OFCCP MISSION

To enforce for the benefit of job seekers and wage earners, the contractual promise of affirmative action and equal employment opportunity required of those who do business with the Federal Government.

Three Legal Authorities

1. Executive Order 11246, as amended

2. Section 503 of the Rehabilitation Act of 1973 (Section 503), as amended

3. Vietnam Era Veterans’ Readjustment Assistance Act of 1974 (VEVRAA), as amended

41 CFR 60-1.5(a) (7) Work on or Near Indian Reservations

• It is not a violation of the equal employment opportunity clause for contractors to extend a publicly announced preference in employment to Indians living on or near an Indian reservation.

• “Near” is defined as the area where a person seeking employment could reasonably be expected to commute to and from work in the course of a day.

• Contractors extending Indian preference shall not discriminate on the basis of religion, sex, or tribal affiliation.

• Using Indian preference shall not excuse the contractor from complying with other requirements of the Chapter 60 regulations.

• Established linkages with tribes and federal contractors working on mega construction projects

• Signed a Memorandum of Understanding between OFCCP and the Council for Tribal Employment Rights

• Organized panel discussions to address Indian and Native American employment issues

• Ongoing training for OFCCP staff on best practices for reaching out to tribal communities and organizations

• Partnering with federal and state agencies
