    That in view of the contents of the following item on the agenda, the(Assessment) sub-committee is RECOMMENDED to adopt the followingmotion:

    That, under the provisions of Section 100A of the Local GovernmentAct, 1972 as amended by the Local Government (Access to InformationAct, 1985), the press and public be excluded for the consideration of thefollowing item:-

    Item 3 - on the grounds that it contains information defined as exempt in

    Part 1 of Schedule 12A to the Local Government Act, 1972 underparagraphs 1 & 2.

    Although there is a public interest favouring public access to

    local authority meetings, given the legally and personally sensitiveinformation contained in the report and appendices, the public interestin maintaining the exemption outweighs the public interest indisclosing the (exempt) information

    (NB The exempt/confidential committee papers on the agenda willcontain information which is commercially, legally or personallysensitive and should not be divulged to third parties. Members arereminded of standing order restrictions on the disclosure of exemptinformation and are invited to return their exempt documentation to theSenior Local Democracy Officer at the conclusion of the meeting, for

    shredding.)

    3 Complaint against a Member

    The Monitoring Officers exempt report and appendices will be tabled on theday and reading time will have been allowed for the sub-committee prior tothe meeting. The sub committee is asked to consider the report, anddetermine the next steps.
