Accomplishments andchallenges of ASEAN

One of ASEAN’s noble goals is thepromotion of regional peace and security, and45-year-old association’s Treaty of Amity andCooperation in Southeast Asia is now achievingthe support of the global countries that lovepeace as an international norm for inter-staterelations. The treaty has even won the respectof major world powers including permanentmembers of the United Nations SecurityCouncil.

At the 19th

ASEAN Summit in Bali,Indonesia, ASEAN Leaders adopted the BaliConcord III “ASEAN Community, in the globalCommunity of Nations” assigning all memberstates the task of endeavoring towards fullrealization of the Concord. So, we the memberstates of the association are duty bound tocreate a more dynamic regional organizationwhile maintaining the centrality of ASEAN.

In fact, the adoption of the ASEAN charterwas followed by the association’stransformation into a rule-based inter-governmental organization with legalpersonality. Currently, all the member statesare in the process of integrating themselvesinto the “ASEAN Community” by 2015 inaccordance with the concept of “One Vision,One Identity and One Community”.

As a result of its central role in the emergingregional architecture, the ASEAN profile hasbeen enhanced in regional and internationalaffairs. Besides, the association is alsoconsistently striving to achieve outwardlooking ASEAN, and the ASEAN Vision callsfor the successful establishment of a peaceful,stable, prosperous and harmonious ASEANCommunity.

Although we have achieved manyaccomplishments, there still remain futurechallenges for us. In this regard, we the peoplesof ASEAN including the citizens of Myanmarshould do our utmost in the ASEAN integrationefforts aimed at narrowing the developmentgap among ASEAN member countries, and theimplementation of Master Plan on ASEANConnectivity, as identified by the ASEANLeaders in the Phnom Penh Declaration andthe Phnom Penh Agenda at the 20

th ASEAN

Singapore says disturbed by double standards ofUS human rights report

SINGAPORE, 17 Aug— Singapore’s Ministry of ForeignAffairs (MFA) on Thursday slammed the US StateDepartment’s “ Human Rights Practices 2011,” saying that thereport “again includes the same gross inaccuracies andmisrepresentations of the Singapore government’s policies.”

“We are disturbed by the double standards applied to theUS’ criticism of our Internal Security Act (ISA),” the ministrysaid in a statement.

The Internal Security Act, which has been in place inSingapore over the past decades, is meant to address threatsto internal security, including threats to public order, communaland religious harmony, and subversive and terrorist activities,it said, hitting back on the criticism contained in the report.

The US report alleged that Singapore used thecontroversial Internal Security Act, which allows preventivedetention without trial under certain circumstances, against“alleged terrorists” in recent years. It also cited caning as apunishment for some crimes in Singapore as one of the“problems.” Singapore said it failed to understand how the

United States reconciles its criticism of the act with thecontinued existence of US detention facilities at Guantanamo.

“By contrast to the Guantanamo detention facilities,which exist outside the framework of US law, the ISA providesa proper legal framework, and prescribes rules, for preventivedetention,” the statement said.

Singapore also reacted angrily to the annual US humanrights report last year, which it said contained the samemisrepresentations and inaccuracies year after year.

“This seems to suggest that the US Department of Stateis really not interested in the facts, and indeed does not wantthe facts to come in the way of the conclusions it wishes toreach, pursuant to its own ideology. This approach underminesthe objectivity of the report,” the Ministry of Foreign Affairssaid.

LONDON, 17 Aug—Awarning system with thepotential to protect againstthe devastating and costlyeffects of a massive solarstorm could be on the horizon.That’s according to researchpublished in the journalAstroparticle Physics. Solarflares can be accompanied bythe release of high energyparticles — a coronal massejection — towards Earth.Ensuing huge geomagneticstorms could wreak havoc onelectronic systems, satellites,power grids andcommunication networks.Data from the study, led byProf Ephraim Fischbach andProf Jere Jenkins of PurdueUniversity, suggest that therate of breakdown ofradioactive materials changesin advance of solar flares.

They hope they can usethis to develop a system thatcould predict when apotentially devastatinggeomagnetic storm might takeplace. This would allowauthorities to adoptprotective measures, such asshutting down satellites, attimes of most risk. But it isunclear how long such asystem would take to develop.Prof Jenkins told BBC News:

“We’re still developingalgorithms to pinpoint whattype of flare and magnitude itwill be.” Other physicists aremore sceptical of theconclusions made by theresearchers. Commenting onthe findings, Dr Peter Soler, aparticle physicist at theUniversity of Glasgow, said:“I do not believe the actualdecay rate is being affectedby this.”

