What Is A Trademark?• Trademark is “a unique sign, design or expression which identifies

products or services of a particular source from those of others.” • Trademarks can be in the form of a picture, symbol, name, signature, word,

letter, shapes, number, sound, etc. (Nike, Coca-Cola, Starbucks, etc.). • Any form of unauthorized usage is called infringement, and the owners

have the right to take legal action against this type of usage.• Trademarks are in the ownership of a business or individuals, however,

they can be used from other parties through their licensing process.• Licensor has the ownership of the trademarks and licensee is authorized to

use the trademark for a period of time.

• Pike Place Market Preservation and Development Authority (PDA) is the owner of all rights, title, and interest in certain trademarks which graphically represent the Pike Place Market. These trademarks are:

• PDA licenses other parties to use these trademarks for uses that will enhance the image of the Pike Place Market.

• The proposed licensed use is consistent with all the primary purposes listed in the slide before. 

• Does not create confusion in the mind of the consumer.• The licensing partners or “licensee” must agree to use the

trademark only in a way that will reflect positively on the Pike Place Market.

• The PDA can enforce against the infringing on its trademark rights to stop the unauthorized use in order to protect its trademark rights and the integrity of its business.

Standards and RegulationsAll licensed products must be consistent with the high standards established for Permitted Arts and Crafts: • The licensee must be closely involved with the design of each article.• The licensee must be closely involved with the production of each
