NRC Introduction 10 CFR 52.17(b)(2)(i) addresses the required contents of an early site permit application (ESPA) that proposes major features of the emergency plans. For such an application, 10 CFR 52.17(b)(4) requires that the Site Safety Analysis Report (SSAR) must include a description of contacts and arrangements made with Federal, State, and local governmental agencies with emergency planning responsibilities. The SSAR must also contain any certifications that have been obtained. If these certifications cannot be obtained, the SSAR must contain information, including a utility plan, sufficient to show that the proposed plans provide reasonable assurance that adequate protective measures can and will be taken in the event of a radiological emergency at the site. Guidance regarding the specific nature of the contacts and arrangements is provided in NUREG-0800 (Standard Review Plan (SRP)), Section 13.3, “Emergency Planning,” which states in Subsection II, “Acceptance Criteria” (SRP Acceptance Criteria Nos. 15 and 18), that the ESP application should include copies of letters of agreement or other certifications, reflecting contacts and arrangements made with local, State, and Federal agencies (including agreements or other arrangements with tribal agencies and private organizations) with supporting emergency responsibilities. The agreement information should be up-to-date when the application is submitted, and should reflect use of the proposed ESP site for possible construction of a new reactor (or reactors). In addition, a discussion of the details associated with any ambiguous or incomplete language in the letters of agreement should be provided in the application. Additional guidance is provided in Section II.B, “Contacts and Arrangements,” of Supplement 2 to NUREG-0654, “Criteria for Emergency Planning in an Early Site Permit Application,” which states, in part, that the descriptions of contacts and arrangements should include the name and location of the organization contacted, the title and/or position of the person(s) contacted, and the role of the organization in emergency planning. ESPA Part 2 (SSAR) Section 13.3.5, “Contacts and Agreements,” states that TVA has held numerous discussions with local, state and county agencies, and emergency response organizations that currently support DOE’s Oak Ridge Reservation, and that these discussions, including letters of support from the State of Tennessee and Anderson County, were productive and indicative of broad support from these organizations in further development of CRN emergency plans. In addition, TVA will maintain arrangements with surrounding emergency response organizations that currently support DOE’s Oak Ridge Reservation, including an existing agreement with the Radiation Emergency Assistance Center/Training Site in Oak Ridge, TN. Section 13.3.5 further states that certification letters from the State of Tennessee, Roane County, and the City of Oak Ridge will be obtained by TVA and provided in the combined license application (COLA), and that a letter of agreement with each of the following organizations will be obtained by TVA for the CRN Site and provided in the COLA. • Local medical facility services • Offsite ambulance service • Local firefighting support • Local law enforcement agencies

The references in SSAR Section 13.3.5 to emergency response organizations that currently support Oak Ridge Reservation do not reflect an acknowledgement by those organizations of the proposed expanded responsibilities associated with the CRN Site. Pursuant to the above-referenced regulations and guidance, the submission of a description of contacts and arrangements made with Federal, State, and local governmental agencies with emergency planning responsibilities is required at the ESP application stage. In addition, the SSAR must contain any certifications that have been obtained. NRC RAI 13.03-01.a Consistent with the requirements and guidance described above, please provide the following information, or explain why it is not required.

a. Provide a copy of the three letters referenced in SSAR Section 13.3.6, “References,” from the Tennessee Emergency Management Agency, Anderson County, and Roane County. Explain why there is no letter of support from the City of Oak Ridge, which is identified in SSAR Section 13.3.5, “Contacts and Arrangements,” and provide a copy if one exists. In addition, provide a copy of the existing agreement with the Radiation Emergency Assistance Center/Training Site in Oak Ridge, TN (for radiological medical support), which is referenced in SSAR Section 13.3.5.

TVA Response NUREG-0800, Section 13.3, Acceptance Criteria Nos. 15 and 18, state that an early site permit (ESP) applicant should include copies of letters of agreement or other certifications, reflecting contacts and arrangements made with local, state, and federal agencies with supporting emergency responsibilities. Site Safety Analysis Report (SSAR) Section 13.3 describes the local, state and county agencies with supporting emergency responsibilities that have expressed support for the Clinch River Nuclear (CRN) Site, including references to letters of support from the State of Tennessee and Anderson County. The attachment to this enclosure contains copies of additional letters of support from Tennessee Emergency Management Agency (TEMA), Anderson County, Roane County, and the City of Oak Ridge. In addition, the attachment to this enclosure contains a copy of the existing agreement with the Radiation Emergency Assistance Center/Training Site in Oak Ridge, Tennessee. The SSAR changes will be incorporated into a future revision of the ESPA. SSAR Subsections 13.3.5 and 13.3.6 are being revised as indicated. Strikethroughs indicate text to be deleted. TVA has held numerous discussions with State, county, and local agencies and emergency response organizations. These discussions have been productive and indicative of broad support from these organization in further development of CRN emergency plans, as indicated by letters of support from the State of Tennessee, and Anderson County, Roane County, and the City of Oak Ridge (References 13.3-4 through 13.3-6 13.3-7).

