Application of SAKD Holdings LLC(“Applicant”) for Variances and Inter-pretations

a new, mixed use, three-story building,having an 80 seat restaurant, and 715sq. ft. of retail use, on the ground floor,and hotel uses for 16 units on the secondand third floors, as well as a roof deck.The proposed uses are conditional usesunder Greenport Village Code Sections150-11(b)(1), (2) and (3). The propertyis located in the WC – Waterfront Com-mercial District. The property is not lo-cated in the Greenport Village HistoricDistrict.
Requested Interpretations
1. Interpretation regarding lot cover-age.
The applicant is requesting an inter-pretation of Section 150-12(B) of theGreenport Village Code to determinewhether the proposed improvementsrequire a variance from the bulk regula-tions set forth in said Section since ac-cording to the applicant, the Project’splans included in the Variance Applica-
tion indicate that the lot coverage (inclu-sive of the building, entrance, and ADA-accessible ramp) total 38.6% of the lot(3,414 square feet of coverage/8,834.24total square feet of lot area), and the Vil-lage Code requires a maximum lot cov-erage of 40%.
2. Interpretation regarding off streetparking requirements
(i) The applicant requests an inter-pretation of Section 150-12(C) of theGreenport Village Code to determinewhether the Project is exempt from theoff-street parking requirements in accor-dance with that Greenport Village CodeSection.
(ii) The applicant requests an inter-pretation of Section 150-16(A)(1) of theGreenport Village Code to determinewhether the Project and/or Propertyare/is exempt from off-street parkingrequirements and from payments in lieuthereof in accordance with that VillageCode Section.
3. Interpretation regarding require-ment for loading berth.Applicant requests an interpretation
of Section 150-16(B)(e) of the Green-port Village Code to determine whetherone off-street loading berth is requiredfor a hotel having 8.787 square feetof floor area when the Greenport Vil-lage Code requires “one berth for each25,000 square feet of floor area”.
4. Interpretation regarding heightlimitation.
Applicant requests an interpreta-tion of Section 150-2 of the GreenportVillage Code to determine whether thedefinition of “height” set forth therein,which is “the vertical distance measured
from the average elevation of the crownof the road to the highest point on theroof” includes a parapet wall, mechani-cal equipment, roof deck, safety fencingand trellis, and/or stairwell and/or eleva-tor bulkhead and shafts.
Requested Variances1. In the event that the Zoning Board
of Appeals determines in its consider-ation of the interpretation requested by
the applicant regarding the applicationof the lot coverage limitation of Section150-12B of the Greenport Village Codethat a lot coverage variance is required,then the applicant requests a lot cover-age variance of 590 square feet, or 6% inthat the proposed building constructionhas a lot coverage of 4,123 square feetrepresenting 46% of the lot, requiring avariance of the maximum lot coveragelimitations of 590 sq. ft., or 6%, of thetotal area of the lot (8,834.2 sq. ft.). Sec-tion 150-12B of the Village of GreenportCode requires maximum lot coverage of40% (3,533 sq. ft.) in the WC-WaterfrontCommercial district.
2. Front yard setback variance of 6feet for wood trellises on Third Street.
Section 150-12(B) of the GreenportVillage Code requires a front yard set-back of 6 feet in the WC WaterfrontCommercial District. The applicant pro-poses overhead wood trellises on thewest property line, along Third Street
(which is a front yard in accordance withthe Greenport Village Code), that areproposed to be built to the property line.The applicant therefore requests frontyard setback variance of 6 feet for theoverhead wood trellises proposed alongThird Street.
3. Front yard setback variance of 1.3feet for front steps on Front and ThirdStreets.
Section 150-12(B) of the GreenportVillage Code requires a front yard set-back of 6 feet in the WC WaterfrontCommercial District. The applicant pro-poses front entrance steps at the inter-section of Front and Third Streets thathave a front yard setback of 4.7 feet.
The applicant therefore requests a frontyard setback variance of 1.3 feet for thefront steps at the intersection of Frontand Third S treets.
4. Front Yard setback variance of 2.42feet for raised outdoor dining area onFront Street.
Section 150-14(C) of the GreenportVillage Code requires an a front yardsetback of that is equal to the average
front yard setback of two existing non-residential buildings with the greatestfront yard setback within 200 feet oneach side and that are on the same sideof the street, and within the same blockand the same district as the proposednonresidential building, and the average,which is the required front yard setback,is 2.42 feet. The proposed raised outdoordining area (on the Front Street or northproperty line which is a front yard pur-suant to Greenport Village Code, , andthe applicant proposes a front yard set-back of “0” feet, requiring a front yardsetback variance of 2.42 feet.
5. Variance of 24 sp aces from parkingspace requirement.
In the event that the Zoning Board ofAppeals determines in its considerationof the interpretation of the applicationof the off-street parking requirement re-quested by the applicant that the projectis not exempt from the off-street parkingrequirement of Section 150-16(A)(1) of

6. Variance from requirement of anoff-street loading berth.
In the event that the Zoning Board of
Appeals determines in its considerationof the interpretation of the applicationof the requirement of Section 150-16(B)(e) of the Greenport Village Code forone off-street loading berth for a hotelhaving a floor area of less than 25,000square feet, that one off-street loadingberth is required, then the applicant isrequesting a variance of the require-ment for one off-street loading berth
in that the proposed building does notprovide for an off-street loading berthand Section 150-16B.(e) of the Village ofGreenport Code requires one off-streetloading berth for each 25,000 sq ft offloor area requiring a variance of 1 load-ing berth.
7. Height variance of 12.0 feet.In the event that the Zoning Board of
