Prior to each payment date, a statement will be submitted to the Director. Payment will be by one check. It is the group’s responsibility to pay by the due date specified in the payment schedule irrespective of whether a statement is received.

Exchange Rate All prices are projected for 2013 and are subject to change. They are based on an exchange rate of $1USD = 0.72 EUR. Adjustments may be made if the exchange rate varies more than 5% on November 9, 2012.

Group Numbers

The services specified are based on a minimum of 40 paying passengers. If this quota is not reached, the price of the tour may be increased proportionately.

Airline Tickets Air Surcharges and Taxes

KI will issue airline tickets after the final payment is received and no later than February 7, 2013. Individuals showing a balance due on their account will not be issued an airline ticket therefore will be subject to flight availability and airfare increases. Actual air taxes and surcharges will be invoiced at time of ticketing, between 90 and 30 days prior to departure. The estimate of air surcharges and taxes listed above will be included on invoices. The actual amount will be known at the time airline tickets are issued. This may require collection of a further payment after final payments.

Complimentary Positions

The tour price is based on 1 free position for every 20 passengers purchasing the full package, including air, (i.e. the 21st, 42nd, 63rd, etc.). Those receiving a free position must still pay air surcharges and taxes and travel insurance if they wish to take it. Note: Land Only travelers do not count towards complimentary positions.

Group Tips Basic group tips are included; however please feel free to give additional tips for exceptional service.

Cancellation

The following cancellation charges will apply if anyone cancels their tour (the insurance premium is not refundable): 50% of funds paid by the passenger will be refunded from the receipt of the first payment through September 19, 2012. No refunds after September 19, 2012 or if the account is in arrears at the time of cancellation

Substitution

Substitutions are encouraged so that cancellation fees can be avoided. The only additional cost for a substitute is the insurance premium, when an insurance package has been purchased, as these payments cannot be transferred. Substitution payments must be received by KI before a refund to the original passenger is made. Substitutions must be made no later than December 9, 2012 or charges will apply.

Terms and Conditions

The full terms and conditions for the tour program which govern the relationship between Kingsway International, LLC and the group, except as amended above, are appended. Receipt of the first payment constitutes full acceptance of the terms and conditions.

The parties confirm that this document accurately sets out the arrangements for the agreed tour. Note that the agreement applies unless KI is advised to the contrary in writing, even if a signed copy is not received. KINGSWAY INTERNATIONAL, LLC

AIR TRANSPORTATIONAirTransportationisinEconomyClassonairlinesdeterminedbyKIthatareIATA(InternationalAirTransportationAssociation)andARC(AirlinesReportingCorporation)membercarriers.

AIR TAXES AND SURCHARGESAirtaxesandsurchargesincludeairport,governmentagencyandsecurityfeesaswellasfuelsurcharges.Theactualairlinetaxesandsurchargesaredeterminedbytheairlinesatthetimetheairlineticketsareissued.

AIR DEVIATIONThosewishingtodeviatefromtheairarrangementsmadeforthegrouphavetwooptions:

1.Tomaketheirownflightarrangements(‘LandOnly’):thosewishingtotakethisoptionwillneedtomakealltheirownflightarrangements,includingsectorsbyairwithinthetour.Anypersonchoosingthe‘landonly’optionmustarrangetheirowngroundtransportationtoandfromtheairports.Ifthe‘landonly’optionisselectedaftertheinitialfull-tourreservationhasbeenmade,a$175changefeeupto120dayspriortodeparturewillapply.Anyonechangingtoa‘landonly’optionlessthan120dayspriortodeparturewillbesubjecttoa$1,000change fee.Thosechoosinga ‘landonly’packagewillnotcount towards thegroup’scomplimentarypositions.

2.Mostairlineswillpermitsomemembersofthegrouptodeviateonthereturn.Thespecificconditionsapplicabletothegroup’stourwillbeadvisedoncetheflightsareconfirmed.Adeviationfeeof$350plusanyapplicableadditionalairfarewillbecharged.Noapplicationswillbereceivedafter120dayspriortodeparture.

CANCELLATIONSThefollowingcancellationchargeswillapplyifanypassengercancelstheirtour(theinsurancepremium,whetherincludedinthetourpriceorpaidseparately,isnotrefundable).

