Like earlier years the Annual Report of the TERC for the year 2010-11 has been prepared which is asper the provision of Section 105 of Electricity Act, 2003.

During the year Commission has issued Order against Petition No.01/2010 for Adjustment of Fuelprice hike. This was necessary as because the Gas price was raised from Rs.2376 per 1000 SCM toRs.5153 per 1000 SCM which was more than double and hence the Petition on Fuel price adjustmentas per the provision of Tariff Regulation was processed and Order issued by the Commission affectingthe FPA recovery from September 2010. During process of the Petition the entire Staff of TERCrendered their valuable services and it could be completed within a reasonable time. The increase inTariff due to Fuel price hike was a burden to a section of the consumer and realizing the woes the Govt.has sanctioned Rs.11 crores as subsidy and some category of Consumers were benefited to someextent.

During the current year 1 No. GT of 21 MW capacity was commissioned by TSECL at Baramurasuccessfully. The overall function of the Utility was found satisfactorily and due to various measureinitiated by TSECL the load shedding from the month of September 2010 to March 2011 was almostNil.

During the year the total generation of TSECL was 772.134MU and Power imported from Centralsector was 484.057MU. Though the total availability power was 1256.191 MU the requirement wasstill about 9.2 % less. Efforts are being taken to improve the power position after taking action toreceive the maximum extent of the central share. The constraint of transmission line still persist in Tripuraand hopeful that after commissioning of the 220 KV/400 KV transmission line by Power grid connectingPalatana and Monarchak situation will improve.

It has also been noticed that awareness programme on Energy Conservation has affected the Domesticconsumption of Electricity which in down trend which has resulted less billing and less recoveries beyondexpectation.

During preparation of the Annual Report the pain taken by TERC staff is thankfully acknowledged.

1. INTRODUCTION:

The Tripura Electricity Regulatory Commission (TERC) was set up in the year 2004. The TERCcompleted 6th year of its operation on 2010-11.During this period the State Commission has taken allefforts to set up a fair, transparent and objective regulatory process in this State. In this 6th AnnualReport, the summary of the activities of this Commission during the year 2010-11 is produced for theknowledge of the Stakeholders and general public.

2. THE COMMISSION :

The Tripura Electricity Regulatory Commission (TERC) was created under the provisions of Sub-section (1) of Section 17 of the Electricity Act, 1998 vide Government Notification No.F.1 (17)/Commr/Power/2003(P-1) dated 24th April, 2004 notified in the Government of Tripura Gazette, Extra -Ordinarydated 26th May, 2004. Accordingly The Tripura Electricity Regulatory Commission (TERC) establishedon 31st May 2004 as a statutory body and as one man Commission under Electricity Act'2003.Inaddition , the Commission , a quasi-judicial body, with effect from 10th June, 2003 has come under thepurview of the Electricity Act,2003, as the Electricity Regulatory Commission Act, 1998 has since beenrepealed. The financial performances of power sector in Tripura was a matter of concern for the StateGovernment and it had drawn up a plan for restructuring of Power sector in Tripura for betterimplementation of the Electricity Act 2003. Accordingly, Tripura State Electricity Corporation Limited(TSECL) was constituted and registered as a public limited Company and started functioning w.e.f. 1stJanuary 2005. The operational control of all assets relating to generation, transmission and distributionand its allied activities has been transferred to Tripura State Electricity Corporation Ltd. (TSECL) fromthe erstwhile Power Deptt., Govt. of Tripura .As per Electricity Act' 2003 TSECL is considered as adeemed Licensee who is responsible for generation, transmission and distribution of Power in Tripura .Ithad submitted its Tariff petition and Annual Revenue Requirement (ARR) for the year 2005-06 and2006-07 and for the subsequent years no ARR has been submitted to the Commission except adinterim Petition on Fuel Purchase Cost Adjustment(FPPCA/FCA, 2010. In this context Commissiondirected to T.SE.CL.to .submit the Petition for the interest of the consumers and simultaneously alsodirected to produce the Annual Accounts for the FY 2006-07,2007-08,2008-09 and 2009-10, asoverdue.

