The regular meeting of the Board was called to order by President Farley with the following members present: Mr. George A. Farley, President, Mr. Sol Levinson, Vice-president, Mr. J. Jerome Framptom> Treasurer,. Mr. Franklin B. Hill, Mr. Edward L. Lilly, Mr. William F. Wooden, Mr. Charles E. Delosier. There being no corrections the President ordered the minutes of the meeting held December 13th be approved as read. Mr. Wooden, moved", seconded by Mr. Hill, that Mr. C. Howard Tickner, Jr. be'notified that he has completed the two year appren- ticeship period. SO ORDERED. Mr. Wooden moved, seconded by Mr. Levinson, that the letter pertaining to Milton Davis' suspension of licenses be made a special order of business for the next meeting. SO ORDERED. Mr. Lilly moved, seconded by Mr. Wooden, that the Governor's report be approved and sent to the Governor. SO ORDERED. THE STATE BOARD" OF FUNERAL'DIRECTORS AND EMBALMERS OF MARYLAND.

The regular meeting of the Board was called to order by President Farley with the following members present:

Mr. George A. Farley, President, Mr. Sol Levinson, Vice-president, Mr. J. Jerome Framptom> Treasurer,.

Mr. Franklin B. Hill, Mr. Edward L. Lilly, Mr. William F. Wooden, Mr. Charles E. Delosier.

There being no corrections the President ordered the minutes of the meeting held December 13th be approved as read.

Mr. Wooden, moved", seconded by Mr. Hill, that Mr. C. Howard Tickner, Jr. be'notified that he has completed the two year appren­ticeship period. SO ORDERED.

Mr. Wooden moved, seconded by Mr. Levinson, that the letter pertaining to Milton Davis' suspension of licenses be made a special order of business for the next meeting. SO ORDERED.

Mr. Lilly moved, seconded by Mr. Wooden, that the Governor's report be approved and sent to the Governor. SO ORDERED.

Mr. Framptom moved, seconded by Mr. Lilly, that the appli­cation of William Winterberg for Pennsylvania courtesy card be approved, and that the Secretary forward same to the Secretary of the Pennsylvania State Board. SO ORDERED.

Mr. Levinson moved, seconded by Mr. Delosier, that a committee be appointed to confer with the office of the Attorney General and have bills prepared governing" the' suggested changes in the law. SO ORDERED.

The President then appointed Messrs. Wooden, Levinson, Lilly and Delosier as the members of this committee.

Mr. Wooden moved, seconded by Mr. Lilly, that the next funeral director's and embalmer's examinations be given starting June 3rd. SO ORDERED.

Mr. Delosier moved, seconded by Mr. Levinson, that Harvey Williamson and Clarence Adams be summonsed to appear before"the Board regarding advertisement which they are running in the Federalsburg's Times. SO ORDERED.

THE STA TE BOARD OF FUNERAL DIRECTORS AND EMBALMERS OF MARYLAND.

The regular meeting of the Board was called to order by President Farley with the following members present:

Mr. George A. Farley, President, Mr. Sol Levinson, Vice-president, Mr. J. Jerome Framptom, Treasurer,

Mr. Edward L. Lilly, Mr. William F. Wooden, Mr. Charles E. Delosier.

There being no corrections the President ordered the minutes of the meeting held' January 10th be approved as read.

Mr. Delosier moved, seconded by Mr. Framptom, that the bill, in the amount of $50.00, for Conference dues be paid. SO ORDERED.

The application of James J. Bruzdzihski for change of address from 3110 Elliott Street, Baltimore, Maryland, to Eastern Avenue and Palczar Avenue, Stemmers Run, Maryland, was approved by the Board.

Letter from Ralph V. Ardis was read notifying the Board of his entrance into the Military Service, and the cancelling of his apprenticeship registration.

Upon reading letter from the Board of Public Works regard­ing rent, the President appointed the following committee to con­tact the Board of Public Works in regard to same. Messrs. Wooden, Lilly, Levinson and Delosier.

Mr. Levinson moved, seconded by Mr. Framptom, that the application of Karl Q,. Fisher for embalmer's apprenticeship regis­tration be approved and the Secretary issue same upon receipt of the required fee of $5.00. SO ORDERED.

Mr. Framptom moved, seconded by Mr. Levinson, that the application of Landon S. Brooks for funeral director's and embalmer's apprenticeship registrations be approved, and the Secretary issue same upon receipt of the required fee of $5.00 each. SO ORDERED.

