    LANSING, Mich. -Attorney General Bill Schuette today announced hisHealth Care Fraud Division has charged Tina Marie Binkley, 44, of

    Almont, Michigan, with two 20-year felonies for her alleged scheme toembezzle more than $460,000 from approximately 136 residents ofBoulevard Health Center (BHC), a Rochester Hills nursing home facility.

    Binkley is no longer an employee of BHC.

    Families deserve to know their loved ones in nursing homes are beingcared for, not being exploited for personal financial gain, saidSchuette. Criminals attempting to victimize our Greatest Generation toline their own pockets will be brought to justice.

    BHC fired Binkley in April 2013 after she allegedly failed to follow standardfinancial reporting procedures. BHC self-reported major bookkeepingdiscrepancies to the Michigan Department of Licensing and Regulatory

    Affairs (LARA). The accountant hired to examine their books more closelyfollowing Binkleys termination discovered several significant points of

    financial concern. LARA then referred the case to the Department ofAttorney General for further investigation.

    Schuettes charges allege that between 2010 and 2013 Binkley used herposition as the BHC business office manager to embezzle $460,266.82from 136 residents at the facility. As business office manager, Binkley wasauthorized to access and manage funds in two separate accountsincluding: the BHC general account, where facility income was depositedand day-to-day facility expenses were paid; and the Resident Trust Fund(RTF) account, which contains funds presented to BHC by residents,deposited into the account and held until residents request funds for theirincidentals.

    Attorney General investigators analyzed BHC bank records whichrevealed an alleged scheme to embezzle $460,000 as Binkley transferredresidents overpayments for room and board from the general account intothe RTF account and later made cash withdrawals from the RTF accountfor personal expenses.

    Resident overpayments to the BHC sometimes occur because many

    residents pay out-of-pocket for room and board and skilled nursing carewhile waiting for Medicaid or other insurance to be approved. In this case,residents or their representatives were not advised of the switch toMedicaid or other insurance in a timely manner.

    It is alleged Binkley embezzled funds by directing subordinate employeesto make cash withdrawals and turn the cash over to her. Investigationrevealed the subordinates were unknowing accomplices in Binkleysalleged scheme. BHC has cooperated with the Attorney General at everystage of this process and there is no indication of any lingering concernswith the facilitys books beyond the charges alleged against Binkley in thiscase.

    Schuette filed the following charges against Binkley in Rochester Hills 52-3 District Court on October 15, 2014:

    Two counts of Embezzlement from a Vulnerable Adult ($100,000 ormore), a felony punishable by 20 years in prison and/or a $50,000 fine or

    three times the value of the money or property involved, whichever isgreater.

    Binkley was arrested by Special Agents from the Department of AttorneyGeneral on October 16, 2014. She is expected to be arraigned inRochester Hills 52-3 District Court tomorrow.Schuette will be mailing correspondence to all 136 victims at their lastknown address pursuant to the Crime Victims Rights Act.

    Project $CAMS

    Attorney General Schuette maintains a partnership with the U.S. SocialSecurity Administration, the U.S. Department of Treasury, AARP, theMichigan Association of Homes and Services for the Aging, and theHealth Care Association of Michigan, in support of Project $CAMS (StopCrimes Against Michigan Seniors), a statewide criminal enforcementinitiative to protect residents of nursing homes from financial exploitation.Project $CAMS covers all of Michigan's approximately 420 nursinghomes, a population of more than 40,000 residents. Prior to the creationof Project $CAMS, only 44 cases of financial abuse against nursing home

    residents had been filed since 2003. Since the project began in 2008,more than 77 additional cases have been filed resulting in 72 convictions,with two cases still pending. Approximately $917,000 in court-orderedrestitution has been secured for victims. In almost every case theperpetrator was a relative.

    Put all financial instructions in writing. This protects you and reduces thelikelihood of misunderstandings. Keep records of all transactions.Understand any lifelong care agreements you are entering into. Documentthe agreement and specify the compensation, if there is any, to be paid to

    the caregiver.

    Ask a professional to review your financial agreements. Your attorney,accountant, or a bank employee can detect changes in your financialactivity that may signal a problem.

    Be cautious of joint accounts. Both parties are equal owners of theaccount and both have equal access to the money.

    Before you assign a power of attorney, be sure you understand the

    authority you are giving to your agent. Know the person to whom you aregiving this authority. Write in the agreement whether the agent will be paidor not, and if so, how much.

    Review your financial statements carefully. Ask a bank employee, atrusted family member, or a social worker or other professional for helpwhen you are unsure about financial documents.

    Stay connected to your community. Social isolation increases your risk ofbecoming a victim of abuse. Find out about community programs or social

    activities in your neighborhood.

    Dont share account numbers or your ATM personal identification number(PIN) with a stranger.

    Check your financial statements promptly and carefully for unauthorizedwithdrawals.

    Never sign blank checks.