3. LEGAL PROVISIONS: There is provision under Section 105 of I.E.Act’2003, “Annual Report of State Commission” which is as follows:-

(1). The State Commission shall prepare once every year in such form and at such time as may

be prescribed, an annual report giving a summary of its activities during the previous year and copies of the report shall be forwarded to the State Government.

(2). A copy of the report received under sub-section (1) shall be laid, as soon as may be after it is received, before the State Legislature.

4. FUNCTIONS OF THE COMMISSION:

The Commission (TERC) is vested with the responsibilities of discharging the following functions:

a). Determination of tariff for generation, supply, transmission and wheeling of electricity, wholesale ,bulk or retail, as the case may be ,within the State ;

b). Regulation of Electricity purchase and procurement process of distribution licensees including the price at which Electricity shall be procured from the generation companies or Licensees or from other sources through agreements for purchase of Power for Distribution and supply within the State;

c). Facilitation of intra – State transmission and wheeling of electricity;

d). Issuance of Licenses to persons seeking to act as transmission Licensees, distribution Licensees and electricity traders with respect their operations within the State;

e). Promote Cogeneration and generation of Electricity from renewable source of energy by providing suitable measures for connectivity with the grid and sale of electricity to any person, and also specify, for purchase of Electricity from such sources, a percentage of the total consumption of Electricity in the area of a distribution Licensee;

f). Adjudication upon the disputes between the Licensees and generating companies and to refer any dispute for arbitration ;

g). Levying fees for the purposes of the Electricity Act’2003;

h). Determination of specification of State Grid Code;

i). Enforcement of standards with respect to quality, continuity and reliability of service by Licensees;

j). Fixation the trading margin in the intra-State trading of Electricity, if considered necessary;

a). Discharge such other functions as may be assigned to it under the Electricity Act,2003;

b). Advice the State Government on all or any of the following matters, namely:-

(i). Promotion of competition, efficiency and economy in activities of the Electricity industry;

(ii). Promotion of Investment in Electricity Industry;

(iii). Re-organization and restructuring of Electricity Industry in the State;

(iv). Matters concerning generation, transmission, distribution and trading of Electricity or any other matter referred to the State Commission by the State Government.

(v). Maintaining transparency and observance of the National Electricity Policy ,National Electricity Plan and Tariff Policy as per Sub-Section (2) of Section 3

5. MISSIONS OF THE COMMISSION :

The missions of the Commission are to:

a. Promote reforms in the Electricity sector.

b. Encourage transparency, competition and economy.

Regulate the Power purchase and procurement process of the Distribution Utilities.

Secure that the legitimate interests of all Stakeholders including the Consumers.

6. CHAIRMAN OF THE COMMISSION

In the place of Sri S.S.Chakraborty, The Government appointed Sri M.R KARMAKAR former Executive Director (Thermal) NEEPCO ltd.. He assumed charge of Chairman of the Commission on 12th January 2009.

7. SECRETARY OF THE COMMISSION Sri Parimal Ch. Roy Retired Executive Engineer (Elect.) has Re-employment and entrusted the job of the Secretary, Tripura Electricity Regulatory Commission, vide Notification No.F.3 (87)/Power/2006/603 dated 30th July, 2010 He assumed his charge on 1st August 2010.

8. OFFICE OF THE COMMISSION. The commission is functioning in the old Chief Engineer (E) office, Bidyut Bhavan Complex, North Banamalipur, Agartala, Tripura, and Pin-799001.

9. HUMAN RESOURCES

The Commission has been functioning since 31st May, 2004 with a bare minimum infrastructure with the Officers /Staff taken mostly on deputation/ /Retirement from State Government. For its different functional needs in areas such as engineering, financial analysis, accounting, information technology, Legal issues and human resources management. In this context finally the Commission has prepared a draft regulation namely (Method of recruitment and conditions of service of officers and Staff) Regulation 2009 which is remained under consideration of the State Government for Gazette Notification. Moreover it is also mentioned here that as per Government sanction provision, there are 22 (twenty two) nos. post in the Commission. But at present the Staff position of the commission are as follows:

10. STATE ADVISORY COMMITTEE:

In exercise of the powers conferred under section 87 of the Electricity Act'2003, the Commission undernotification No. F.29/TERC/09/250-77 Dated, 27th July 2009 reconstituted a new TRIPURA STATEADVISORY COMMITTEE.

