudsman will not respond to me. Some parties such as: Peter Garrett MP, Minister for the Environment have written to me stating that he has sent my complaint to Robert McClelland MP, Commonwealth Attorney-General and I have had no response from this Attorney-General.

5. I do have in my possession many letters from Politicians such as: Prime Minister, Julia Gillard and numerous other Commonwealth and Queensland Politicians all of which show concern for the seriousness of my complaint but actually never do anything.

6. I also wish to rely on a number of letters, diagrams, charts and tables written by myself and previously sworn in form of Affidavit on 10th September 2007 and witnessed by Mr. Mark Hogan a Solicitor with Kennedy and Cooke, Merimbula, NSW and filed in the Brisbane Supreme Court under File Number 6528/07. I have attached this Affidavit and its’ contents along with my statement of claim.

7. The following is a list of matters that as far as I know under UCPR Court Rules 1999; Rule 150. Please refer to paragraph 4 of my complaint dated 18th

May 2010 as I found that my Carer’s property was unfit for human habitation and I had nowhere else to live or take shelter, I believe it is obvious that I was in a situation that due to the overall PUBLIC NUISCANCE of the Council and the situation only existed due to the serious NEGLIGENCE of the Council due to their total lack of PERFORMANCE.

8. In relation to paragraph 5 of my complaint under Rule 150 of UCPR, I found myself in a situation of DEPRIVATION OF LIBERTY TO TRAVEL, PURCHASE FOOD SUPPLIES, and NOR THE ABILITY TO USE ELECTRICALLY OPERATED HEALTH AIDS AND THIS IS DUE TO THE COUNCILS’ NEGLIGENCE AND PUBLIC NUISCANCE.

9. In relation to paragraph 6 of my complaint, I believe that Council was and still in a situation of ILLEGALITY and the situation appears to be with MALICE OR ILL WILL and having no regard whatsoever for the basic human rights of the Residents of the area. I have since found out that the stopping of most services including essential services such as: Electricity was done with the use of DECEPTION AND TRICKERY BY SUCH THINGS AS FORGERY such as: the Forged DCP 3 Document which is addressed further in this complaint.

10. In relation to paragraph 8 of my complaint, I was due to the TRICKERY AND CHEATING by the Council; I was forced to then, along with my Carer Michael Mathews to pay rent in other areas.

11. In relation to paragraphs 9, 10, 11, 12 and 13 of my complaint, it is clear to see that as a Lawful Caring Person, I then felt obliged along with my Carer to assist another Cow Bay Community Resident, Mr. Kevin McDonald in order to assist him to survive as he was also a Victim of years of ILLEGALITY against himself. The UNCONTIONABLE CONDUCT of the Council almost caused Mr. McDonald’s death. Of the work we did in assisting Mr. McDonald also caused more serious stress and trauma to myself and my Carer.

12. In relation to paragraph 14 of my complaint, these matters are covered in depth in my Affidavit dated: 10th September 2007 which is now Exhibit G in File Number 6528/07 at the Brisbane Supreme Court Registry shows the ongoing ILLEAGALITY, PUBLIC NUISCANCE AND NEGLIGENCE of the Council.

13. In relation to paragraph 15 of my complaint, it is best to refer to my Affidavit dated 10th September 2007 as is noted in paragraph 12 of this document. The Refrigeration tests done speak for themselves and clearly show that the

Unlawful stopping of our Electricity Supply has caused serious health problems in our Community.

14. In relation to paragraphs 16, 17 and 18 of my complaint, further show damages done to our whole Community as a result of ILLEGALITY, CHEATING, TRICKERY AND DECEPTION causing gross inhumane PUBLIC NUISCANCE.

15. In relation to paragraph 19 of my complaint, the Defendants are well aware of the Daintree Future Study and I can and will bring the complete copy of this report to the Court in person.

16. In relation to paragraphs 20 and 21 of my complaint, shows the unending desire of Council to CONCEAL TRUTH with the tragic results in the death of Mr. Steve Terry, GROSS NEGLIGENCE.

17. In relation to paragraphs 22 and 23 of my complaint, these paragraphs show that I have worked extremely hard in attempts to bring Justice to our Community at Cow Bay and please note that Jason O’Brien our Local Member of Parliament had demanded for the Council to be sacked.

18. In relation to paragraphs 24, 25, 26, 27 and 28 of my complaint, from a Public Interest point of view and in the best Interest of Natural Justice these matters need to be thoroughly investigated, the Crimes and Misconduct Commission are well aware of this situation but have refused to make any comment or take any action.

