    Romanian Social Policy concerning Children sEducation and Health

    Children s Education.

    hildrens human rights promotionand observance is the fundamentalprinciple in all actions concerning

    children whether undertaken by public orprivate social welfare institutions, courts oflaw, administrative authorities or legislativebodies. The rights of children have developedas a very debated issue and is alsoregarded as having a crucial role in theRomanian society today. Among them, thechildrens right to education, self-expressionand autonomy are of a paramountimportance as they ground the very specialpersonality traits: self-determination andresponsibility1. The reform of the Romanianeducation system have overtaken manyother sectors reform, but its effects havenot always been the expected ones, themeasures taken being often deprived ofobjectives coherent for the entire educationsystem. We must notice the decreasementof the value of education inside familieswhich confront themselves with difficultiesof socio-economic nature, fact that causesschool abandonment and childrensreorientation toward labor market, often inillegal conditions. For lack of propermeasures, these effects can lead to a long

    term perpetuation of poverty, by creating avicious circle poverty-low education, lackof education-poverty. Rural education constitutes anotherproblem reflected in low school results,schooling rate and promoting differentschool cycles much lower than in theurban education, low participation ofadolescents from rural zones to superioreducation levels. Law no. 272/2004 concerning theprotection and promotion of childrensrights includes a series of stipulationsregarding childs education, recreation andcultural activities. Thus, child has the rightto an education which must permit him thedevelopment, without discrimination, ofhis aptitudes and personality. Childs parents prioritary have therights to choose the kind of education thatis to be given to their child and theobligation to matriculate the child and toassure the regularly attendance of schoolcourses by this one. Children older than 14years old can ask the consent of the trialcourt for changing the kind of educationand professional training. The Minister of Education andResearch, as a specialty body of centralpublic administration, as well as schoolinspections and education units, asinstitutions of local public administration

    with attributions in education field, areforced to take the measures necessary for2:a) facilitating the access to pre-school

    education and assuring compulsoryand free general education for all thechildren;

    b) developing education programs foryoung parents, in order to prevent alsofamily violence;

    c) organizing special courses of trainingfor children which can not fulfill thedemands of national school curriculum,in order to prevent premature entranceon labor market;

    d) organizing special courses of trainingfor children who have abandonedschool courses, in order to reintegratethem in the national education system;

    e) observing childs rights to vacationand resting time, as well as his right toparticipate freely to cultural andartistic life;

    f) preventing school abandonment foreconomic reasons by taking activemeasures of providing social servicesin school environment such as: food,supplies, transport and others.In the frame of training-educational

    process, child has the right to be treatedwith respect by the didactic staff andinformed about his rights, as well as themodalities of exercising them. Corporalpunishments are prohibited by law duringthe training-educational process. Membersof didactic staff have the obligation topoint out the cases of bad treatments,abuses and neglecting children to thepublic service of social assistance andchilds protection.
