OZTIX “FOO FIGHTERS” ONLINE SKILL COMPETITION TERMS AND CONDITIONS

ENTRY INTO THE COMPETITION

1. PROMOTER - The Promoter is Ticket Solutions Pty Limited trading as Oztix (ABN: 94 106 907 206) of 37 Venner Road, Annerley, QLD 4103 (the “Promoter”). Information on how to enter forms part of the terms of entry. Entry into the Oztix “FOO FIGHTERS” ONLINE SKILL COMPETITION (the “Competition”) deemed acceptance of these terms and conditions. 2. TIMES - Competition begins at 6.00am (AEDT) on Wednesday 16th March 2011 and closes at 11.59pm (AEDT) on Sunday 20th March 2011 (the “Competition Period”). 3. INELIGIBILITY - The officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter, the agencies associated with this Competition, and their related bodies corporate are not eligible to enter. 4. ELIGIBILITY - To enter the Competition and be eligible to win, entrants must: (a) register for membership online at www.oztix.com.au; and

(b) complete the online entry form; and (c) in 150 words or less answer the following question; “Why are you Foo Fighters’ biggest fan?” (the “Competition Question”).

5. VALID ENTRIES - All entries must include the entrant’s name, address, postcode, daytime phone number (including area code), mobile phone number (if applicable), email address and date of birth to be eligible for entry. Incomplete entries or those with defamatory, copyrighted, pre-used or offensive content will be ineligible. It is the entrant’s responsibility to inform the Promoter if their residential address, email address or phone number changes during the Competition Period.

6. ONE ENTRY - Only 1 entry per membership will be permitted.

7. AGE - If the Prize winner and/or their guest are under the age of 18 years on the 24th March 2011 they must be accompanied by a legal parent or guardian (at their own cost) in order to participate in the Prize.

PRIZE 7. There is 1 x Major Prize. The Major Prize consists of:

2 x return domestic economy airfares from the Major Prize winner’s nearest capital city (as determined by the Promoter) to Sydney, valued at a maximum of $2000;

1 x night’s accommodation in Sydney, valued at a maximum of $250;

1 x return transfer from hotel to (“Event”): valued at a maximum of $250

1 x double general admission pass to see the Foo Fighters performing at a secret and exclusive Sydney location on Thursday 24th March 2011, scheduled to take place at 6pm (the “Event”), this is a money can’t buy prize;

ONLINE SKILL

8. ONE PRIZE / ONE EVENT - Only one Prize will be awarded and all aspects of the Prize must be used at one time to coincide with date and time of the Event.

9. VALUE OF PRIZE - The total maximum value of the Prize is AUD $2,500. The Prize values are the recommended retail values as provided by the suppliers and are correct at the time of printing. The Promoter is neither responsible nor liable for any change in the value of the Prize occurring between publishing date and date the Prize is claimed. All Prize values are in Australian dollars.

9. NON-TRANSFERABLE - The Prize is not transferable or redeemable for cash. The Prize or any element of the Prize cannot be exchanged for any other prize/s. The Prize Winner agrees, as a condition of entry, that the Prize cannot be transferred, sold, re-sold, auctioned, loaned or rented, or used for any competition, sponsorship or promotional arrangement. The Prize Winner agrees to present valid identification at the entrance to the event. 10. VARIATION - The contents of the Prize may vary and shall vary at the Promoter’s sole discretion. The Prize is subject to availability and the terms and conditions of the entities supplying the Prize. The Promoter accepts no responsibility for any Prize that is damaged, delayed or lost in transit.

11. JUDGING - The Competition will be judged on the basis of creativity and skill at the offices of the Promoter, 37 Venner Road, Annerley, QLD 4103 on Monday 21st March 2011 at 11.00am (AEDT). Chance plays no part in the selection of the Prize winner. The Prize winner will be notified via email or phone on Monday 21st

March 2011 and their name published on the Oztix website from Noon, Monday 21st March 2011. The Prize must be claimed within 3 days of the publication of the Prize winner’s name by telephoning Oztix on 1300 762 535. 12. AWARDING PRIZE - If a Prize winner cannot be contacted or does not claim the Prize by the stipulated date, then the Prize will be forfeited and a substitute prize will not be offered in lieu of the Prize.