19. In relation to paragraphs 29, 30, 31, 32 and 33 of my complaint, these paragraphs show the need again, for thorough investigations needed including Criminal investigations in regards to the total destruction of Democratic Process and the hidden (occult) methods and behaviours of Council and other Officials in relation to all matters North of the Daintree River, which includes Cow Bay of course.

20. In relation to paragraphs 34 and 35 of my complaint, Council has never denied the fact that the whole Council has always voted and resolved that the Mains Electricity Power Supply MUST BE COMPLETED FOR THE PEOPLE OF COW BAY AS IT IS THEIR HEALTHFUL, LAWFUL RIGHT TO ESSENTIAL SERVICES IN COMMON WITH ALL OTHER CITIZENS. Although Council has never denied this fact, Council had

unknown to the people of Cow Bay placed a secretive ban on my/our Mains Electricity Supply to be completed by the use of their FORGED D.C.P 3. 3.2.-3.2.1. a, b, c, d, e, f, g ,h, Document. This Document has apparently been used in many ways unknown to the Residents of Cow Bay, but we do know it was used in a form of DECEPTION AND TRICKERY in the 1998 Environmental Impact Statement for Ergon Energy and the Minister for the Department of Mines and Energy certainly should have known that this Document was a FORGERY, I would like to call upon Mr. Michael Mathews to give evidence to the Court in relation to this matter.

21. In relation to paragraphs 36 and 37 of my complaint, these paragraphs speak for themselves.

22. In relation to paragraphs 38, 39, 40 and 41 of my complaint, these paragraphs again, show the continuing efforts of our new Council, the Cairns Regional Council to continue with the DECEPTION, TRICKERY, CHEATING, BREACH OF LOCAL GOVERNMENT RULES AND COMPOUNDING THE INHUMANE PUBLIC NUISCANCE to the Residents of Cow Bay.

23. In relation to paragraphs 43, 44, 45 and 46 of my complaint, these paragraphs quite clearly show ongoing NEGLIGENCE in relation to the safety and health of its’ Residents of Cow Bay. Attached to this Affidavit are photographs in relation to these matters.

24. In relation to paragraphs 47, 48, 49 and 50 of my complaint, these paragraphs describe the situation where I have been DEFRAUDED of my basic rights causing great financial expenses which have due to Councils’ behaviour become great waste of my money as Council reneged by BREACH OF CONTRACT OR TRUST after refusing to abide by Councils’ resolution to quote; “Initiate engagement on the provision of power north of the Daintree River”. Where at the same extraordinary meeting called by Members of the Council on or about the 2nd of April 2007 and reported in the Mossman Port Douglas Gazette Newspaper on the 5th April 2007. Councillor George Pitt added an amendment that quote; Council does not support any impediments to this process.” This amendment was also accepted by the full Council. The fact that this extraordinary meeting was called and Council voted again to allow us Residents of Cow Bay to finally have our Mains Electricity Power Supply completed proves conclusively that Council had SECRETIVELY had a hidden ban on our Electricity Supply completion for many years. Our Council had finally been EXPOSED for their ILLEGAL, INHUMANE PUBLIC NUISCANCE and the fact that

Council had been completely trashing ALL LAWFUL DEMOCRATIC PROCESS for many years had finally become Public Knowledge. *The Article mentioned above from our Local Newspaper is also attached to this Affidavit. Please refer to page 1 of Exhibit A. Apparently at this extraordinary meeting our Councillors’ such as: Mr. Bill Bellero were calling out for a return to Democracy and to get rid of the Dictatorship.

25. Why our Local, State and Federal Politicians and Law Enforcement Officials have never taken action against the Perpetrators of these Crimes is astonishing and in fact further LAWLESS behaviour. Many other Local Government Councils in Australia have been abolished and have had Government Administrators put in place in situations such as this.

26. In relation to paragraphs 51, 52, 53, 54, 55, 56, 57, 58 and 59 of my complaint, these paragraphs clearly show the Extreme Harm done to myself and the Destroying of my/our basic rights and the Total Removal of my ability to live in a Safe and Healthy Environment again due to the DECPECTION, TRICKERY, CHEATING, PUBLIC NUISCANCE, MALACE AND ILL WILL, FRAUDALENT AND ILLEGAL NEGLIGENT BEHAVIOUR of our Local Government Council, the Cairns Regional Council which has chosen to continue the OBSCENE INHUMANE ABUSE OF OFFICE just like the former Douglas Shire Council.

