Program Background and Purpose


Program Background

The Publicly Owned Housing Program (POHP) was first established by the Minnesota Legislature in 2005

to offer assistance to Housing Redevelopment Authorities (HRAs) and Public Housing Authorities

(PHAs) that provide public housing to individuals and families (households with children).


Program Purpose

The purpose of POHP is to rehabilitate and preserve public housing units, particularly to address health and life safety, accessibility, energy and water efficiency, and critical needs.


Funding Availability and Terms

• POHP funds are provided in the form of a 20-year, deferred, forgivable loan with a 35-year compliance period to HRAs/PHAs that operate public housing

• Up to $8 million is available through the 2018 POHP RFP

Eligibility Criteria

• Minimum PHAS score of 80 required

• No minimum or maximum loan request amounts

• All or part of a proposed project may be funded

• Incompatible with RAD transactions that involve a transfer of ownership to a non-public owner

Concept-Based Application

• Rolled-out during 2017 RFP as a result of HRA/PHA feedback

• A variety of reasons for not applying for funds, including:

• Not aware of the RFP

• Materials were too burdensome

• Specific comments and concerns:

• 20-year Physical Needs Assessment was difficult and expensive due to needing a third party expert

• Applicants needed to hire an engineer for assistance with project scope and costs


Concept-Based Application

• No third party reports required

• An easier sources and uses workbook

• A concept-based application rather than a completed scope of work

• No box.com

• Technical assistance with POHP program staff


Eligible Projects

• Health and Life Safety

• Accessibility

• Critical Needs

• Energy and Water Efficiency

Health and Life Safety

• Repair or replacement of mechanical equipment

• Repair or replacement of any conditions that indicate imminent structural collapse or failure

• Environmental remediation for mold, radon, friable asbestos or lead-based paint hazards


Accessibility

• Lack of compliance with Section 504 of the Rehabilitation Act of 1973

• Lack of compliance with the Architectural Barriers Act, the Fair Housing Act or the American with Disabilities Act (ADA)

• Improvements such as Universal Design or demonstrated need for aging-in-place features


Critical Needs

• Replacement or repair of items that have outlived their expected useful life

• Conditions determined to be critical via certified HUD UPCS/Real Estate Assessment Center (REAC) Deficiencies Inspections Report

• Any work described in Minnesota Housing’s Rental Housing Design/Construction Standards (RHD/CS), Chapter 10 - Critical Needs and Preservation Housing Projects


Energy and Water Efficiency

Energy and water efficiency improvements: reduce operating costs, reduce tenant utility costs, create healthier living environments.

Potential improvements include:

• Replacement of inefficient plumbing fixtures with water conserving fixtures

• Replacement of inefficient/antiquated Heating Ventilating and Air Conditioning (HVAC)

• Lighting controls

• Weatherization improvements such as additional insulation, air-bypass sealing, exterior window/door upgrades

• Renewable energy systems may be considered if supported by a third party analysis with a simple 10 year payback

The Importance of Partnership

Examples of Partnership

• Working with your local city or county departments and representatives

• Example: Local city/county health departments

• Exploring strategic partnerships with your local water, gas and electric utilities

• Utilities are required to spend money on energy improvements for low-income residents/properties.

• Don’t rely on the utility website. Call the utility directly to see if there are custom rebates available.

• Determining if there are other organizations that could help with a specific part of your project

• Example: Local Weatherization Service Providers or local non-profits

Small Cities Development Program(SCDP)

Funds for the program are provided by the U.S. Department of Housing and Urban Development (HUD) for the benefit of eligible non-entitlement local units of government (cities and counties) through a competitive application process for a variety of community development needs.

How to become an administrator?

Rental Rehab Activities

Eligible improvements include, but are not limited to: • Structural improvements including, roof repair or

replacement, exterior and interior walls, substandard floors, stairs, foundations, cabinets/countertops (if all are units are being replaced)

• Windows and doors

• Hard-wired smoke and carbon monoxide detectors

• Improvements that make the housing more accessible and habitable for persons with disabilities

• Improvements of heating, plumbing, or electrical systems

• Weatherization and increased energy-efficiency

• Exterior painting or siding, as necessary

Rental Rehab Activities

• Ineligible improvements include, but are not limited to, the following:

• Fireplaces and wood stoves

• Decks or patios, unless part of dwelling entry or exit

• Floor coverings, unless to correct documented health and safety concerns

• Appliances, window treatments and decorative work

• Walk in bathtubs, unless to meet accessibility standards for units designated to meet accessibility standards

• Kitchen cabinets and countertops, unless to address inadequate or unsanitary food storage or preparation issues, or to make cabinets and countertops meet accessibility standards for units designated to meet accessibility standards

• Demolition of any part of the structure (other than accessibility)

Federal Objectives-Rental

51% of units must meet:

• Benefit to low and moderate income people on a household basis (80% of county median income) for housing

• Rents at HUD Fair Market Value or agreed upon MH rents

Federal Requirements

• Environmental Review: includes public comment periods and historical clearance

• Davis-Bacon (Rental 8 units or greater)

• Fair Housing/Equal Opportunity

• Annual reporting

• Monitoring- ongoing
