I, Michael David Smith, the undersigned affiant, a living man upon the land of Missouri, and not a corporation or legalfiction, etc., born upon the land in Missouri, in the United States of America on the Twentieth Day of the Fourth Month in theYear of Our Lord Nineteen Seventy, declare that I am of majority and competent to state the matters set forth herein withfirst-hand knowledge of the facts and that they are true, correct; not misleading, and certain, admissible as evidence.

I. This plain statement of fact being a matter that must be expressed to be resolved. In commerce truth is sovereign.Truth is best expressed in law in the form of an affidavit. An uncontroverted affidavit stands as truth in commerceand becomes the judgment. It can only be challenged by a rebuttal affidavit item for item signed under penalty ofperjury and can only be satisfied by payment, agreement, resolution, or by a trial by jury according to the commonlaw of Missouri.

2. I am presenting this affidavit for truth in commerce and as a Contract for Waiver of Tort.

3. The public record is the highest form of evidence; I am creating a public record by declaration of said copyright byrecording this document in the public record at (www.NationaIPublicRecordRegistry.info) accessible to all on theWorld Wide Web.

The person and name known as MICHAEL DAVID SMITH, and any/all derivatives thereof being a legal fiction(s)without form or substance, and without any resemblance to any natural born living being, is entirely an intentionalcommercial fraud created by the alleged de facto, military government officials and agents of the nul tielcommercial corporation(s) doing business as, but not limited to: the UNITED STATES, USA, US,GOVERNMENT OF WASHINGTON D.C., DISTRJCT OF COLUMBIA (including any agencies/persons claimingjurisdiction over any US territories, possessions, enclaves, etc.), et ai, FEDERAL RESERVE BANK,DEPARTMENT OF TREASURY, INTERNAL REVENUE SERVICE, BUREAU OF ALCOHOL, TOBACCOAND FIREARMS, FEDERAL BUREAU OF INVESTIGATION, DEPARTMENT OF HOMELAND SECURITY,CENTRAL INTELLIGENCE AGENCY, NATIONAL SECURJTY AGENCY, AMERICAN BANKINGASSOCIATION, AMERICAN BAR ASSOCIATION, STATE OF TEXAS, STATE OF ILLINOIS, STATE OFMISSOURJ, etc., with subdivisions being corporate municipal counties, boroughs, parishes, and corporate municipalcities. User further consents and agrees with all of the following additional terms of Self-executing Contract/SecurityAgreement in Event of Unauthorized Use: Payment Terms: In accordance with fees for unauthorized use of MICHAELDA VID SMITH© as set forth above, User hereby consents and agrees that User shall pay Secured Party all unauthorized-usefees by User within ten (10) days of the date User is sent Secured Party's invoice, hereinafter "Invoice," itemizing said fees.Default Terms: In event of non-payment in full of aU unauthorized-use fees by User within ten (10) days of date Invoice issent, User shall be deemed in default and; (a) all of User's rights in property pledged as collateral by User, as set forth inabove in paragraph "(2)" immediately becomes, i.e. is, property of Secured Party; (b) Secured Party is appointed User'sAuthorized Representative as set forth above in paragraph "(8)"; and (c) User consents and agrees that Secured Party maytake possession of, as well as otherwise dispose of in any manner the Secured Party, in Secured Party's sole discretion, deemsappropriate, including, but not limited by, sale at auction, at any time following User's default, and without further notice,any and all of User's property and rights in property, described above in paragraph "(2)," formerly pledged as collateral byUser, now property of Secured Party, in respect of this "Self-executing Contract/Security Agreement in Event ofUnauthorized Use," that Secured Party, again in Secured Party's sole discretion, deems appropriate. Therefore, I hereby and herein reserve the right to amend and make amendment to the attachedinstrument as necessary in order that the truth may be ascertained and proceedings justly determined. If any living soul hasinformation that will controvert and overcome this signed and sworn declaration in this commercial matter, you must adviseme of the facts in the form of a signed and sworn Commercial Affidavit within ten (10) days from recording hereof,proving with particularity by stating all requisite actual evidentiary fact and all requisite actual law, and not merely theultimate facts of conclusions of law that this affidavit by declaration is substantially and materially false sufficiently tochange materially my or the fictions status and factual declaration.