Mr. Clarence Adams and Mr. J. Harvey Williamson appeared, accompanied by W. Brewster Deem, attorney of Denton, Maryland, and after a thorough discussion Messrs. Adams and Williamson agreed to discontinue the type of advertising they have been running in the Federalsburg Times, and upon warning by the Board charges were dis­missed.

Mr. Framptom moved, seconded by Mr. Delosier, that Harvey Williamson be permitted to review his 1940 funeral director's ex­amination papers. SO ORDERED.

Mr. Levinson moved, seconded by Mr. Wooden, that, after reviewing the marks given Harvey Williamson on questions 2, 5, 8, 14, 16 and 24 which were questioned by Mr. Williamson, the marks remain the same and that Mr. Williamson be so notified.

SO ORDERED.

'Mr. Wooden moved, seconded by Mr. Framptom, that the re­quest of Albert Rice for examination before having completed his apprenticeship period be denied. SO ORDERED.

Mr. Wooden moved, seconded by Mr. Lilly, that the applica­tion of Milton Davis for reinstatement of his funeral director's and embalmer's licenses be denied. SO ORDERED.

Mr. Delosier moved, seconded by Mr. Lilly, that Mrs. Helen Stevens, Charles F. Dill, Memorial Funeral Chapel, Inc., Charles H. Alexander and Ethel Hicks be summonsed to appear before the Board, and show cause why they are using misleading advertising.

SO ORDERED.

Mr. Levinson moved, seconded by Mr. Delosier, that the meeting now adjourn. SO ORDERED.

THE STATE BOARD OF FUNERAL DIRECTORS AND EMBALMERS OF MARYLAND.

The regular meeting of the Board was called to order by Vice-president Levinson with the following members present:

Mr. Sol Levinson, Vice-president, Mr. J. Jerome Framptom, Treasurer,

Mr. Edward L. Lilly, Mr. Franklin B. Hill, Mr. William F. Wooden, Mr. Charles E. Delosier.

There being no corrections the minutes of the meeting held February 14th were approved as read.

Mr. Robert E. Kanode appeared, representing the Memorial Funeral Chapel, Inc., and after a thorough discussion of notices appearing in the newspaper Mr. Kanode, for the Memorial Funeral Chapel, Inc., promised to discontinue such practices.

Mr. Charles F. Dill and Mrs. Helen Stevens appeared, and after a thorough discussion of notices appearing in the newspaper promised to discontinue such practices in the future.

Charles H. Alexander and Ethel Hicks appeared regarding notices appearing in the newspaper and were warned to discontinue all such practices, and they agreed not to let it happen again.

The application of Albert M. Dippel for Martin W. E. Dippel, Inc., for change of address from 330 South Bond Street, Baltimore, Maryland to 35 South Ann Street, Baltimore, Maryland, was approved by the Board.

Mr. Wooden-moved, seconded by Mr. Hill, that the applica­tions of Burton Harold Levinson and Jack Herman Levinson for funeral director's and embalmer's apprenticeship registrations be approved, and the Secretary issue same upon receipt of the required fee of |5.00 each. SO ORDERED.

Mr. Wooden moved, seconded by Mr. Hill, that the Secretary write Mt. St. Joseph's College and inquire if Leonard F. Ruck is a student in their college, and if not and he is serving a full time apprenticeship under his father that his application for embalmer's apprenticeship be issued him. SO ORDERED.

Mr. Delosier moved, seconded by Mr. Wooden, that the follow­ing amendments of the present law as suggested by the Attorney General's office, be approved and that same be referred to the legis­lature for passage.

338. The said Board shall have the power at any time to suspend or revoke any license heretofore granted to carry on the business of funeral director or the pro­fession of embalming for the following causes and after full hearing of all parties in interest:

1. Conviction of a crime involving moral turpitude. 2. Unprofessional conduct which is hereby defined as

follows: (a) Misrepresentation or fraud in the conduct of the

business of a Funeral Director or Embalmer. (b) False or misleading advertising as a Funeral

Director or Embalmer. (c) Solicitation of business by the licensee, his

agents or employees whether such solicitation occurs after death or while death is impending; provided that this Act shall not be deemed to prohibit general ad­vertising.