Certification letters from the State of Tennessee, Roane County and the City of Oak Ridge will be obtained by TVA and provided in the COLA.

Surrounding emergency response organizations currently support DOE’s Oak Ridge Reservation. TVA will maintain arrangements with local medical facilities to receive patients from the CRN Site. A Letter of Agreement (LOA) for local medical facility services for the CRN Site will be obtained by TVA and provided in the COLA. TVA has an existing agreement with the Radiation Emergency Assistance Center/Training Site in Oak Ridge, Tennessee, for radiological medical support (Reference 13.3-8).

TVA will maintain arrangements for offsite ambulance assistance to the CRN Site. A LOA for ambulance service for the CRN Site will be obtained by TVA and provided in the COLA.

TVA will maintain arrangements for local firefighting support. The senior offsite fire official responding to the CRN Site will coordinate response activities with the TVA Incident Commander. The CRN Site is responsible for providing radiological protection and proper safety clearance in affected areas. A LOA for local firefighting support for the CRN Site will be obtained by TVA and provided in the COLA.

TVA will maintain agreements with local law enforcement agencies to provide law enforcement support when necessary. A LOA for local law enforcement agency support for the CRN Site will be obtained by TVA and provided in the COLA.

b. SSAR Section 13.3.5, “Contacts and Agreements,” refers to certification letters that will be provided from the State of Tennessee, Roane County, and the City of Oak Ridge in the COLA. Explain why Anderson County is not included in this list of offsite agencies.

TVA Response SSAR Section 13.3, “Conduct of Operations”, in conjunction with Part 5, “Emergency Plan,” of the ESPA describes the emergency preparedness for a small modular reactor (SMR) facility at the CRN Site. In Part 5 of the ESPA, TVA proposed two distinct emergency plans in accordance with 10 CFR 52.17 (b)(2)(i) for approval. ESPA Part 5A describes the emergency plan for Plume Exposure Pathway (PEP) Emergency Planning Zone (EPZ) at the Site Boundary. ESPA Part 5B describes the emergency plan for PEP EPZ consisting of an area approximately two miles in radius from the site center. SSAR Section 13.3.5 does not include Anderson County in the list of offsite agencies that will provide certification letters because neither of the two proposed emergency plans encroach into Anderson County. c. For each of the local/offsite support organizations, referred to in SSAR Section 13.3.5 by the nature of the arrangements they currently provide in support of the Oak Ridge Reservation (i.e., medical, ambulance, firefighting, and law enforcement (listed above)), provide a letter of agreement, certification, or other documentation of arrangements that describes their acknowledgement of their expanded support for the CRN Site. Consistent with the requirements and guidance cited above, include the name and location of the organization contacted, the title and/or position of the person(s) contacted, and the role of the organization in emergency planning.

TVA Response NUREG-0654, “Criteria for Emergency Planning in an Early Site Permit Application,” Supplement 2, Section II.B, “Contacts and Arrangements,” specifies that an ESP applicant must include a description of contacts and arrangements made with local, State and Federal agencies with emergency planning responsibilities. SSAR Section 13.3 identifies local/offsite agencies with supporting emergency planning responsibilities. TVA has held several productive discussions with these organizations and has received broad support from them, as indicated in the letters of support provided in the attachment to this enclosure. These letters include names, location of organizations contacted, and the title of the people contacted in the organizations. Additionally, the letters express the organization’s plans to actively participate in all emergency planning and radiological emergency preparedness exercises and evaluations.

The nature and extent of emergency planning support required from organizations referenced in SSAR Section 13.3.5 is not finalized because the ESPA proposes two distinct emergency plans requiring significantly different levels of emergency planning support. Therefore, TVA plans to obtain and provide the certification letters and letters of agreements from local/offsite support organizations at the COLA stage.