The major role of the Advisory Committee as assigned to it under Section 88 of the Electricity Act'2003is to advice the Commission on

(i). Major question on Policy.(ii). Matters relating to quality, continuity and extent of service provided by the Licensees.(iii). Compliance by the Licensees with the conditions and requirements of their License.(iv). Protection of Consumer interest.(v). Electricity supply and overall Standards of performance by Utilities.

11. MEMBERS OF THE STATE ADVISORY COMMITTEE

The Tripura Electricity Regulatory Commission, (TERC) obtained nominations from differentorganizations to represent interest of Commerce, Industry, Transport, Agriculture, Labour, Consumers,Non - Govt. organizations ,Academic and Research bodies in the Electricity sectors as per section 87(2) of the Electricity Actr'2003.Accordingly under order Dated 27th July2009 of this Commission 12members were nominated on the Advisory Committee to represent the interests of various groups andthe Chairman of TERC functioning as EX-OFFICIO Chairperson of the Committee. One meetings of the State Advisory Committee, viz 13th meeting was held on 20th July 2010 during theyear 2010-11.Wherein it was apprised by the Commission the matter of Natural Gas Price hike and itseffect to cause on the Power Generation and Power Purchase in reference to the petition (FPPCA/FCA 2010) submitted by the Licensee and also the action taken report over the 12th Minutes ofmeeting of the State Advisory Committee which was held on 30th March 2010 . Most of the memberswanted to know about the Status of Annual Accounts of TSECL. They have strongly suggested that theCorporation should submit the pending financial annual accounts. In absence of accounts /balance sheetmembers were not in favour of FPPCA consideration. After long deliberation they expressed that thedata/figures which were submitted by the Licensee should be strictly checked/verified by the Commis-sion before arriving any decision .Otherwise it will over the poor and overall consumers. They sug-gested that the Licensee should take step to give publicity in the local papers and in local languages aswell as publication through press release in connection of gas price revision and its affect to the powergeneration cost as well hike in monthly bill payable by the consumers. Subsequently they also discussedon the action taken report of the licensee and suggested to take more stern action about the safety andprecaution of line maintenance staffs, billing system improvement for the interest of the consumer,engagement of PRO for dealing and publication of power supply related matters for the awareness ofthe consumer, proper awareness for the consumers through newspaper.

12. PETITION RECEIVED BY THE COMMISSION :-

In the matter of Fuel Power Purchase cost adjustment (FPPCA), the Licensee i.e. TSECL has submit-ted a Petition No. 01/2010 on 5th July 2010, before the Commission for approval of the adjustment ofcost against increase of fuel (gas) cost and increase of Power purchase cost.

13. ORDERS ISSUED BY THE COMMISSION : -

On the basis of Petition No.01/2010 dated, 5th May 2010, en effect Gas price hike and Powerpurchase cost incensement the Commission need to analyze en tout of all relevant documents submit-ted by the Licensee and side by side submission made orally and in writing during public hearing and allobjection submitted by the objector, reply thereof from the Licensee and other submission made byrepresentative before Hon'ble Chairman TERC and the Commission passes the orders on 13th Sep-tember 2010 which will be effective from 1st September 2010 . Subsequently the State governmentdeclared subsidies among some categories consumers a sum of Rs.11 Crore viz. Kutirjyoti, Domesticrural (0-31, 0-51, 51-150 Unit), Small Comml/Pan shop (0-30 and 0-150 Unit) and Public Utility i.e.Irrigation up to 5 HP. In this context Commission has issued an Amendment Order on 22nd September2010.The details of the Present Tariff Structure is furnished in the Annexure -1

12. CONSUMERS GRIEVANCES REDRESSAL FORUM AND APPOINTMENT OF OMBUDSMAN

Consumers’ Grievances Redressal Forums have been established at Sub-Division level, District/ Division Level and Head Quarter level of Power sector and the Secretary TERC has been designated as Ombudsman as per Section 42 Sub-section (5) of the Electricity Act’2003. However, the Appellate Tribunal is not in favour of such system and directed vide order D. O. No 15/9(1)/2009/APTEL/FOR/CERC Dated, 16th Feb’2010 to appoint one full pledged Ombudsman to act independently and neutral body . And accordingly Sri Sudhangsu Roy Choudhury Executive Engineer (E) was placed to TERC who has engaged as OMBUDSMAN W.E.F. 31st July’10 under the establishment of TERC.

