AlthoughtheDistrictwilladdresstheCharterSchool’sotherstatedconcernsregardingthe facilities costs used to compute the pro-rata share during the course of FUAnegotiations, it does maintain that it is entitled to include the cost of propertyinsurance.Cal.Admin.Codetit.5,§11969.2providesthedefinitionof“facilitiescosts”for thepurposesofdetermining thepermissiblegeneral fund costs to include in thecalculationofthepro-ratashare:

As used in Education Code section 47614(b)(1), "facilities costs" are thoseactivitiesconcernedwithkeepingthephysicalplantopen, comfortable, andsafeforuseandkeepingthegrounds, buildings, andequipmentinworkingconditionand a satisfactory state of repair. These include the activities of maintainingsafety inbuildings, onthegrounds, and in thevicinityofschools. This includesplant maintenance and operations, facilities acquisition and construction, andfacilitiesrentsandleases.

The District believes that it is allowed to include insurance (which only includespropertyinsurancecoveringtheDistrict’sstructures, anddoesnotincludecontentsorliabilityinsurance)becausethesecostsconstituteexpensesincurredin“keepingthe…buildings… inworkingconditionandasatisfactorystateof repair,” in theeventthatthey are damaged and an insurable claim is made. Therefore, the Charter Schoolsoccupying the District’s facilities under Proposition 39 directly benefit from thepropertyinsurancethattheDistricttakesoutonthestructuresthattheyoccupy.