27. In relation to paragraphs 60, 61, 62, 63, 64, 65 and 66 of my complaint, I have sent my basic 68 paragraph statement of claim far and wide to Politicians, Government Departments, Police, Women’s Groups, Organizations Assisting Disabled People, Church Groups and Media Organizations. In most instances people appear to be fearful to comment as they seem to be aware that the behaviour of our Council is a type of hidden GENOCIDE and they realize that this behaviour is being condoned by State and Federal Government by their SILENCE. I have had numerous responses but they keep suggesting that I should continue to write to our Local Council to have these matters addressed, the problem is that I have been doing this for quite a few years now and I know that many other Residents of the Cow Bay District have also been doing this for many years but to no avail. Just a wall of SILENCE from Council.

28. In relation to paragraph 67 of my complaint which shows a clear ADMISSION from the former Mayor, Mike Berwick in regards to the great harm and DAMAGES done to us Cow Bay Residents.

29. I repeat again that I have attached a number of documents to this Affidavit in support of my claim which can be examined if necessary in the Supreme Court.

30. I am quite willing to negotiate a fair and just compensation settlement with Council, I am also quite willing to undergo Court Mediation with Council but at this point in time Council have shown that they are totally unwilling to communicate in any way.

31. Please refer page 2 of Exhibit A, this letter is mentioning the INHUMANE ABUSES and the EXTREME HARM DONE, another recent Suicide of a Cow Bay Resident and the well known matters of CRIME in the District.

32. Please refer page 3 of Exhibit A, this is a Desperate Plea for Help on behalf of my Carer for both of us.

33. Please refer page 4 of Exhibit A, this is another Plea for Help pointing out the POLITICAL VIOLENCE against the Residents of Cow Bay.

34. Please refer pages 5, 6, 7, and 8 of Exhibit A, these 4 pages of Exhibits are a letter from myself to the Cairns Regional Council, dated 25th August 2010. The contents of this letter are very SERIOUS MATTERS OF ILLEGALITY AND OBSCENE INHUAME BEHAVIOUR BY OUR COUNCIL. And Council still refuses to respond.

35. Please refer page 9 of Exhibit A, this is a letter from the Hon Peter Garrett, Minister for Environment, referring our matters of complaint to: the Commonwealth Attorney-General, Robert McClelland MP, as expected we have never received a response addressing our issues.

36. Please refer page 10 of Exhibit A, this is another of many letters that I have sent to the Cairns Regional Council, this letter speaks for itself and still Council will not respond.

37. Please refer to pages 11, 12 and 13 of Exhibit A, this letter to Saint Vincent De Paul Society dated the 14th August 2010, in relation to all of my furniture and possessions at my home at Cow Bay. My Carer had made an arrangement with St Vincent De Paul Society at Bairnsdale, Victoria, for me to donate all of my possessions to St Vincent De Paul Society as described on page 13. My Carer, Michael had spoken with Jim at Bairnsdale St Vincent De Paul and Jim contacted Cairns St Vincent De Paul Society to arrange for them to pick up all of my possessions. Ultimately Jim reported to my Carer that the Cairns Regional Council had intervened in the process and as far as I know my

possessions were never picked up by St Vincent De Paul Society. I would like to rely on my Carer, Michael Mathews to explain to the Court what has happened and also explain to the Court matters involving Mr. Rob Reilly of the Cairns Regional Council as I believe that Rob Reilly was FALSEY acting as a LEGAL REPRESENTATIVE FOR THE COUNCIL which I believe is a FALSE ASSUMPTION OF AUTHORITY and behaving in a manner of FALSE PRETENSE. This appears to be due to the fact that NO Councillors’ nor Councillors’ Solicitors will respond to my Pleas for Justice, so I suggest that the only assumption that can be made is that Senior Members of Council have somehow fooled or paid Mr. Rob Reilly to PRETEND TO BE COUNCILS’ LEGAL REPRESENTATIVE.

38. Please refer to page 14 of Exhibit A, this document is about Pollution matters such as: Noise etc, our Highly Toxic and Totally Unaffordable Generators are in BREACH of Councils’ own LAWS. It is effectively ILLEGAL for me to use a Generator in our Residential Area. I would like to rely on my Carer, Michael Mathews again to explain the situation of large scale Pollution and ALL matters involving the ILLEGAL USE OF GENERATORS AND THE ILLEGAL STORAGE OF LARGE QUANTITIES OF COMBUSTIBLE FUELS AND ILLEGAL TOXIC CHEMICAL STORAGES FORCED UPON THE RESIDENTS OF COW BAY. I also wish to rely upon the video featuring Mr. Bob Perry on the Amazing Australia Website. Bob Perry is also a Local Genuine Environmentalist. (Not one of the pretend Political environmentalists).

