Kohn, assisted lead counsel Kristine Poplawski in challenging methodology and other requirements for determining federal agricultural labor shortage which was prelude to INS admission of replenishment workers from abroad. Madera Chptr., MAPA v. Honig (Madera Co. Superior Ct. No. 32126): Was lead pretrial counsel in action challenging local and statewide policies for certifying bilingual education instructors; with P. Roos, settled case against school district and prepared for trial against State Dept. of Education; with P. McBride v. Modesto City Schools (Stanislaus Co. Superior Ct. No. 372122): With co-counsel Jack Daniel, California Rural Legal Assistance, challenged a middle school graduation standard established by school board (requiring certain knowledge of the

A number of students with learning disabilities and/or limited English proficiency were not allowed to participate in graduation activities because they failed the Constitution test. A complaint and application for a temporary restraining order were filed in June 2006, eight days after the board refused to rescind its policy. The court denied the TRO.

Gutierrez v. EDD, 14 Cal.App.4th 1791, reh. denied (1993) : With P. Gee, wrote appellate brief in unemployment insurance benefits appeal alleging that claimant meets state's "able and available" requirements, notwithstanding lack of authorization to work under federal immigration laws.

Perez v. INS, 72 F.3d 256 (2d Cir. 1995): With Attorney Bertrand Bosmans, wrote most of petition for review by appellate court and wrote amicus curiae brief on behalf of American Immigration Lawyers' Association and National Lawyers' Guild Immigration Project on issue of confidentiality for legalization applicants under immigration reform act.

Visser v. Swoap (Sacramento Co. Superior Ct. No. 337016): With Anson Levitan, Marie Bockwinkel and Anita Evans, co-counseled in suit challenging state procedures for reviewing applicants for the "medically needy" disability assistance program. Reached settlement which was to expedite cases and make process more comprehensive and applicants more informed.

National Center for Immigrants' Rights, Inc. v. INS, 791 F.2d 1351 (9th Cir. 1986): Principal author of amicus curiae brief on behalf of several farmworker organizations; argued that employment of undocumented workers had little or no effect on displacement of citizen or lawful resident workers.

Perales v. Thornburgh, 967 F.2d 798 (2d Cir. 1992), judg't vacated sub nom. Reno v. Perales, 509 U.S. 917 (1993): Co-author, with P. Gee, Linda Bosniak and L. Guttentag, of amicus curiae brief on behalf of individual legalization applicants and immigrants' organizations; briefed argument that immigration reform act was to be construed liberally and that loss of immigration benefits could result in great harm.

McNary v. Haitian Refugee Center, 498 U.S. 479 (1991): Co-author, with P. Schey and P. Gee, of amicus curiae brief on behalf of classes of legalization and SAW applicants in other litigation; briefed argument that federal court review of INS implementation of the Special Agricultural Worker amnesty program was proper.

Rael v. Taylor, 876 P.2d 1210 (Colo. 1994): Co-author, with Richard García and Todd Howland, of amicus brief on behalf of Colorado residents seeking land rights to disputed communal property. Brief encouraged court to look to non-US legal jurisprudence and International Covenant on Civil & Political Rights.

Galvez-Letona v. Kirkpatrick, 3 Fed. Appx. 829 (10th Cir.), 2001 WL 91610: Principal author of amicus brief on behalf of approximately 70 disability, immigrant, religious and ethnic organizations seeking to affirm district court order, under §504 of the Rehabilitation Act, granting naturalization to Galvez-Letona, a Guatemalan applicant who met all the essential requirements of the naturalization program.