(d) Employment by the licensee of persons known as "cappers", "steerers", or "solicitors" or other persons to obtain funeral directing or embalming business. (e) Employment directly or indirectly of any appren­

tice, agent, assistant, embalmer, employee or other person on part or full time, or on commission, for the purpose of calling upon individuals or institutions by whose influence dead human bodies may be turned over to a particular Funeral Director or Embalmer. (f) The buying of business by the licensee, he agents,

assistants or employees, or the direct or indirect pay­ment or offer of payment of a commission by the licensee, his agents, assistants or employees for the purpose of securing business. (g) Aiding or abetting an unlicensed person to practice

funeral directing and embalming. (h) Solicitation or acceptance by a licensee of any com­

mission, bonus or rebate in consideration of recommending or causing a dead human body to be disposed of in any crematory, mausoleum or cemetery. (i) Violation of any of the provisions of this Act. (j) Violation of any State law or municipal or County

ordinance or regulation affecting the handling, custody, care or transportation of dead human bodies. (k) Fraud or misrepresentation on obtaining a license. (l) Refusing to surrender the custody of a dead human

body upon the demand of the person lawfully entitled to the custody thereof. (m) The selling or offering for sale of shares, certi­

ficates or interests in the business of any Funeral Di­rector or Embalmer or in any corporation owing or con­ducting an undertaking or embalming establishment under the promise of or purporting to give to the purchasers thereof a right'to the service of such Funeral Director, Embalmer or corporation at a charge or cost less thah that offered or given to the public at large. Before proceeding to suspend or revoke any such license,

the person against whom complaint is made shall be furnished with a copy of the complaint and the charges made against him, and shall be given an opportunity for a hearing before the Board in person, or by attorney, and at such hearing testimony may be offered for and against the accused. Board shall be reduced to writing, stating also the reasons for said action, and a copy thereof shall be delivered or mailed to the person against whom complaint is made.

The above motion was approved with Mr. Hill voting no against Section C and E.

Mr. Lilly moved, seconded by Mr. Wooden, that the meeting now adjourn. SO- ORDERED.

Mr. Levinson moved, seconded by Mr. Lilly, that the request of Lewis U. Iglehart to review his 1940 funeral director's examina­tion papers be denied, for the reason that he stated in his request that he only wished to review his papers to prepare himself for the coming examination. SO ORDERED.

Mr. Wooden moved, seconded by Mr. Lilly, that the applica­tion of John M. Caldwell for branch at Frederick, Maryland, be approved. SO ORDERED.

After reading request of Leonard Whalen for reinstatement of his funeral director's and embalmerTs licenses, the President appointed the following committee to investigate and report to the Board: Mr. Wooden, chairman, Mr. Levinson and Mr. Lilly.

Statement of Jerome Crocetti regarding the change of his name to Jerome Delia Noce was read and approved by the Board.

Mr. Framptom moved, seconded by Mr. Hill, that the appli­cations of Alyce Young and Theodore Lawson for funeral director's apprenticeship registration, and Marion N. Bankard and Theodore Lawson for embalmer's apprenticeship registration be approved, and the Secretary issue same upon receipt of the required fee of $5.00 each. SO ORDERED.

Mr. Wooden moved, seconded by Mr. Hill, that the application of Merwyn C. Fuss for Pennsylvania courtesy card be approved, and that the Secretary so inform the Pennsylvania State Board. S6 ORDERED.

Mr. Wooden moved, seconded by Mr. Hill, that the funeral director's examination be held on Tuesday, June 3rd, 1941 starting at 10:00 A.M., and the embalmer's examination be held on Wednesday, June 4th, 1941 starting at 10:00 A.M. SO ORDERED.

The President then appointed Mr. Levinson, chairman of a committee to prepare funeral director's1 and embalmer's examination questions.

THE STATE BOARD OF FUNERAL DIRECTORS AND EMBALMERS OF MARYLAND.

The regular meeting of the Board was called to order by Mr. Farley and Mr. Leonard J. Ruck presented his credentials which were in order.

Mr. Franklin Bowen Hill was then selected as temporary chairman.

Immediately upon Mr. Hill's assuming the chair, and the following members being present: Mr. George A. Farley, Mr. Sol Levinson, Mr. Franklin B. Hill, Mr. Edward L. Lilly, Mr. Leonard J. Ruck, Mr. William F. Wooden anddMr. Charles E. Delosier, Mr. Hill called for a motion for president of the Board for the en­suing two years.

Mr. Wooden moved, seconded by Mr. Delosier that Mr. George A. Farley be nominated for office of President. SO ORDERED.

Mr. Levinson moved, seconded by Mr. Wooden, that the nominations be closed and Mr. Farley declared duly elected President for the en­suing two years. SO ORDERED.

Mr. Farley then assumed the-chair.

Mr. Delosier moved, seconded by Mr. Lilly, that Mr. Sol Levinson be nominated for the office of Vice-president. SO ORDERED.

Mr. Wooden moved, seconded by Mr. Delosier, that the nominations be closed and Mr. Levinson be-declared duly elected Vice-president for the ensuing two years. SO ORDERED.