39. Please refer to page 15 of Exhibit A, these 2 photos show the EXTREMELY DANGEROUS STATE OF OUR ONLY ACCESS ROAD to my home. This road is in such a DANGEROUS STATE that it is quite obviously ILLEGAL for our Council to keep this road open for Public use. This road had been in this state for approx 2 years as ALL Local Residents are well aware. I wish to rely on my Carer, Michael Mathews again to explain the SAFETY ISSUES CONCERNING OUR ROAD AND THE DAINTREE RIVER FERRY TO THE COURT.

40. Please refer to page 16 of Exhibit A, these 2 photos show my Carer, trying to remove truck and caravan from being stuck in my driveway due to Council NEGLIGENCE and again I wish to rely on my Carer, Michael Mathews to explain to the Court. My driveway and our main road had become in such a dangerous state that I then was trapped on my property as I was too fearful to drive.

41. Please refer page 17 of Exhibit A, these 8 photos show the full extent of both my and my Carers’ efforts to renovate, decorate, paint and establish gardens to my home with the promise of having our Mains Electricity Supply completed after the lifting of the SECRETIVE, UNLAWFUL BAN ON OUR ELECTRICTY SUPPLY. This would also have allowed our Cow Bay General Store and Service Station to re-open as it was forced to close because of the impossible high costs of Diesel Fuel to run its’ Toxic Polluting Generators. We then would have had at least basic food supplies.

42. Please refer page 18 of Exhibit A, this photo shows the extremely expensive new gas fridge and new gas stove I bought in order to finally establish somewhere to live as for my whole life I had NEVER had a SAFE, SECURE PLACE TO LIVE.

43. Please refer pages 19, 20 and 21 of Exhibit A, these 8 photos show the extent that I went with the help of my Carer to establish a SAFE, SECURE HOME for myself. Please also note in the top photo of page 21 that I had very good friendly relationships with our local cassowaries whom spent a great deal of time existing peaceably at my home with me. I did extensive work in decorating and gardening and was existing in a wonderfully peaceful manner with our native flora and fauna for a short period of time whilst awaiting our Council to finally fulfil its’ promises to allow our Electricity Supply to be Completed and to let us live in peace. But unfortunately due to our new Council Regime of the Cairns Regional Council choosing to go back to the dark INHUMANE ways of the previous Douglas Shire Council under the Illegal Dictatorship of Mayor Mike Berwick. My ability to live in my home in a peaceful manner with my cassowary friends was destroyed.

45. Please refer pages 24, 25, 26 and 27 of Exhibit A, these next 5 photos show how both myself and my Carer ended up living nowhere. Please take note of page 27 and the photo of my tent after living in the harsh elements. We had to leave our home as we had drug dealers living next door, the Local Police said it was not safe for us to remain in the Cow Bay District as I had provided a great deal of evidence of Criminal behaviour within our Council and I had assisted the Police with information in regards to wide spread Criminal Activity in our District, which I believe has been largely because of the ILLEGAL behaviour of the Council which caused almost total unemployment in our District hence people turn to Crime in order to Survive and this is why

we ended up homeless. I rely on my Carer, Michael Mathews to explain this further to the Court.

46. Please refer pages 28, 29 and 30 of Exhibit A, as this ABC News Article shows that more and more older women are being forced into the ranks of homelessness and yet in my case I did have a home and my Local Council (and unfortunately appears to be assisted by the Queensland State Government) have completely taken away my ability to live in my home in a manner common to at least most other Australians. Our Local Council has added enormously to the shortage of liveable housing by UNLAWFULLY REMOVING ALL BASIC HUAMN RIGHTS. As being a whole total of life Victim of Crime, this Article speaks on the mental health problems caused by homelessness, my own Anxiety has increased severely with being homeless, by NOT having a SAFE, SECURE home to live in, it has also increased ALL of my own serious health problems, e.g. living in harsh conditions in the middle of winter with still NO access to Doctors, Chemist, Shops and of course with still NO electricity. I rely on my Carer, Michael Mathews to explain this further to the Court.

47. Please refer page 31 of Exhibit A, this document clearly speaks for itself.

48. Please refer pages 32, 33 and 34 of Exhibit A, these 3 pages written by the Office of the United Nations; Declaration of Basic Principles of Justice for Victims of Crime and Abuse of Power. Taking into consideration ALL the HARM and DAMAGES done to myself, I believe I have the Lawful Right to call upon this Document in support of my claim. And again I rely upon my Carer, Michael Mathews to further explain this to the Court.

49. Please refer page 35 of Exhibit A, this Document speaks for itself. I rely on my Carer, Michael Mathews to explain this further to the court as I am now so traumatised by the actions and omissions of both the former Douglas Shire Council and the now Cairns Regional Council.