In exercise of Power conferred by Section 166(4) & 166(5) of Electricity Act, 2003, the State Government constituted a “Co-ordination Forum” & “District Committee” vide Notification No.F.5(6)-POWER/2005 Dated 23rd December 2005. The Forum consisted as follows:

18. ELECTRICITY OMBUDSMAN

Electricity Ombudsman is a statutorily authority designated by the Commission to settle appeals ofconsumers on the orders of the Consumer Grievance Redressal Forum.Sri Sudhangsu Roy Choudhury, Executive (Elect.) is deputed to the Commission vide Office Order No.F.3 (21)/Power/2005/412-20 dated, 3rd July 2010 of the Deputy Secretary to the Government ofTripura. He is joined on 31st July 2010 and appointed as the Electricity Ombudsman vide office OrderNo.F.1/TERC/09/339-53 dated 21st August 2010. 22. MEMBERSHIP OF THE FORUM OF REGULATORS (FOR) AND FORUM OFINDIAN REGULATORS (FOIR)

SERC’s are the members of the FOIR. The Secretariat of the FOR & FOIR is Located at the Central Electricity Regulatory Commission, New Delhi. The Forum provides a venue for exchange of views and information among Indian Electricity Regulators and preparation of common ground and agenda in respect of various regulatory issues. The Annual subscription of Membership of the Forum of Indian Regulators (FOIR) & Forum of Regulators (FOR) is Rs.50, 000.00 & Rs.200, 000.00.

The Annual subscription of FOR &FOIR paid up to 2010-11. During the financial year 2010-11 the Chairperson of TERC has attended the following meetings held at various places; 1. From 20-04-2010 to 21-04-2010 attended 19th Forum of Regulators meeting held at Shillong

where various agendas like National Solar Mission(NSM)- Connectivity and evacuation thereof , Time of Day (TOD) Tariff and its impact analysis, Multiple and parallel Licensees and impact, Interaction with Chairperson APTEL - Judicial approach of Regulators, Implementation of Section 142 etc. were discussed for further guidelines.

2. On May 24th 2010 meeting for the Forum formation of Eastern & North Eastern Regulators was held in Kolkata where modalities for formation and Registration etc. were discussed. The minutes were circulated among the Chairpersons of Eastern and North Eastern States for further action.

3. On 15th July 2010, meeting of Forum of Eastern India Regulators was held at Bhubaneswar and it was attended. The discussion held and confirmed the eligibility of the Regulatory Commission of the State of Orissa, Bihar, Jharkhand, West Bengal, Assam, Meghalaya, Arunachal Pradesh, Tripura, Mizoram, Manipur and Nagaland for becoming members of the Society.

4. From 25th to 26th September2010 meeting of 20th Forum of Regulators was held at Thiruvanthapuram where various topics in connection of the Regulators like CAG report on Viability of Distribution Utilities , Model Regulation on Open Access, Prepaid metering- -Legal & Regulatory issues, off Grid renewable Power Generation, training programme on Open Access- power change and transmission pricing etc. were discussed.

5. From 27th to 28th November 2010 meeting of 21st Forum of Regulators was held at Chennai where draft model relation on Consumer Grievance & Redressal Forum, Ombudsman and Consumer Advocacy , Demand Response, Electricity for all etc. were discussed for adoption and action by all SERC’s

6. From 28th to 29th January 2011 attended Forum of Indian Regulators meeting at Mysore , where gas price determination and need of the Gas Regulatory body was discussed .

