A transgender patient accusing the Oregon State Hospital of gender

discrimination and flawed care will wait longer for her day in court

Complaints brought against OSH by Rebekah Brewis in a habeas

corpus case had been scheduled to come before a Marion County

judge today and Friday

But the planned two-day evidentiary hearing was shelved Wednesday

and it appears unlikely to be reset because Brewis is due to be

discharged from the Salem psychiatric facility soon as early as next

week

In an interview Wednesday Brewis made it

clear that she doesnt intend to let OSH off the

including filing a civil suit against the hospital

for alleged damages

Brewis 30 alleged in court papers that OSH failed to provide proper

treatment for her medical conditions including gender identity

disorder

The rare condition commonly is described as a conflict between a

persons physical gender and the one they actually identify with

Prior to entering OSH Brewis racked by extreme discomfort with his

male body committed numerous acts of self-mutilation and

repeatedly attempted to kill himself

At OSH Brewis took steps on a transitional path from male to female

She dressed in womens clothing changed her name to Rebekah and

took feminizing doses of estrogen

As Brewis tells it the hospital violated her rights by housing her on an

all-male ward and subjecting her to around-the-clock staff monitoring

She also asserted that the hospital failed to provide her with

specialized care for gender identity disorder

Brewis sought a Marion County court order requiring the hospital to

provide her with appropriate care

The state denied Brewis claims of discrimination and inadequate

treatment in legal papers

In December Brewis won a preliminary victory in her legal clash with

the state when Circuit Judge Joseph Guimond denied a state

lawyers motion to dismiss the case