IN THE COUNTY COMMISSION FOR ROANE COUNTY, TENNESSEE

A RESOLUTION supporting the Tennessee Valley Authority in its Small Modular Reactor (SMR}

application to the United States Department of Energy

WHEREAS, the United States Department of Energy (DOE) and the Tennessee Valley Authority (TVA) have had a significant impact on the local cities, counties, region, state and even nation and world with the development of advanced technology; and

WHEREAS, two of the three Department of Energy Oak Ridge facilities are located in Roane County and have contributed extensively to both the local economy and livability by improving the standard of living; and

WHEREAS, the Oak Ridge DOE facilities are large consumers of electric power, currently generated from fossil fuels; and

WHEREAS, the Oak Ridge DOE facilities desire to reduce or eliminate their carbon footprint by reducing or eliminating the use of fossil fuels; and

WHEREAS, Small Modular Reactors have the potential to provide the United States and Roane County, Tennessee, clean, safe, cost-effective energy, create jobs and spur economic development; and

WHEREAS, the Tennessee Valley Authority owns property adjacent to the DOE Reservation which was previously approved for the construction of the Clinch River Breeder Reactor, an energy project which was cancelled in the early 1980's; and

WHEREAS, TVA has expressed its desire to use its Clinch River Breeder Reactor property, along with power distribution lines which are located on adjacent property, for consideration of a Small Modular Reactor, making this an ideal site for a Small Modular Reactor; and

WHEREAS, TVA has partnered with Babcock and Wilcox mPower technology for the development of the SMR; and

WHEREAS, Roane County, Anderson County, Knox County, Loudon County and other adjacent counties and cities have worked in and around nuclear activities and the nuclear industries for decades and have the employee workforce and skill set to make a Small Modular Reactor a successful project;

NOW, THEREFORE, BE IT RESOLVED that the Roane County Commission supports TVA's application to obtain a Nuclear Regulatory Commission license to build and operate an

Roane County can be expected to fully approve and support the local construction and use of a small number of such SMR electric power plants if:

• Plant final design appears to include features that now gain wide international support for the SMR concept.

• Reactor cooling water from the anticipated group of SMR reactors will not threaten the health of persons using the Clinch River or cause enough heating to impair water quality or cooling capacity for existing users.

• Emissions of radioactive contaminants to air or water during normal or plausible upset circumstances are unlikely to induce adverse health effects.

• Probably direct and indirect economic costs of the deployment do not outweigh the likely gains for either public or private sectors, and

• Spent fuel and radioactive trash from this SMR Project will be stored thoughtfully and safely onsite until its planned removal from Roane County.

BE IT FURTHER RESOLVED that a copy of this resolution be transmitted to our state and federal legislators asking for their support for TVA's application to the U.S. Department of Energy.

The City of Oak Ridge is writing this letter of support for the submittal of the Early Site Permit application for a small modular reactor in the greater Oak Ridge area. The City could not be more pleased at this action to implement the latest in nuclear technology. The proposed site provides the convenience of proximity to the Oak Ridge National Laboratory and the efficiencies of the Watts Bar nuclear power plant to provide additional resources in the vicinity.

The City of Oak Ridge is prepared to work with the Tennessee Emergency Management Agency (TEMA) to support the site. The Oak Ridge Fire Department is one of six fire departments in the state of Tennessee with an ISO rating of 2, the highest of any department. Our ability to respond to hazardous material matters and public emergencies is the subject of continuous training and learning. We look forward to being a willing partner in planning for the emergency programs that will be needed to support the small modular reactor. We look forward to being included with all exercises and evaluations associated with the Clinch River as chartered by Nureg-0654 and 44-CFR-350.

We look forward to being included as the adjacent local government and will assist as appropriate in any planning efforts to make this project successful.

LETTER OF AGREEMENT - RADIATION EMERGENCY ASSISTANCE CENTER/TRAINING SITE (REAC/TS) SUPPORT

Please reference your electronic mail of March 25, 2015, requesting that the Department of Energy (DOE) REAC/TS facilities and team continue to provide 24 hour availability of backup assistance to the Tennessee Valley Authority in the event of a medical/radiological emergency, which exceeds in-house and commercially available capability. This response constitutes our agreement to provide this service upon your request. The agreement remains in effect until terminated in writing by either party.

We wish to remind you that our REAC/TS facilities in the Oak Ridge Institute for Science and Education (ORTSE) are government controlled and operated by the Oak Ridge Associated Universities under contract with DOE. Therefore, REAC/TS is prohibited from competing with commercial firms that can provide radiological emergency services. Only if the magnitude or uniqueness of a radiological emergency exceeds your in-house and commercially available capabilities would REAC/TS be authorized to provide back-up services.

Since these facilities are government controlled, no fee or retainer is required to assure the availability of backup services by REAC/TS. However, if you utilize the services of REAC/TS, we should expect to recover those costs that could reasonably be related to handling such an incident, including all charges billed to DOE or ORJSE by hospitals and physicians.