50%offundspaidbythepassengerwillberefundedfromreceiptofthefirstpaymentuntilthedatepriortotheduedateforthefinalpaymentNofundswillberefundedtothepassengeraftertheduedateforthefinalpaymentorifanypaymentsareinarrearsatthedateofcancellation

Shouldworldconditionsaffectthestagingofthetour,theU.S.StateDepartmentbanstraveltothecountriesincludedintheitineraryorshouldKIdeterminethatthesafetyofitsclientsisotherwisebetterserved,KIreservestherighttoofferacomparableprogramatanalternatedestination. Should this offer not be accepted by each passenger within 10 days of theoffering,thecancellationpenaltiesoutlinedabovewillapply.Allcancellationsmustbemadeinwritingandsentbymail,faxore-mailtoKI.

SUBSTITUTIONSKIrecognizesthatcircumstancesoccurwhereitmaybenecessarytocancelparticipationinthisprogram.Substitutionsareencouragedsothatcancellationfeescanbeavoided.Theonlyadditionalcostforasubstituteistheinsurancepremium,whereaninsurancepackagehasbeenpurchased,asthesepaymentscannotbetransferred.KImustbenotifiedofsubstitutionatthetimeofcancellation.Substitutiondeposits/paymentsmustbereceivedbyKIbeforearefundtotheoriginalpassengerismade.Substitutionsmustbemadenolaterthan90dayspriortotravelorchargeswillapply.ThisclausedoesnotapplyifKIhascanceledaperson’sparticipationinaccordancewiththeprovisionsofthesetermsandconditions.

PASSPORTSEverytourmembermusthaveavalidpassportthatwillbeineffectforatleastthreemonthsafterthedateofconclusionofthetour.KImustreceiveacopyofthepassportnolaterthan120dayspriortodeparture.

FREQUENT FLYER PROGRAM MEMBERSKIwillpassfrequentflyerprograminformationtotheairlinesifsuchinformationisreceivednolaterthan60dayspriortotravel.Itistheindividualtraveler’sresponsibilitytoensuretheairlineinsertsthisinformationintotheirbooking.Manyairlinesdonotprovidemileageaccrualforgrouptravel.Travelersshouldcheckwiththeirfrequentflyercarriertodetermineiftheyqualifyforanymileageaccrual.KIisunabletoprovideticketcopiesafterdeparture.

ARBITRATIONAnydisputes shall be resolvedbybinding arbitration in theCounty of El Paso,ColoradothroughtheAmericanArbitrationAssociation.

RESPONSIBILITYThe responsibility of KI is strictly limited. KI acts only as agents for transportationcompanies,hotels,andotherpublicservicesandit istheexpressconditionthatweshallnotbecome liable fordelays, losses,oraccidents incurredbysaidpersonsoroperatorstopassengersandbaggagefromwhatsoevercause.KIalsoreservestherighttochangetherouting,hotels,and/orsightseeingandanyserviceoffered,should localconditions inouropinionwarrant; theextracost, if any,mustbepaidby thepassengers.The right isreservedtorefuseanypersononthistour.Theairlinesandothertransportationcompaniesconcernedarenottobeheldresponsibleforanyactoromissionoreventduringthetimepassengersarenotonboardtheirplanesorconveyances.Thispassage contract in use by thecarriersconcernedwhenissuedshallconstitutethesolecontractbetweentheairlinesorothercarriersandthepurchasersofthetourand/orpassengers.Alladditionalexpensescausedbywar,landslides,strikes,weatherdelays,illnessoraccidentsaretheresponsibilityofthepassengers.ByutilizingtheservicesofKI,thetourmemberagreesthatthemaximumliability forKI is thepriceof the tourand that theexclusive venue for all claims,actionsor proceedings against KI of whatsoever nature arising out of this contract shall be theCountyofElPaso,Colorado,andsuchclaims,actions,orproceedingsshallbedeterminedaccordingtolawsandjurisdictionoftheStateofColorado.

VARIATIONS TO TERMS AND CONDITIONSAnyvariationsoradditions to theseTermsandConditionswillonlybevalid ifprovided inwritingbyanOfficerofKI.
