84. NARRATIVE OF THE FACTUAL BASIS FOR PROBABLE CAUSE: The undersigned certifies and swears that he/she has just and reasonable grounds to believe that the heretofore named defendant did commit the violations of law as stated above and the factual basis for this belief is as follows:

Your Affiant is Senior Inspector Bobby Hartwell of the Office of the Inspector General, Florida Department of Corrections.

Your Affiant has probable cause to believe Inmate Tyrece Fleming DC# 383708, did commit the criminal offenses of Attempted Premeditated Murder of a Correctional Officer in violation of FS 777.04(1) and Possession of Contraband in a State Institution, to wit homemade knife in violation of FS 944.47(1 )(a)(S)) by in a premeditated fashion, leaving the three victims after a verbal disagreement, purchasing a homemade knife, commonly referred to as a shank, in his dormitory and then returning to where the victims were located on the other side of the compound of Apalachee Correctional Institution East Unit located in Jackson County, FL, with full intention of stabbing and killing staff members, who were dressed in official Department of Corrections uniforms, identifying them as Correctional Officers in the lawful performance of their duties.

In a sworn statement, post Miranda, Inmate Tyrece Fleming indicated

A review of the video recording system for the center gate area of Apalachee Cl East Unit showed approach the gate with Inmate Fleming on the other side. and Officer can be seen standing in the background. goes straight to the gate and it opens and he steps through. At that point, the gate closes. is not completely facing Inmate Fleming as Inmate Fleming charges .and begins striking in the back. Almost immediately, can be seen on Inmate Fleming turns to and starts stabbing her with the knife. Officer administers chemical agents on Inmate Fleming. Inmate Fleming turns on Officer and starts stabbing at her. Inmate Fleming begins to dance around and goes after and begins stabbing at her again. Inmate Fleming can be seen running from staff and is taken into custody.

All three victims recorded, sworn statements match the suspect's sworn statement and the video of the incident. All three victims indicated they wanted to file charges on Inmate Fleming for the attack.

Your Affiant respectfully submits that probable cause has been established that Inmate Tyrece Fleming DC# 383708 did commit the criminal violation of Attempted Premeditated Murder of Correctional Officers, 3 counts, in violation of FS 777 .04( 1 )(a)( 4 ), and Possession of Contraband in a State Institution, to wit a homemade knife in violation of FS 944.47(1 )(a)(S), in a premeditated fashion by leaving the three victims after a verbal disagreement, purchasing a homemade knife, commonly referred to as a shank, in his dormitory and then returning to where the victims were located on the other side of the compound of Apalachee Cl East Unit located in Jackson County, FL, with full intention of stabbing and killing staff mE:mbers.
