Enclosed is your Application Packet for your approval to train VA eligible persons under the provisions of Title 38, United States Code.

Please do not reproduce this application on front to back settings. Each page must be printed separately and single-sided. Supporting

documents, i.e. catalogs and handbooks, are preferred on CD R/W Format with PDF attachments. Flash/thumb drives and electronic

submissions are not permitted.

APPLICATIONS SHALL BE SUBMITTED ANNUALLY OR ANY TIME DURING THE CALENDAR/ ACADEMIC YEAR AS

CHANGES OCCUR.

To process your approval, please submit one copy of each item (forms requiring a signature should have an original/ink signature):

Please note the following items:

• The job which is the objective of this training must be one in which progression and appointment to the next higher classification

are based upon skills learned through organized and supervised training on-the-job and not such factors as length of service or

normal turnover; (NOT COMMISSION BASED)

• The training content of the program must be adequate to qualify the VA eligible person for appointment to the job for which she or

he is to be trained;

• The job must customarily require a period of training of not less than 6 months and not more than 2 years of full-time training;

• The length of the training period must not be longer than that customarily required by other training establishments in the community

to provide the VA eligible person with the required skills, arrange for the acquiring of job knowledge, technical information, and

other facts which the VA eligible person will need to learn to become competent on the job for which she or he is being trained

• VA Forms: The VA Form 22-8794, Designation of Certifying Official(s), and VA Forms 20-8206, Statement of Assurance of

Compliance with Equal Opportunity Laws, are provided for annual submission.

• For any programs or certificates that are offered/operate within a third-party contract, the third party must also be an approved

facility or submit an entire application for approval. Supporting documentation must accompany application. (i.e. memorandum of

understanding or contract)

Please submit your approval packet within 60 days of receipt of this letter. Upon receipt of the above items we will begin processing

your current year’s approval. Failure to respond to this notice may result in any new programs or courses being offered by your

1. The entrance wage or salary paid by the training establishment to employees already trained in the kind of work for

which the VA eligible person is to be trained is $ _____per ______ (this figure and the Wage to be Paid upon

2. The wages to be paid to the VA eligible person upon entrance into training are not less than wages paid to non-

veterans in the same training position and are at least 50 percent of the wages paid for the job for which he or she

is to be trained, and will be increased in regular periodic increments until, not later than the last full month of the

scheduled training period they will be at least 85 percent of the wages paid for the job for which the VA eligible

4. Credit for previous training including training while in the military has been evaluated and credit has been awarded

and has reduced or shorten the length of the total training appropriately.

STATEMENT OF ASSURANCE OF COMPLIANCE

WITH EQUAL OPPORTUNITY LAWS ______________________________________________________________________________(hereinafter called the "Signatory").

HEREBY AGREES THAT

it will comply with Title VI of the Civil Rights Act of 1964 (42 U.S.C. 2000d et seq.), Title IX of the Education Amendments of 1972,

If any real property or structure thereon is provided or improved with the aid of Federal financial assistance extended to the Signatory

by VA or ED, this assurance shall obligate the Signatory, or in the case of transfer of such property, any transferee, for the period

during which the real property or structure is used for the purpose for which the Federal financial assistance is extended or for another

purpose involving the provision of similar services or benefits. In all cases, this assurance shall obligate the Signatory for the period

during which the Federal financial assistance is extended to any of its programs by VA, ED or any other Federal agency.

THIS ASSURANCE is given in consideration of and for the purpose of obtaining Federal financial assistance, including facilities

furnished or payments made under sections 104 and 244(1) of Title 38, U.S.C. Also, sections 1713, 1720, 1720a, 1741-1743, 2408,

5902(a)(2), 8131-8137, 8151-8156 (formerly 613, 620, 620a, 641-643, 1008, 3402(a)(2), 5031-5037, 5051-5056 respectively) and 38

U.S.C. chapters 30, 31, 32, 33, 35, 36, 82, and 10 U.S.C. chapter 106. Under the terms of an agreement between VA and ED, this

assurance also includes Federal financial assistance given by ED through programs administered by that agency. Federal financial

assistance is understood to include benefits paid directly to the Signatory and/or benefits paid to a beneficiary contingent upon the

beneficiary's enrollment in a program or using services offered by the Signatory.

The Signatory agrees that Federal financial assistance or other benefits will be extended in reliance on the representations and

agreements made in this assurance; that VA or ED will withhold financial assistance, facilities, or other benefits to assure compliance

with the equal opportunity laws; and that the United States shall have the right to seek judicial enforcement of this assurance.

THIS ASSURANCE is binding on the Signatory, its successors, transferees, and assignees for the period during which assistance is

provided. The Signatory assures that all contractors, subcontractors, subgrantees, or others with whom it arranges to provide services

or benefits to its students or trainees in connection with the Signatory's programs or services are not discriminating against those

students or trainees in violation of the above statutes.

6. REMARKS

It is acknowledged that each of the individuals designated as certifying officials must successfully complete online training for new

certifying officials prior to being granted access to VA's certification system. It is hereby certified that the Department of Veterans Affairs

will be notified of any changes in the designations shown on this form as they occur.
