    Recommendation s}: Consideration of a resolution awarding a construction contract toMonterey Peninsula Engineering, the lowest responsible bidder, for the2013 Sidewalk Repair Project for a not to exceed amount of 60,900;approving 9,135 for project contingency, and approving 6,090 to NeillEngineering for Project and Construction Management Services

    Executive Summary: On December 30, 2013, four bids were submitted to the City for the 2013Sidewalk Repair Project: (1) Monterey Peninsula Engineering for 60,900;(2) Stowe Contracting for 69,124; (3) Don Chapin Company for 79,000;and Earthworks for 79,300. The project consists of the removal andreplacement of sidewalk segments at eight locations within thecommercial district. The City's Engineer has tabulated the bids receivedand determined that Monterey Peninsula Engineering is the lowestresponsible bidder. Per Municipal Code 3.12.420, public workscontracts for more than 25,000 shall be let by formal written contractapproved by resolution of City Council. Therefore, this item is on theagenda for Council to award the contract and authorize the CityAdministrator to execute the contract documents.

    Analysis/Discussion: The purpose of this project is to correct and eliminate potential trippinghazards and to provide a safe walking environment for pedestrians. Theproject involves the removal and replacement of new sidewalk,reconstruction of cobblestone curb and gutter, installation of new slotdrain, sub-drain, curb drains, maintaining tree wells, and the resetting of

    existing utility boxes. The anticipated start date for the repair workwould be February 2014 and should be completed within 30 days.

    Council allocated 484,000 of Measure 0 funding for street and roadprojects, including sidewalk repairs, as part of the fiscal year 2013-14budget. It is recommended that Council award the sidewalk repaircontract to Monterey Peninsula Engineering in the bid amount of60,900. In addition, it is recommended that the project include a

    budget of 1 % for project/construction management to Neill Engineering( 6,090) and a project contingency of 15% ( 9,135) for a total projectcost of 76,125.

    A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARMEL-BY-THE-SEAA WARDING THE 2013 SIDEWALK REPAIR PROJECT CONSTRUCTIONCONTRACT TO MONTEREY PENINSULA ENGINEERING IN N AMOUNT NOT

    TO EXCEED 60,900; APPROVING 9,135 FOR PROJECT CONTINGENCY ANDAPPROVING 6,090 TO NEILL ENGINEERING FOR PROJECT ANDCONSTRUCTION MANAGEMENT SERVICES

    WHEREAS, numerous sidewalk segments have been identified as being in need of repairin order to provide a safe walking environment for pedestrians; and

    WHEREAS, the City Council approved expenditure of Capital Improvement funds forsidewalk repair as part of the streets and road project as part of the FY 2013/2014 budget; and

    WHEREAS, the 2013 sidewalk repair project was advertised in the Monterey CountyHerald on December 16, 2013 and December 21, 2013; andWHEREAS, four bids for the project were received on December 30, 2013 and the CityEngineer has determined that the lowest responsible bidder was Monterey PeninsulaEngineering; andWHEREAS, the project has been determined to be categorically exempt under CEQA15301(c).NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITYOF CARMEL-BY-THE-SEA DOES:

    1 Award a contract for the 2013 Sidewalk Repair Project to Monterey PeninsulaEngineering in the estimated amount of 60,900 subject to the provisions of thedocuments and certifications set forth in the plans and specifications applicable tothe project and as required by California law.2. Authorize the City Administrator to execute the construction contract upon thereturn of the contractor's executed contract documents and the review and theapproval of the City Attorney and the City's Administrative Services Director.3. Approve a contingency in the amount of 9,135 or 15%, and authorize the CityAdministrator to approve change orders in an amount not to exceed 70,035.4. Approve 6,090, or 10%, for construction-related engineering and projectmanagement services for Neill Engineers.5. Authorize funding of 76,125 from Capital Improvement Account 13-89585(2013-14 Streets and Roads Project).