LONDON, 17 Aug —People from blood groups A,B and AB are more at risk ofheart disease than those withthe more common blood typeO, a study suggests. An analysisof 20 studies showed thateating dark chocolate dailyresulted in a slight reductionin blood pressure. TheCochrane Group’s report saidchemicals in cocoa,chocolate’s key ingredient,relaxed bloodvessels.However, there arehealthier ways of loweringblood pressure.The theory isthat cocoa contains flavanolswhich produce a chemical inthe body called nitric oxide.This ‘relaxes’ blood vesselsmaking it easier for blood topass through them, loweringthe blood pressure.

However, studies havethrown up mixed results. TheCochrane analysis combinedprevious studies to see ifthere was really an effect.There was a huge range in theamount of cocoa consumed,from 3g to 105g a day, by each

participant. However, theoverall picture was a smallreduction in bloodpressure.A systolic bloodpressure under 120mmHg(millimetres of mercury) isconsidered normal. Cocoaresulted in a 2-3mmHg

reduction in blood pressure.However, the length of thetrials was only two weeks sothe longer term effects areunknown.

Lead researcher KarinRied, from the NationalInstitute of IntegrativeMedicine in Melbourne,Australia, said:

“Although we don’t yethave evidence for anysustained decrease in bloodpressure, the small reductionwe saw over the short termmight complement other

treatment options and mightcontribute to reducing the riskof cardiovascular disease.”High blood pressure is bothcommon and deadly. It hasbeen linked to 54% of strokesworldwide and 47% of casesof coronary heart disease.However, chocolate packsplenty of fat and sugar as wellas cocoa so is not the idealway of lowering bloodpressure.

There has also been awarning in the Lancet medicaljournal that dark chocolatemay contain fewer flavanolsthan you might think. Darkchocolate contains a highercocoa count than milkchocolate so should containmore flavanols, however, theycan also be removed as theyhave a bitter taste.

Victoria Taylor, of theBritish Heart Foundation,said: “It’s difficult to tellexactly what sort of quantitiesof flavanol-rich cocoa wouldbe needed to observe abeneficial effect and the bestway for people to obtain it.

LONDON, 17 Aug—Thedeath toll from landslides is10 times higher than generallyestimated, with most fatalitiesoccurring in South Asia, Chinaand Latin America, accordingto a British study publishedon Thursday.

In the seven yearsbetween 2004 and 2010, 2,620fatal landslides occurredaround the world, causing32,322 deaths, researchers atDurham University,northeastern England said,adding that the figure wasconservative.

during the northernhemisphere’s summer,especially during the Asianmonsoon, and amongdensely-populated slumsbuilt on deforested slopes,they said.

Hotspots in Asia includethe southern edge of theHimalayas, Sri Lanka, theChinese coasts and themountains around theSichuan basin in centralChina, Chinese Taipei andthe Philippines, the island ofJava in Indonesia. In thewestern hemisphere, deadlylandslides occur most in Haiti

and in highlands from Mexicothrough Colombia to Chile,where denuded slopes arevulnerable to storms.

Natural gas well burst kills one, injures three in ColoradoDENVER, 17 Aug—A

high-pressure burst ofnatural gas at a well operatedby Canadian energy giantEncana Corporation inColorado killed one man andinjured three other workerson Wednesday, the companyand local authorities said.

Regarding thatproposal, Dr Aung Than ofShwebo Constituency, U KhinMaung Oo of MonywaConstituency, Daw Mi MyintThan of Ye Constituency, UTun Myint Oo of MongpanConstituency, U Thein Aungof Thanbyuzayat Con-stituency and U Kyi Tha ofGwa Constituency discussedthat according to theprescribed law, rules,procedures, orders anddirectives continue to beannounced. Rules prescribethe ways of how a prescribedlaw comes into effect.

Therefore, it is knownto all that how important arule and regulation is. TheHluttaws are amending thenecessary laws as much as theycan. But, it has been assessedthat the relevant Union levelorganizations are hesitant inthe promulgating of rules overthe relevant laws. Therefore, asuggestion is that theministries and the UnionAttorney-General Office areto appoint enough skilledpersonnel, to consult withother qualifies lawyers asnecessary, to introduceeffective management and to

take systematic steps. Onlythen, will the people beinformed about complete lawsand rules as soon as possible.

As to the proposal,Deputy Attorney-General UTun Tun Oo of the UnionAttorney-General Officeclarified that necessary rulesand regulations, notifications,orders, instructions andprocedures for an already

prescribed law can beannounced, adding that suchrules and regulations areannounced only when they arenecessary although they havebeen promulgated but for somelaws, only notifications, ordersand instructions areannounced. There are somecases that need to be handledas appropriate according to thesubjects. There were many lawswhose rules haven’t beenannounced among the lawsprescribed in successive eras.

