Dear Ms. Barnett:

This Office is responding on behalf of the Department of Defense to all Freedom of Information Act (FOIA) requests relating to the death of Osama Bin Laden that were submitted to any component of the Department of Defense. This response concerns the request you submitted to the Department of the Navy (request # DON 201 1 F05 1288) who subsequently referred your request to Commander, Naval Air Force, Pacific (request # 32-1 1) and Commander, Naval Special Warfare Command. In their letter of May 17,20 1 1, Commander Naval Air Force, Pacific (COMNAVAIRPACT) advised you that they had confirmed that the U.S. Special Operations Command (USSOCOM) was in receipt of the request and would process it separately. You requested records regarding the killing and sea burial of Osama Bin Laden. Specifically, you requested the incident report of killing to include time and date and how Osarna's body was transported to the ship; transferlacceptance paperwork of ship accepting Osama's remains, to include time, date and ship representative signature; paperwork for sea burial to include the ship authorization andlor higher command level sign off and the time and date of burial

Your request was subsequently assigned FOIA case number 1 1 -F-1155 by this Office. This is a partial response to your request- based on the search conducted by Commander, Naval Air Force Pacific (COMNAVAIRPAC); the response from USSOCOM has not yet been completed.

Enclosed are 10 emails (3 1 pages) found in the course of a search conducted by COMNAVAIRPAC, which have been determined to be partially responsive to your request. No other records were found on the USS Vinson. Please note that these emails are provided to you as they were released in FOIA litigation (Judicial Watch v. Navy.) These emails were reviewed and determined to be partially releasable. Certain information being withheld within the documents is currently and properly classified pursuant to Executive Order 13526, 1.4(a) concerning military plans, weapons systems, or operations; 1.4(c) concerning intelligence activities (including covert action) and intelligence sources or methods; and 1.4(d) concerning foreign relations or foreign activities of the United States, including confidential sources. Information is also exempt by a statute establishing particular criteria for withholding; specifically 10 U.S.C.5 130b, which permits the withholding of information about personnel in overseas or routinely deployable and sensitive units. In addition, some of the withheld

information is exempt from release pursuant to the deliberative process privilege. Some information is withheld because its release would constitute a clearly unwarranted invasion of the personal privacy of individuals. Consequently, this information is denied pursuant to 5 U.S.C. § 552(b)(l),(b)(3),(b)(5) and (b)(6).

As this is a partial response to your request, you may wish to wait until you have received a complete response before filing an appeal. However, if you are not satisfied with this action, you may appeal to the appellate authority, the Director of Administration and Management, Office of the Secretary of Defense.