13. AVAILABILITY - It is a condition of entry that the Prize winner and their guest must be available to travel to and stay in Sydney on the date of the Event specified by the Promoter in Clause 7 above. 14. TRAVEL - Travel to the Event may be subject to the Prize winner and their guest being available at least 2 hours prior to the commencement of the Event performance taking place, as advised by the Promoter. Prize winner and their guest must dress with appropriate, comfortable footwear and clothing for travel and wet weather conditions. No intoxicated persons, prohibited drugs or hazardous matter (including but not limited to explosives and fireworks) will be allowed at the Event. The Prize Winner and their guest must observe and obey any instructions given by the Promoter or Event staff in connection with their travel to and from the Event and participation at the Event. The Promoter and the Event staff reserves the right to conduct any necessary searches

and/or refuse entry to the Event if the Prize Winner and their guest fail to comply with any conditions set out in these terms and conditions.

ONLINE SKILL

15. AIRFARES - In the event that the Major Prize winner is a resident of Sydney (which shall be determined at the absolute discretion of the Promoter), the respective flight component of the Major Prize will be forfeited in full and no substitute will be offered. 16. OTHER COSTS - All ancillary costs and expenses incurred in taking and using the Prize (including but not limited to mini bar, spending money, gratuities, telephone calls, food, beverages, insurance and taxes) are the sole responsibility of the Prize winner and their guest, unless expressly stated as being part of the Prize.

17. TAX - Prize winner is advised that tax implications may arise from their Prize winnings and they should seek independent financial advice prior to acceptance of their Prize.

18. RELEASE - It is a condition of accepting the Prize that the Prize winner and their guest may be required to sign a legal release in a form determined by the Promoter or Event staff in their absolute discretion, for example, a film release form.

19. RIGHT OF ENTRY - The Promoter reserves the right to refuse to allow the Prize winner or his or her guest to take part in any or all aspects of the Prize, if the Promoter determines, in its absolute discretion, that the Prize winner or his or her guest are not in the mental or physical condition necessary to be able safely to participate in the Prize.

20. IDENTIFICATION - All entrants agree to provide the Promoter or the Promoter’s authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as the Prize winner or if reasonably requested by the Promoter or the Promoter’s authorised agent. Proof of age, identification, residency and entry considered suitable for verification is at the sole discretion of the Promoter. In the event that the Prize winner cannot provide suitable proof, the Prize winner will forfeit the Prize in whole and no substitute will be offered. 21. WARRANTY - By entering the Competition, each entrant warrants that their entry, is their own original work and that they own all rights, including copyright in their entry. Each entrant indemnifies the Promoter in the event that this warranty is false.

22. NO FAULT - No responsibility will be taken by the Promoter, Oztix, Channel [V], FOXTEL, AUSTAR or Optus TV for any changes in dates, times or artist cancellations or other arrangements that may prevent the Prize winner from receiving the Prize as listed.

23. CANCELLATION - The Promoter reserves the right to cancel (a) the award of Prize to, and/or to disqualify any individual who, as determined in the sole discretion of the Promoter, has breached these terms and conditions or who has otherwise engaged in unlawful or improper conduct that is designed to jeopardise the fair conduct of the Competition, or (b) in its absolute discretion, at any time before the awarding of the Prize to cancel the Competition or to vary or cancel the terms of the Competition or the award of the Prize

including, without limitation, circumstances where in the Promoter’s opinion (which it shall form in its absolute discretion) a Prize winner does not satisfy the Competition entry requirements or the Promoter cannot conduct the Competition or award the Prize for any reason beyond its control. (c) In the event that the Promoter cancels or varies the Competition or varies or withdraws the Prize it shall not be liable to any person for any loss or damage (including loss or damage caused by any negligence) arising out of, or in connection with, such cancellation, variation or withdrawal; and be required to conduct the Competition at any other time.

24. LATE ENTRIES - No responsibility will be accepted by the Promoter for late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the entry into the Promoter’s database and NOT time of transmission by the entrant. The Promoter will accept no responsibility for any delays to entry caused by technical disruptions or malfunctions. The Promoter accepts no responsibility for outdated or incorrect contact details or contact details by which the entrant cannot be contacted during business hours on the relevant dates.

25. FINAL DECISION - A decision of the Promoter in relation to the conduct of the Competition is binding and conclusive and no correspondence will be entered into. 26. ENTRY AT OWN RISK - Entrants enter the Competition at their sole risk. With the exception of liability which cannot be excluded by law, the Promoter shall not be liable for any loss or damage which is suffered (including but not limited to indirect or consequential loss) or for personal injury suffered or sustained as a result of taking or using the Prizes or entering the Competition. 27. DATA - All entries become the property of the Promoter and may be communicated to the public by the Promoter or used for promotional purposes, subject to the Promoter’s privacy policy which is available at www.oztix.com.au. By entering the Competition, the Prize winner agrees to the use of their name, image, audio-visual recording and/or photograph/s, without compensation, and agree that the Promoter will own copyright in any such images, audio-visual recordings and photograph/s.
