SARDINIA SUMMER SCHOOL17-22 July 2017Nuoro, Italy
2Foundations of European Contractual Law - FECL
The Summer School proposes, starting from the Roman legal experience, the study of the legal institutes of the
private sector that represent the historical and dogmatic roots of the contemporary legal experience of the contemporary Europe, with particular attention to the discipline of bonds and contracts and with the
aim to highlight not only the lines of continuity but also the profound dierences between the Roman
conceptions and the dogmas of the present. The perspectives suggested by the awareness that, in
the political reality of the European Union and especially in the future of the future, there is a need for
a concrete unication of European contract law.Starting from the Roman legal experience and
illustrating the elaboration and interpretation of Roman
sources in medieval science, the formative and structural path of the solutions prepared by the
jurisconsults in their reection on the principles of the subject matter of bonds and contracts will be
reconstructed, welcomed by modern codications. The general principles of the contractual disciplines of Italy,
France, Germany/Austria will be analyzed; Spain/Portugal, Hungary and Poland, and the
reverberations of European contractual matters in the Latin American countries, with particular regard to
Brazil, will be highlighted. Attention will also be paid to the analysis of the articles of today’s unication of
European contract law, with particular reference to the Principles of European Contract Law (PECL) and the
Draft Common Frame of Reference.