7. On 12th of February 2011 , the 22nd Forum of Regulators meeting was held at Mumbai where CEAS’s powers of Technical Clearance under J&K Act,2016, Common Guidelines for License condition including Tariff for SEZ, consideration of Model Supply Code , Issue relating to Bachat Lamp Yojana (BLY), Discom Viability /Tariff Adequacy etc. were discussed and views of Regulators in connection of abundant space for Solar energy generation, Land Acquisition Reforms Act for Electricity Industry were exchanged. It was understood that land Acquisition Law was lying in Parliament for pass.

21. TARIFF ORDER STATUS:

The Commission has passed 2(Two) Tariff order on receipt of Tariff petition and Annual Revenue Requirement (ARR) from the Licensee i.e. TSECL for the year 2005-06 & 2006-07. No Tariff petitions received from the Licensee for the years 2007-08, 2008-09 and 2009-10 due to non-finalization of accounts and some other reasons. The Tariff order issued for 2006-07 is still in force. The Licensee has been reminded for submission of the said Petition.

22. TREND OF TARIFF RISING:

21% rises over previous Tariff order which was issued on 1st April 1999. 14% rises over previous Tariff order which was issued on 1st August 2001. 33% rises over previous Tariff order which was issued on 1st July 2003. 8.78 to 17.16% i.e.averagely12.97% rises over previous Tariff order which was issued on 1st July’ 20055% rises over previous Tariff order which was issued on 1st July 2006 46% rises over previous Tariff Order due to Fuel & power purchase adjustment (FPPA) which was issued on 13th Sept'2010.

23. PERFORMANCES OF CORPORATION: There is only one number of Licensee in Tripura namely Tripura State Electricity Corporation limited (TSECL). They are solely responsible for generation/Transmission/Distribution in this State. The performances during the period of Report were found satisfactory. 26. ESTABLISHMENT OF COMMISSION FUND :The Commission, TERC is at present functioning with the Govt. grant to meet up the expenses on salaryand other office establishment expenditure. As this Commission is a Statuary body having quasi judicialPower, an independent fund structure is felt essential by way of Govt. grant and by collecting of petitionfees etc. This structure has been found very essential to have a smooth functioning atmosphere and totake decision by the Commission itself. However, this will start functioning subject to the approval of theGovt. A fund Rules in this respect is under active consideration by the Commission and shall be preparedvery shortly.

27. ACCOUNTS AND AUDITS OF STATE COMMISSION:

As per the Electricity Act, 2003 vide Section 104 stipulates that the State Commission shall maintain proper accounts and other relevant records and prepare annual statement of accounts in such form as may be prescribed by the State Govt. in consultation with the Comptroller & Auditor General of India . The Commission having no officer with the Finance background the preparation of accounts of the Commission is lagging behind. Also it stipulates vide clause 104 sub section 2 that the accounts of the State Commission shall be audited by the Comptroller & Auditor General of India (CAG). As stated pending of the preparation of annual accounts the CAG could not proceeded with the audit. The Accountant General office, Agartala has already forwarded formats for the preparation of the annual accounts in their prescribed manner. The same could not be compiled by the Commission in absence of Accounts officer though the Commission is continuously persuading the Govt. for the placement of one Accounts Officer. As the Audit Report after compilation by the CAG is required to be laid before the State Legislative Assembly, the preparation of annual accounts is highly important. So long the TERC prepared monthly receipt and payment accounts and yearly balance sheet for the Income and expenditure and has sent to the A.G. office requesting to carry out the Audit. But the audit procedure has yet not been completed due to above reason. In this context, Commission invites sealed quotation/quotations from the reputed and experienced Firm/Firms, registered under Institute of Chartered Accountant of India for the preparation and compilation of Annual Accounts of TERC as per stipulated /guideline of Sr. Audit of officer/ECPA(HQ), A.G. for the year 2006-07,2007-08,2008-09 & 2009-10. Accordingly, The S.Basu Thakur & Co., Agartala is the lowest quotationer and awarded the same. As per terms and condition the said Firm has completed his Job and submitted to the Commission which is awaited for further disposal.

