Wetell you some of the important things to keep in mind when filing anomination.CHOOSE CAREFULLYThe nominee is only a custodian or trustee, and not the owner ofthe assets in most cases. A nominee is legally bound to transferthe assets to the legal heirs. There are many cases where legalheirs have approached courts to direct the nominee to hand overthe assets to them. Courts have often ruled that the nominee is atrustee and a custodian and it's the legal heirs who should inheritthe assets.Legally, anyone can be a nominee, but it's advisable to have closefamily members and legal heirs as nominees. "The nominee andthe legal heir should be the same person to avoid any potentialdispute," said Gautami Gavankar, executive director, trusteeshipservices, Kotak Mahindra Trusteeship Services Ltd.A nominee may also need to hold the assets indefinitely if no legalheirs claim it, says Varghese Thomas, Partner, J Sagar Associates.The law doesn't prescribe any time by which legal heirs can claimthe assets. According to lawyers, the law of limitation does notapply when someone holds the assets as a trustee.Things could be different if the nominee is also one of the legalheirs. "If other legal heirs don't act in a reasonable time, the nomineeis entitled to presume that they have relinquished their right. Theasset will exclusively belong to the nominee in that event," saidMukesh Jain, corporate lawyer and founder of Mukesh Jain andAssociates, a Mumbai-based law firm. The definition of a"reasonable time" varies, and the court will take a call based onthe facts of the case.AVOID MISTAKESAlthough filing nomination seems like a simple exercise but even aspelling error can create problems for the family members whileclaiming the assets. "Sometimes people make mistakes in writingthe correct names of the nominee. If it does not match with theKYC documents of the nominee, it may lead to disputes and delayat the time of payment," said Gavankar.The details of the nominee such as name, address, date of birthand relationship with the deceased, among others, have to bespecified clearly to avoid any dispute. In case of more than onenominee, it is important to mention the share of each nominee.In case the nominee is a minor, remember to add an elderly familymember's name as a guardian. "Not appointing a guardian for aminor nominee or adding an elderly family member (father ormother), who may not be around at the time of the demise of theaccount holder is another mistake," said Nishant Agarwal, managingpartner and head-family office, ASK Wealth Advisors.UPDATE THE DETAILSGenerally, people give nomination details at the time of making theinvestment or buying an asset, and forget about it. It is advisableto update the details periodically. "Check nominations at least oncea year, and check spelling and all the details at the time the firstinvestment statement is received," said Lovaii Navlakhi. managingdirector and CEO, International Money Matters, a Bengaluru basedfinancial planning firm.It's important to update nomination details after certain events inlife. "One must update the nominee in case of any change in therelationship status or death of a nominee. If any changes aremade in the nomination, the corresponding details should beupdated across the documents," said Agarwal.A nomination allows financial institutions such as banks andinsurance companies to transfer the investments or assets to theperson nominated by the deceased without getting into legalprocesses such as obtaining a succession certificate. Theseprocesses take time and the family is not able to access the assetor investment in the interim. So take all necessary steps to updateyour nomination details as early as possible.

As you deal with the trauma oflosing a loved one, making a lifeinsurance claim may becomedaunting if you don't know howto go about it. One of the mostimportant aspects to consideris the difference between thenominee and heir when itcomes to insurance claims.Insurance policy is treated as an estate of the deceasedpolicyholder. Legal heirs have a right over the policy as long asthe assets of the deceased policy holder devolve upon her.However, in life insurance, there is a concept known as beneficialnominee. This provision was introduced in the Insurance Laws(Amendment) Act, 2015. If an immediate family member (parents,or spouse, or children) is made the nominee, then the proceedswill go to the intended person. Legal heirs will not have any claimon the money. "If the nominee is not survived by the insured, theproceeds will go to the legal heirs," said Mukesh Jain, corporatelawyer and founder of Mukesh Jain and Associates, a Mumbai-based law firm. In the absence of a nominee, the legal heir canclaim the insurance proceeds. "Apart from the claim intimationletter and other requisite documentation like death certificate, IDproof of the beneficiary, policy papers, discharge form (if any),post mortem report and hospital records (in case of unnaturaldeath), the legal heir needs to submit the succession certificateissued by a competent court which establishes the right of thelegal heir over the assets of the deceased policy-holder, includingthe insurance proceeds," said Vatsala Sameer, companysecretary, Canara HSBC Oriental Bank of Commerce LifeInsurance.If there are multiple legal heirs and only one is claiming theproceeds, then all other legal heirs need to agree and expresstheir consent to the insurer for that. "The affidavit-cum-indemnitysigned by all the legal heirs protects the insurer from similar andseparate claims under the policy," said a spokesperson from PNBMetlife Insurance Co. Ltd. The legal heir can make a claim whenthere is no nomination any time before the maturity of the policy,or if the insured has not requested a fresh nomination in case ofthe death of the nominee or in case of death ofthe nominee afterthe claim is filed but before its settlement.In case the deceased has more than one child and has notnominated all of them, a claim can be lodged only by the nominatedchild and the insurer shall pay the proceeds to the nominee only.Other children can stake claim to their shares by moving acompetent court oflaw, said the PNB Metlife spokes-person.
