Purpose. To establish a solid waste management working group (hereafter referred to as the “Partnership”) with U.S. Army Garrison-Hawai`i, Joint Base Pearl Harbor-Hickam, Marine Corps Base Hawai`i, and Coast Guard Base Honolulu and the City and County of Hawai`i (C&CH) (hereafter referred to as “the Parties”) to work collaboratively in all aspects related to the management of solid waste generated by the Parties on the island of Oahu. 2. Goal. To develop a comprehensive and integrated approach for solid waste management on the island of Oahu that will assist the Parties in their individual solid waste management programs and support mutual solid waste and sustainability objectives. This approach will: 1) coordinate the Parties’ efforts to reduce, reuse, and recycle wastes; 2) consider the relative economic advantages of management technologies and the potential for resource recovery; 3) coordinate waste management programs to support sustainability objectives deemed important by the Parties such as “net-zero waste” and “energy security”; and 4) contribute to the vitality of the Oahu economy and quality of life for the region’s citizens.

CITY AND COUNTY OF HONOLULU SUBJECT: SOLID WASTE MANAGEMENT PARTNERSHIP

1. Purpose. To establish a solid waste management working group (hereafter referred to as the “Partnership”) with U.S. Army Garrison-Hawai`i, Joint Base Pearl Harbor-Hickam, Marine Corps Base Hawai`i, and Coast Guard Base Honolulu and the City and County of Hawai`i (C&CH) (hereafter referred to as “the Parties”) to work collaboratively in all aspects related to the management of solid waste generated by the Parties on the island of Oahu. 2. 3. Areas of Consideration. For the Parties to achieve these goals, the Partnership intends to actively cooperate in the following efforts:

a. Identification of key stakeholders and resources necessary to develop a plan that addresses the Parties’ collective, long-term waste management and waste-to-energy needs (to include increasing the use of alternative energy, reducing fossil fuel use, and increasing landfill diversion);

b. Development of a Plan of Action and Milestones (POAM) that identifies key actions and timelines necessary to implement a plan that meets the Parties’ collective, long-term, waste management and energy security needs;

c. Development of a strategic management plan that minimizes inputs into the waste stream through source reductions, and enhances re-use, recycling, and the disposal of solid waste through an effective integration of composting, waste-to-energy conversion, landfill, and/or other technologies that address all Parties’ requirements;

d. Participating in regular face-to-face meetings and conference calls to collaborate in the development of a comprehensive, island-wide plan to meet the objectives of the Parties

e. Devoting staff time to support Partnership initiatives activities;

f. Identifying stakeholders and recruiting new participants, on an as-needed basis, to support the Partnership in both advisory and implementation roles; and

g. Analyzing, selecting, and developing recommendations for potential collaborative waste management initiatives that support the goals of the Parties and the Partnership.

4. Governance. The Parties, through the Hawai`i Joint Interservice Resource Group (HI JIRSG), will constitute the Core Project Management Group of the Partnership, and will act as the decision-making body for this initiative. The Parties will seek, as required, cooperation with appropriate city or state agencies, other federal agencies, non-governmental organizations, and private or commercial entities on Partnership initiatives; and, as determined by the Parties, other participants may join the Partnership in either advisory or implementation roles for particular initiatives

5. Decision Making. Although majority consensus is desirable, any party who for whatever reason cannot support an initiative is allowed to abstain or withdraw without repercussion, from participation in that initiative. 6. MOU Commencement, Amendment, and Cessation. This MOU will be effective when signed by an appropriate representative of each of the Parties. This MOU may be amended at any time by the mutual written consent of the Parties. Unless otherwise agreed to by the Parties, this MOU will expire 5 years after commencement. Any of the Parties may terminate their participation in this MOU at any time by notifying each of the other Parties in writing one hundred eighty (180) days before the termination date. 7. Limitations.

a. Any commitments made or actions taken by the Parties, related to this MOU, are still subject to each party’s normal procedures governing such action. Nothing in this MOU constitutes either the authority or the intent to expend appropriations; to enter into any contract, agreement for assistance, or interagency agreement; or to incur any financial obligations. Any contracts, interagency agreements, etc., (i.e., any endeavor involving expenditure of US government funds) entered into incident to, or as a result of, this MOU will still be governed by applicable law, policy, regulation and procedures (e.g., contracting through procedures ensuring full and open competition) and will be executed via and governed by written agreements and/or other documents, separate from this MOU. This MOU does not create any right or benefit, substantive or procedural, enforceable by law or equity, for or against any of the Parties to the MOU, their officers or employees, or any other person. This MOU does not apply to any

person or organization outside of the Parties. b. The Parties agree that the “Solid Waste Management Partnership (SWMP)” name may be used in conjunction with other agreements or initiatives in the future. No one Party to this MOU claims exclusive rights to the “SWMP” name, and other stakeholders are welcome to join the Partnership at any time during this partnership period. 8. Contacts for the Parties. The following individuals are the designated contacts of the Parties for this MOU and are the members of the Core Project Management Group on behalf of their organizations: If

this contact information changes, the Parties agree to notify all other parties to this MOU in writing; such written notification shall become an addendum to this MOU.