28. FINANCE AND ACCOUNTS: The Finance and accounts of the TERC were maintained by the TSECL/Power Department, Govt. of Tripura till March 2006. From April 2006, the fund is being received from StateGovernment by TERC. The Unaudited Statement of Income and Expenditure for the Financial Year 2010-11 of TERC is furnished below:

28. BUDGET PROVISION FOR 2010-11:

The budget provision for FY 2010-11 was Rs.40 (forty) lacs and an amount of Rs.8, 75,000 has been released by the State Govt. as 1st installment against 1st quarter of FY 2010-11.

30. LEGAL DISPUTES. No legal dispute/disputes encounter by the Commission during the financial year.

31. AWARENESS ON CONSERVATION OF ENERGY:

Due to the prevailing climate changes the consumption of Electricity has increased. The uses of cooling appliances have risen enormously. The Peak demand has observed to be around 200 MW at Peak Hours (Off Peak 120MW) against availability of 131MW in Tripura during 2009-10.There is unlikely to improve the Situation in next 2 years. Hence the conservation of Energy is must. To combat the situation the economic use of Electricity by all Consumers are essential. Few Tips are furnished below under Banner Pay Less Electricity Bill.

“PAY LESS ELECTRICITY BILL: TIPS”

CFL (Compact Fluorescent Lamp) and FTL (Fluorescent Tube light) consume less Electricity and release no heat like the incandescent Lamps are ideal for home and office illumination. However Fused CFL to be disposed off with precaution against eruption of toxic agents.

Operate and use WASHING MACHINE, GEYSERS, IRONS, WATER PUMP during off Peak hours i.e. between 11 PM to 5P.M. as demand of Electricity at peak hours is high. This also helps to reduce load shedding during peak hours (5 to 10PM).

Use more BEE (Bureau of Energy Efficiency) Star Power appliances. As star rated

appliances are energy efficient and draws less electricity. Use of proper size Geysers with thermostat where temperature can be adjusted.

Use of Gas Geyser is more efficient. Use AC’s(Air conditioners) along with running electric Fan and set temperature at

28°C- by setting air conditioner a couple of degrees higher and circulating fan cool air around consume Electricity less than setting the air conditioner to a lower temperature. As per the report it is seen there is saving of Electricity of about 22%.

Painting of the roof top of building with white paint will reflect more sun heat and keep building cool. White or light shaded painted walls reflect sun light. Uses of cooler and illumination system thus reduce electricity considerably.

Installation of window shading-Patio covers, awnings, and solar window

screens shall shade home from sun. Instead of putting appliances i.e. AC, TV, Computers, Mobile chargers on

sleep/standby mood, switch off completely when not in use. This will save Electricity.

Switch off Light, Fans, Computers, Monitors, Printers, Music system etc.

when not in use. Uses of Old plug point, old plug top, old switches, old tape recorder may

be avoided which consume more electricity.

USE OF REFRIGERATORS: - Before storing the food stuff inside the refrigerator allow the food stuff to attain room

temperature. Do not allow the Refrigerators to frost whenever the frost gets more than 5mm thick

defrost the refrigerator. Defrost the refrigerator for half an hour during peak load period i.e. between 5 PM to

10 PM. Smart Refrigerators.

USES OF WASHING MACHINE:

It is better to wash cloths putting full load on the machine because the power consumption of the machine is same whether it is operated on full load or partial load.

Always use cool water to ring clothes. Avoid use tumble Drier if the weather is suitable for hanging clothes outside.

Smart washing machines.

USE OF GEYSERS:

o Choose Geyser with a thermostat and set temperature according to the season. o Always use water heater to suit your normal need and avoid using over sized Geysers. TIPS are collected & circulated for economic use of electricity. A little effort may save electric Bill considerably – Reducing load shedding during peak load period. Consumption may be reduced up to 50%.

30. CONCLUSION: During the period w.e.f. April 2010 to March 2011, the Commission received considerable support and cooperation from the Govt. of Tripura and also from the Licensee i.e. TSECL and from all section of the public of Tripura like previous years .It is expected that this support will continue during ensuing years also for better tomorrow in Power sector .The biggest achievement of the Commission is that it could bring down the Revenue-gap and AT&C losses of Licensee(TSECL) substantially without any increase in tariff to any category of Consumers in the State of Tripura since 2006-07.