According to Section13 (B) of the 1973 law ondefining the words, if there wasno prescribed date ofenforcement for a law, the lawwas in force on the day when itwas announced. Althoughrules haven’t been announced,a law can be in force and itsprotection and rights can beenjoyed. It means that law canbe in force although its rules

are announced.All in all, it cannot be

surely said that theannouncement of rules isrequired for every lawspromulgated by thePyidaungsu Hluttaw. Rulesare announced only whenthe subjects of original lawsare needed. In defining theoriginal laws, definition mustbe in real terms according tothe rule of law policy.Therefore, it is stated in theprovisions that rules can beannounced instead rulesmust be announced. That waswhy, the original law is inforce although the ruleshaven’ been announced.

Matters can beaddressed smoothly by theearly announcement of rulesfor a law whose provisionscan be implemented throughthe announcement of rules.But the relevant Union levelorganizations have to taketimes in scrutinizing, draftingand submitting the laws stepby step and announcementof rules for a law is not alwaysneeded. Thus, only rules andregulations for the necessary

laws should be announced.There can be problems for theUnion level organizations toannounce rules andregulations in 90 days. As it isalready stated that a law is inforce when it has beenannounced, coordination isto be made on whether thereis necessary to announce therules or not. And the proposalshould be put on record.

U Thein Swe whosubmitted the proposal saidthat at a time when changes

are taking place there requirerules and regulations and theoriginal law alone is notenough for a law capable ofprotecting the people. Onlythen, can the people enjoythe rights. Thus, he soughtthe decision of the Hluttawwhich approved the proposalwith 273 votes, 68 against,and 18 in absentia.

In 2005-2006 fiscal year, the majorrepair was carried out for thebridge spending K 17 million.In 2008-2009, K 4.85 millionwas spent on maintenance ofdamaged parts.

The ministry ismaintaining the ancientbuildings by scrutinizing thecultural heritage value. Inmaking assessment, tombs atLinzin Graveyard do not meet

No 5 asked whether there is a plan to reopen governmenttimber shops in the townships across the nation. UnionMinister for Environmental Conservation and Forestry U WinTun replied that the ministry sold 176,600 tons of sawn timberto region governments for construction of schools, religiousbuildings and social organization buildings as regionaldevelopment from 2001-2002 fiscal year to 2011-2012 fiscalyear. So, the ministry sells 16054 tons of sawn timber per year.

A total of 14206 tons of sawn timber was sold forconstruction of houses for rural people from 2007-2008 to2011-2012 fiscal year and it was 2841 tons of timber on averageyear. A plan to sell 18500 tons of sawn timber for the people,5000 tons for rural housings and 10000 tons of sawn timber fordevelopment of states and regions in 2012-2013 fiscal year.

The ministry is placing emphasis on regionaldevelopment and supply of timber demand for the people.

Deputy Minister for Culture Daw Sanda Khin repliedto questions on cultural sector raised by three Hluttawrepresentatives.

U Ha Shein Bwe of Chin State Constituency No 8 askedwhether there is a plan to send scholars from theArchaeology Department under the Ministry of Culture tostudy Cho Chin ethnic in lineage of Pyu in Mindat District. (See page 9)

Supreme Court of the Union, region/state high courts hold coordination meetingNAY PYI TAW, 17 Aug —

A third coordination meetingof the Supreme Court of theUnion and region/state highcourts was held at the meetinghall of the Union SupremeCourt here at 9 am today.

In his address at themeeting, Chief Justice of theUnion U Tun Tun Oo stressedthe importance of judiciaryprofessional skills, honestyand moral courage of judgesin judging complicated casesto become the fair trials as thejudiciary system has todecide the cases between thepeoples and between theState and the people inaccordance with the law. Healso noted that the region/state high courts have theresponsibility to direct the

district/township courts in therespective region and areason points of law.

He also urged the judgesand employees at courts to

love the truth and to havemoral courage to be able tosupport the impartiality of thejudiciary pillar and to fight thecorruption at courts.

From 30 March, 2011 to30 June, 2012, the SupremeCourt of the Union hasaccepted 2957 civil cases,judged 2481 cases so far and

have still heard the remainingcases while it has accepted1996 criminal cases in the sameperiod, concluded 1697 casesso far and have still hard the

remaining 299 cases. Duringthe same period, 10130 civilcares have brought to theregion and state high courts. (See page 9)