50. Without the Healthy Mains Electricity that was by Law to be supplied to every Residential Household within the District of Cow Bay as with any land subdivided and made Residential in Australia, this ILLEGAL BAN, STOPPING OF OUR MAINS ELECTRICITY SUPPLY FROM BEING COMPLETED, has caused for ALL Residents of Cow Bay severe HARM and for myself as this District is in the wet tropics, without Mains Electricity I cannot live at my home as I do have chronic asthma and the mould causes me to not be able to breathe and then I have to continually leave my home, just so as I can breathe. As I have collapsed and had to be resuscitated during my

CURFEW hours by my Carer. As a disabled pensioner I have 2 life threatening illnesses and when I try and live at my home in Cow Bay both of these illnesses cannot be managed as when I live in other areas with Normal Mains Electricity. I am now emotionally traumatised every time I try and live at my home in Cow Bay due to the sub human treatment that I have to endure there. The Obscene emotional trauma of being locked down (ILLEGALLY IMPRISONED) each and every night from midnight until 6 am, as far as I know this situation is unknown in Australia and has never occurred in Australian History. As I am a victim of crime for the whole of my life I am deeply appalled that I need to have my photo taken, put on a plastic card with my address, just to cross the river ferry to my home this causes more trauma by the ILLEGAL IMPOSING ON ME OF LIVING UNDER A CURFEW IN “FREE AUSTRALIA”. With my extensive Medical needs and whilst I try to live at my home in Cow Bay, I have NO access to Doctors, Hospitals etc, 24 hours per day and when I am ILLEGALLY UNDER THIS CURFEW I AM STUCK WITH LIFE THREATENING CONDITIONS. As basic Humane Infrastructure has been ILLEGALLY STOPPED to my home, I even have difficulty to get a Telstra Landline Telephone as there were not enough lines put in place to ALL the Residential Properties. My home and ALL other Residential Properties have NO Mobile Phone Coverage. When I eventually do get a Landline Phone (which usually takes contacting the Telecommunications Ombudsman) then if I want to have Internet Coverage, then this is only a dial up service that works spasmodically or I can choose to have Satellite Internet that completely drops out due to the heavy rains in the wet season, so neither of these options I can use whereas when I am living in Normal conditions away from my home at Cow Bay, I have Mobile Phones, Mobile Internet and the choice of Landline non dial up Internet use as well as Libraries, Internet Cafes, Community Centres etc. When I am homeless and not trying to live at my home in Cow Bay I manage my chronic asthma as I do not have the mould spoors on my lungs and if I have a severe attack of asthma I can use my nebuliser (which I need Electricity to plug it into) not like when I try to live at my home in Cow Bay with NO Mains Electricity. Also at my home in Cow Bay I have NO lighting, NO healthy refrigeration, NO security lighting (and as a victim of crime I have had death threats), NO television and I cannot go out at night to other areas south of the Daintree River that have these facilities as I cannot afford to miss the last ferry at 11.45pm to take me back to my ILLEGALLY IMPOSED GAOL. I have been deprived of ALL Basic Human Needs, I have spent ALL of my savings on rent in living in other areas of Normalcy which then I have had to buy Normal Electric Fridges,

more furniture etc, that everyday free Australians take for granted. I have been treated worse than a Criminal, as at least in Prisons there is access to Doctors, Electricity, and Television etc and yet I have NEVER broken the LAW.

51. I also wish to rely on the contents of the Government Publication known as: “The Daintree Futures Study” and the Government Publication known as: “Evaluation of the Daintree Rescue Program”. 56. All Australian Citizens and Residents have a Duty of Care under Law to behave in a manner that is beneficial to the Rights and Wellbeing of ALL other Australian Residents. In simple terms under Queensland Criminal Law this is known as: “Duties relating to the preservation of human life”, refer: Judge Reginald Francis Carter’s, “Criminal Law of Queensland”. Judge Carter’s writings are very much in accordance with the teachings of “Christ Jesus” of Nazareth. Example: “Do unto others as you would have others do unto you!”. This is the basis of our Common Law today. And the following quotes by Christ Jesus: “The Truth shall set you free” and “Love Conquers ALL things”. My claim is truthful and seeks freedom from Tyranny. If the Court loves Justice then my claim will be Upheld and Finally Conquer the Evil Deception of Politics for ALL Australians. Under Australian Law and Basic Moral Values (Aussie Values) it is Illegal to Harm or cause Damages to ANY Australian Citizens or Residents, even if the Damages occur by Accident, Compensation must be paid!