Mr. Delosier moved, seconded by Mr. Hill, that Mr. Edward L. Lilly be nominated for the office of Treasurer for the ensuing two years. SCI ORDERED.

Mr. Wooden moved, seconded by Mr. Hill, that the nominations be closed, and Mr. Lilly be declared duly elected as Treasurer for the ensuing two years. SO ORDERED.

Mr. Levinson moved, seconded by Mr. Wooden, that Mr. Delosier be nominated Secretary for the ensuing two years. SO ORDERED.

Mr. Wooden moved, seconded by Mr. Hill, that the nominations be closed and Mr. Delosier be declared duly elected Secretary for the ensuing two years. SO ORDERED.

Mr. Levinson moved, seconded by Mr. Wooden, that Mrs. Elsie W. Almy be retained as stenographer. SO ORDERED.

Mr. Wooden moved, seconded by Mr. Levinson, that the American Express Company money order, No. 9448693, in the amount of $5.00, which accompanied an application for Millard B. Callender's funeral

Brown for embalmerTs apprenticeship registration be approved and that he be declared eligible for examination upon completion of apprenticeship period by reason of a previous Board having declared that he had the equivalent of a high school education, and that the length of time spent in embalming school be considered enough, he having applied for examination at that time when his school credits would have made him eligible. SO ORDERED.

Mr. Wooden moved, seconded by Mr. Ruck, that the applica­tion of Richard F. Curley Funeral Home, Inc. for funeral director's license be denied because said corporation was not registered with the Board on June 1, 1937. SO ORDERED.

Mr. Ruck moved, seconded by Mr. Levinson, that the appli­cations of Stanley M. Thomas and J. Jacob Hartenstein for Maryland courtesy cards be approved, and the Secretary issue same upon pay­ment of the required fees. SO ORDERED.

Mr. Wooden moved, seconded by Mr. Levinson, that the appli­cation of Mrs. Louise Hill for funeral Director's apprenticeship registration be approved, and the Secretary issue same upon the payment of the required fee. SO ORDERED.

Mr. Ruck moved, seconded by Mr. Wooden, that the applica­tion of Middleton Vandergrift for embalmer's apprenticeship regis­tration be approved, and the Secretary issue same upon the payment of the required fee. SO ORDERED.

Mr. Wooden moved,' seconded by Mr. Ruck, that the under­taker's and embalmer's licenses of Leonard Whalen be reinstated, and same be renewed upon the payment of the required fee of $10.00.

Mr. Delosier submitted the following amendment to the by­laws to the State'Board of Funeral Directors and Embalmers of Mary­land:

I herewith submit an amendment to Article 4, headed Ex­amination, Section 1 of the By-laws, as printed on page 14 of the present printed' copy of the Acts of the General Assembly of Maryland ~and By-laws, changing the time of ex­aminations to March instead of June, and changing the date upon which' applications- for said examinations must be sub­mitted to the Board to February 1st, instead of May 1st. If approved this" Section of the by-laws will then read as follows:

The regular meeting of the Board was called to order by President Farley with the following members present:

Mr. Wooden reported that he had interviewed the Telephone Company and was given to understand that no listings were placed in the telephone directory except upon authorization from the per­son under whom the telephone is billed.

Mr. Wooden moved, seconded by Mr. Levinson, that the appli­cations of J. Preston Holloway and Walter R. Holloway for Delaware courtesy cards be approved and forwarded, to the Delaware State Board. SO ORDERED.

Mr. Wooden moved, seconded by Mr. Hill, that the applica­tions of William E. Haines, Perry A. Reese and Winfred B. Dahling for Maryland embalmer and funeral director courtesy cards be ap­proved, and the Secretary issue same upon the payment of the re­quired fees. * SO ORDERED.

Mr. Levinson moved, seconded by Mr. Lilly, that cemeteries be sent a copy of the laws and a letter accompany same calling attention to that section which makes the cemetery liable. SO ORDERED.

Mr. Hill moved, seconded by Mr. Lilly, that the applica­tions of Edward L. Landwehr, James G. Fletcher, Annie A. Johnson and William T. Ladd for funeral director's apprenticeship registra­tion, and William T. Ladd and- James P. Keller for embalmer's appren­ticeship registration be approved, and the Secretary issue same upon the payment of the required fees. SO ORDERED.

The Secretary then-presented the funeral director's and em­balmer's examination papers of Marshall P. Hayes for marking, and after examining the funeral director's examination it was found that Marshall P. Hayes failed to pass, having-received an average of fifty-six four fifths per cent.

Mr. Levinson moved, seconded by Mr. Hill, that the embalmer's papers of Marshall P. Hayes be held until the January meeting for marking. SO ORDERED.
